(I) ADOPTION OF MINUTES
Regular Meeting of December 9, 1996
(II) RECOMMENDATIONS CONSIDERED
REGARDING THE OFFICIAL PLAN
A recommendation to reconsider the reinsertion of Clause 1(a) to the
recommendation to approve the Official Plan was passed. This Clause reads as
follows:
“Revise Schedule I (the Land Use Structure) by redesignating the lands located on
the east side of Whites Road north of Finch Avenue, between the hydro right-of-
way, from “Urban Residential Areas - Low Denisty Areas” to “Open Space
System - Natural Areas.”

In Planning Recommendation Report 1/97, it is recommended that Council
recommend to Regional Council that Draft Plan of Condominium 18CDM-96004,
submitted by Commercial Devco Incorporated, for the establishment of
condominium tenure on lands being Part Of Lots 8, 9 and 10, Registered Plan
489, BE APPROVED.

2. APARTMENTS IN HOUSES

To approve a recommendation directing staff to prepare a report setting out
recommendations for inspecting apartments in houses and ensuring compliance
with the Fire Code, Zoning By-laws, Property Standards By-law and other
municipal regulations.

3. EMPLOYEE BENEFIT GROUP INSURANCE
1997 RENEWALS

In the Manager of Human Resources Report HR 02/96, it is recommended that a
by-law should be enacted to authorize the execution of the necessary documents to
provide employee benefit group insurance for entitled Town employees or retired
employees during 1997.

AS TO REGIONAL ROAD CONSTRUCTION PRIORITIES

5. EXEMPTION OF BLOCK 1, PLAN 40M-1281

THE PICKERING HYDRO-ELECTRIC COMMISSION FOR
THE PERIOD COMMENCING DECEMBER 1, 1996 AND

In Clerk’s Report CL 49/96, it is recommended that a draft by-law to fix the
salaries of the Commissioners of the Pickering Hydro-Electric Commission for
the period commencing December 1, 1996 and expiring on November 30, 1997,
be forwarded to Council for enactment.

8. REGIONAL “WHO DOES WHAT” COMMITTEE

In Clerk’s Report CL 48/96, it is recommended that the letter from the Regional
Municipality of Durham dated November 25, 1996 advising that the Regional
Council has established a “Who Does What” Committee with a mandate to look
at all aspects of service delivery at the Regional level and see how they fit into the
Municipal Services Delivery Program be received.

10. EXEMPTION OF LOTS 3, 4, 5 AND 6, PLAN 40M-1861

In Legal Services Report L 007/97, it is recommended that a draft by-law to
exempt Lots 3, 4, 5 and 6, Plan 40M-1861, from part lot control, be forwarded to
Council for enactment.

(IV) OTHER BUSINESS
1. Councillor Brenner introduced a Notice of Motion to request that the Towns of
Pickering and Ajax explore the merits of hiring a Chief Administrative Officer to
serve both municipalities. He also requested that a copy of this Notice of Motion
be forwarded to the Town of Ajax for its information.
2. The following matters were discussed prior to the regular meeting:
a) The Executive Director Operations distributed a copy of the Status of
Storm Sewer Map and information with respect to the Brock North
Landfill Transfer.
b) The Executive Director Operations advised that problems have been
experienced today at the Pickering Nuclear Generating Station, the
Darlington Nuclear Station and the Bruce Nuclear Station.
c) The Executive Director Operations discussed with Committee the
proposed schedule for the 1997 Budget Meetings.
d) The Executive Director Operations distributed a memo prepared by the
Director of Planning and the Building Services Manager with respect to
basement apartments.

That the Executive Committee of the Town of Pickering having met on January 13, 1997,
presents its first report to Council and recommends:

That Council recommend to Regional Council that Draft Plan of Condominium
18CDM-96004, submitted by Commercial Devco Incorporated, for the
establishment of condominium tenure on lands being Part of Lots 8, 9 and 10,
Registered Plan 489, BE APPROVED, subject to No. I to Recommendation
Report conditions listed in Appendix No. 1/97.
2. APARTMENTS IN HOUSES
FILE NUMBER - B 1000
WHEREAS the previous Provincial Government passed legislation which
permitted apartments in houses as a matter of right with few restrictions; and
WHEREAS this type of housing, unless strictly regulated, can have a negative
impact on the tenants of such housing, and the neighbourhood and community in
which they are situated by:
1. creating additional parking and traffic problems
2. unsafe conditions such as no smoke detectors or lack of proper
exits
3. putting unplanned pressure on municipal services such as water
and sewers
4. creating additional pressure on the schools because owners are not
paying additional education taxes; and
WHEREAS on May 22, 1996, the present Provincial Government passed the Land
Use Planning and Protection Act which reinstates municipal authority in
determining whether or not to allow apartments in houses; and
WHEREAS the said Act states that no apartment created after November 16, 1995
is permitted, except where a building permit was applied for and issued before
May 22, 1996; and
WHEREAS the said Act also provides a grandfathering provision which serves to
allow “as of right” any apartment which was used or occupied on or before
November 16, 1996 and that such units must comply with the requirement of the
Fire Code; and
WHEREAS the issue of apartments in houses is of such an importance that
Council must be aware of the number of such units in existence and the impact
they have;

NOW THEREFORE the Council of the Corporation of the Town of Pickering
hereby directs staff to prepare a report setting out recommendations for inspecting
such units and ensuring compliance with the Fire Code, Zoning By-laws, Property
Standards By-law and other municipal regulations; and
THAT this report and the report submitted by the Director of Planning and
Building Services Manager dated January 2, 1997 be tabled at a Council Meeting
no later than March 31, 1997.
3. EMPLOYEE BENEFIT GROUP INSURANCE
1997 RENEWALS

That a by-law should be enacted to authorize the execution of the necessary
documents to provide the following for entitled Town employees or retired
employees during 1997:
(a) group life insurance and long term disability benefits, to be provided by
Maritime Life Assurance Company; and
(b) group health and dental insurance, to be provided by Liberty Health
(Liberty Mutual Insurance Group).
4. RECOMMENDATIONS OF THE TOWN OF PICKERING
AS TO REGIONAL ROAD CONSTRUCTION PRIORITIES

That Public Works Report PW 1/97 on Regional Road construction priorities
within the Town be received, adopted and forwarded to the Regional Municipality
of Durham with the request that its recommendations be implemented.
