Anderson COUNCILLORS: Byers Cahill Coburn Fisher Robertson Stoner ALSO PRESENT: N. C. Marshall - Town Manager B. Taylor - Town Clerk ( I ) ADOPTION OF MINUTES Meeting of June 15, 1981 ( I I) 1. DELEGATIONS Mr. John Lyon, representing the Glengrove Community Association, addressed Council to support the motion to repeal By-law 1279/81 and to state his concerns about the plaza on the southwest corner of Rosefield Road and Finch Avenue. Mr. Lyon stated that he understood that the intent of By-law 1279/81 was to legalize the 59 unit townhouse development only. The zoning for the plaza was approved in 1976 before the surrounding townhouses were built and now because of the high density, a great deal of traffic is generated in the area making it dangerous for children. Mr. Lyon stated that it was probably Council's intent in 1976 that only a corner store be estab- lished at this location, however, a fast food outlet will be established here adding to the problems of traffic, parking and garbage. Mr. Lyon asked that Council consider rezoning this property now to exclude a restaurant use. 13/81 - 45 - 2. Mr. Richard Thom, 1723 Dunchurch Street, addressed Council and submitted a petition dated July 6, 1981 from the residents of the village of Dunbarton objecting to the draft plan of subdivision by Runnymede Developments. Mr. Thom asked that Council reopen the discussions on the subdivision. He was concerned about the access of Street K onto Dunbarton Road adding traffic to the village and detracting from the village atmosphere. The added traffic will be a threat to the children who attend the two day care centres in the village and the Dunbarton Community Plan states that develop- ment should enhance the present village. A representative of Dunbarton/Fairport United Church stated that the church is already used to its capacity and since it is a commun- ity building which will require more facilities because of Runny- mede's proposed development, it is incumbent upon Council to make provisions for this. 3. 4. Mr. Bruce Schroeder, 1010 Finch Avenue, stated that he was concerned about the planning process involved in Runnymede's subdivision. Ten months have lapsed from the time the original plan of subdivi- sion was circulated to this date and the first opportunity residents had to comment on the commercial block was at last week's Planning Committee Meeting. Since the Community Plans do not make reference to a commercial site on the southwest corner of Dixie Road and Finch Avenue, this issue should be discussed in more detail. Mr. Schroeder stated that he first saw the environmental study for the commercial block today and felt this should have been made available sooner. s. Mr. Murray Chusid, Barrister and Solicitor, representing J.D.S. Investments Limited, stated that he does not understand what support there is for a commercial block in the draft plan of subdivision of Runnymede Developments. He was concerned that there is no market for a food store at this location. Mr. Chusid asked that the approv- al of the commercial block be deferred for two weeks so that his client can study the market and if Council is not prepared to grant the deferral then Mr. Chusid is opposed to the commercial block and in particular to proposed supermarket. 6. Mr. L. Greenbaum, representing Runnymede Developments Limited, stated that Dixie Road is to be realigned and a traffic signal installed at the intersection of Dixie Road and Kingston Road. The access of Dunbarton Road onto Kingston Road would be cut off and Street K would be an access out of the village of Dunbarton. Mr. Greenbaum stated that he has met with representatives of the Dunbarton Fairport United Church several times and they have been informed that when they know what land they require for church expansion, they are to approach him. Mr. Greenbaum reiterated his committment to sell land to the church at less than market value. In response to previous comments, Mr. Greenbaum stated that he would provide undertakings that no construction traffic will travel on Dunbarton Road and the M.T.R.C.A. is generally satisfied with this development subject to certain conditions which can be satis- fied. Mr. Greenbaum pointed out that he is seeking an Official Plan amendment to permit the commercial block and even when this is approved, a rezoning would be required to permit the supermarket Mr. Dennis Stevens of M.M. Dillon answered various environmental questions on behalf of Runnymede Developments. 13/81 - 46 - (III) RESOLUTIONS Resolution #41/81 - See Appendix #1 Moved by Councillor Robertson Seconded by Councillor Coburn That the Report of the Executive Committee dated June 22, 1981 be adopted. CARRIED Councillor Fisher declared a conflict of interest with ~ect to Item #13 because his son is a Volunteer Fire- ITgfiter. Resolution #42/81 - See Appendix #2 Moved by Councillor Cahill Seconded by Councillor Byers That the Report of the Planning Committee dated June 23, 1981, be adopted with the following amendment: That the marking for the designated park in the Altona Forest in the Highbush Community Plan be reduced to half its size but the provision for park requirements in this area remain the same. CARRIED Recorded Vote Yea: Councillors Byers, Cahill, Coburn, Fisher, Robertson and Mayor Anderson Nay: Councillor Stoner Resolution #43/81 - See Appendix #3 Moved by Councillor Robertson Seconded by Councillor Byers That the Report of the Planning Committee dated June 29, 1981, be adopted, with the following amendment: that Items #4 and #5 of the Planning Committee Report be deleted and the following substituted therefor (see Planning Report #32/81 attached hereto): 13/81 - 47 - That Draft Plan of Subdivision 18T-80064 submitted by John Boddy Developments Limited, on lands being Part Lot 26, Concession 1 be APPROVED AS REVISED to permit the development of 331 single detached dwelling units, 40 semi-detached (or above grade detached) dwelling units, a 0.93 hectare church block, a 0.12 hectare open space block, and 14 blocks for future residential dev- elopment, subject to the following conditions: 4. 1. 2. 3. 4. s. 6. 7. Changes in 'red' as shown on the plan stamped approved this date. That the owner make satisfactory arrangements with the Town regarding the required parkland dedication. That the owner enter into a satisfactory subdivision agreement with the Town. That the owner make satisfactory arrangements with the Town and Region regarding: a) the provision of all services b) the allocation of sewage treatment capacity and water capacity for the development. That the owner agree to dedicate to the Town and other proper authorities: a) all road allowances with proper corner roundings b) 0.3 metre reserves at all temporary street terminus shown as Blocks 355 - 363, inclus- ive on the draft approved plan. c) 0.3 metre reserves along the south side of Finch Avenue shown as Blocks 364 and 365 on the Draft Approved Plan. d) a. 3.44 metre road widening on the east side of Faiport Road shown as Blocks 366 and 367 on the Draft Approved Plan. Block 353 as a Public Walkway e) f) any other easements as required. That the owner make satisfactory arrangements with the appropriate authorities regarding the provision of underground wiring, street lighting, cable television and other similar services. That the streets within the draft plan be named to the satisfaction of the Town. 13/81 - 48 - 9. That the owner submit for approval by the Town, site plans and streetscape elevations showing the location and relationship of all buildings prior to the issuance of any building permit. That prior to final registration of this plan, the owner: 8. a) satisfy the requirement of the Metropol- itan Toronto and Region Conservation Authority submit a Draft M-Plan to be approved by the Town Planning Department b) c) satisfy the Town with respect to the precise alignment on the Draft Approved Plan of the east terminus of Glenanna Road d) submit a tree preservation programme to the satisfaction of the Town and that no existing trees be removed until such time as the above noted programme has been approved by the Town 10. That the owner make satisfactory arrangements with the Town regarding the removal or dem- olition of all structures on the subject property. 11. That the owner agree to dedicate Block 354 to the Town as Open Space. 12. That Block 352 be zoned for church purposes. 13. That Blocks 368-381 (inclusive) be developed for residential purposes in conjunction with abutting lands. 14. That the purchasers of the homes within the development be advised with (within) the agreement of purchase and sale that although there is a proposed school site within the adjacent development, the students from the subject development may have to be transported to existing schools and that a school is not likely to be built for several years and only then if it can be justified to the satisfaction of the Minister of Education. 5. That By-law Amendment Application A7S/80, sub- mitted by John Boddy Development Limited on lands being Part Lot 26, Concession 1 to rezone the subject lands from 'A' Agricultural to an approp- riate zoning be APPROVED AS REVISED to implement approved draft plan of subdivision 18T-80064(R) CARRIED 13/81 - 49 - Resolution #44/81 Moved by Councillor Cahill Seconded by Councillor Byers That Block 327 in the draft plan of subdivision by Runnymede Developments Limited not be designated as a commercial block at this time and that this block be designated for future development in 1983. CARRIED Resolution #46/81 Moved by Councillor Robertson Seconded by Councillor Fisher That the request of the Glengrove Softball Association dated May 1, 1981 to conduct a beer tent in Centennial Park on September 5, 1981 with a rain date of September 19, 1981 be approved subject to the approval of the Liquor Licence Board of Ontario. CARRIED 13/81 - 50 - Resolution #48/81 Moved by Councillor Robertson Seconded by Councillor Fisher That the firm of HP Creative Services Limited be retained to complete a Promotional Programme for the Town of Pickering, consisting of a brochure, statistical booklet and audio visual presentation, and That they be retained to carry out a Marketing and Distri- bution Programme for the material, consistent with the terms of their proposal of June 26, 1981 directed to the Mayor in the amount of $62,831.00. CARRIED Recorded Vote Yea: Councillors Byers, Coburn, Fisher, Robertson, Stoner and Mayor Anderson Nay: Councillor Cahill Resolution #49/81 Moved by Councillor Robertson Seconded by Councillor Fisher WHEREAS, On May 16, 1977, Council passed Resolution 86/77, Item 4 of which approved Draft Plan of Subdivision 18T-76070, subject to certain conditions, one of which requires that registration of the plan and construction occur within 18 months of draft plan approval; and WHEREAS, on September 15, 1980, Council passed Resolution 102/80, Item 2 of which approved a l-year extension of the Minister of Housing's draft plan approval dated July 18, 1977; and WHEREAS, Kipark Construction Limited is requesting the Town's consent to a further extension of the Minister of Housing's draft plan approval; NOW THEREFORE, BE IT RESOLVED THAT: 1. That Town Clerk is hereby authorized and direct- ed to advise the Minister of Housing for the Province of Ontario that the Town of Pickering consents to a further l-year extension (i.e. to July 18, 1982) of the Minister of Housing's approval of Draft Plan of Subdivision 18T-76070. 13/81 - 51 - 2. Item 4 of Resolution 86/77 is hereby amended by deleting Condition 10 and by substituting the following therefor: 10. Registration of the draft plan of subdivision occurring on or before July 18, 1982, and construction commencing in accordance with the provisions of the Subdivision Agreement referred to above. CARRIED Resolution #50/81 Moved by Councillor Robertson Seconded by Councillor Cahill 1. That By-law 1279/81 is in conformity with the Official Plan of the Region of Durham and in force at the time that this by-law was passed namely the 21st day of April, 1981; 2. and that no further Official Plan has been pro- posed by Council nor approved by the Ministry of Housing since the passing of said By-law 1279/81 in which the said by-law would not be in conformity. That the letter of objection to By-law 1279/81 received from Mr. John Lyon and others dated June 17th, 1981 be received; and that the objection be deemed invalid because it is based on a misunderstanding of the intent of the By-law and not on factual grounds. 3. That the Town Clerk be directed to make application to the Ontario Municipal Board to dispense with a public hearing of By-law 1279/81. CARRIED Resolution #52/81 Moved by Councillor Robertson Seconded by Councillor Coburn WHEREAS the Municipality has approved a Plan of Subdivision for lands being developed by Runnymede Development Corporation and more particularly described as Part Lot 25, Concession 1, Pickering and Part Block "A", Plan M-l037 and Lots 1 and 2 Plan 489; (18T-80034) WHEREAS the Dunbarton-Fairport United Church has expressed interest in securing title to lands abutting their existing property adjacent to the Runnymede property; BE IT THEREFORE ENACTED THAT Runnymede Development Corporation Limited be advised that the Municipality intends to withhold the entering into of a Subdivision Agreement on Draft Plan 18T-80034 until such time as the Town has been advised that the Church and Runnymede have come to terms with respect to said property. Resolution #55/81 Moved by Councillor Cahill Seconded by Councillor Byers That the intersection of Oklahoma Drive and West Shore Boulevard be established as a school crossing station; and that the Municipal Law Enforcement Officer be directed to hire a school crossing guard for this station to commence in September, 1981. THIRD READING Councillor Cahill, seconded by Councillor Byers moved that the report of the Committee of the Whole on By-law Numbers 1301/81, 1302/81, 1312/81, 1314/81, 1315/81, 1316/81, 1317/81, 1318/81, 1319/81, 1320/81, 1321/81, 1322/81, 1323/81, 1324/81, 1325/81, 1326/81, 1327/81, 1328/81, 1329/81, 1330/81, 1331/81, 1332/81, 1333/81, 1334/81, 1335/81, 1336/81, 1337/81, 1338/81, 1339/81, 1340/81, 1341/81, 1342/81, 1343/81, 1344/81, C-16 and C-17 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. 13/81 - 58 - (V) 1. OTHER BUSINESS Councillor Cahill introduced the following Notice of Motion: Moved by Councillor Cahill Seconded by Councillor Byers WHEREAS over the past number of years the public has express- ed concern and objection over the use of off-road motorized recreational vehicles on public and privately owned lands; and WHEREAS several reports have been written on this subject with the conclusion that the major problem in urbanized areas is primarily with vehicles such as motorcycles, mini- bikes and trailbikes but also, to an ever increasing degree, with snowmobiles, pedalbikes, all-terrain and modified large-tired vehicles; and WHEREAS many organizations in the Province have been estab- lished to promote the safe and lawful usage of recreational vehicles in defined areas and to meet the interests of owners in terms of providing marked trails, competition and an opportunity for persons with similar interests to assemble; and WHEREAS unfortunately these efforts have had a minimal deterrent effect on the majority of vehicle owners and certain problems connected with the ownership and use of off-road motorized recreational vehicles still exist; namely: 1. Damage to public and private property, namely, grass, vegetation, soil compaction, fences and structure; 2. Disturbing the peace of residents due to the high level of noise emission of vehicles; 3. Pollution through exhaust fumes, gas and oil spillage; Safety hazards for people and primarily children because of speed, inexperience and disregard for reasonable precautions in relation to the terrain of the area being travelled (e.g. hilly and woody areas, playground areas); 4. s. Lack of parental control, in terms of the age and capability of the driver in the areas where the vehicles are being driven; 6. The limited ability to enforce existing legis- lation relating to off-road motorized recreational vehicles by law enforcement officers; and 7. The reluctance of the Provincial Government to pass effective legislation to control the sale and use of off-road motorized recreational vehicles; and 13/81 - 59 - WHEREAS it is the opinion of the Council of the Corporation of the Town of Pickering that the most effective method of controlling and minimizing the detrimental effects of the off-road motorized recreational vehicles is to request the Provincial Government, in the strongest possible terms, to enact certain legislation; NOW THEREFORE, BE IT RESOLVED THAT: The Town Clerk request the Provincial Government to enact legislation which would implement the following recommended procedures: 1. (a) (b) (c) (d) (e) all off-road motorized recreational vehicles, prior to sale by any means, must be registered and licensed in the same manner and under the same regulations and penalties as an automobile or motorcycle; all drivers of off-road motorized recreational vehicles must be tested and licensed to operate such vehicles by the Ministry of Transportation and Communications. In the event of juveniles operating vehicles, or otherwise contravening any regulations, the parent or guardian shall be held re- sponsible for such actions; registered owners of off-road motorized recreational vehicles shall be responsible and liable for all usage of the vehicles (e.g. in the event an unlicensed driver was operating the vehicle in contravention of a By-law or other legislation, both the driver and the owner would be charged with the appropriate offences); off-road motorized recreational vehicles found operating on public or private property without written or designated permission may be impounded by the Police Department having local jurisdiction; and off-road motorized recreational vehicles used in an ancillary capacity to a farm operation be exempt from the legislation in question. 13/81 - 60 - 2.
