City of Pickering
The applicant requests relief from Zoning By-law 3036, as amended, to permit a
maximum lot coverage of 38 percent for the lands to be severed, whereas the
by-law permits a maximum lot coverage of 33 percent.
The applicant requests approval of this variance in order to obtain a building
permit for the construction of a new two-storey single detached dwelling on a
future parcel of land to be severed.
M. Yeung, Assistant Secretary-Treasurer outlined comments received from the
City of Pickering Planning & Development Department recommending approval
subject to conditions. Written comments were also received from the City's
Development Control Manager expressing no concerns.
Chris Lazaridis, agent, was present to represent the application. Mark Coleiro of
1502 Oakburn Street was present to obtain additional information and
clarification on the elevation of the proposed dwelling and zoning by-law.
In response to questions from M. Coleiro and a Committee Member, M. Yeung,
Assistant Secretary-Treasurer explained the application and provided
clarification on the zoning by-law requirements.

That application PICA 56112 by L. Cirone, be Approved on the grounds that a
maximum lot coverage of 38 percent on a future parcel of land to be severed is a
minor variance that is desirable for the appropriate development of the land, and
in keeping with the general intent and purpose of the Official Plan and the Zoning
By-law, subject to the following conditions:
1. That this variance apply only to the future severed lot fronting Oakburn
Street, created through Land Division Application LD 103112, as generally
sited and outlined on the applicant's submitted plans.

2. That final approval is granted by the Region of Durham Land Division
Committee respecting Land Division Application LD 1 03/12 for the creation of
the severed lot fronting Oakburn Street and that the Land Division application
is final and binding.
3. That the applicant obtain a building permit for the proposed construction by
October 17, 2014, or this decision shall become null and void.

The applicant requests relief from Zoning By-law 3036, as amended by By-law 1521182,
2495187, 4655195 and 4766196 to permit a maximum gross floor area of 685.3 square
metres for all business offices, commercial schools, financial institutions, professional
offices, and any retail store uses on the lot, whereas the by-law permits a maximum ·
gross floor area of 300 square metres for all business offices and professional offices,
and a maximum gross floor area of 200 square metres for commercial schools, financial
institutions or any retail stores uses on the lot.
The applicant requests approval of this variance in order to allow for greater flexibility to
provide a broad range of commercial uses at the plaza.
Recommendation:
The Planning & Development Department considers the maximum gross floor area of
685.3 square metres for all business offices, commercial schools, financial institutions,
professional offices and any retail store uses on the lot to be a minor variance that is
desirable for the appropriate development of the land, and in keeping with the general
intent and purpose of the Official Plan and the Zoning By-law, and therefore
recommends Approval of the proposed variance, subject to the following conditions:
1. That this variance apply only to the existing commercial building, as generally
sited and outlined on the applicant's submitted plans.
Background:
Over the years, there has been a number of zoning by-law amendments and minor
variances approved on the subject property. The property currently permits a variety of
uses, some of which have maximum gross floor area attached to each use, while other,
permitted uses do not. For further details of the permitted uses on the property and
associated gross floor area for each use please see below under the Zoning By-law
section of this report.

The applicant is requesting to increase the maximum gross floor area provision for
certain permitted uses in order to allow for a broader range of uses on the property and
flexibility in its leasing/tenant options.
Comment:
Official Plan and Zoning By-law
Pickering Official Plan-"Urban Residential Areas-Low Density Areas" within the
Liverpool Neighbourhood
• permissible uses in the Urban Residential Areas designation includes, but not
limited to, the following:
• residential uses
• home occupations
• limited offices serving the area
• limited retailing of goods and services serving the area
• compatible special purpose commercial uses serving the area
• the proposed variance complies with the general intent of the Pickering Official
Plan policies
The property is zoned "C6" by Zoning By-law 3036 as amended by By-law 1521/82,
2495/87, 4655/95 and 4766/96. The permitted uses and maximum gross floor area
associated with each use in the "C6" zone are as follows:
Permitted Uses: Maximum Aggregate Gross Floor Area
Business Offices and Professional Offices 300 square metres
Commercial School, Financial Institution 200 square metres
and Retail Store
Dry Cleaning Depots, Laundromats, n/a

Appropriateness of the Application
• the intent to limit the gross floor area of certain permitted uses, within the zoning
By-law was to encourage a variety of uses on the property that will serve the
daily convenience needs of the area residents, to ensure that sufficient parking is
provided on-site and to ensure that there are no significant increases in traffic
flows to the site
• the parking by-law requirement is 4 parking spaces per 93 square metres gross
floor area and therefore the minimum parking requirement for the property is
30 parking spaces whereas a total of 33 spaces are provided on-site, resulting in
a surplus of 3 parking spaces

• as a comparison, recently approved parking standards for commercial properties
in the City of Pickering is 4 parking spaces per 100 square metres of gross
leasable floor area
• applying recent parking standards of 4 parking spaces per 100 square metres of
gross leasable floor area, the subject property would require a minimum of
28 parking spaces, resulting in a surplus of 5 parking spaces
• the increase in the maximum Gross Floor Area on the property would not
significantly increase traffic flows to the site or negatively impact Traffic flows
along Finch Avenue and Dixie Road
• the City has no record of any public complaints or concerns on parking on the
subject property
• there appears to be no adverse impact to the surrounding neighbourhood
• the requested variance allows the owner the ability to accommodate a variety of
uses on-site to serve the surrounding neighbourhood
• the intent of the official plan and zoning by-law is maintained
