Peter Rodrigues charged with 16 offences under City’s sign bylaw Jeff Mitchell jmitchell@durhamregion.com DURHAM -- A justice of the peace is to rule next month on former Pickering poli- tician Peter Rodrigues’s claim that bylaw charges laid against him prior to the 2014 municipal election were political sabo- tage. If Mr. Rodrigues’s motion alleging abuse of process on the part of the City is suc- cessful, charges laid against him under Pickering’s sign bylaw will be stayed; if the Charter challenge fails, the matter will proceed to trial in provincial offences court. Mr. Rodrigues was charged with 16 offences under the City’s bylaw weeks before the election, which he eventually lost to opponent David Pickles by a nar- row margin. The charges were laid after he repeatedly parked his Dodge van, which sports a bright yellow wrap with his picture and name on it, outside City hall. Mr. Rodrigues alleges the City laid the charges after Mr. Pickles complained the van was essentially a large sign that con- stituted an unfair electoral advantage; he also claims news of the charges was fed to the media, resulting in negative publicity just prior to the election. The abuse of process application also claims the City affected Mr. Rodrigues’s ability to defend himself by waiting until September to lay charges relating to inci- dents that allegedly spanned months. In court Tuesday, Dec. 22, Mr. Rodrigues’s lawyer Carol Shirtliff-Hinds accused the City of siding with Mr. Pickles and using its sign bylaw to correct what it saw as an unfair election practice. “The actual (charges) laid against Mr. Rodrigues had nothing to do with election signs or election fairness,” Ms. Shirtliff- Hinds said. “They are using a bylaw in a way it was not meant to be used. “The act of laying these charges was for an ulterior motive,” Ms. Shirtliff-Hinds suggested. David Reiter, the lawyer representing the City, said there’s no question that Mr. Rodrigues’s insistence on parking the van outside City hall led to the charges being laid. But he argued that the charges were laid after the former councillor was warned repeatedly, over many months, that he was contravening the sign bylaw and risked being charged. “Mr. Rodrigues was breaking the sign law in order to gain an electoral advan- tage; he’s the one who linked the two,” Mr. Reiter said. “We warned him about it and he wouldn’t stop.” Mr. Reiter cited several meetings, con- versations and e-mails City officials had with Mr. Rodrigues, urging him to park his van in the underground parking area reserved for council members. “The City had been raising it again and again,” Mr. Reiter said. “Mr. Rodrigues said, take me to court.” Ms. Shirtliff-Hinds had proposed to call witness evidence -- she subpoenaed reporters and politicians -- in support of the motion. But at the end of the day Tuesday, Justice Gerald Ryan indicated he’d heard enough submissions to make a ruling on the motion. “I will make a decision on whether this application is granted or denied on the next appearance,” he said. “If it’s denied, we’re going to trial immediately.” The matter returns to court in Whitby Jan. 12. Authorities in Pennsylvania announced Wednesday morning that Mr. Cosby would be charged with aggravated indecent assault, relating to an attack on a woman at his home in 2004. Media reports indicate the charge relates to allegations made by Andrea Con- stand, a Pickering native who met the enter- tainer when she was affiliated with Temple University. Ms. Constand, who now works as a mas- sage therapist in Toronto, has steadfastly refused to comment on the allegations, and legal action she has launched against Mr. Cosby. Her U.S. lawyer Dolores Troiani was quot- ed Dec. 30 in People Magazine as expressing gratitude to Pennsylvania authorities, who recently reopened an investigation into Ms. Constand’s allegations. Her original report -- made first to Durham police and then relayed to U.S. authorities -- resulted in no charges. “We hope justice will be done,” Ms. Troiani was quoted as telling People. Ms. Constand’s allegation first surfaced a decade ago. In the years since women have begun to come forward, telling stories simi- lar to hers: Many claimed they were taken advantage of after being given pills and alco- hol by the comedian, who is now 78. As the allegations were aired momentum grew, and more women made their claims public. Now, more than 50 women have said they were victimized. Mr. Cosby has repeatedly denied the allega- tions, and recently launched defamation suits against some of his accusers. Ms. Constand has detailed her allegations in a statement of claim against Mr. Cosby. The suit alleged she was working with the Tem- ple University women’s basketball team in the early 2000s when she became acquainted with Mr. Cosby. She eventually came to view the much older man as something of a men- tor, the suit claims. Ms. Constand alleged that in January of 2004 she was drugged and sexually assault- ed during a visit to Mr. Cosby’s home. She approached Durham police with the allega- tions in 2005. Ms. Constand, 42, entered into a confiden- tiality agreement as part of her legal proceed- ings, and has repeatedly refused to comment on her allegations or those made by other women. She couldn’t be reached for comment Wednesday. People Magazine quoted her lawyer, Ms. Troiani, as saying her client is prepared to fol- low through with the criminal process. “I think she’s a very strong lady,” she told the magazine. “She’ll do whatever she needs to do.” Pickering woman’s allegations lead to charges against comic Bill Cosby SIU announces charges Dec. 29 after investigation into roadside ‘interaction’ DURHAM -- A police officer has been charged with assault after an investigation into a roadside incident last summer that left an Oshawa man with a concussion. The charge, against an OPP officer, was announced Dec. 29 by the Special Inves- tigations Unit, an arms-length agency that investigates incidents of serious injury or death involving cops. The unidentified Oshawa man, 19, pulled to the side of Hwy. 401 near Jane Street when his car broke down at about 12:30 a.m. July 1, the SIU said. Two OPP offi- cers attended the scene; during an “inter- action” the Oshawa man was injured and sustained a concussion, the agency said. Director Tony Loparco concluded there are grounds to believe the officer had com- mitted a criminal act, the SIU said. Consta- ble Scott Hearndon is charged with assault causing bodily harm. The SIU declined further comment as the charge is now before the courts. Const. Hearndon has been ordered to appear in a Toronto court in February. Effective Jan. 1, water rates will increase by 5.6 per cent, and sanitary sewer user rates will rise by 4.4 per cent for a com- bined increase of five per cent. This means the average quarterly water and sewer bill is going up to $226.51. This works out to $906.04 over the year, up from $863.04 in 2015. Regional chairman Roger Anderson said the increase will allow Durham to continue providing reliable water and sewer services and ensure financial sus- tainability. “When compared to other household costs -- such as hydro, gas, or cable and Internet -- water and sewer are the least expensive services, and the most impor- tant,” he said. The Region says user rate increases provide for the maintenance and repair of aging infrastructure, cover inflation- ary increases in operating costs and fund capital improvements. At least I hope that is the case. I hope that, for even just a little while, all of us will find the time to ponder, wonder and dream just a bit. That we will make an effort to be still every now and then and work that atrophied imagi- nation muscle back into shape. When we are children, our lives are so very full of dreams, hopes and possibilities. We can be anything, do anything, have anything. No one has placed limits on our lives yet. But as we age, if we are not vigilant, if we listen to others too much or if we let fear set up shop in our hearts, then fences begin to go up in our minds and in our lives. Soon we may even find that we are pounding those posts in ourselves, regretfully but resolvedly setting boundaries in our existence where before there were none. Seeing and believing only in what is and forgetting about what might be. It’s an easy trap to fall into. What is feels so real, so heavy, so permanent. Whereas what might be is as tenuous as fairy dust or smoke from a distant, smoldering flame. But I am convinced that our real- ity comes from where we place our attention. Keep your eyes sadly glued on what is and it will remain. But fan that distant flame with your imagination -- dream a little more every day -- conjure a better, hap- pier, more fulfilling reality, some- thing that makes your heart leap and speaks loudly to that kid inside you who knew exactly how to live this life and you will have set in motion your own deliverance. You will have taken the most important steps of your life. Walking towards your own happi- ness. This New Year, by all means make resolutions. Resolve is good. It’s how we make things happen. But leave the cigarettes, the diet and the exercise to themselves. Resolve, instead, to be happy. Resolve to dream more, to spend some time every day with that beau- tiful kid inside you. Resolve to hon- our your aspirations, desires and passions and to turn a deaf ear to those who don’t. Resolve to build no more fences in your life and to slow- ly tear down those that exist. You deserve nothing less. Happy New Year. -- Durham resident Neil Crone, actor, comic, writer, saves some of his best lines for this col- umn. neil crone Enter Laughing As we prepare for our New Year’s cel- ebrations, or just a quiet night at home, there is much to reflect upon about the year that was 2015. This year had some memorable moments, both good and bad. Who could forget the April 3 fire in downtown Whitby? The fire began at about 2 a.m. at Jimmy O’Toole’s Pub at 121 Brock St. S. and spread to two adjacent buildings: 119 Brock, which is home to the Pita Pit, and 123 Brock, which houses Rawlicious. Each of the businesses had apartments located above them; 23 people were displaced. The cause of the fire was ruled as unde- termined by the Ontario Fire Marshal’s office. Damage was estimated at more than $1 million. The Oshawa Generals put the team and the city on the map this year win- ning the Memorial Cup on May 31. The Generals claimed junior hockey’s most coveted trophy with an exhilarating 2-1 overtime victory over the Kelowna Rockets before a pro-Generals crowd of 10,391 in the final game to be played at Le Colisee Pepsi in Quebec City. The team went undefeated in the tourna- ment. Covanta’s energy-from-waste facil- ity continued to make headlines for all the wrong reasons. The state-of-the-art facility, already a year behind sched- ule, failed environmental testing ear- lier this year and in December failed another test for producing about 2.5 per cent more ash than it should. After much debate and work Scu- gog councillors voted in November to buy an ISP in a bid to bring high-speed Internet to Scugog Island. The Town- ship will be requesting $5.6 million in loans from Durham Region for the project. Mayor Tom Rowett hopes the pur- chase deal will close by the end of Janu- ary, 2016 and that work can begin on July 1. By July 1, 2017, he expects the project to be complete connecting Scu- gog Island to the World Wide Web. The Township of Uxbridge found itself in a state of collective mourning earlier this year after the death of long- time councillor Pat Mikuse. Ms. Mikuse died on July 7 after a lengthy battle with cancer. She was just months into her newest term as Ward 3 councillor, a position for which she was first elect- ed in 2006. Her death left residents and fellow council members reeling. In a byelection Dave Barton was elected to replace Ms. Mikuse. Hwy. 407 continued to connect Dur- ham Region from Pickering to Clar- ington. The highway was to open in December but was put off until spring 2016 due to delays in early design work and because remaining pavement markings and asphalt work couldn’t be done in the winter. The Pickering resident, and the change that will come to council as a result of her new position, is the Pickering News Advertiser’s newsmaker of the year. Ms. O’Connell was first elected to Pickering council in 2006 as Ward 1 City councillor. In 2010, she took on incumbent Bonnie Littley and won the Ward 1 Regional council seat. In 2015, Ms. O’Connell ran for the Liberal Party in the newly formed Pickering-Uxbridge riding and beat out Conservative incumbent Corneliu Chisu. “It’s been a lot of really good memories so it’s kind of a closing of one chapter and an opening of the next,” she said in an emotional delegation before council after win- ning the race. Mayor Dave Ryan said “I’m sure good things will come of that for the City of Pickering” when speaking of Ms. O’Connell’s new job at the last council meeting of 2015. Ms. O’Connell’s vacant seat meant council had to decide whether to hold a byelection for the her Regional seat, or appoint Ward 1 City Councillor Kevin Ashe to the job. Although some residents spoke against it, Coun- cil approved Ward 2 Regional Councillor Bill McLean’s motion to appoint Coun. Ashe. Coun. McLean said hold- ing a byelection for the Regional seat could be costly because if Coun. Ashe were to run and win, there would be a second byelection held at the local level. By appoint- ing Coun. Ashe, only one byelection would be necessary. Now the race for the Ward 1 City council seat is on. Twelve candidates have thrown their name into the ring, giving former councillors Peter Rodrigues and Maurice Brenner a chance to make their way back to City Hall and 10 others the opportunity to join council for the first time. Another prominent Pickering story in 2015 was the fed- eral government announcing it would transfer 5,200 acres of its land that was originally designated for a potential airport to the Rouge National Urban Park. Also, after years of the Pickering lands being in limbo, former Durham College president and founding president of the Universi- ty of Ontario Institute of Technology, Gary Polonsky, was named by Transport Canada as an independent advisor who will discuss with stakeholders potential development opportunities around the lands. His report, including his suggestions, should be complete by August. NEW YEAR’S HEARING SAVINGSNEW YEAR’S HEARING SAVINGS Carla Dayon of Pickering played the “Connect & Win” contest at her dealership Cowan Buick GMC in Bowmanville, Ontario and won 1 of 30 vehicles. She is pictured above with her son Nate and fiancé Michael Heuthe. (l to r) Cindy Elliott, Sales Representative at Cowan along with Anita Ross District Manager of Sales for General Motors of Canada Company, and Sean Crooks Sales Manager of Cowan were very excited to present Carla and her family with their brand new GMC Terrain. The “Connect & Win” contest is open to residents of Canada who, at the time of entry, have reached the age of majority in their province of residence and possess a valid unencumbered driver’s license in good standing in the province or territory in which they reside. Employees of GM Canada, its dealers and service staff, and each of their subsidiaries and affiliates, their advertising and promotional agencies affiliated with this contest, suppliers and members of their immediate family and those domiciled with such employees are not eligible to enter this contest. “Immediate family” is defined as parents, siblings, children, spouse or partner. The contest opened December 4th, 2015 to participating dealers and closes on January 4, 2016, so there are still a couple of days left to try your luck and visit a local dealer to play. All contest participants will receive an award consisting of a Credit Award in an amount ranging from $1,000 to $10,000 CDN (inclusive of applicable GST, HST, QST and PST) towards the purchase or lease of an eligible 2015 or 2016 MY Chevrolet, Buick or GMC vehicle or win a Vehicle Award equal to the amount the participant would have been required to pay the dealer for an eligible 2015 or 2106 MY Chevrolet, Buick or GMC vehicle with a manufacturer’s suggested retail price (“MSRP”) of $35,000 CAD or less (as further described below; see Vehicle Awards), including the $1,000 base award. For example, if you receive an award of $1,500, that award consists of the base award of $1,000 plus a prize of $500. If you win a Vehicle Award, then you receive the base award of $1,000 and win a prize consisting of the difference between the total amount you would be required to pay the dealer for the Vehicle Award and the base award. Maximum retail value of each Vehicle Award is approximately $35,000 CAD, depending on vehicle selected by Vehicle Award winner. Headquartered in Oshawa, Ontario, General Motors of Canada Company employs more than 9,000 people across the country and is a recognized leader in green manufacturing. GM Canada markets the full range of fuel-efficient Chevrolet, Buick, GMC and Cadillac vehicles and related services through Canada’s largest automotive dealer network. More information regarding GMCL models can be found at www.gm.ca, www.gminnovates.ca or by following @GMCanada on Twitter. While stress can be the body’s way of preparing us to cope with potentially threatening situations, it becomes a problem when it interferes with our ability to prop- erly handle our daily routines. Here are some tips to help you minimize its negative effects: 1. Figure out the source of your stress. Oftentimes we feel like everything is overwhelming. However, by getting specific and pin- pointing the stressors in your life, you’re closer to coping. 2. Focus on what you can control. Identify these stress triggers and determine how to take action. 3. Learn about relaxation, breathing, meditation and visualization techniques to help relax your mind. 4. Breathe to manage your symptoms. Deep breathing is one of the best ways to lower your body’s stress level. 5. Getting enough sleep is crucial. Stress sometimes causes troubled sleep and in turn insomnia reduces your ability to fight stress. 6. Manage your time. Organize your day and priorities more effectively. Learn to delegate and let go. 7. Take the time to eat well. Your body needs the energy and proper nutrients to help face and manage stress. A healthy diet will ensure that you are fueled to succeed in all your daily tasks. 8. Take part in physical exercise, especial- ly outdoors if you can. Yoga, for example, is proven as a stress-relieving activity. 9. Adopt a positive attitude. Put things into perspective and don’t dwell on the negative. 10. Look for help. While options for treatment to ease stress can be limited, homeopathic products such as Sedatil provide relief of nervousness, irritabil- ity, and hypersensitivity without drowsi- ness or risk of dependency. It offers a non-sedative solution that calms you down, yet allows you to remain alert and focused to react and accomplish what you need to during stressful situations. Recommended for everyone 12 years of age and older, Sedatil is perfect for stress that comes on very quickly: such as a student worried about a test, an older adult anxious about a medical exam or procedure, an anxious flyer, or an execu- tive worried about an important presen- tation. www.newscanada.com du r h a m r e g i o n . c o m Ne w s A d v e r t i s e r • De c e m b e r 3 1 , 2 0 1 5 21 AP We take care of all your health and wellness needs •Fast and friendly service •Free prescription delivery •Diabetes education •Seniors’ discount 88 Harwood Ave South, Ajax (905) 239-5690 Pharmacist/Owner Bowen Chen 1-888-880-6813 www.RAHdurhamwest.com Call Today for a FREE in-home consultation to discuss your home care options. He is proud to be continuing his father Ted’s tradition of offering delicious, original recipe, award winning homemade hamburgers. The restaurant’s blueprint for a better burger includes a toasted soft bun (that are delivered fresh daily), a seven ounce freshly grilled beef patty, topped with crisp iceberg lettuce, sliced beefsteak tomato, a slice of red onion, pickles, ketchup and yellow mustard. To make your burger even better, you can add on cheddar cheese, Canadian bacon and/or peameal bacon. Customers also love their famous steak on a Kaiser, homemade onion rings, French fries, sweet potato fries, homemade chicken souvlaki and The Big M chicken Caesar salad as well as the tasty Greek salad. While you are here, you can also enjoy one of the signature milkshakes, a soft ice cream cone or a sundae. When you visit The Big M, it’s like taking a trip back in time. The restaurant offers an authentic 60’s vibe. The combination of great food and outstanding customer service will have your coming back time and time again. “We pride ourselves on our 50 plus year tradition of serving the Bay Ridges area, which is why we’ve gone back to the restaurant’s original feel,” Chris says. “We offer high quality food and a good time – plus, you can’t get a better hamburger or steak on a Kaiser anywhere else.” It’s no surprise that that the restaurant was voted in as number one hamburger in Ajax and Pickering. Drop by or drive up to The Big M at 711 Krosno Blvd. (at Liverpool Road, south of the 401) in Pickering for an incredible dining experience. She taught for many years in Toronto and nine years in Pickering before moving to Clar- ington. With the popularity of shows such as Dancing with the Stars, there’s been a renewed interest in ballroom dancing. Many of her students are seniors, but she teaches all ages from seven and up. Sever- al years ago Cameron tried a class just for teens. She was surprised what happened. “You know what? It was all boys,” she says. “Three teenage boys. Essentially they just stopped because they couldn’t find a teenage girl to dance with them.” An Ottawa native, Cameron started dancing as a four year old in Montreal. She also sang and skated and says her parents wanted her to be another Barbara Ann Scott. But she wanted to be a Ginger Rog- ers. As a teenager in the 1950s, Cameron met a partner, her teacher Jeff Henssen, who suggested they go to England to train and do competitive dancing. Her website, www.feathers-studio.com, lists her many accomplishments and titles, including Canadian Open and Closed Champions. In 1965, representing Canada at the world championships, Cameron and her part- ner won the Jive Trophy and were semi- finalists in Modern. She says it was the first time North Americans had made a semi- final or final. After her stint competing, Cameron and Henssen trained teachers at several stu- dios in Toronto. In 1979, after a singing career, she returned to dance and moved to Pickering. Cameron’s students range from beginners to professionals who themselves want to teach. And brides and grooms who want to make an impression on their big day (“they don’t want to look bad”). Visit www.feathers-studio.com to learn more or call 905-263-8224. At the top here is Canada’s Peter Orr celebrating after he knocked the ball loose from USA catcher Thomas Murphy to win baseball gold at the Toronto 2015 Pan Am Games. Canada upset the USA 7-6 in 10 innings at President’s Choice Ajax Pan Am Ballpark. The Games produced several medals for local athletes, including gold for Pickering’s Braxton Stone Papadopoulos (right), shown letting out a victory scream following her dramatic come- from-behind victory against Jackeline Renteria of Colombia in the second semifinal of the 63 kg wresting match. The Games weren’t quite so kind to Pickering tennis player Brayden Schnur (top left), who lost his men’s singles quarter-final match to USA’s Dennis Novikov 6-3, 6-4 at the Canadian Tennis Centre. Beyond the Games, Ajax boxer Brandon Cook had Uruguay’s Rafael Sosa Pintos (below right) wincing in pain before he was counted out by referee Mark Simmons in the fifth round of their bout at the Hersey Centre. Cook retained his WBA Intercontinental championship belt with the win.
