Kearns - Chief Administrative Officer - Director, Planning & Development - Director, Corporate Services & Treasurer - Manager, Policy - City Clerk - Principal Planner, Policy - Committee Coordinator (I) ADOPTION OF MINUTES ~ Regular Meeting of December 17, 2001 Special Meeting of December 17, 2001 Special Meeting of January 14,2002 Special Meeting of January 14, 2002 Councillor Ryan advised that the Minutes of the Special Meeting of January 14, 2002 starting at 10:41 p.m. should be amended by replacing his name with Councillor McLean's as the seconder on the motions put forward by Councillor Holland. (ID PRESENTATIONS 1. Councillor Holland made a presentation to the winners of the Winterfest "Passport to Prizes" contest. 2. The Manager, Policy and the Principal Planner-Policy made a presentation to Council on the results of the Liverpool Road South Area Detailed Review. (lID DELEGATIONS - 1. The following delegations will address Council concerning the Rezoning Application on the Whitevale Mill: -' a) Jim Thompson, 437 Churchwin St., urged Council to give consideration to the problem of access to the Seaton Hiking Trail. He stated that this application is premature, other issues must be resolved before approval is given. The proposed house is large to the standards in Whitevale with a 100' frontage on Mill St. and a 30' frontage on Whitevale Rd. He suggested that perhaps the garage could be placed elsewhere on the property. He stated his concern with water and sewage and with the impact on Duffins Creek from the property clean-up. - 1 - Council Meeting Minutes Monday, January 21,2002 7:45 p.m. - .-. - 2. 3. 4. 5. b) Gord Willson, 455 Whitevale Road, requested that the application be deferred until the larger planning issue concerning access and public parking is addressed. c) Chris Speirs, 35 Robertsfield Rd., Toronto, applicant stated that the preliminary design has been approved by Heritage Pickering (LACAC) and that the set back on Mill Street for the residence is further than the 2 residences across the street. He stated his desire to improve this property and that nothing of his proposal will affect legal access to the trail. d) Rick Goslin, 425 Whitevale Road, stated that the design submitted by Mr. Speirs meets all Whitevale Guidelines and that this application will benefit him by discouraging vandalism in the area. e) Ron Dawe, 385 Whitevale Road, advised of his support of this rezoning appliction. He stated that there are two separate issues; a) need to access the north trail; and b) rezoning application. He strongly urged Council to address the parking and access issue, but not to hold up this application because of trail issue. A lady speaking on behalf of the Aroukatos, 1222 Kingston Road, addressed Council with respect to the application for rezoning at 1210 and 1218 Kingston Road. She advised of their concern with respect to access onto Hwy. 2. She questioned if consideration has been given to signalization lights from this development and whether or not this is the type of development Council wishes along Kingston Road. Brenda Mignardi, 803 Modlin Road, addressed Council in support of the Notice of Motion regarding the establishment of a Domestic Violence Unit. She thanked Councillor Brenner for his assistance with respect to a family requiring immediate housing. Stanley Stein, representing Pickering Harbour Company, addressed Council with respect to the Pickering Harbour Company development application. He stated their opposition to the deletion of 40 units, the Report and Official Plan Amendment 6 and requested Council defer this policy. Mr. Stein further addressed with Council the resolution passed by Council on January 14th concerning illegal dredging undertaken by the Pickering Harbour Company. He advised that the Toronto Regional Conservation Authority and Pickering Harbour Company are working together on this issue and that the Pickering Harbour Company were issued permits for dredging. The Coolwater Farms property has been restored and no significant environmental damage occurred. The following delegates addressed Council concerning applications SP-2001-03, Glenbrook Homes and the Liverpool Road South Area Detailed Review: a) Phil McMullen, PACT, Board Director, stated their opposition to this application and advised that PACT and BECA will intervene, on behalf of the residents, at any OMB Hearing concerning this matter. He stated that both organizations have recommended both sides of Liverpool Road be zoned for commercial and retail uses and also that an open marina vision be retained. b) David Steele, PACT, Chair, stated his opposition to this application and townhouses being placed back to back. c) Stanley Stein, representing Glenbrook Homes, advised of concerns in the staff report and stated their opposition to kitchen facilities being placed on the second floor, of upgraded floor load design; of the establishment of appropriate fire-rated materials in the ground floor construction; and of the establishment of the finished ground floor of dwelling units at a similar established grade as the improved future sidewalk. -2- Council Meeting Minutes Monday, January 21, 2002 7:45 p.m. (IV) RESOLUTIONS Resolution #08/02 - Aooendix #1 - Moved by Councillor Ryan Seconded by Councillor Brenner That the Report of the Planning Committee dated January 14, 2002, be adopted with the following amendments: Item #2 Deferred to the Council Meeting of February 4, 2002, pending response ITom the ORC. CARRIED Council considered the following motion in conjunction with the above resolution: Resolution #08/02(a) Moved by Councillor Pickles Seconded by Councillor Brenner That Item #2 be deferred to the Council Meeting of February 4, 2002, pending response from the Ontario Realty Corporation. CARRIED ....... Resolution #08/02(b) Moved by Councillor Holland Seconded by Councillor McLean That Item #3 be amended by adding in Recommendation #2 which appeared in the Planning Agenda of January 14,2002 and reads as follows: "The City Council direct Planning & Development Staff to commence a City-initiated zoning by-law amendment for lands generally located on the north side of Kingston Road, west of Pine Creek, east of "The Townhomes of Walnut Lane" development, and south of existing dwellings fronting Storrington Street, to establish compatible residential zoning on those lands generally in keeping with the Walnut Lane Area Development Guidelines adopted by Council in June, 1994.' REFERRED TO THE 2002 BUDGET Resolution #O8/02(c) Moved by Councillor Pickles Seconded by Councillor Holland - That the Amendment to Item #3 be referred to the 2002 Budget for further consideration. CARRIED Councillor Johnson declared an interest in the matter concerning the application of the Uxbridge Conservation Association to the Ontario Trillium Foundation as he is involved in litigation concerning the UxbridgelPickering Townline and Sideline 8. - 3 - Council Meeting Minutes Monday, January 21, 2002 7:45 p.m. Resolution #09/02 -. Moved by Councillor Brenner Seconded by Councillor McLean That the Report of the Committee of the Whole dated January 14, 2002, be adopted. CARRIED Resolution #10/02 Moved by Councillor Holland Seconded by Councillor McLean That Council adopt the recommendations contained in Addendum to Report PD 42-01 substituting Appendices Band C of the Addendum Report for Appendices I and II of the original report PD 42-01, the effect of which deletes the A-I residential precinct. CARRIED Recorded Vote: Yes: Councillors Brenner, Holland, Johnson, McLean, Pickles, Ryan and Mayor Arthurs. Council considered the following motion in conjunction with the above resolution: ..... Resolution #10/02(a) Moved by Councillor Holland Seconded by Councillor McLean That Policy 11.S(p) be amended by replacing the words 'does not adversely affect the aquatic environment' with 'represents best environmental impact as determined by the Toronto and Region Conservation Authority'; and That an appropriate related change be made to the Liverpool Road Waternont Node Development Guidelines. CARRIED -4- Council Meeting Minutes Monday, January 21,2002 7:45 p.m. Resolution #11/02 - Moved by Councillor Ryan Seconded by Councillor Pickles That Draft Plan of Subdivision SP-2001-03 submitted by Mr. J. Winters of Glenbrook Homes, on lands being Part of Lot 22, Range 3, B.F.C., City of Pickering, to permit the establishment of three development blocks to support 17 townhouse dwelling units providing minimum construction criteria to readily accommodate retrofit to accept commercial uses within the ground floor of those units, and to create a fourth development block within the rear of the subject lands to support vehicular access, vehicle parking and seasonal boat storage, be APPROVED, subject to the conditions outlined in Appendix I to Planning Report Number PD 36-01. That the Council of the Corporation of the City of Pickering hereby approves the 2002 Animal Control Budget as recommended by the Pickering, Ajax and Whitby Joint Animal Control Committee at its meeting of December 12,2001. This figure represents 51% of 10 million women. . one in three women experience physical assault, from threats of assault to attacks causing serious injury. . 39% of women in Canada experience sexual assault, form unwanted sexual touching (15%) to sexual violence involving wounding, maiming or life endangerment. . children witness violence in four out of ten marriages where violence is reported. . more than one in four women have experienced violence in a current or past marriage. . 45% of victims know their attackers. . 29% of women have experienced violence at the hands of a present or former partner. . 15% of women experience violence by the men they still live with. . 21% of women are assaulted while pregnant. . 63% of women attacked by their male partner are assaulted more than once; 32% are assaulted more than 10 times. . only 14% of violent incidents against women are reported to the police. . 39% of violent marriages have children who have witnessed the violence. This means that more than one million children in Canada have witnessed violence in their own homes. . in 1996, 80% of the victims of criminal harassment were female. . 88% of those charged were male. . women were most frequently stalked by ex-partners whereas men were stalked by acquaintances or strangers. . between 1977 and 1996, in Canada, 1,525 wives were killed by their husbands while 513 husbands were killed by their wives. . in Ontario between three and six women are murdered each month by their current or former male partner. . one in eight women are abused by their intimate partner. . abuse also occurs in same sex relationships. - AND WHEREAS in addition these acts of violence as reported by Statistics Canada, . one in four women will be sexually assaulted during her lifetime. Of these, halfwill be against women under the age of 16 (Ontario Women's Directorate). . one in two women have experienced some form of sexual violence (Statistics Canada Survey, 1993). . one in three women has experienced some form of sexual violence that can be legally defined as Sexual Assault (Statistics Canada Survey, 1993). -6- - .... - Council Meeting Minutes Monday, January 21, 2002 7:45 p.m. . according to the Solicitor General, a sexual assault is reported in Canada every 25 minutes. Another report, from the Canadian Advisory Council on the Status of Women, indicates that every 17 minutes a woman is sexually assaulted. . it is estimated that 80-90% of Canadian women will experience sexual harassment at some point in their working lives. . 57% of rapes happen while on dates (Ontario Women's Directorate). . 60% of sexual assaults occur in private homes (Ontario Women's Directorate). . only one in three assailants is a total stranger; two out of three assailants are mends, acquaintances, boyftiends, co-workers or relatives (Ontario Women's Directorate). . 83% or women with disabilities will be sexually assaulted during their lifetime (Ontario Women's Directorate). . the majority of date and acquaintance rape victims are young women aged 16-24 (Ontario Women's Directorate). . date rape has the lowest reporting rate of all forms of sexual assault. It is estimated that only 1 % of all date rapes are reported to the police (Ontario Women's Directorate). . according to Statistics Canada, only 6% of all sexual assaults are reported to the police. . nearly 90% of sexually assaulted women do not consult with any helping professional after the assault. . a study found that 60% of Canadian college-aged males said that they would commit sexual assault if they were certain they would not get caught (Ontario Women's Directorate). AND WHEREAS the preceding statistics from the 1993 Statistics Canada Survey have now been supplemented by more recent statistics; AND WHEREAS within the Regional Municipality of Durham, domestic violence against women has already resulted in an increasing number of homicides; AND WHEREAS such crimes require specialized resources to investigate and provide ongoing support; NOW THEREFORE the Council of the Corporation City of Pickering hereby requests that Durham Regional Police Service form a Domestic Violence Unit; and THAT a copy of this resolution be forwarded to the Council of the Regional Municipality of Durham and the Councils of the area municipalities for endorsement and to all Durham MPP's and MP's. Councillor Holland gave notice of a motion concerning the OMB and its increasing role. 2. Councillor Holland spoke of and showed slides of barges on Frenchman's Bay stated that some had not been moved for ten years. He suggested that this issue must be aggressively addressed. 3. Councillor Pickles have notice of a motion concerning Provincial lands and a further notice concerning F ederallands. 4. The following matters were discussed prior to the regular meeting: a) The Chief Administrative Officer distributed correspondence concerning Proposed 2002 Budget Timetable, Pickering Harbour Co. Millennium Square Lease and letter from TRCA concerning dredging. b) The Director, Planning & Development advised that changes have been made in proposed Amendment 6 to the Pickering Official Plan, Policy 11.5(h) (ii), by inserting the words 'provision for' in front of the bullet points that deal with fire alarms, separate mechanical systems, and emergency lighting, and that related changes have been made to the Liverpool Road Waterfront Node Development Guidelines. ...... (a) That Zoning By-law Amendment Application A 19/01, initiated by the City of Pickering, on lands being Part of Lot 17, Concession 1, on the west side of Notion Road in the City of Pickering, to permit a range of prestige and higher order mixed employment uses, be APPROVED; (b) That the draft by-law to amend Zoning By-law 3036, as amended, to permit a range of prestige and higher order mixed employment uses including related development standards, as specified in Appendix II to Report Number PD 02-02 be FORWARDED to Council for enactment; 4. That the revised Notion Road Area Development Guidelines, be ADOPTED as the City's strategy for detailed land use, urban design, transportation and inftastructure within the Notion Road Area, as set out in Appendix III to Report Number PD 02-02; .... 5. That "Informational Revision 10 to the Pickering Official Plan" be ADOPTED, as set out in Appendix IV to Report Number PD 02-02; 6. (a) That Pickering Official Plan Amendment Application OPA 87-002/P, submitted by Silwell Developments Limited & Berma Estates Limited (now the Metrontario Group), on lands being Part of Lot 17, Concession 1, City of Pickering, to amend the Pickering District (Official) Plan from Light Industrial to Medium Density Residential be REFUSED, and the applicant be so advised; (b) That Zoning By-law Amendment Application A 5/87, submitted by Silwell Developments Limited & Berma Estates Limited, on lands being Part of Lot 17, Concession 1, City of Pickering, to amend Zoning By-law 3036 to permit townhouse residential dwellings be REFUSED, and the applicant be so advised; 7.
