( I I) RESOLUTIONS Resolution #20/85 - See Appendix #1 Moved by Councillor Stoner Seconded by Councillor Mitchell That the Executive Committee Report dated March 11, 1985, be approved. CARRIED Resolution #21/85 Moved by Councillor Arthurs Seconded by Councillor Stoner That the Program of Proposed Expenditures for Highway Improvements for the year 1985, be approved. (Bayly Street reconstruction) By-law Number 1989/85 Being a by-law to repeal By-law 1805/84, authorizing the execution of a Subdivision Agreement between The Corporation of the Town of Pickering and 556168 Ontario Limited respecting part Lot 22, Concession 2, Pickering (Draft Plan 18T-79049, western part) By-law Number 1990/85 Being a by-law to authorize the sale of part of the road allowance between Lots 16 and 17, Concession 1 (Part 1, Plan 40R-8066) and part of the road allowance between Lots 20 and 21, Concession 1 (Part 1, Plan 40R-8064), Pickering, to Her Majesty the Queen, in right of the Province of Ontario, represented by the Minister of Transportation and Communications for the Province of Ontario (Squires Beach Road, formerly Station Road/Valley Farm Road; GO-ALRT) By-law Number 1991/85 Being a by-law to authorize the execution of releases of servic- ing/development/site plan Agreements between Torwest Properties Limited or Bramalea Limited and The Corporation of the Town of Pickering respecting part Lot 19, Range 3, B.F.C., Pickering (Part 4, Plan 40R-2384) (draft plan 18T-83013) By-law Number 1992/85 Being a by-law to authorize the execution of a Release by the Corporation of the Town of Pickering of William Arthur Leslie and Norma Shirley Leslie from the financial covenants contained in a Deed respecting Part Lot 33, Concession 3, Pickering (Part 3, Plan 40R-6295) By-law Number 1993/85 Being a by-law to amend By-law 1064/79 licensing, regulating and governing taxicab and limousine drivers, owners and brokers By-law Number 1994/85 Being a by-law to authorize the execution of an Agreement between The Corporation of the Town of Pickering and Macaulay/Shiomi Con- sultants Ltd. for the preparation of the Community Improvements Policies Study. ~ 7/85 25 THIRD READING Councillor Stoner, seconded by Councillor Mitchell moved that the report of the Committee of the Whole on By-law Number 1987/85, 1988/85, 1989/85, 1990/85, 1991/85, 1992/85, 1993/85 and 1994/85 be adopted, and that the said By-laws be now read a Third Time and PASSED, and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED By-law read a First, Second and Third Time and Finally Passed. ( IV) 1. OTHER BUSINESS Councillor Cahill reported that he has received a letter from Bell Canada regarding the provision of Durham directories for Pickering residents with 281, 282, 284 and 288 exchanges. 2. Councillor Cahill inquired about the status of the proposed Seaton Community Study. ( IV) CONFIRMATION BY-LAW By-law Number 1995/85 Councillor Stoner, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on March 18, 1985 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. APPENDIX # 1 TOWN OF PICKERING The Executive Committee of the Town of Pickering having met on March ll, 1985 presents its fifth meeting to the Council of the Town of Pickering and recommends: 1. ADJUSTMENTS TO TAX ROLL FILE NUMBER - C 1000 That the tax roll be reduced by $6,929.54 to reflect ad- justments and corrections to the tax accounts as follows: Realty Taxes $1,228.34 Business Taxes 5,349.62 $6,929.54 2. T-5-85 - 2 TWO-WAY SPREADER DUMP BODIES AND HOISTS FILE NUMBER - C 4300 That Tender No. T-5-85 submitted by Frink Canada for the supply of 2 two-way spreader dump bodies and hoists in the amount of $23,026.40 ($lO,760.00 each plus Provinc- ial Sales Tax) be accepted. 3. SUBDIVISION AGREEMENT WITH 556168 ONTARIO LIMITED FILE NUMBER - B 4100 - 18T-79049 WHEREAS, pursuant to the provisions of By-law l805/84, the Town has entered into a Subdivision Agreement dated March 19, 1984 with 556168 Ontario Limited respecting the development of part Lot 22, Concession 2, Pickering (Draft Plan l8T-79049, western portion), which Agreement provides, in part, that, in the event the plan of subdi- vision is not registered on or before December 3l, 1984, the Town may, at its option on one month's notice to the owner, declare the Agreement to be null and void; and WHEREAS, the plan of subdivision was not registered on or before December 31, 1984, and at least one month's notice has been provided to the owner in accordance with the Agreement; NOW THEREFORE BE IT RESOLVED THAT: l. In accordance with section 35 thereof, the Subdi- vision Agreement dated March 19, 1984, between 556l68 Ontario Limited and the Town, the authority for the execution of Which is contained in By-law l805/84, for the development of that part of Lot 22, Concession 2, Pickering, being the western part of Draft Plan 18T-79049, is hereby declared to be null and void. 4. FLEA MARKET AT FAIRPORT BEACH PUBLIC SCHOOL FILE NUMBER - D 2300 That pursuant to Section 7 of By-law 1073/79 (Business Licensing), the Fairport Beach Home and School be exemp- ted from the provision of licensing flea markets for their function to be held on March 30, 1985. 5. UNCOLLEC~lBLg iNVOICE WRITE-OFF FILE NUMBER - C 5380 That the Amberlea Homeowner's Association unpaid invoice in the amount of $100.05 be written off as uncollect- ible. 6. GRANT REQUEST FROM AJAX-PICKERING AND WHITBY ASSOCIATION FOR THE MENTALLY RETARDED FILE NUMBER - C 2163 That the request of the Ajax-Pickering and Whitby Assoc- iation for the Mentally Retarded dated March 4, 1985 for a grant in the amount of $2,097 to assist in their summer day camp program be approved; and that this amount be charged to Account 2195 (Grants to Organizations and Individuals). 7. NATIONAL PHYSIOTHERAPY WEEK FILE NUMBER - A 2111 That Mayor Anderson be authorized to proclaim the week of March 17 to 24, 1985 as "National Physiotherapy Week" in the Town of Pickering. 8. ACCOUNTS FOR APPROVAL FILE NUMBER - C 2310 That the accounts in the amount of $4,484,238.21 for the period ending February 28, 1985, as submitted by the Town Manager, be approved. 9. REQUEST FOR A SALES PAVILION FILE NUMBER - D 2200 That the request from Victoria Woods for permission to erect a sales pavilion on the northwest corner of Dixie Road and Finch Avenue be granted. lO. PROPOSED MODIFICATIONS TO TOWN CENTRE AND LIVERPOOL COMMUNITY PLANS FILE NUMBER - B 1000 That staff be directed to proceed with proposed modi- fications and amendments to the Town Centre and Liver- pool Community Plans with respect to flood damage centres without further circulation. Ll. PROPERTY SALE FILE NUMBER - D 3360 That the Town Manager be authorized to accept the offer to purchase 1.2 acres of land at Sheppard avenue and Merritton Road, and to negotiate the closing date. L2. APPRAISAL OF MUNICIPAL BUILDING FILE NUMBER - E 5130.01 That quotes be invited for the appraisal of the Munici- pal Building from Tom Gifford and Anthony May.
