His firm is handing the class action suit against Chartwell Ballycliffe Long Term Care and Retirement Residence on Station Street. The suit is for all resi- dents, with Margaret Roper of Grimsby serving as the represen- tative complainant. Roper's mother, Iris Roper, died on April 20 of COVID-19 at the age of 93. "I consider it my duty to my mother to push for an investiga- tion of this tragedy. Those that are responsible for this state of affairs must take responsibility and be held accountable. That is the rea- son I decided to go forward with this action on behalf of all the resi- dents of Ballycliffe," Roper said at the time the suit was filed. There were 31 deaths at Bally- ciffe between March 29 and June 14, when the outbreak was de- clared over. Ballycliffe had the second highest number of deaths of all long-term care facilities in Durham, trailing Orchard Villa in Pickering, where 78 people died. The Orchard Villa figure in- cludes both the long-term care fa- cility and the retirement home. In all, there were 109 total cases of COVID-19 at Ballycliffe, with 78 resolved. The legislation was tabled on Tuesday, Oct. 20 and it limits law- suits to gross negligence and in- tentional misconduct. "After listening to the con- cerns of Ontarians, we want to ensure people can seek redress against gross negligence, inten- tional misconduct and bad actors who fail to make an honest effort to follow COVID-19 guidance and laws," Attorney General Doug Downey said when the legisla- tion was released. Downey said the legislation was designed to provide liability protection for health-care insti- tutions, businesses, charities, non-profit organizations, front- line workers and coaches and vol- unteers if they are blamed for "in- advertent" spread of the virus, but made good-faith efforts to fol- low public health guidelines. The proposed law would be retroactive to March 17 if passed. "It doesn't actually let the bad actors off the hook," Downey add- ed. "If you get to the level of negli- gence, like gross negligence... or you're just thumbing your nose at the government's public health suggestions, you're still on the hook." Will said, "It's terrible legisla- tion which I'm hoping will ulti- mately be defeated. The real problem with it is we've had neg- ligence as a cornerstone of our civil justice system for over 100 years." "This legislation comes in and with the stroke of a pen, says too bad, people died and there's no compensation and you're just out of luck," Will added. Sharon Ranalli, the vice-presi- dent of marketing and communi- cations for Chartwell, said in a statement, "We offer our sincere sympathies to the family of Mrs. Roper and are deeply aware of how difficult a time this is for their family. We are in receipt of the Statement of Claim and will be responding in defense of the claim. "Chartwell took immediate and sustained actions to height- en its response measures from enhanced infection and protec- tion protocols, screening and res- ident monitoring, following man- datory visitor restrictions and compliance with all government directives," Ranalli added. The Regional Munici- pality of Durham is asking residents to put used or un- wanted household batter- ies out for recycling on their collection day for fall battery collection during blue box collection days over the week of November 2. Pickup for battery recy- cling is available to house- holds across Durham who receive curbside garbage and recycling collection. Three steps to recycle old batteries: 1: Find one of the orange labels which went out to residents attached to the 2019-2020 Waste Collection Calendar Guide. If your guide is long gone (recy- cled, presumably) a print- able version of the label can be found at dur- ham.ca/Battery. 2: Stick the label to a clear, sealable plastic bag and fill that bag with used or unwanted household batteries. 3: Put the sealed battery bag on top of your blue box for paper during the week of November 2. Three don'ts for recy- cling batteries: 1. Before pickup, don't store batteries anywhere warm, wet or with flamma- ble or conductive materials. (Terminals on lithium and nine-volt batteries should be covered with masking tape prior to storage.) 2. Don't put loose batter- ies inside your blue box and expect collection work- ers to be able to find and sort them. Keep batteries separate from other blue box materials. 3. If you miss your col- lection date, don't put the batteries out the next week. Three things you may not know about battery re- cycling: 1. Why it's this week — On November 1, clocks go back for Daylight-saving time. A development propos- al by Marshall Homes came before the planning and development commit- tee in December 2019, through a land severance application rather than a draft plan of subdivision. Residents spoke against the proposal at the meet- ing. However, councillors approved the plan, and now, the new homes are on their way up. The area, Rosebank Road and Denbrook Drive, is an established low-den- sity residential subdivi- sion consisting of two-sto- rey detached homes. Marshall Homes is put- ting its unique "Flexhouz- es," essentially two homes in one. To nearby resident Da- vid Sanderson, who's not opposed to development, the new homes simply won't fit in with the neigh- bourhood. "Put something in that's comparable," he said. The Pickering Official Plan requires that a prop- erty capable of being divid- ed into more than three ad- ditional lots must be devel- oped by a plan of subdivi- sion, unless council feels it's not necessary, which was the case here. This property was zoned in 1984 for develop- ment, but the seller held onto it until recently. "I completely get it's a huge change for the people that live beside it but with zoning rules, if you've got the zoning, you can get a building permit," Cather- ine Rose, Pickering's chief planner, said in an inter- view. Craig Marshall, presi- dent of Marshall Homes, said in an interview: "The services were already in there so it was no secret that this was going to be a development some day." Sanderson noted two of the lots fronting Dencourt Drive will be short by more than two metres of the city's lot frontage require- ments. He also said the propos- al is not in the spirit of the Design with Nature sec- tion of the Official Plan, nor in maintaining the community character. Sanderson said the number of displaced ani- mals that were living in the wooded area is significant. "That small wooded ar- ea was home to foxes, rac- coons, skunks, rabbits, squirrels, chipmunks and several species of birds," he said. He said Marshall Homes gave two trees to nearby homes. "It would be hard to re- place a 40-year-old tree," he said. Marshall Homes has been planting trees to make up for the loss. "We're doing our best to blend that into the existing subdivision," Marshall said. "For a small subdivi- sion, we're putting a lot of trees in." Sanderson feels the dis- ruption, dirt and noise dur- ing construction will be significant to locals. "I'm just hoping they get this developed quickly, on time, that there's no inci- dents to mine or my neigh- bours' properties," he said. Marshall, who said the development is expected to be completed in summer 2021, noted the develop- ment will increase proper- ty values. "Redevelopment gener- ally improves the value of the properties for every- body around it," he said. The out- break of the novel coronavi- rus COVID-19 in late 2019 and early 2020 hit small busi- nesses especially hard, with many being forced to close their facilities to customers in an effort to prevent the virus from spreading. Estimates regarding the effects of the COVID-19 out- break on small businesses varied, but many small busi- ness owners were forced to let go employees as they confronted steep declines in revenue. Sam Demma and Dillon Mendes, founders of Pick- Waste, have been cleaning up trash in Pickering since they were high school stu- dents in 2017. After hosting around 200 community cleanups, PickWaste has filled nearly 2,000 bags of lit- ter in Pickering. With COVID-19 being a concern in the community, Halloween will likely look different this year. Even if it isn't officially cancelled, many parents are planning to avoid trick-or-treating with their children. Mendes and Demma have an idea they say will help rid the city of trash on the ground, and allow kids to still partake in some fun this Halloween. "The idea is simple. Three steps," said Demma. First, get your kids dressed up in their cos- tumes; second, take them outside to fill a bag of gar- bage; and finally, reward them with treats at home. And don't forget to take pho- tos. Those who take part can share their photos and litter collections on social media using the hashtag #TrickOrTrash.
