FROM ◊ Ω PICKERING - Residents in the Bay Ridges area say re- sponse to a fuel spill in their lo- cal creek has been slow and subpar. Residents reported the spill last week, after a heavy smell enveloped the neighbourhood and - what appears to be - diesel was spotted in the creek run- ning through Douglas Park, near Liverpool Road and High- way 401. Ryan Pfeiffer/Torstar GONE FISHING DURHAM - Health offi- cials want to speak with anyone who may have come in contact with a ra- bid bat in Pickering. The bat was found ill/in- jured on a property in the Dixie Road and Glenanna Road area on June 3, ac- cording to the Durham Re- gion health department. A resident found the bat and took it to the To- ronto Wildlife Centre, where it was euthanized and sent to the University of Guelph for testing. Ini- tial tests at the university lab were inconclusive re- sults, so the bat was sent to the Canadian Food Inspec- tion lab for further tests. The positive result was confirmed on Aug. 7 and the health department re- ceived the positive rabies report on Aug. 8. "As no human exposure had been identified at the time that the bat was first delivered to the Toronto Wildlife Centre, testing may have been delayed as the situation was deemed not urgent," Ross Ma- cEachern, manager, health protection, said in a statement. "However, since we're not sure how long the bat might have been in the area, or if it may have also been in other locations around the neighbour- hood, the health depart- ment would like to speak with anyone who may have had any type of contact with the bat. If we receive calls from individuals indi- cating that they had con- tact with this bat, everyone affected will be assessed to determine if there is a need for followup treatment. If treatment is required, it will be administered by a health care practitioner." Rabies can be found in bats and other wild ani- mals in the community, MacEachern noted. People need to be cau- tious and avoid all contact with these animals. He also stressed that people need to ensure that their pet dogs, cats and ferrets are up-to- date on their rabies vacci- nation. Anyone who may have been bitten or scratched by a wild animal should im- mediately wash the area with soap and water and then seek medical atten- tion. Anyone who believes they may have been ex- posed to the bat in the Pick- ering area is urged to call the health department at 905-723-3818 or 1-888-777- 9613. DURHAM - Ontario's appel- late court has ruled in favour of the Durham Region Crown attor- ney's office in a legal fight with police that was sparked by a law- suit over a cold case murder in- vestigation. The Ontario Court of Appeal cited prosecutorial immunity in striking down a crossclaim filed by Durham police against the Crown, an action taken after a man acquitted of murder filed a lawsuit alleging negligence on the part of both entities. Durham police claimed they were given bad advice by the Crown during an elaborate investigation into the decades-old case. "It is plain and obvious that prosecutorial immunity bars the crossclaim," the ruling, released Aug. 12, says. "Crown attorneys do not owe the police a duty of care in respect of the legal advice they provide to them." The legal issues arise from an investigation into the murder of Beverly Smith, who was found shot to death in her home in north Oshawa in 1974. After revisiting the cold case, Durham police charged Alan Dale Smith with second degree murder in 2008. Within months the case against Smith, who was not relat- ed to the victim, unravelled and the Crown withdrew the charges. But police, acting on the advice of the Crown, reopened the investi- gation into Smith, according to the ruling. Project Fearless was a months-long Mr. Big-style opera- tion during which Smith was be- friended by undercover cops who posed as criminals. The auda- cious charade culminated with a staged murder, and Smith was en- listed by his friends to dispose of what he thought was a body. During the investigation Smith was pressed by the cops about his role in the 1974 killing, and on two occasions gave con- fessions. Although those confes- sions did not jibe with known facts about the murder, he was re-arrested in the summer of 2009 on a first-degree murder charge. Smith spent almost five years in custody before a judge ruled the confessions inadmissible at trial, finding police had breached his charter rights. He was acquit- ted outright in July of 2014. Smith soon sued police, prose- cutors and the provincial attor- ney general, alleging he'd been the victim of a negligent investi- gation, unlawful arrest and im- prisonment and infliction of men- tal suffering. In their response to the suit Durham police filed a crossclaim, claiming investigators had relied on the Crown attorney's office to approve investigative techniques and, ultimately, the laying of a murder charge against Smith. "The (Durham police) relied on this legal advice in good faith and would not have proceeded as they did had the Crown attorney's office advised them otherwise," the Court of Appeal ruling says. "Furthermore, the (police) pled that they would not have charged (Smith) for murder but for the Crown attorneys' legal advice." Alan Smith's claim against the Crown was struck in a lower court, but the judge allowed the police crossclaim to proceed in part. In 2018 the police crossclaim was struck down by Divisional Court, which cited the principle of prosecutorial immunity, re- jecting an argument that immu- nity should not apply to advice provided by the Crown prior to the laying of charges. The ruling was challenged in the Court of Appeal, which up- held the Divisional Court judg- ment. The Appeal Court once again cited the Crown's pre- sumed immunity. The court also noted that allowing the cross- claim to proceed might result in a "chilling effect." This could cause Crown attorneys, with whom po- lice consult on investigations and the laying of charges, to be "moti- vated less by legal principle than by a calculated effort to ward off the spectre of liability." The court ordered the police to pay legal costs incurred by the Crown in the amount of $20,000. A victim made his way to a nearby residence and called 911 after being stabbed "numerous times" during an altercation with two suspects around 10:30 p.m. Aug. 14 in Lord Durham Park, Durham police said. He was tak- en to hospital and is expected to recover. One suspect was arrested Aug. 15, police said. Christopher Lee- son, 20, of Ajax is charged with aggravated assault, weapons pos- session and possession of co- caine. A second suspect is still being sought, police said Friday. But at the same time I can't apolo- gize for standing up for Ca- nadian jobs because that's a part of what Canadians expect me to do." Never have I seen a prime minister so shrewdly and deceptively use the electorate to shield himself, but that's exactly what we have in Prime Minister Trudeau. Canadians have become his go-to card to ex- plain away his decisions - be it good or bad. Usually a prime minis- ter should be able to speak on behalf of the people he represents, but not this one. Is he saying we expec- ted him to go to bat for SNC- Lavalin by putting a provi- sion into the budget to pro- tect the company that the company actually lobbied for? Ethics commissioner Mario Dion stated in his re- port that "The evidence showed there were many ways in which Mr. Tru- deau, either directly or through the actions of those under his direction, sought to influence the at- torney general." "The prime minister, di- rectly and through his se- nior officials, used various means to exert influence over Ms. Wilson-Raybould. The authority of the prime minister and his office was used to circumvent, under- mine and ultimately at- tempt to discredit the deci- sion of the director of pub- lic prosecutions as well as the authority of Ms. Wil- son-Raybould as the Crown's chief law officer," Mr. Dion said. This is the second time that the prime minister has been found guilty of contra- vening the code of ethics - the first was for receiving gifts from the Aga Khan surrounding a family trip he took to the prince's pri- vate island in 2016/2017, de- spite the fact that the Aga Khan's foundation was lob- bying the government at the time. Now there's this. I've lost track of the number of times Prime Minister Trudeau has in- voked the name of Canadi- ans and Canadians' inter- ests to cast his spell, hoping to blind the people to his own ways. It's not working. Vote for who you will in October, but understand who we currently have in office. Even if the RCMP gets involved, since the name of Canadians has been used so often, it only seems fitting that we take back our name at the polls. The cheerful pooch, a 10- month-old lab-hound mix, was introduced to the me- dia Thursday morning at Durham police headquar- ters, where Const. George Tudos provided an update on the whirlwind story that began when Milo was sto- len from a Toronto Hu- mane Society shelter. The dog has now been adopted by the officer and is set- tling in to his new home. "The dog's been on quite an adventure," said Tudos. Milo went missing Aug. 9 when a man walked into the kennel area of the shel- ter, slipped a leash on him, and walked out. Police were able to determine the suspect boarded an east- bound GO train and rode to the end of the line in Osha- wa. On Sunday, Aug. 11, po- lice tracked the suspect down in Pickering. Chris- topher Rich, 31, of no fixed address is charged with theft, possession of proper- ty obtained by crime and breach of probation. Tudos said the incident generated a great deal of in- terest, and it's that fascina- tion with the story that led to its happy conclusion. Po- lice were provided with tips that led them to a sus- pect, who was in posses- sion of the dog when they located him in Pickering. That's when the officer, who wished to remain anonymous, came into contact with Milo. A dog owner, she provided the pooch with a much-needed drink of water, and then was tasked with driving him back to the Humane Society pound. It was on that trip a bond was formed, Tudos said. "Right away she really grew fond of this dog," he said. The cop, who was looking for a canine com- panion for her dog at home, asked about adopting Milo that day. He came home with her this week. "Since bringing Milo home, he's been nothing short of wonderful," the of- ficer said in a message re- layed by Tudos. That wonder has includ- ed the energetic Milo eat- ing a slipper and chewing through his harness. "But it's OK," the officer opined. "Milo's been a great addition." During Thursday's me- dia event Milo, apparently oblivious to his rapid rise to fame, cavorted about a conference room, nibbling at dog treats Tudos kept pulling from his pocket. His happy-go-lucky dispo- sition is disarming, Tudos noted as he discussed the officer's instant affinity for the pooch. "After meeting this dog briefly this morning, I can understand why," he said. BLIND RIVER - An Ajax woman faces numerous charges after false identifi- cation was supplied to the OPP. On Aug. 8 at about 5:17 a.m. the East Algoma De- tachment of the OPP re- sponded to a traffic com- plaint on Highway 17 in the Township of North Shore after a white car struck a construction cone and was swerving all over the road. Police located the vehi- cle as it entered the Town of Blind River and stopped the car. The driver provided false identification to the officer. Upon verifying the true identity of the driver it was determined she was prohibited from operating a motor vehicle. Cassandra Beckett-Ben- jamin, a 23-year-old from Ajax, was arrested and charged with: • Personation with in- tent to avoid arrest, prose- cution or obstruct justice, contrary to section 403(1) (d) of the Criminal Code (CC); and • Operation while pro- hibited, two counts, con- trary to section 320.18 of the CC; and • Driving while under suspension, contrary to section 53(1) of the Highway Traffic Act The accused was re- leased on a promise to ap- pear and is scheduled to ap- pear at the Ontario court of justice in Blind River on Oct. 31. So far, it isn't clear where the diesel came from. "As no source has been identified, we think that it may be attributed to a motor vehicle incident on the highway," says Mark Guinto, manager of pub- lic affairs and corporate communications for the City of Pickering. As of Sunday, Guinto said the creek appeared to be flowing clear with "a small amount of colour sheen noted in pockets and an odour is still pre- sent." Area resident Shaun Rickard says the situa- tion isn't being take seri- ously. "It was a substantial spill," he says. "The whole neighbourhood smells of diesel. Last night (Sun- day) sitting on my porch I could still smell it." Back in 2010, there was a diesel spill in the same creek and Rickard says the response then was much more aggressive. This time around, he says officials were slow to respond and that absor- bent booms aren't enough to contain the diesel. "We've had some pret- ty heavy rain in the last few days, whatever was in the creek is out in the bay now," Rickard says. "This is serious environmental pollution ... in my opin- ion, somebody dropped the ball here." Pickering resident Luanne Cainer often brings her kids and dog to Douglas Park to walk by the creek and says she was "bowled over" by the smell of diesel when she arrived on Friday. "You can see that the (booms) aren't really do- ing anything, they're not stopping it from moving through the creek. This is just so sad to see." Pickering Ward 2 re- gional Coun. Bill McLean says he will be asking city staff to investigate "thor- oughly" to pinpoint the source of the spill. If it was due to a vehi- cle accident, he wants to see the city's lawyers look at recovering cleanup costs through the vehicle owner's insurance. "It is so upsetting to see our streams and riv- ers contaminated with petroleum products that are so damaging to fish and wildlife," McLean says. Officials with the Min- istry of the Environment did not immediately re- spond to a request for comment. Metroland covered a similar spill in the same creek in 2010, which generated a big response from the province. Reporter Jillian Follert visited the site and connected with city officials to learn more about what is being done to clean up this latest spill. DURHAM - The Whitby and Pickering GO stations could be getting new names. On Thursday, Aug. 1, Metrolinx issued a notice seeking proposals for a "naming rights opportu- nity" for GO rail stations. The transit agency is looking to sell the naming rights to five stations. The others include Exhibi- tion, Clarkson and Oak- ville, which are on the Lakeshore West line. However, marketing experts say Metrolinx shouldn't expect private companies to be banging down the agency's door to buy naming rights for GO Transit stations. Howev- er, there could be limited opportunities to raise rev- enue from its plan to sell sponsorships of transit assets. Transportation Minis- ter Caroline Mulroney said the Progressive Con- servative government hopes the plan will send the message that "Ontario is open for business." "Transit riders are looking to have an experi- ence that is continually improving, and govern- ments are looking for ways to fund those service improvements in ways that don't affect fares. So this is one way to do that," she said in an interview. The document posted Aug. 1, which was first re- ported by the Toronto Sun, states the naming rights opportunity is open to "interested parties in any category," and Metro- linx will enter into deals that provide "the most fi- nancial benefit." T he document also said companies could, as part of a potential spon- sorship agreement, have access to anonymized GO Transit ridership data. Mulroney said it was too early in the process to say whether the govern- ment would bar compa- nies from certain sectors, such as liquor and canna- bis production or political groups, from bidding. While her government is planning to take owner- ship of the Toronto's TTC subway network, the min- ister said the current pro- posal doesn't include sell- ing naming rights to those stops. According to Metro- linx, the five stops were chosen "based on rider- ship and strategic geo- graphic locations," but the agency is also open to proposals for other sta- tions. T he notice doesn't list how much revenue Metro- linx expects to generate, but the Sun reported that, according to documents it had obtained, the agency estimates the value of naming rights at up to $500,000 per station per year. T he document states Metrolinx is open to other types of arrangements, including offering compa- nies the right to use the GO brand in its promo- tions, "experiential op- portunities" such as branded areas or retail spaces on station proper- ty, and discounted GO or Union Pearson Express tickets for events co-spon- sored by private entities. Chris Gibbs, an associ- ate professor at Ryerson University's Ted Rogers School of Management, said Metrolinx shouldn't expect a lot of interest from companies wanting to slap their names on a transit stop. "My experience with sponsors and brands is that's not something they're going to be inter- ested in," he said. According to Gibbs, the goal of any sponsorship is to exploit the positive emotional connection the public might have with as- sets such as sports stadi- ums or iconic buildings and transfer those feel- ings to a brand. Howev- er, we are always careful about spending your tax dollars. As such, one effective way of being mindful of the budget is to pur- sue new avenues of revenue gen- eration. With council's approval last year, staff launched a new pro- gram to sell the naming rights of city-owned assets to companies or organizations for a fixed peri- od of time. Let me be clear, we will only be renaming a facility. We are not selling the facility it- self, nor are we selling the oper- ations or assets within. There won't be an impact on program- ming or service delivery. Across Ontario, there are over 70 parks, stadiums, arenas, recreation centres, theatres, and performance venues named after a business. The Tribute Communities Centre in Osha- wa, FirstOntario Centre in Mil- ton, the Paramount Fine Foods Centre in Mississauga, and the CAA Centre in Brampton, are just a few examples of munici- pal naming rights partnerships. As you may appreciate, the city is faced with a challenging f iscal reality. By selling naming rights, we are able to raise sig- nificant non-property tax reve- nues for the benefit of Pickering and its residents. What's the al- ternative? We could turn to our residents and businesses and collect more taxes. Alternately, we could borrow money, which would increase our debt. Or, we could simply not proceed with a project, because we can't afford it. We believe that slashing pro- grams and cutting services does not make for a vibrant commu- nity. For these reasons, we are pleased to inform you that the Pickering Recreation Complex will be renamed the Chestnut Hill Developments Recreation Complex. The total value of this 15-year agreement is $1.125 mil- lion, which will help fund major renovations, including lobby improvements, change room upgrades, and enhancements to both security and accessibility. Chestnut Hill Developments is a respected home builder whose landmark San Francisco By the Bay community has re- energized the Liverpool and Bayly neighbourhood. Its new Universal City project will rede- velop the area just east of the Pickering GO Station, and pro- vide opportunities for residents to live in our city centre with convenient access to downtown Toronto, and other parts of the GTA.
