Director, City Development, Report PLN 16-15 Zoning By-law Amendment Application A 3/15 Draft Plan of Subdivision Application SP-2015-02 Draft Plan of Condominium Application CP-2015-01 1144317 Ontario Limited Plan 1051, RCP Lot 126, 40R-23692 Part 1 (1741 Fairport Road) 1 City co A Planning & Development Committee Meeting Minutes • worsosim Monday, December 7, 2015 7:00 pm — Council Chambers Chair: Councillor Johnson Peter Swinton, PMG Planning Consultants, appeared before the Committee on behalf of the applicant in support of the application and to answer any questions. Anne Tulloch, 921 Dunbarton Road, appeared before Committee stating she lives next door to the proposed site and expressed her concerns with the proximity of the road to her driveway, and sought clarification on this matter. Tahir Khan, 911 Dunbarton Road, appeared before the Committee, noting concerns regarding the proximity of his home to the proposed dwellings. He also expressed concerns regarding privacy, and lighting issues, stating these should be addressed. A brief discussion period ensued with Members seeking clarification from staff regarding the road coming off of Dunbarton Road as well as any control measures the City may have for limiting the number of exterior lights on houses. Recommendation Moved by Councillor McLean Seconded by Councillor Pickles 1. That Draft Plan of Subdivision Application SP-2015-02, submitted by 1144317 Ontario Limited, on lands being Plan 1051, RCP Lot 126, 40R- 23692 Part 1, to establish a single development block to facilitate a common element condominium consisting of 9 lots for detached dwellings, as shown on Attachment#3 to Report PLN 16-15, and the implementing conditions of approval, as set out in Appendix I, be endorsed; and • 2. That Zoning By-law Amendment Application A 3/15, submitted by 1144317 Ontario Limited, to implement Draft Plan of Subdivision SP-2015-02, on lands being Plan 1051, RCP Lot 126, 40R-23692 Part 1, be endorsed with the provisions contained in Appendix II to Report PLN 16-15, and that staff be authorized to finalize and forward the implementing Zoning By-law Amendment to Council for enactment. Carried (III) Part `A' Information Reports Nilesh Surti, Manager, Development Review & Urban Design, gave an outline of the requirements for a Statutory Meeting under the Planning Act. Information Report No. 09-15 Official Plan Amendment Application OPA 15-004/P Proposed Amendment 27 to the Pickering Official Plan Proposed Informational Revision 22 to the Pickering Official Plan City Initiated Official Plan Review: The Environment and Countryside A public information meeting was held under the Planning Act, for the purpose of informing the public with respect to the above-noted application. D. Jacobs, Principal Planner— Policy with the aid of a power point presentation, provided an overview of the proposed City initiated Official Plan Amendment No. 27 in relation to the environment and countryside. He outlined highlights of the proposed Amendment 27, explaining conformity with the Natural Greenbelt Plan and how it will clearly identify and distinguish the Natural Heritage System. He also provided an outline of the comments and concerns received to date. Andre Kern, 5192 Old Brock Road, Claremont, appeared before the Committee representing the Claremont Conservation Group. He outlined concerns with the development having a negative effect on the residents of Claremont. He noted the land is currently an active agricultural production and protected under the Greenbelt Plan, the Provincial Policy Statement as well as the Oak Ridges Moraine Conservation Plan. He stated that the majority of the Hamlet is in the Oak Ridges Moraine and that the 90 acre field acts as a giant water filter, providing a vital source of clean drinking water. He stated the Moraine Plan allows for only a minor rounding out of rural settlements and that an earlier attempt to allow development was denied in 2007 by the Minister of Municipal Affairs and Housing as not meeting the intent of the Moraine Plan. He stated his support of the Province on this matter. He also stated this amendment does not constitute a minor rounding out and respectfully requested that any boundary change for Claremont be deleted from the amendment. Jennifer Laffier, 5279 Old Brock Road appeared before the Committee noting her concerns for any development that would infringe on the Oak Ridges Moraine. She stated that she was one of 200 residents who have signed a petition. She expressed a number of concerns with the amendment as well as the motion previously approved by Council regarding land designations in Claremont. She stated that any amendments of this nature could be precedent setting, making it difficult for other municipalities across southern Ontario to fight for protection of their environmental lands if this amendment is allowed. She also noted that the number of homes indicated earlier was not a minor rounding out. She asked that 3 • citq co Planning & Development Committee Meeting Minutes . MMOIOC Monday, December 7, 2015 7:00 pm — Council Chambers Chair: Councillor Johnson the request to open up lands in Claremont for re-designation be reconsidered, stating the environmental impacts were a huge concern. She also expressed her hope to see more environmental groups, representatives from the Federal and Provincial governments as well as media involved to better understand the concerns of the residents of Claremont. A question and answer period ensued with clarification being sought from staff on the number of homes that could be built without an amendment. Peter Rodrigues, 750 Whitevale Road, appeared before the Committee, stating his agreement with the previous delegates. He provided clarification on previous comments he had made in reference to the September 21st Notice of Motion, stating the amendments to the boundary should have read that they were not minor. He also stated that the Carruthers Creek headwaters should be included in the Greenbelt Plan. Mr. Rodrigues stated he felt there was no justification for the motion coming forward at this time, noting there were no flooding issues in Claremont, and also that there was no justification for schools. He asked that Council rescind the earlier motion from September 21st regarding the Hamlet of Claremont and act in accordance with the community. A discussion period ensued regarding the Crombie Report which was just released, with questions raised regarding whether this changes the fundamental assumptions made in relation to the amendments being considered by the City and the potential impact on this plan. The timelines and processes surrounding the Crombie Report were also questioned and whether it was premature to take a stand prior to any decisions of the Province.
