Special Meeting of January 25, 1988. m (Ii) DELEGATIONS 1. Vern Jasper, Twice Arena Ltd., addressed Council with respect to his rezoning application. He requested that some retail uses such as a drug store and optical outlet be permitted as the abutting owner to the west mhas them and that he not be restricted to Associated Industrial zoning. He also stated that the parking requirements in the Staff Recommended Plan are excessive. See Items #7, #8 and #9 of the Planning Committee mReport 2. Mary Rycroft, Fred Schaeffer Planning Group, addressed Council with respect to the rezoning and draft plans mof subdivision submitted by Fairport Development Inc. and Jameton Ltd. She spoke in favour of the revisions to the Staff Recommendation. lO See Items #3, #4, #5 and #6 of the Planning Committee Report m m ! i' 6/88 24 (III) RESOLUTIONS Resolution #26/88 - See Appendix #1 Moved by Councillor Mitchell Seconded by Councillor Brenner That the report of the Planning Committee dated January 19, 1988 be adopted wi th the following amendments: Condition 9 in Recommendations #3 and #5 were amended to read as fol 1 ows: "That the owner submit for approval by the Town, site plans and streetscape elevations showing the location and relationship of all buildings prior to the issuance of building permits; and any that the owner ensure that the site plans submitted illustrate clearly the exact location of the trees to be preserved and of the protective measures installed." Condition lO.(b)(i) in Conditions #3 and #5 were amended to read as follows: "submit a REVISED Environmental Report that addresses various matters including an environmental impact analysis plan, a description and explanation of such plan, and the specific stormwater control methods and detailed grading methods required to ensure retention of pre-development drainage conditions and vegetation identified for preservation; and" Condition lO.(e) in Condition #3 was amended and added into Condition #5 as follows: "submit a detailed tree planting programme to the satisfaction of the Town, which programme will require the planting of trees on the rear of Lots 28 to 31 and 35 to 38, with a minimum of 10 trees to be planted, each tree having a minimum caliper of 3 inches and that the owner provide the necessary securities to the Town to guarantee the completion of such a tree planting programme." Recommendations #7, #8 and #9 were deferred. CARRIED ! ! ! 6/88 Resolution #28/88 Moved by Councillor Mitchell Seconded by Councillor Brenner SUBSIDY FOR BRIDGE EXPENDITURES FILE NUMBER - C 2440 That the Council of The Corporation of the Town of Pickering petition the Minister of Transportation for a supplementary allocation of subsidy monies for work on a bridge under its jurisdiction to support estimated expenditures of $250,000 in accordance with the Public Transportation and Highway Improvement Act. CARRIED Resolution #29/88 Moved by Councillor Brenner Seconded by Councillor Robertson ANNUAL SUBSIDY FOR ROADS FILE NUMBER - C 2440 That the Council of The Corporation of the Town of Pickerin9 petition the Minister of Transportation for the annual subsidy under the provisions of the Public Transportation and Highway Improvement Act on expenditures made durin§ the year 1987 in the amount of $3,252,225.11. CARRIED Resolution 30/88 Moved by Councillor Mitchell Seconded by Councillor Brenner ADOPT 1987 MEMORANDUM OF SETTLEMENT FOR CUPE 129 FILE NUMBER A 4000 That the Memorandum of Settlement between CUPE Local 129 and the Town of Pickering with respect to the Conciliation Officer's Report of April 27, 1987 and in connection with the 1987 collective bargaining be adopted. CARRIED 6/88 {IV) BY-LAWS Councillor Coburn, seconded by Councillor Robertson, moved for leave to introduce by-laws of the Town of Pickering: By-law Number ~ Being a by-law to adopt a Community Improvement Plan for the Bayview Street Rehabilitation Area of the Town of Pickering. By-law Number 2661/88 Being a by-law to amend Restricted Area {Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in Part of Lot 1, Plan 1051, in the Town of Pickering. {A 10/87; 18T-87004) Councillor Mitchell declared an interest with respect to By-law '2'661/88 as his wife is an employee of John Boddy Developments By-law Number 2662/88 Being a by-law to provide for the establishment maintenance and operation of certain community recreation centres within the Town of Pickering. By-law Number 2663/88 Being a by-law to amend the Town of Pickering Municipal Code to adopt the 1988 estimates of all sums required during the year for the purposes of the Municipality of the Corporation of the Town of Pickering, and to provide for the levying of the rates resulting therefrom and to levy the rates necessary to cover the estimated 1988 levy from the Council of the Corporation of the Regional Municipality of Durham. By-law Number 2664/88 Being a by-law to amend the Town of Pickering Municipal Code to fix instalment dates respecting the collection of taxes. By-law Number 2665/88 Being a by-law to provide for interest to be added to tax arrears. By-law Number 2666/88 Being a by-law to establish a penalty for non-payment of current taxes. By-law Number 2667/88 Being a by-law to authorize the execution of a Transfer of an electric switching unit on Part Block 62, Plan 40M-1488, Pickering from The Corporation of the Town of Pickering to Pickering Hydro Electric Commission. By-law Number 2668/88 Being a by-law to authorize the execution of a Transfer of storm sewer easement from Duffin Developments Inc. to The Corporation of the Town of Pickering, over Part Lot 21, Concession 2, Pickering {Parts 5, 6 and 7, Plan 40R-10816). I 6/88 27 (IV) BY-LAWS - (continued) By-law Number 2669/88 Being a by-law respecting remuneration for Members of Council. By-law Number 2670/88 Being a by-law to accept the offer dated January 29, 1988 of Pitney Bowes of Canada Ltd. to purchase that part of Lot 18, Range 3, B.F.C., Pickering, designated as Parts 7, 8 and 9, Plan 40R-2638 (except Part 2, Plan 40R-7115), and to authorize the Mayor and Clerk to execute same on behalf of the Town. By-1 aw Number 2671/88 Being a by-law to accept the offer dated January 29, 1988 of Pitney Bowes of Canada Ltd. to purchase that part of Lot 18, Range 3, B.F.C., Pickering, designated as Part 1, Plan 40R-3158 and to authorize the Mayor and Clerk to execute same on behalf of the Town. THIRD READING Councillor Robertson, seconded by Councillor Brenner moved that the report of the Committee of the Whole on By-law Numbers 2660/88, 2661/88, 2662/88, 2663/88, 2664/88, 2665/88, 2666/88, 2667/88, 2668/88, 2669/88, 2670/88, 2671/88 and 2672/88 be adopted, and that the said By-laws be now read a Third Time and PASSED, and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (V) OTHER BUSINESS 1. Councillor Arthurs stated that the lights on the sales trailers located at Finch Avenue and Valley Farm Road should be turned off at night. 2. Councillor Arthurs asked for reports on the resignation of the Head Librarian and on the status of the Civic Complex. 3. Councillor Morgan asked that Duberry Drive, Beaton Way and Denby Drive be designated as through highways. requested that the Clerk determine 4. Councillor Brenner if the green boxes located at Valley Gate and Riverview Crescent are still required by Canada Post. 5. Councillor Brenner stated that traffic in the Granite Court, Whites Road and Oklahoma Drive area should be reviewed in order that northbound vehicles move more quickly. 6. Councillor Brenner asked for a copy of the minutes of meeting regarding a delay a Public Utilities Committee in the reconstruction of Whites Road. 6/88 By-law Number 2673/88 Councillor Arthurs, seconded by Councillor Coburn moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 1st day of February, 1988 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. I 1. Delete section 2I in its entirety and replace it with the following: I Community Services and Facilities (a) The Community Services and Facilities Idesignation as illustrated on Schedule IA recognizes as permitted uses the existing fire hall on Bayly Street, the Don Beer IArena on Dillingham Road and the Art Thompson Arena on Bayly Street. (b) In addition, on the lands designated IServices and Facilities Community that abut the Art Thompson Arena, uses that are oriented toward community and Irecreational services shall be permitted to be established. These uses shall include such facilities as assembly ihalls, professional offices, clubs, commercial-recreational establishments, commercial schools and scientific, research or medical laboratories.
