DELEGATIONS
2.
Mr. Bruce Freeman, representing Bramalea Limited,
addressed Council with respect to the Notice
of Motion regarding a study of assessment and
stated that his company has been able to attract
industry to Pickering because of the favourable
tax base which is lower than municipalities in
Metropolitan Toronto and the surrounding area.
A reassessment under Section 86 of The Assessment
Act would affect not only the industrial and
commercial sector but also older homes on large
lots, and farms. Such a reassessment may effect
the Town's portion of the Regional levy.
Mr. Murray Stroud addressed Council with respect
to the Notice of Motion regarding a study of
assessment and states that inequities in the
assessment base was not an issue in the election
and The Assessment Act states that there must
be significant inequities before conducting a
study. This motion could create a division in
the municipality by setting one group of home-
owners against another. Those living in older
homes and on farms would be most affected by
a reassessment.

Mr. Rick Hull, representing the Rosebank and
East Rouge Ratepayers Association, addressed
Council with respect to the Notice of Motion
regarding a study of assessment and stated that
if there are inequities in the assessment base
a study should be conducted and the report of
the study made public. This study will be financed
by the taxpayers and should not be done unless
it is necessary.

Councillor Robertson, seconded by Councillor Cahill moved
for leave to introduce By-laws of the Town of Pickering:
By-law Number C-12
Being a By-law to amend The Town of Pickering Municipal
Code to adopt the 1981 estimates of all sums required during
the year for the purposes of the Municipality of the Corpor-
ation of the Town of Pickering, and to provide for the
levying of the rates resulting therefrom and to levy the
rates necessary to cover the estimated 1981 levy from the
Council of the Corporation of the Regional Municipality
of Durham.
By-law Number C-13
Being a By-law to amend The Town of Pickering Municipal
Code to fix installment dates, penalty amounts and interest
rates respecting the payment and collection of taxes.
By-law Number 1226/81
Being a Restricted Area By-law to amend Restricted Area
By-law 2511, as amended, to implement the Official Plan
of the Town of Pickering District Planning Area, Region
of Durham, in Part Lot 18, Range 3 Broken Front Concession,
in the Town of Pickering.
By-law Number 1227/81
Being a Restricted Area By-law to amend Restricted Area
By-law 2511, as amended, to implement the Official Plan
of the Town of Pickering District Planning Area, Region

By-law Number 1228/81
Being a Restricted Area By-law to amend Restricted Area
By-law 3036, as amended, to implement the Official Plan

Being a By-law to amend By-laws 2511, 2520, 3036 and 3037

Being a By-law to amend By-law 851/78 providing for the
regulating of parking, standing and stopping on highways

Being a Restricted Area By-law to amend Restricted Area
By-law 3036, as amended, to implement the Official Plan
of The Town of Pickering District Planning Area, Region
of Durham, in Part Lot 24, Concession 2 in the Town of
Pickering.
THIRD READING
Councillor Robertson, seconded by Councillor Cahill moved
that the report of the Committee of the Whole on By-law
Numbers C-12, C-13, 1226/81 as amended, 1227/81, 1228/81,
1229/81 1230/81, 1231/81, 1232/81, 1233/81, 1235/81 and
1236/81 be adopted, and that the said By-laws be now read
a Third Time and PASSED and that the Mayor and Clerk sign
the same, and the Seal of the Corporation be affixed thereto.

third reading of the by-laws:

That By-law 1226/81 be amended in section 5B(Zone Require-
ments) by adding the following subsection:

Special Provisions
Notwithstanding the requirements of section
5A above, a place of amusement or entertainment
which is a billiard or pool room may be
permitted only in connection with a commercial---
recreational establishment which is a bowling
alley.
and in section 5A (Uses Permitted) by adding the following
clause to item (e): "subject to the provisions of subclause
(j) of clause B of this subsection".

By-laws read a first, second and third time and finally
passed.

OTHER BUSINESS
1.
Councillor Cahill requested the total amount
of money spent on vandalism in 1980.
2.
Councillor Cahill further requested a report
on the reason for the dramatic drop in charges
in 1980 over 1979 by the Ontario Humane Society.
3.
Councillor Cahill reported that the average hydro
user in Pickering pays $7.15 more than a user
in Ajax.
4.
Councillor Stoner requested that the sidewalk
in front of Denmar Park be shovelled and kept
clear of snow throughout the winter.
5.
The Frenchman's Bay Jaycees requested permission
to use the Town Crest in conjunction with a crest
it is developing and the permission was so granted.

NOTICE OF MOTION
Moved by Councillor Cahill
Seconded by Councillor Byers
Whereas, the Assessment Act, R.S.O. 1970, chapter 32, section
86, as amended, provides in part for the implementation
of a process of assessment equalization where significant
inequalities exist; and
Whereas, it is apparent that such inequalities may exist
in the existing assessments of properties within the Town
of Pickering; and

Whereas, it is deemed advisable to request a study to deter-
mine if such inequalities actually exist and to demonstrate
their magnitude prior to determining whether or not this
Council should request the Minister of Revenue to implement
the assessment equalization process referred to;
NOW THEREFORE, BE IT RESOLVED THAT:
1.
The Town Clerk, on behalf of the Corporation
of the Town of Pickering is hereby authorized
and directed to request the Minister of Revenue
to prepare a study of the various classes of
property, i.e. residential and farm and commercial
and industrial, to determine if assessment inequal-
ities exist and if so, to demonstrate their magni-
tude, and to present such study to this Council
to enable it to determine whether or not to request
the Minister of Revenue to implement the assess-
ment equalization process provided in section
86 of The Assessment Act.

By-law Number 1237/81
Councillor Stoner, seconded by Councillor Fisher moved
for leave to introduce a By-law of the Town of Pickering
to confirm the proceedings of the Council of the Corporation
of the Town of Pickering at its meeting held on February
2, 1981, and that same be now read a first, second and
third time and that the same be now finally passed and
that the Mayor and Clerk sign the same and that the Seal
of the Corporation be thereto affixed.
CARRIED
By-law read a first, second and third time and finally
passed.

That the Durham Regional Council be requested
to modify the Community Plan for thè Fairport
Community Central Area as follows:
1.
Delete paragraph A(b) of Section 3 and
replace with:
"b) The 4 hectare (10 acre) site which
is located on the south side of Bayly
Street between Begley Street and St. Mar-
tin's Drive may be developed for resident-
ial purposes within the Medium Density
1 range. Provision shall be made for a
neighbourhood park on the south-west corner
of the site. No structure on this site
shall exceed 12 metres (39.37 feet) in
height".

Delete the words "Max. 27 Units per Hectare
(11 Units per Acre)" and add the roman
