Environmental groups are taking the Ontario gov- ernment to court for giving developers the OK to build on the provincially signifi- cant Duffins Creek wet- lands complex in Picker- ing. The Ministry of Housing and Municipal Affairs ap- proved development in this area to accommodate a warehouse facility through a Ministerial Zoning Order (MZO) in late October. Ecojustice filed the legal application on behalf of En- vironmental Defence and Ontario Nature. The chal- lenge seeks to have the MZO quashed and declared unlawful for failing to com- ply with provincial law and policy, as the 2020 Provin- cial Policy Statement un- der the Planning Act does not permit development on provincially significant wetlands. "Ecojustice is going to court to protect important wetlands in Pickering and across southern Ontario from a provincial govern- ment that is intent on disre- garding environmental protections and giving de- velopers a free pass to dig up the earth to their heart's content," said Ecojustice lawyer Laura Bowman. Pickering-Uxbridge MPP Peter Bethlenfalvy said the MZO was request- ed by the City of Pickering, with the support of the Re- gion of Durham, to help speed up the development of a tourism, entertain- ment centre and ware- house facility that will cre- ate 10,000-plus jobs and boost the economy in the region. "The City of Pickering will still maintain other land use planning approv- als including site plan con- trol approval, which would enable them to set out con- ditions of development ap- proval," he said. Bethlenfalvy added the Toronto and Region Con- servation Authority (TRCA) and the proponent have also signed an agree- ment and are in active dis- cussions about how to en- sure that there is creation of ecological benefits that meet or exceed any loss to the natural system. "As this matter is cur- rently before the courts, it would be inappropriate to comment further," he said. Provincially significant coastal wetlands help to mitigate flooding, store carbon, filter water and provide habitat to wildlife. "It is outrageous that we have to go to court to force the Ontario government to uphold its own policies that protect provincially signif- icant wetlands like Lower Duffins Creek," said Tim Gray, executive director of Environmental Defence. He said the Lower Duf- fins Creek wetlands are some of the best and last re- maining coastal wetlands in the Greater Toronto Ar- ea. "For the government to authorize its destruction for a warehouse is beyond egregious. Now to top it off, the province is proposing to take away the power of conservation authorities to stop such destruction, put- ting all of Ontario's sensi- tive natural areas in line for development." Gray is referring to pro- posed changes to the Con- servation Authorities Act, which will allow develop- ers to bypass a conserva- tion authority's restric- tions. In the past, MZOs were rarely used and were re- served for exceptional cir- cumstances. In this year alone, the province has is- sued more than 30 MZOs to fast-track development. "Doug Ford must repeal his destructive MZOs that allow his government to override local planning rules and run roughshod over environmental pro- tections," said Oshawa MPP Jennifer French and NDP Environment critic Ian Arthur in a joint state- ment. The Ontario New Demo- cratic Party has joined a list of voices opposed to de- veloping on the wetlands. GROUP TAKING PROVINCE TO COURT OVER PICKERING PROJECT KRISTEN CALIS KCalis@durhamregion.com NEWS Developers of Durham Live can now go ahead and build a warehouse as part of its development in Pickering, which critics say should not happen due to its location on provincially significant wetland. Sabrina Byrnes/Metroland File Two local members of parliament have added their names to the list of people who are disappoint- ed with plans to develop on provincially significant wetland in Pickering. Pickering-Uxbridge MP Jennifer O'Connell and Ajax-Pickering MP Mark Holland sent a letter to the Minister of Crown-Indige- nous Relations Carolyn Bennett stating concerns over a Minister's Zoning Order (MZO) granted in late October for the devel- opment dubbed Project Lonestar. The develop- ment is part of Durham Live, and includes a ware- house distribution centre at Squires Beach Road and Bayly Street in Pickering. The City of Pickering and developer Triple Proper- ties requested the MZO in the spring. O'Connell and Holland said the land is situated within the Traditional and Treaty lands of the Wil- liams and Pre-Confedera- tion Treaties. "The destruction of this land and water source is a clear message to the stew- ards of these lands, show- ing no regard for meaning- ful consultations and rec- onciliation," the letter said. They asked the minister to carefully consider the impact of this development in regards to Aboriginal and treaty rights, and to see if there is any action the federal government can do to address this. Chief Kelly LaRocca of the Mississaugas of Scugog Island First Nation (MSIFN), whom the City of Pickering is currently working to improve its re- lationship with, wrote a let- ter to Mayor Dave Ryan on Nov. 11, on behalf of the Chiefs of the Williams Treaties First Nations. "While we were pleased that the City of Pickering reached out to our MSIFN in an effort (to build a) stronger relationship with its local Indigenous com- munity, we have come to realize that as a municipal government, the City com- pletely missed the mark," it said. The letter said reconcili- ation, "the act of restoring harmony," must mean more than land acknowl- edgments and flag flying — two of the steps Pickering has recently taken. "To develop the Picker- ing wetland amounts to anything but restoring harmony to the land or harmony to the relation- ship with the local Indige- nous community," the let- ter said. Pickering's manager of public affairs and corpo- rate communications, Mark Guinto, said in a statement that Mayor Ryan did not have an opportuni- ty to speak with Chief La- Rocca on the matter of the Durham Live MZO prior to her issuance of the letter. "They have subsequent- ly spoken, and committed to having more meaningful dialogue on the matter," he said. CDCD conducted a sur- vey to better understand what resources and sup- ports will be needed to sup- port non-profit organiza- tions through COVID-19. A common concern: fi- nances. The survey found the overwhelming need for non-profits is an increase in funding, with a specific emphasis on dollars allo- cated to core and opera- tional support. "People are saying, 'We need help paying our bills,' " Gardner said. Only half of the respon- dents were confident that they will recover and re- turn to their previous level of service. "Those who relied on fundraising events were immediately concerned," Gardner said. Although 90 per cent of respondents are still open and operating, the fund- raisers many held in 2019 and the early part of 2020 have gotten them through thus far. Gardner said it's going to be around 18 to 24 months before these orga- nizations will be truly af- fected. "It's kind of a calm be- fore the storm type of mo- ment right now," he said. He said there is an "in- crowd" of non-profits that are connected and aware of funding opportunities, but there are others that need more communications. The report found the Re- gion of Durham could help by taking a more active role in communicating non-profit events and ini- tiatives, and developing networking opportunities. The survey showed em- ployees are concerned about their employment and balancing their home and work responsibilities. "We're asking more of our staff than I think other people in other sectors," said McNee-Baker. Many are homeschool- ing their children, and they have to physically go to work. Also, since Community Living services the vulner- able community, there is added pressure. "We constantly remind them, what you do in your personal time has to do with people you support," McNee-Baker said. Staff have also been re- deployed and shifts have changed. "They're doing it so will- ingly and they're so appre- ciative that they still have a job," she said. At St. Paul's on-the-Hill Community Food Bank, volunteers are still giving their time at the food bank. But what used to be a busy environment as vol- unteers would come in to stock the shelves and pre- pare items for pickup, has become much more struc- tured, and has added rules surrounding food pickup. "Luckily the clients are co-operative and the volun- teers are willing to come in and help," said food bank director Marg Jocz. The need for the food bank has become even greater since COVID-19 hit. "Comparing January to October, there was a 20 per cent increase in food bank use for us," Jocz said. In a time when others are struggling, she said the donations have been con- stant. Perhaps it's because it's Pickering's only food bank, or because it always has had strong community support. "People are being inven- tive, they're being support- ive and the community is being very responsive," Jogz said. Even still, uncertainty lingers across the non- profit sector. "We don't know what the future is going to bring," Jocz said. "It doesn't matter where you live or what you do. Tomorrow is un- known." Paid for by the Government of Ontario Teachers and support staff at a group of private Montessori schools in Durham have ratified a new collective agreement, ending a two-week long strike. The strike at Blaisdale Montessori School impacted about 700 students across campuses in Ajax, Oshawa, Bowmanville and Pickering. "These workers took a meaningful stand for a fair contract that raises the bar for everyone, especially the 55 per cent of members who were earning minimum wage," said Candace Rennick, secretary treasurer of CUPE Ontario. "This strike was about fairness for loyal, dedicated and hard-working Montessori teachers and support staff who deserve to be treated with respect." The new five-year collective agreement includes up to a 7.72 per cent wage im- provement for members who earn close to minimum wage and wage improvements averaging 2.5 per cent each year of the col- lective agreement. The union says the new agreement was ratified with an "overwhelming majority" on Nov. 30. Sara Lorne, president of CUPE Local 525, says it took "a tremendous amount of courage and conviction" for teachers and support staff to take job action during the pandemic. "I'm incredibly proud of our members who stood united during each step of bar- gaining -- together we fought hard and con- cluded this round of negotiations with a fair contract that reflects the value of these dedicated teachers and support staff," Lorne said. Officials with Blaisdale Montessori School did not respond to a request for comment. Lara Di Gregorio, direc- tor, acquisitions and asset management for Crest- point, said, "We bought this land in June of 2019 and we partnered with Blackwood Developments. They had a previous relationship with Amazon through a differ- ent facility they worked with them on over in Cale- don." Crestpoint owns the site and Blackwood is the de- velopment manager. Also in the partnership is Broc- colini, which is leading the construction of the one- million-square-foot build- ing. "We started working on this project in early 2020 and it's been very, very ex- citing. Of course, in Sep- tember we finally signed a lease and everybody knows about it now," she said. "It took a little while, but we're very, very excited about it," Di Gregorio added. Amazon announced it would open a fulfillment centre at Rossland and Sa- lem roads in Ajax in early September. About 1,000 jobs will be created. "We bought about 110 acres. The site is 129 acres in its entirety, but we have to give some to the TRCA, so the remaining acres on the south, which is around 48 acres. We plan on build- ing industrial as well. We have a three-building plan." They don't have tenants signed up for the three southern buildings, but Di Gregorio said, "We've had some significant interest in varying sizes for the south." She said the pandemic has slowed business down across the GTA. "We are very confident. We think the location is outstanding in terms of proximity to highways, la- bour, transit. So we are fairly confident. We are planning on building at least one building on spec, on speculation," she said. "We expect to break ground in the south in the spring of 2021," she added. Building on spec is "market dependent," she explained. "So in a market you have confidence in that your downtime will be rela- tively minimal when you put it up ... It's fairly com- mon to build on specula- tion." It's possible for the Am- azon building, at about one million square feet, to be completed by September of next year. "What we've been told by our partner is late 2021," Di Gregorio said. "Steel starting going up (recent- ly), which is an exciting milestone for us. A million- square-foot building is fair- ly sizeable in Canada. In the GTA, there's a few oth- er million square footers you could find. This is one of our larger buildings." The announcement came on #Giving- Tuesday and it's the second round of CO- VID-19 relief funding the town has issued. It's part of the Ajax Council COVID-19 Spe- cial Response Fund. "I found we needed pic- ture books about provinces and territories, and I decid- ed to write one," said Melis- sa Marie, a special educa- tion teacher in the Toronto Catholic District School Board. An Adventure In Cana- da is the story of a young boy who journeys across Canada to each province and territory, where he sees an animal indigenous to each region he visits. This book is meant to help children learn their provinces, territories, landscapes and animals of Canada. Marie finds there is a lack of focus on Canadi- an content in popular liter- ature which is why she wrote this book and hopes to see it used in the class- room. She chuckles that in the end, it was an American publisher that chose to move forward with the book. "I've used it in the class- room and the kids love it," she said. "They didn't real- ize we have bison in Cana- da. They're mesmerized by the animals." Marie's own children are ticked by her publica- tion. Her daughter, 10, was her test subject when she wrote it, and her son, 5, en- joys it. "It was the first book he brought to me a second time and asked for me to read it to him again," she said. Accomplishing one of her personal goals is a les- son she shares with her students. "That's one of the things that I teach them," she said. "You can never quit dream- ing."
