ment Act, the Council of the Corporation of the Town of
Pickering hereby requests an allocation of subsidy funds

of $2,905.00 for Combined Capital and Operating Assistance
Programme.

AND WHEREAS notices in writing of applications have been
received by the Clerk of the Municipality for the cancell-
ation, reduction and refund of taxes for various reasons;
AND WHEREAS upon investigation and receipt of reasonable
explanations all claims have been substantiated;
BE IT THEREFORE RESOLVED that the Council of the Town
of Pickering accept the following list of applications

Being a By-law to authorize the execution of a Site Plan

THIRD READING
Councillor Cahill, seconded by Councillor Stoner moved
that the report of the Committee of the Whole on By-law
Numbers C-l0 as amended, 1206/80, 1207/80, 1208/80, 1209/80,
1210/80, 1211/80, 1212/80, 1213/80, 1214/80, 1215/80 and
1216/80 be adopted, and that the said By-laws be now read
a Third Time and PASSED and that the Mayor and Clerk sign
the same, and the Seal of the Corporation be affixed thereto.

By-law Number 1217/80
Councillor Cahill, seconded by Councillor Stoner moved
for leave to introduce a By-law of the Town of Pickering
to confirm the proceedings of the Council of the Corporation
of the Town of Pickering at its meeting held on December
15, 1980, and that same be now read a first, second and
third time and that the same be now finally passed and
that the Mayor and Clerk sign the same and that the Seal
of the Corporation be thereto affixed.

Deleting the second sentence of Section
I.D. and replacing it with the following
senctence:
"Where feasible, proposals should provide
for the improvement of the intersection
and the redevelopment of adjacent parcels
of land."

Deleting the last sentence of Section
I.D. and replacing it with the following
sentence.
"If residential uses are developed or
redeveloped vehicular access must be con-
fined to Glenview Road. The design of
buildings, their siting and landscaping
along Kingston Road frontage must contri-
bute towards the reduction of noise pen-
etration from Kingston Road."

GERMAN - CANADIAN CLUB

That the Council of the Town of Pickering re-
affirms its recognition of the German-Canadian
Club of Pickering, K.G. Old Severin, as a ser-
vice club;
and that the request of the said club to hold
its Masquerade Dance on Saturday, January 31,
1981 and its 7th Annual "EIN PROSIT" Bavarian
Festival on Saturday, April 4, 1981 and its
11th Annual Oktoberfest on Saturday, October
3, 1981 and its Mardi Gras on Saturday, November
14, 1981, all in the West Shore Community Centre
be approved subject to the approval of the
Liquor Licence Board of Ontario;
and that Saturday, November 14,1981 be declared
as "Mardi Gras Day" in Pickering.

1981 REGIONAL SEWER RATE
FOR THE TOWN OF PICKERING

That the 1981 Sewer Commodity Rates and Service
Charges for the Town of Pickering be set at
87.5% of the Region's uniform Rates and Charges;
and that the balance of the required revenue
be secured by a charge to the Sewage Reserve
Fund held by the Region in our name.
ROOF REPAIRS - RESERVE

That a 1981 provision of $25,000 be set aside
in the Reserve for Replacement of Capital Equip-
ment G/L 4611 to cover Roof Repairs to "Munic-
ipal Buildings";
and that the 1980 year-end balances in the
Capital Fund for Roof Repairs to Recreation
and Library buildings be transferred to the
Reserve for Replacement of Capital Equipment
G/L 4611, for control purposes;
and that an ongoing roof maintenance system
similar to that presently in use by the Re-
creation Department, be started on all non-Res-
idential and Cultural buildings in the Town.

TRANSFER OF 1980

That non-recurring revenue received in 1980
in the amount of $291,000 be transferred in
1980 to the Community Facilities Development
Reserve Fund (G/L 4225) and be used for capital
expenditures for community facilities in the
Town of Pickering, as stipulated in the Reserve
Fund By-law 357/76.

That Co-operative Tender WD 42-80 submitted
by the Canadian Salt Company for the supply
of sodium chloride in the amount of $22.55
per tonne be accepted subject to the approval
of the Ministry of Transportation and Commun-
ications.

PICKERING-AJAX RESCUE UNIT -
BUDGET REPLACEMENT OF ENGINES

That the Pickering-Ajax Rescue Unit be author-
ized to proceed with the purchase of two Volvo
engines to replace the existing engines on
the PARU craft at a projected cost of $9,245.00;
and that this amount be included in the 1981
budget;
and that this approval be given subject to
the approval of the Town of Ajax.

the execution of a Subdivision Agreement pertain-
ing to the lands within that draft plan;
and whereas the said Subdivision Agreement
provides in part that:
In the event the plan of subdivision is
not registered on or before August 21,
1980, the Town may, at its option on one
month's notice to the owner, declare this
Agreement to be null and void;
and whereas the present owner of the subject
lands, Nolmar Properties Limited is requesting
the Town's consent to a one-year extension
of the Minister of Housing's draft plan approval
dated February 21, 1978;

NOW THEREFORE, BE IT RESOLVED THAT:
a)
The Town Clerk is hereby authorized and
directed to advise the Minister of Housing
for the Province of Ontario that the Town
of Pickering consents to a one-year exten-
sion (i.e. to February 21,1982) of the
Minister of Housing's approval of Draft
Plan of Subdivision 18T-77059.
b)
The Town Solicitor is hereby authorized
and directed to issue the Town's notice,
in accordance with the provisions of the
Subdivision Agreement, to the owner, of
the Town's intentions to declare the Sub-
division Agreement to be null and void.

subject to the posting of a irrevocable Letter

paid to the Town $26,350.00 cash in lieu of
the provision of parkland.with respect to Draft
Plan of Subdivision 18T-77080 (Plan M-1185);
and whereas the payment of the said sum was
based upon the anticipated development of the
subject property to the extent of 43 resident-
ial units;

and whereas By-law 1199/80 has been enacted
limiting the development of the subject lands
to 37 residential units;
and whereas the Subdivision Agreement respecting
Plan M-1185 has therefore been amended to re-
quire the sum of $22,675.00 to be paid to the
Town in cash in lieu of the provision of park-
land;
NOW THEREFORE BE IT RESOLVED THAT:
a)
The sum of $3,675.00 being the difference
between $26,350.00 and $22,675.00 be refund-
ed by the Treasurer to Eagle Brook In-
vestments Limited and Ballycroy Investments
Limited as a refund of an overpayment
of cash in lieu of the provision of park-
land.

Owner to make satisfactory arrangements
with the appropriate authorities regarding
the provision of underground wiring, street
lighting, cable television and other simil-
ar services.
That the streets within the recommended
draft plan be named to the satisfaction
of the Town.

That the owner submit for approval by
the Town, site plans and streetscape ele-
vations showing the location and relation-
ship of all buildings prior to the issuance
of any building permit.
That prior to final registration of this
plan, the owner:
a)
satisfy the requirements of the Metro-
politan Toronto and Region Conservation
Authority;
b)
submit a Draft 'M' Plan to be approved
by the Town Planning Department.
c)
submit a tree preservation programme
to the satisfaction of the Town and
that no existing trees be removed
until such time as the above noted
programme has been approved by the
Town.

ments with the Town regarding the demolition
of all structures on the subject property
prior to the issuance of any building
permit.

That the owner enter into a satisfactory
agreement with the Town regarding the
provision and construction of the road
through the Hydro Corridor linking Draft
Plan 18T-80021 with Draft Plan 18T-79068.

That the applicant agree that the purchas-
ers of the homes within-the development
, will be advised with (within) the agreement
of purchase and sale that although there
is a proposed school site within the ad-
jacent development, the students from
the subject development may have to be
transported to existing schools and that
a school is not likely to be built for
several years and only then if it can
be justified to the satisfaction of the
Minister of Education.
