Theraceisontosupport children’shealth Ajax & Pickering hospital Mercedes-Benz Durham Appeal Court overturns racism ruling against GM Oshawa worker sued company over lost job JEFF MITCHELL jmitchell@durhamregion.com DURHAM -- Ontario’s top court has overturned a rul- ing that awarded nearly $160,000 to a former employee at General Motors in Oshawa, finding a judge erred in con- cluding the company had created a poisoned work envi- ronment. Although employee Yohann Johnson may have legiti- mately felt he was being discriminated against, there’s insufficient evidence that racism was at the root of his dis- pute with another worker, the Ontario Court of Appeal said in a ruling released July 31. The court was also critical of Superior Court Justice Alfred Stong’s finding that GM created a poisoned atmo- sphere that forced Mr. Johnson out of his job. In fact, the company launched three separate investi- gations in Mr. Johnson’s claims, and ruled out racism as the source of a dispute he had with a co-worker, the ruling says. “There is no reason to question that Johnson genuinely believed that he had been the victim of racism in his work- place,” Justice Eleanore Cronk wrote on behalf of jurists David Watt and David Doherty. “However, I also conclude that the evidentiary record in this case does not support the trial judge’s findings of rac- ism, a work environment poisoned by racism and, hence, Johnson’s constructive dismissal.” The ruling reverses the outcome of a civil trial heard by Justice Stong in 2012, and damages totalling nearly $160,000 awarded to Mr. Johnson. Mr. Johnson, a production supervisor in the body shop at GM’s Oshawa plant for almost eight years, sued after a protracted dispute that began in early 2005 when a worker refused to attend a training course he was in charge of. Mr. Johnson, a black man, complained to management, alleg- ing racism was the reason. GM conducted three investigations into the dispute and found that personal enmity between the men, not racism, was at the heart of the dispute. The company took action against the other worker that included suspending him, but that suspension was rescinded after his union stepped in, the ruling says. Mr. Johnson left his job in the summer of 2005, claim- ing disability arising from discriminatory treatment at the workplace. He remained off the job for about two years, until a company doctor declared him fit to return to work. GM offered Mr. Johnson concessions that included a trans- fer to another area in the plant and flexible hours, but he rejected the offers, the ruling says. In 2007 the company notified Mr. Johnson that they con- sidered his refusal to return to work a voluntary resigna- tion. Mr. Johnson sued the company in 2008, alleging GM’s actions amounted to constructive dismissal -- in effect, he alleged he was forced to quit because his workplace had become intolerable. When he ruled on the suit in 2012 Justice Stong sided with Mr. Johnson, agreeing with the allegations of work- place racism and constructive dismissal. But that finding was not supported by the facts of the case, the appeal court ruled. The incident that sparked the dispute did not substantiate allegations of a poisoned work environment, and GM’s response was not improper, the ruling says. “The evidence does not support the conclusion that GM repudiated its employment contract with Johnson or that it acted unreasonably in treating Johnson’s decision not to return to work as a voluntary resignation of his employ- ment with GM,” the court said. ‘‘There is no reason to question that Johnson genuinely believed that he had been the victim of racism in his workplace. ’ Justice Eleanore Cronk wrote on behalf of jurists David Watt and David Doherty. The Whitby OPP detach- ment, with assistance from the provincial police force’s aircraft, laid 109 charges dur- ing the blitz, including charg- ing four motorists with stunt driving. The fastest speed clocked was 218 km/h when an officer observed a vehicle travelling along Hwy. 401 in Pickering. The driver was apprehend- ed by officers at Brock Street in Whitby. That driver was under suspension and had liquor readily available in the vehicle, say OPP. All four motorists charged with stunt driving had their licences suspended for seven days and vehicles impound- ed for one week. “It was a busy day for the officers. Speeding is an aggressive driving behaviour and is a major cause of motor vehi- cle collisions. On Feb. 5, the woman impersonated a Toronto resident to obtain an account with a cellphone provider based in the Pickering Town Centre, police said. The woman obtained several smart phones and left. That same day the suspect is believed to have opened an account in the victim’s name at retail outlets in Whitby and Oshawa, purchasing household items. On Feb. 7 the sus- pect went to a cellphone shop at the Oshawa Cen- tre and opened a fraudu- lent account in the vic- tim’s name, police said. Once again she purchased a number of smart phones and fled before being detected. The suspect is a white woman in her 20s with dirty blonde hair. She wore glasses, jeans and a dark jacket. Cops trying to identify Durham perfume thief DURHAM -- Police are appealing to the public in an effort to identify a suspect in the theft of per- fume from Durham Region stores. The lone suspect is responsible for the theft of thousands of dollars worth of perfume from Shoppers Drug Mart outlets in Pickering and Ajax, Durham police said. He’s believed to have struck on three occasions between July 15 and 23. Police have now released security camera images of a suspect in hopes of identifying him. I just wanted to write in and say how much I appreciated the recent front-page story about the Polhamus family. I found it really encouraging and uplift- ing to hear about a local family of that size that is making it work in this day and age. I come from a family with six kids, with the two youngest being added through foster- ing and adoption. Our house has always had lots of people living in it and I wouldn’t have it any other way. I thought this family’s story was a cre- ative and refreshing angle from which to present the statistics of families in Canada. In a day where news outlets can so often focus on negative elements of society, thank you for bringing a focus to “good” news. Joel Witton Ajax Youth get a taste of potential future in Durham Given the importance of tourism in Durham Region, combined with the high unemployment levels among youth here, Durham College’s Centre for Food will offer excellent programs and career options to prospective students. The new addition to the Whitby campus is almost finished. And while the $18-mil- lion, 36,000-square-foot Centre for Food will transform the campus with the addi- tion, at capacity, of 900 additional stu- dents, what they’ll be learning and doing is the story. Culinary, hospitality, tourism, agriculture and horticulture programs will be held there starting in September. With an emphasis at Durham Region on the tourism industry and the growing number of restaurants and hotels across the region and in the GTA, these are programs that students should be considering. We heard recently from Durham Work- force Authority that 23 per cent of people aged 15 to 24 in the Oshawa Census Met- ropolitan Area (CMA) were unemployed in December 2012, compared to the over- all unemployment rate of 6.2 per cent for the area. At the time, we said it’s crucial for youth to be cognizant of the job market, not just today but in five years, to better plan their post-secondary education. With the opening of the Centre for Food, young people would do well to research the programs and consider the career options. How many times have we heard in the last few years that schools are graduat- ing a lot of teachers, but the jobs just aren’t there. On the other hand, the tourism, culi- nary and hospitality programs at the new centre will graduate students in sectors of the economy that show no sign of slowing down. And, of course, these are careers that can take a person places, literally to all ends of the earth. The skills learned and experi- ence gained at the Whitby campus will be just as valuable here in Durham as in Den- mark or Dubai. But there’s more. The Centre for Food will include a wine and food pairing lab, a bake lab, a greenhouse, gardens filled with fresh produce and herbs, and a full-service, green-certified teaching restaurant and lounge. Local farmers have already indi- cated they want to provide plots for agri- culture students. We should never forget the economic and cultural importance of agriculture to Durham Region. The Centre for Food will be a tremendous benefit to the region. Notes on a nice vacation Our family’s two-week vacation passed in the blink of an eye. Here are a few mes- sages to the people we interacted with during that time. To the woman who kept texting while she drove along Hwy. 115 as other drivers were trying to merge from Peterborough -- never do that again. To the Art Gallery of Ontario -- a sink attached to a piece of wood hanging on a wall is not art. To the driver of the black Honda Civic on Hwy. 401 who felt he was at the India- napolis Speedway on a recent Sunday instead of Canada’s busiest road -- watch out for karma. To GO Transit on its 30-minute train service to Toronto -- well done. To the guy driving 130 km/h in the left lane of the 401 while checking his phone in his lap -- keep your head up. To the three young men, and I use the term very loosely, who thought it OK to hurl a hurricane of expletives at a family in front of them at the Bowmanville Golf and Country Club because they felt they were playing too slowly -- thank you for giving my kids a great example of how never to act. To the guy who came in a truck to take away my old barbecue not 10 minutes after I had put it at the curb -- good radar. To the Toronto-area fire department which continued to block two of the west- bound Hwy. 401 express lanes near the airport even though the accident was all cleared up -- move your trucks to the shoulder ASAP. To the golfing gods who one day allowed me to win a family golf tourna- ment, then just as quickly said ‘that’s it’ -- what do I need to sacrifice to get the mojo back? -- Managing editor Mike Johnston will keep trying to win back favour from the golfing gods. I don’t have much in my life that I regret or wish that I could undo or re-do, but there is one episode that has weighed upon me lately. Grades 7 and 8 were not wonderful years for me. I wonder if they are for any kid. It’s an awful time. Our bodies are like science experiments gone horribly wrong. Our emotions, behaviour and judgment are at the behest of a hormonal stew that makes menopause look like a case of the hiccups. And we endure all of this while shedding the comforting cocoon of childhood for the ill-fitting and clumsy wings of maturity. It’s not something I would wish on anyone. And it’s a dangerous time. Packs of adoles- cents are like jackals, only far more vicious. Life is a daily struggle to remain noticeable enough to be accepted but not so conspic- uous as to be labelled different. In the dog- eat-dog Darwinian world of pubescence, to be at all different is to become a target. There was a boy in my class who had the completely innocent misfortune to be born with what is commonly referred to as a ‘wine stain’ on his face. A slightly darker discoloration on a large part of his cheek and jaw. He was a com- pletely healthy, completely normal, com- pletely likeable individual in every other respect. But of course none of that mattered. What mattered, in the kill-or-be-killed jun- gle of pimply-faced, gangly-limbed apes that passed for my peer group, was that he looked, and ipso facto was, different. We were merciless with this boy. And to this day I am ashamed to say that although I knew it was clearly wrong, I had not the intestinal fortitude to listen to that little voice of love that told me so. Instead I hear- kened to the panicked shouting of my ane- mic, sickly ego, reminding me, in its twist- ed logic, that if weren’t him, it would surely be me. Kill or be killed. Taunt or be taunt- ed. And so, in spite of the churning of my guts, I went along with all of it. I don’t remember seeing this boy after Grade 8. I have often wondered what hap- pened to him. Did his parents move to some place hopefully less savage? Did he eventually find some classmates with fewer scabs on their knuckles and more courage in their hearts? I hope so. I really do. I did go looking for him. At 53, almost 40 years too late, I went searching for him on Facebook and the Internet because I want- ed to apologize. I wanted to undo even a little of what had been so shamefully done. Did I think it would actually make that much of a difference to him? Probably not. In all likelihood, I and the rest of the proto- zoa who attacked him back then have long and happily been off his radar. We were not worth the time or effort. The truth, of course, is that it would make me feel better. Not the most noble of reasons but at least a reason. It’s all moot at this point, anyway. The Internet, in spite of its enormity, has yet to yield any real connection to my past. I have not found him. Or if I have, he has chosen not to be found. Not by me, anyway. And who could blame him? Mankind, for all our ingenuity, has not perfected time travel. And maybe that’s good. According to BMO Insurance’s Annual Travel study that landed in the northnews@northumberlandnews.com e-mail account, 24 per cent of Canadians have, at some point, required medical attention for themselves or a travel companion while on vacation. That being said, 42 per cent remain confident they could cover all of their medical costs if they required medical attention while abroad, even if uninsured. Julie Barker-Merz, vice-president and chief operating officer of BMO Insurance, said treatment for a broken leg in Florida could cost up to $20,000, while decompression sickness in Thailand could cost up to $40,000 US to treat. Furthermore, about 31 per cent of Canadians either never or only sometimes purchase travel medical insurance when vacationing outside of Canada. The centre is set to open in September. The new $18-million, 36,000-square-foot Centre for Food at the Whitby campus is nearing its completion date set for later this month. Despite an elevator workers’ strike that’s delayed elevator installation, the work on the top-of-the-line facility near Thick- son Road and Hwy. 401 in Whitby is moving quickly. “We’re at a point where there’s 50 to 60 peo- ple in there, so we’re really rocking and roll- ing,” said Darrin Caron, dean and principal of the Whitby campus and the Centre for Food, on a tour of the site. The building will open up to students in culinary, hospitality, tourism, agriculture and horticulture programs in September and will feature a wine and food pairing lab, a bake lab, a greenhouse, gardens filled with fresh produce and herbs, and a full-service, green- certified teaching restaurant and lounge. The school’s culinary arts will be much larg- er than the small program that was run out of Maxwell Heights Secondary School in the past. “It’s going to change the face of the Whitby campus for sure,” said Mr. Caron. The restaurant that will be run by culinary students and staff will feature produce that will be grown on site, local food and a menu that will change as the cuisine featured in the classroom changes. The official restaurant opening will be in October. But food is not the only focus of the new building. “We have a full made-up hotel room,” said Mr. Caron. And programs have moved over from the main campus in Oshawa, such as special events planning, which will add some females to the formerly male-dominated campus. The lack of female students in the Whitby campus was one of the biggest complaints from stu- dents. “The addition of this building when we’re at capacity will add about 900 students to cam- pus,” said Mr. Caron. “It takes us quite quickly from a satellite campus to almost another campus.” The building itself will be ideal for special events. “We’re envisioning events and wine tast- ings,” said Michelle Darling, Durham College senior project manager. Mr. Caron added a large classroom upstairs will be ideal for small weddings and retire- ment parties. Sustainability is a big focus at the centre, from the grass-covered roof that’s a great insu- lator to taking advantage of Durham’s agricul- ture by “utilizing local as best as we can. “The concept of field to fork was our presi- dent’s (Don Lovisa’s) idea,” said Mr. Caron. Mr. Caron said community partnerships are key in making the school a success. He’s already received offers from local farmers willing to provide plots for students working in agriculture. The school plans to hold vari- ous cooking competitions for chefs from local restaurants, as well as culinary boot camps for high school students who many be interested in attending the Centre for Food in the future. The school has received financial help from the Town of Whitby and the Region of Dur- ham, and has launched a public fundraising campaign. The school is hoping to name cer- tain buildings and features, such as the res- taurant, after someone who makes a sizeable donation. In the meantime, however, students voted on the restaurant name, and the winning choice will be announced soon. The school is counting on revenue from the restaurant and the food kiosks, which will fea- ture prepared meals-to-go and baked goods. But Mr. Caron believes the new school will only benefit Durham. “The amount of hospitality and restaurants in our region will continue to grow,” he said. This new school will not only help gradu- ates find employment in Durham, but will also benefit local hotels, farmers and restau- rants, which he hopes to work with, and not compete against. Six players with a Durham Region connection are among the 40 invited to the U18 selection camp, taking place Aug. 10-18 at the Canadian International Hock- ey Academy in Rockland, Ont., while one other will be at Canada’s national women’s development team camp Aug. 10-18 in Calgary. Brooklin’s Kassidy Sauve, who played last season for the Durham West Lightning of the Provincial Women’s Hockey League, is one of four goalies in the hunt for a spot on the U18 team. KASSIDY SAUVE A family of fighters Ajax native Kyle Marsh set to make pro debut Brad Kelly bkelly@durhamregion.com PICKERING -- Kyle Marsh comes from a long line of fighters, both in and out of the boxing ring. He is the third generation of boxers in his family, following in the footsteps of his grandfather who fought in the army, his dad who was a professional, as well as his uncles. But it was his dad’s fight outside the sport, fending off two strokes, that actually accelerated Marsh’s foray into the amateur ranks. And on Saturday night the Ajax native will take another step in his career, making his professional debut at the Powerade Centre in Brampton. After graduating high school from Denis O’Connor in Ajax, Marsh followed the fam- ily boxing tradition and started to train. Just two weeks in, his dad, Bobby, suffered a stroke that, at the time, the family thought was going to prove fatal. “At the time they thought he wasn’t going to make it,” says Marsh in recounting the story. “I was offered a fight that happened to be on my birthday and I took it, thinking my dad would get a chance to see me fight before he passed.” The fight was on his 19th birthday, and despite recording a pair of knockdowns, he lost on a split decision. A second stroke followed for the elder Marsh, prompting the family to move north to Peterborough about three years ago to help reduce the stress and enjoy the tran- quility of cottage country to the north. Marsh continued with his amateur career, amassing a 20-6 record, and in the process, opened a boxing gym in Peterborough with his dad. It has all led to joining the professional ranks, where Marsh, now 22, hopes to make his mark. “Ever since I started boxing, the goal was to go professional,” he says. “My father was a professional, so were all my uncles, and my grandfather boxed in the army. The whole reason we did amateur was to get experience and then go professional. “I never had the style to be an Olympic fighter. I wasn’t a guy that threw a jab and ran away. I’m an old school kind of fighter in the new age.” Marsh has had a strong support team behind in pursuit of his professional dream, including World Class Conditioning in Pickering, where he has been working on his strength and conditioning for the fight. “Kyle has shown significant improve- ments in his strength, agility and quick- ness. His strength training has definitely taken him to the next level to prepare for his debut pro fight,” says Ray Wood. While the boxing commission was still sifting over proposals before an opponent was confirmed for Saturday’s lightweight (135-pound) fight in Brampton, Marsh already has a second fight lined up for Aug. 24 in Nova Scotia. “I’m looking to go as far as I can,” he says of the goal. “I’d like to one day fight for a world championship, but I’m taking every- thing one step at a time. “My ultimate goal is to be a world cham- pion and leave an impact in the sport.” PICKERING -- Kyle Marsh will be making his professional boxing debut on Saturday at the Powerade Centre in Brampton. Peister won silver medals on the pommel horse and vault and a bronze medal on the rings. Cuenca also tied for the bronze medal on rings. River Saliba competed in the Level 1, 10-year-old group and won a silver medal on vault and a bronze on pommel horse.
