"We did not get justice - plain and simple," Brij Goberdhan, un- cle of murder victim Arianna Go- berdhan, said outside the Osha- wa courthouse Thursday. "Who do we ask for justice?" Moments earlier Superior Court Justice Jocelyn Speyer had sentenced Nicholas Baig, Goberdhan's husband, to life in prison with parole eligibility set at 17 years. Baig pleaded guilty in January to second-degree mur- der in the death of Goberdhan, who was nine months pregnant when she was stabbed 17 times at his parents' home in Pickering on April 7, 2017. Baig, 27, is a jealous and ma- nipulative man who killed Go- berdhan because he feared she was leaving him, Speyer said in her reasons for sentencing. The second-degree murder conviction carries a mandatory sentence of life in prison. The minimum period of parole ineli- gibility for the offence is 10 years and the accepted range for do- mestic homicides between 12 and 17 years, Speyer noted. The Crown, citing the reprehensible nature of Baig's offence, had en- couraged the judge to go beyond that range and impose parole in- eligibility of 20 years. That number was what Arian- na's loved ones were hoping for, her mother, Sherry Goberdhan, said after the sentencing. Noting the number of wounds inflicted during the attack, Sherry said, "(Arianna) has been stabbed 18 times now with this sentence to- day." Goberdhan and Baig were married in November of 2016 and lived for a time with his parents in Pickering. In January of 2017 Goberdhan moved back into her family's house as their relation- ship deteriorated. Baig's abusive attitude toward his wife was exemplified in "vile" texts he sent her, calling her a "skank" and a "lying b---h" among other epithets, Speyer said. HAVE YOUR SAY ON CATHOLIC BOARD'S FUTURE AT AJAX MEETING COUNCIL DURHAM - The Dur- ham District School Board is anticipating an influx of students with autism over the next year, as a result of changes to Ontario's au- tism program. A new report says an ad- ditional 350 to 400 students with autism who have "sig- nificant needs" are expec- ted by winter 2020 - about triple the normal amount. The report also says about 16 to 20 of the stu- dents will require "inten- sive supports," which means two or more staff. School board chair Mi- chael Barrett says it can cost tens of thousands of dollars to provide support for a child with complex needs. "The reality is, it will cost hundreds of thousands to be able to service and meet the needs of our most vulnerable," he says. "This is going to be one of these dilemmas that not just Dur- ham, but all school boards are going to face." The overhaul of Onta- rio's autism program will see children under age six receive up to $20,000 a year, while those over six will get $5,000 a year. Childhood budgets up to age 18 will be capped at $140,000 for kids entering the program before age six. Lifetime funding for those entering at an older age will be limited to $55,000. In March, the govern- ment said families will be allowed to renew current behavioural therapy ser- vices when they expire, for an additional six months, to help adjust to the chang- es. But at some point, many children and youth who have been receiving sup- ports and therapy in the community will be looking to school boards. At the same time, school boards are facing the pros- pect of fewer teachers as a result of class-size changes, as well as funding cuts. For example, for the past two years, the Durham board has received $3.5 mil- lion a year in "local priori- ties" funding, which has funded 27 educational as- sistants, 21 elementary spe- cial education resource coaches and five secondary special education resource teachers. The government is end- ing that funding June 30. There has also been a re- duction to "special inci- dence portion" funding for students who require in- tensive supports. "It's going to be a very difficult budgeting pro- cess," Barrett said, noting that it's too early to specu- late on whether the Dur- ham board will have to make cuts. "There is a be- lief that the school board is going to fill the gap. The re- ality is, the cost of provid- ing these services is no- where near being met." Durham District School Board trustees recently re- leased a joint statement that outlines their con- cerns about the autism funding model and urges Durham families to contact their MPP to voice con- cerns. Barrett says this is something everyone should be concerned about. "Even parents who do not have children with spe- cial needs, we should all be concerned. There's only one pot of money - and it's shrinking." Officials with the Dur- ham Catholic District School Board recently said about 30 additional stu- dents with autism are ex- pected to join their board by the fall. DURHAM BOARD EXPECTING 350 TO 400 MORE STUDENTS WITH AUTISM The Autism Advocacy Community and Taxpayers group is protesting changes to the autism support systems. The funding the Ford Conservatives unveiled on Feb. 6 averages just $8,750 per year for a child who receives funds starting at two years of age, but the average cost of intensive therapies range from $50,000 to $70,000 per year. A 19-year lease agree- ment has been reached that will keep the slots ringing and the horses running at Casino Ajax. Great Canadian Gam- ing (GCG) Corporation reached an agreement with the Ontario Lottery and Gaming Corporation to keep the casino open, while ensuring quarter- horse racing at Ajax Downs will remain until 2038. GCG will operate Casi- no Ajax as well as the Dur- ham Live project now un- der construction in Picker- ing. The future of the slots and horse racing was cloudy when the Durham Live proposal in Pickering was announced last year. Last October, Ajax MPP Rod Phillips announced Casino Ajax would remain open. However, the num- ber of slots would be low- ered to a maximum of 500. Currently, there are 800 machines there. Bob Broadstock, presi- dent of Quarter Racing Owners of Ontario, said the lease is "the best news the quarter-horse racing industry has heard in years. The Ontario govern- ment has committed to en- sure we continue to have a place to race, the confi- dence to invest, and the en- couragement to continue to work to grow our indus- try right here in Ajax. By giving our industry the certainty that we'll contin- ue to have a site tor ace at, in addition to the long- term funding agreement the government has al- ready announced, quarter- horse racers have the cer- tainty we need to thrive." The quarter-horse rac- ing industry and related businesses employ about 1,700 people in Durham Re- gion. Ajax Downs is the on- ly quarter-horse racing fa- cility in Ontario. Justin Picov, president of Ajax Downs, thanked the OLG, GCG and the pro- vincial government for agreeing to the lease. "We're looking forward to working through plans to improve the offerings at Ajax Downs to ensure our guests continue to have the best racing and gaming ex- perience possible," Picov said. He also thanked Phil- lips and government offi- cials for their efforts. "Without their sincere desire to ensure a future for quarter racing in Onta- rio, none of this would have been possible. This is a great way to start our 50th year of racing," he added. In addition to Casino Ajax and Durham Live, GCG also operates Great Blue Heron Casino and Ca- sino Woodbine. Company CEO Rod Bak- er said GCG has plans to create about 4,000 new jobs in Ontario in the coming years. "The decision by the provincial government to create a new gaming zone at Ajax Downs has secured several hundred jobs at that location, with no im- pact on the number of jobs originally planned at the new facility under devel- opment in Pickering," Bak- er said. "This agreement also provides an opportunity for further capital invest- ment and a more diverse selection of gaming op- tions to our guests. Great Canadian is pleased with the collaboration from all stakeholders in bringing this agreement to fruition and the commitment by the provincial government to economic development and job creation in Onta- rio," he noted. In addition to the slots, Casino Ajax also offers bet- ting on horse racing across North America. As the host community, Ajax has received more than $85 million in nontax gaming revenue since the slots opened in February 2006. With 800 slots, the town receives about $8 mil- lion annually. With 500 slots, the town is expecting to receive be- tween $4.5 million and $5 million annually. In a statement, Ajax Mayor Shaun Collier said, "Congratulations to all parties that came to the ta- ble to formalize this agree- ment. Council is apprecia- tive and proud of their ef- forts. The town looks for- ward to continued partnership between OLG, Great Canadian Gaming and Ajax Downs for a pros- perous future." DEAL KEEPS CASINO, HORSE RACING IN AJAX Another season of quarter-horse racing kicked off May 5 at Ajax Downs. The quarter-horse racing association and the province have reached a 19-year lease agreement at the track. This is the 50th year of horse racing at the site. STORY BEHIND THE STORY The plight of Casino Ajax and quarter-horse racing at Ajax Downs has been an ongoing saga in the community. We have been following the ramifications for almost two years. On April 7, 2017, Goberd- han went to see Baig in Pickering. At 9:42 that night she called 911; she did not speak, but an operator heard Goberdhan pleading with Baig to let her go home. When the call ended the operator called back. Go- berdhan confirmed she needed police; she screamed and the call end- ed, court heard. Security cameras at the home re- corded Baig leaving at 9:44 p.m. He got into Goberd- han's car and drove away. When police arrived they found her dead, with a large knife beside her body. Baig was arrested the next day. Thursday Speyer said that Baig, who has been in custody since his arrest, still "lacks insight" into his actions. "He describes what he did as a mistake that he cannot explain or under- stand," the judge said. "He sees himself as a victim." Outside the courthouse following the sentencing a group gathered for a dem- onstration in support of a petition begun by Goberd- han's family, calling on fed- eral politicians to imple- ment laws to criminalize the killing of a unborn child during an act of vio- lence against the mother. Canadian law currently has no protections for in utero children. Brij urged reporters to publicize the family's plight and put pressure on politicians to bring about change. "The politicians need to get their heads out of their collective a---s," he said. "If the justice system and poli- ticians will not do it, who will do it for us?" Sherry said that while she can do little about the sentence given to Baig for his crime, she will contin- ue to strive to change what she sees as a void in Cana- dian law. "It's in God's hands," she said. "Our focus now is to change the law." NEWS Continued from page 3 NICHOLAS BAIG SENTENCED TO LIFE WITH PAROLE ELIGIBILITY SET AT 17 YEARS DURHAM - After the man who murdered their pregnant daughter was sentenced May 2, the fami- ly of Arianna Goberdhan found little comfort in the court's decision. Nicholas Tyler Baig pleaded guilty to murder- ing his wife, who was nine months pregnant at the time of her death. The at- tack also caused the death of her unborn child, who was to be named Asaara. He was sentenced to life in prison without the possibil- ity of parole for 17 years. "To me, he has no re- morse," says Arianna's mother, Sherry. "We will never get our daughter back. Domestic violence cases come up so often to the court, at least if he got a longer sentence, it would have been a deterrent." Baig was not charged for the death of his daughter as no law exists regarding the death of unborn children as a result of murdering a pregnant woman. "It's not sufficient," says Alexandra Macgregor, one of Arianna's best friends. "That's two lives he took. He should be in prison for the rest of his life." The courtroom was filled with family and friends of the Goberdhan family, who wore shirts with Arianna's image on the front and the name of a new campaign inspired by her, the Phenomenal Wom- en Project. The project aims to push for new legis- lation holding those who kill pregnant women ac- countable for the deaths of both mother and child. After the sentencing, a rally was held outside of the Durham Region court- house in Oshawa. Protest- ers included friends of the victim and family, her par- ents and other family mem- bers as well as supporters. Brij Goberdhan, Arian- na's uncle, reprimanded the court's decision to not increase Baig's parole ineli- gibility to the Crown's re- quested 20 years. "Who do we ask for jus- tice from?" he asked the crowd during a heated speech. "If there's any chance for appeal, I'm ask- ing for this. We did not get justice." Protesters chanted: "End domestic violence now, break the silence now" as they held up signs that read Justice For Baby Asaara and The Baby Mat- ters Too, to name a few. They also urged bystand- ers to sign an online peti- tion to urge the federal gov- ernment to change the laws regarding the murder of pregnant women. Jeff Durham was one of the supporters in atten- dance at the rally. In 2014, Durham's pregnant wife and daughter were mur- dered, prompting a push for a private member's bill called Cassie and Molly's Law. The bill did not pass. "There were no charges for Molly, our daughter," says Durham. "There's no law because it's been seen as a political liability by politicians." In the past, the Abortion Rights Coalition of Canada said the bill demonstrated a Conservative "anti-abor- tion agenda." "This has nothing to do with abortion, it's (about) a mother's right," says the victim's sister, Carissa. "Knowing that my sister was nine months pregnant, for the judge to not consid- er my niece a victim as well, it's heartbreaking." While family and friends mourn their loss, there remains hope The Phenomenal Women Pro- ject will inspire change in the current legal system and recognize both mother and child in the case of pregnant murder victims. "Our focus now is to make sure that we try to change the law to get jus- tice for our granddaugh- ter," says Sherry, adding she is hopeful legislation will change in the future. DURHAM - Durham po- lice have announced an- other round of community consultation as they con- sider adopting the use of body-worn cameras by of- ficers. The service is inviting residents to weigh in with their views on the technol- ogy, which has been in lim- ited use as part of a pilot project since June of 2018. The survey seeks input from residents who have had interactions with offi- cers wearing the cameras, and those who've dealt with cops not using the technology, said Sgt. Ja- son Bagg. The service is looking to find out if the presence of the cameras enhances a feeling of trust among those interacting day to day with cops on the beat, Bagg said. While there is an impression the cam- eras foster trust and mutu- al respect, that's not been scientifically quantified, he said. "There aren't any stud- ies in Canada demonstrat- ing that," he said. "We're going to be looking at whether there's an im- provement in community perception, and if there's support for (the cameras). "If the community is not supportive of this technol- ogy, we have to examine if it's a worthwhile endea- vour for us," Bagg said. Durham's police servic- es board is taking its time in analyzing BWCs, which have been a topic of discus- sion since 2014. The ser- vice has undertaken a thorough examination of the technology, including frequent consultation with the public, as it mulls equipping all its officers with the cameras. They are widely per- ceived as a means of assur- ing accountability on the part of officers and the in- dividuals with whom they interact, and ensuring the accuracy and quality of ev- idence gathered by those officers. The technology has and continues to be the subject of an ongoing cost-benefit analysis; BWCs increase the workload for officers who use them, and come with associated costs for data processing and stor- age. A 2016 report to the board estimated the cost of fully implementing BWCs in Durham at almost $24 million. In June 2018 about 80 frontline officers in two platoons in west division, which serves Ajax and Pickering, were deployed with cameras for what is to be a year-long pilot pro- ject. Traffic enforcement officers were also equipped with the technol- o gy at that time. And mem- bers of the Festive RIDE team were wearing cam- eras when they hit the streets in November 2018 for the start of their seven- week assignment. An earlier poll of resi- dents who dealt with offi- cers outfitted with cam- eras resulted in positive feedback, Bagg said. "Those community members reported a more positive perception of offi- cers," he said. "They re- ported a more positive im- pression of the Durham Regional Police Service generally." Ongoing community consultation will be criti- cal to the service's analysis of BWCs, he said. "We want to be making intelligent decisions," he said. "They can't be based on emotions. Care about /newsletters DURHAM - On April 2, Camilla Brown was one of about 45 people celebrat- ed at the Durham Catholic District School Board's annual recognition night for volunteers. The fun twist? The local parent was being honoured for orga- nizing the very event she was being honoured at. "I kind of threw my own party," Brown says with a laugh. For the past three years, she has been the lead organizer for the Dis- tinguished Catholic Vol- unteer Awards, organized by the school board and the Durham Catholic Par- ent Involvement Commit- tee. It's just one of the ways that Brown gives back to her children's school and school board. The mom of three kids - ages nine, eight and six - has been volunteering since her oldest started school. She goes on field trips, helps out in the class- room, pitches in at school events. Brown sits on the Dur- ham Catholic Parent In- volvement Committee, as well as the parent council at James Catholic School in Ajax, where her chil- dren attend. Most days of the week, you can find her at the school, helping to orga- nize the Healthy Hunger lunch program. "I do whatever is need- ed. I just want to be of ser- vice," says Brown, who says having her own busi- ness gives her the flexibil- ity to make volunteering f it with her work sched- ule. "I do it out of love and wanting to give back. But I'm also very social and I don't want to miss out on the fun." Brown says she had no idea she would be chosen as one of the year's volun- teer honourees and was shocked when the princi- pal and vice-principal at St. James took her aside to share the news. "My mouth dropped," she says, adding that she is "very, very honoured," by the recognition. T he annual volunteer night, now in its sixth year, is one of Brown's fa- vourites - she says the chance to hear about how volunteers impact school life is always moving. Her message to others thinking of volunteering is that even small acts can make a big difference at busy schools. "It could be something as easy as helping the sec- retary distribute flyers to each class," Brown ex- plains. "If I can save her 10 or 15 minutes, she could use that time taking care of a parent or child who needs help." One volunteer from each DCDSB school was honoured at the volunteer night on April 2, which in- cluded a reception and ceremony. T he event leads up to National Volunteer Week from April 8 to 13. Emergency Prepared- ness Week runs from May 5 to 11 and the theme this year is "Are You Ready?" During the week, Ajax Fire and Emergency Ser- vices encourages home- owners to think about emergency situations. Kristy Pankhurst, a fire prevention inspector for the service, said knowing risks can help a family pre- pare. She also urges everyone to have an emergency sur- vival kit for their home and vehicles, and also have one for their pets. "Whether at home or on the road, emergency kits should keep you and your family prepared for at least 72 hours. Check your kits regularly and restock them. Everyone in your family should know where to find your emergency kits. Remember to monitor expiry dates on food, wa- ter, medications, batteries, etc., and rotate supplies so you always keep items fresh," Pankhurst said in a statement. This theme this year fo- cuses on the importance of individuals and families being prepared for emer- gencies before they hap- pen. The fire service urges everyone to have an emer- gency plan, which should include a safe place to go. If there's no safe place, an evacuation centre can be used. Pets are welcome at evacuation centres. Other tips include learning about nuclear re- sponse preparation if someone lives, works, plays or goes to school near the Pickering nuclear station.
