SPECIAL COUNCIL MEETING
A Special Meeting of the Pickering Town Council was held
on Monday, January 25, 1982 at 7:24 P.M.
This Special Council Meeting was called to consider a resol-
ution to permit the law firm of Feigman and Chernos to
commence a Supreme Court Action against the Pickering Harbour
Company Limited.

RESOLUTIONS

Seconded by Councillor Cahill
WHEREAS, for many years, the Councils of the Corporations
of the Township of Pickering and of the Town of Pickering
have been concerned with respect to the existing and future
use of Frenchman's Bay, and the control over such use;
and
WHEREAS, its investigations into the history of the use
of the Bay, and related activities, have resulted in certain
matters coming to its attention, which matters are of a
legal nature and relate to the rights of both the Corporation
of the Town of Pickering and of the Province of Ontario;
and
WHEREAS, it is therefore deemed desirable to submit certain
matters to the jurisdiction of the Supreme Court of Ontario
by means of an Action against Pickering Harbour Company
(Limited) and Frenchman's Bay Harbour and Marine Service
Company Limited;

NOW THEREFORE, BE IT RESOLVED THAT:
1.
The law firm of Feigman and Chernos is hereby
authorized and directed to commence, on behalf
of the Corporation of the Town of Pickering and
the Attorney General for Ontario upon the relation
of the Corporation of the Town of Pickering,
with the consent of the Attorney General for
Ontario, a Supreme Court of Ontario Action against
Pickering Harbour Company (Limited) and Frenchman's
Bay Harbour and Marine Service Company Limited,
as co-defendants, respecting the claims set out
in the draft Writ of Summons attached hereto
as Schedule "A" to this Resolution.
2.
The issuance of a Consent, by the Town Clerk,
authorizing Feigman and Chernos to use the name
of the Corporation of the Town of Pickering as
relator in the above-mentioned Action, which
Consent is in the form attached hereto as Schedule
"B" to this Resolution, is hereby authorized,
directed and ratified.
3.
The Corporation of the Town of Pickering hereby
agrees to indemnify and keep indemnified, the
Attorney General for Ontario, for his costs of
the proceedings of the above-mentioned Action.
