It’s confusing data local experts weren’t expecting to find when they dug into 20 years of cervical cancer statistics. “It’s very confusing and inconsistent, we don’t know why it is,” says Mary-Anne Pietrusiak, an epidemiologist with the Durham Region health department. A new report shows the incidence of cervical cancer among Durham women ages 20 to 34 was 10.8 per 100,000 between 1986 and 2007, while the rate for Ontario was 7.4 per 100,000. In all other age groups the incidence rate is very similar. On the flip side, research shows 87 per cent of Durham women ages 20 to 69 had a pap test in the past three years, which is higher than the 81 per cent for Ontario. Higher screening rates typically result in lower cancer rates, because testing can catch abnormal cells early. Evidence raised ‘reasonable doubt’, lawyer argues JEFF MITCHELL jmitchell@durhamregion.com TORONTO -- A judge failed to properly instruct jurors on evidence that might have helped acquit a man of the murder of a trucker almost six years ago in Pickering, lawyers argued Thursday before the Ontario Court of Appeal. The court reserved its deci- sion after hearing arguments in the appeal of Paul Cyr, a Montreal man convicted in 2009 of the first-degree mur- der of trucker Donald Woods. Mr. Woods, 35, was executed when his load of air-chilled chicken was hijacked in June 2006. Lawyers Joe Wilkinson and Anida Chiodo advanced several grounds of appeal, including one based on instructions Superior Court Justice Bryan Shaughnessy gave to jurors prior to their deliberations. Mr. Wilkin- son argued Justice Shaugh- nessy erred in not sufficient- ly highlighting evidence he said raised doubt about Mr. Cyr’s guilt. “Combined, the evidence was capable of rais- ing reasonable doubt,” Mr. Wilkinson said. During the 2009 trial the Crown alleged Mr. Cyr mur- dered Mr. Woods at a Bel- leville truck stop and then drove the load of chicken to the GTA, where the cargo was sold. Mr. Woods, of Brock- ville, was killed by a shotgun blast to the head. His body was found in his truck, which was abandoned outside a Pickering shopping plaza. The Crown alleged Mr. Cyr arranged to sell the chicken, and called as a witness a man who admitted buying the sto- len cargo. Mr. Wilkinson argued Thursday that Justice Shaugh- nessy ought to have issued specific instructions about how jurors should weigh evi- dence of the buyer, who was unable to identify Mr. Cyr in a police photo line-up, and whose testimony about the timing of the transaction sup- ported Mr. Cyr’s alibi. Anoth- er witness corroborated that alibi, Mr. Wilkinson noted. “If the defence could raise a doubt about Mr. Cyr being the chicken seller, that would mean an acquittal,” he said. Crown counsel Susan Magoutiaux replied that the judge covered issues of rea- sonable doubt, including evidence that contradicted the prosecution theory and the Crown’s burden of proof, in his charge to the jury. It wasn’t necessary to high- light the evidence in favour of Mr. Cyr for a specific instruc- tion, she argued, calling Jus- tice Shaughnessy’s charge “appropriate and compre- hensive. “What was appro- priate was what was done by the trial judge,” Ms. Magout- iaux argued. Mr. Cyr was convicted in late June 2009 after a com- plex trial based on circum- stantial evidence. The time limit is one element of a new draft pro- cedural bylaw that will be going before council’s executive committee on Monday, May 14. “We were trying to keep people on track,” Ms. Shields said of a proposed five-minute time limit. “Delegations were getting longer and a lot of municipalities were going with the five-minute limit so we thought that might be appropriate, but it was by far the biggest issue we heard at the public meeting so we decided to leave it as is and I think people will be really happy about that.” Ms. Shields and city solicitor Paul Bigioni were on hand for an informal information session on Tuesday, May 1 where residents who spoke at the January meeting could ask questions and air any concerns with the new draft. Other changes from the procedural bylaw include a start time of 7 p.m. for council meetings, as opposed to the current 7:30 p.m. start time, and a proposed end limit of midnight, although councillors will have the option of extending the meeting to 1 a.m. with a vote. The deadline for delegations to sign up to speak at meetings was also extended to noon on Monday meeting days, as opposed to the Friday before. Resident Andy McKinnon expressed some con- cern with an item in the new bylaw that said del- egates should first speak to the standing commit- tee in charge of the issue they wished to speak on, but was reassured that residents could also come to council. “We’re asking residents to go to committee first because it gives us an opportunity to take your comments and actually investigate and get answers,” Ms. Shields explained. “When delegates show up at council we have no opportunity to investigate or really even think about comments. Often those issues are approved at that meeting and then move through the pro- cess, so there’s no opportunity to incorporate your concerns.” The draft procedural bylaw will be debated by council on Monday, May 14. If endorsed it will proceed to the regular council meeting on Tues- day, May 22 for final approval. Feedback Remarks show lack of understanding, compassion To the editor: Re: ‘Convicted officer no longer meets requirements for the job’, letter to the editor, durhamregion.com, March 31, 2012. Since when did it become acceptable to equate the inadvertent development of a drug dependency, whether psychologi- cal or physiological, with the loss of “good moral character and habits”? When it comes to moral character, good habits, and a condition of drug depen- dency or lack of it, they’re not necessarily dependent on each other. The writer’s conclusion that the police officer is no longer trustworthy and with- out integrity is completely unfounded because I’m sure she lacks, as she should, all the pertinent details related to the offi- cer’s case. Her comments further display a total lack of understanding where drug addiction, its causes, and recovery are con- cerned, not to mention compassion. Based on her cursory style of assessment a considerable portion of society could be deemed to be without good character and habits. Patrick Wright Ajax Rouge PaRk Someone must take up the cause To the editor: Re: ‘Pickering Federal lands not included in Rouge Park study area’, news, April 26, 2012. As a former Pickering councillor and member of the Rouge Park Alliance, and before that the Rouge Duffins Greenspace Coalition, I’m extremely disappointed that the many Rouge Park environmentalists, and members of the Rouge Park Alliance are not advocating to include the Pickering federal lands in the study area for the Rouge National Park. These Pickering federal lands are already included in the greenbelt and would never be needed if an airport ever does come to Pickering. Also, this area includes the headwaters of the West Duffins Creek and the only real way to link the Rouge Park to the Oak Ridges Moraine. On the Durham side of the fence, our environmental advocates, such as RDGC, Durham Conservation, and the Green Door Alliance have mentioned these lands in need of another management minis- try besides Transport Canada ever since talk of a Rouge National Park emerged. We were told the conversation would happen about the lands, and now it seems we’ve been sidelined -- again in Durham. It’s a shame that a campaign hasn’t gone forward from many Rouge advocates about the limbo of all these federal greenbelt lands. I’m surprised and it seems even neg- ligent by some environmentalists to just draw a line and ignore the worthy lands on the other side of the fence and leave them without a proper management plan. I hope Durham residents will take up the cause. Bonnie Littley Pickering conFusion What’s going on at Petticoat Creek? To the editor: My wife and I went for a walk through Petticoat Creek recently. What was differ- ent was that the gate attendant told us that pedestrians must pay a $6.50 admission fee to walk through the park. This is only if you enter the park from Whites Road and go past the gatehouse. If you enter from the east or west on foot or bicycle on the waterfront trail there is no charge. Is this really the case or has there been a miscom- munication with the front gate staff? We have been walking through the park for 15 years and have never had to pay. As well, the unfinished pool upgrades are being paid by various levels of government through taxes. Since this is the only capital improvement made at the park in the last decade I’m left wondering what this admis- sion fee is going towards. In the past you had to pay an admission fee when entering the park by car, and separate fees to use the pool. These would pay for the upkeep and the pool respectively. Pedestrians have never been charged admission. All content copyright We think... email responses to newsroom@durhamregion.com Editorial Opinions Kudos to Durham students for promoting tan-free prom Young adults across Durham Region might consider following the lead of a group of Pickering High School students who are promoting a tan-free prom later this spring. The students have been recruiting their peers to commit to the tan-free pledge and raise awareness of the proven can- cer-related dangers of tanning beds -- the World Health Organization declared them a class one carcinogen in 2009 -- in the weeks leading up to the end-of-high- school rite of passage. According to the Canadian Cancer Soci- ety, indoor tanning before age 35 increas- es the risk of developing skin cancers by 75 per cent. This effort by students is sup- ported locally by the Durham District Health Unit and the Canadian Cancer Society. As with the health effects of smoking in historical terms, knowledge in the medi- cal community and society at large accu- mulated over time and led to wider aware- ness, higher quit rates and fewer people taking up the habit. Still, some will choose to smoke, regard- less of the body of knowledge about its effects on health, or the potential hazards associated with it. In fact, not everyone who smokes tobac- co suffers from cardiovascular or lung dis- ease, or develops cancer. In that regard, the effort by students is commendable in terms of raising aware- ness, providing people with information and study data on indoor tanning, and peer encouragement to consider alterna- tives. By providing their peers with important and up-to-date data, and presenting them with a logical rationale about the benefits of avoiding artificial tanning, students can make informed decisions. But that is, and should be, the most they can do, as student spokesman Ty Clarke indicated this week in noting that aware- ness and education were the main goals of the campaign. As he said: “Take the initiative to take care of yourself.” Provide encouragement, provide infor- mation and provide support for those who sign on to the initiative. But in our democratic society, we must also allow room for people to choose, even if we disagree, even if it seems to defy logic or science. Much like the sale of tobacco, tanning salons operate well within the law. Apollo Alex Verde, 38, is accused of fraud and identity theft, and may have been operating in the GTA for the past several years, Durham police said. He was busted March 30 in Toronto by Durham police. He was wanted on fraud charges in the west as well as criminal harassment and threaten- ing death in Ontario. Mr. Verde, who was formerly known as Jaspal Singh Virdi and has used several aliases, was placed on the RCMP’s fugi- tive list for offences in Calgary and British Columbia. He’s been wanted since fleeing the west in 2005 and taking up residence in the GTA, police said. It’s alleged he used information from banking call centres to access accounts. The frauds have totalled millions of dollars over the past decade, police said. The man’s aliases include Alex Dior, Alex Diore, Alex Crighton, Anju Mittal, Alex Kry- chek, Kiara Alexo Mittal, Andy Crychek, Devon Crightin, Alex Ksania and Erik Gay. Investigators are interested in speak- ing to anyone who may have had dealings with the man. Or, that women are getting regular tests but not following up if they get abnormal results. About 500 Durham women were diag- nosed with cervical cancer between 1987 and 2007 and more than 130 local women died of the disease in that same period. The health department is working to ensure young women are vaccinated against human papillomavirus, which is the main cause of cervical cancer. The vaccine has been offered to Grade 8 girls at school clinics since 2007. Between 2007 and 2011 an average of six out of 10 girls completed the vaccina- tion series, which puts Durham’s numbers ahead of those from other public health units in the province. The Region’s three sexual health clinics also offer pap tests to women 25 and under, performing more than 6,400 between 2006 and 2010. However Oshawa Councillor Amy Eng- land says she regularly hears from women who have trouble accessing the screening because they are over 25 and don’t have a family doctor. “This is something I’m really concerned about, this is a serious women’s health issue,” she said. “I’m happy to hear the health department is working on this. There needs to be more places women can go to get this test, it’s something that could save a life.” Starting this year the Ontario Cervical Cancer Screening Program will include new features such as letters inviting women to get a pap test and follow-up letters after their results. “They are developing a more robust pro- gram, before people had to count on them- selves or their doctor but now there will be these reminders,” Ms. Pietrusiak says. The health department will also be send- ing information to local physicians to alert them to the new statistics and partnering with community clinics to increase access to cervical cancer screening. The Cosmic Campout Music Fes- tival brings local artists and musi- cians to the fairgrounds to trans- form it into a campsite May 18 to 20. The gates open at 9 a.m. for camp- ers and weekend or day passes are available. The weekend is to raise money for Org4peace, a non-profit organization that provides educa- tional sponsorship for children in Nepal and raises money to support children’s homes and schools. Rai Scimone, an event organizer, says it’s not the only charity that will benefit: organizers plan on giving back locally as well, with a food drive for the Clarington East Food Bank. Music is at the heart of the week- end-long festival, however. Cosmic Campout has a line-up starting Friday at 7 p.m. that continues with local artists through the weekend. Among the performers are Whit- by’s Busker Bros. and Death and the Ninth Day, Clarington’s The Stone Sparrows and Oshawa’s The Standstills and The BoneDevil. There’s even a chance on May 19 to get up on stage with an open mic in front of the festival crowd. “You don’t really realize it until you move out of our area, but there really is a hotbed of music here,” says Mr. Scimone. “If you go to Toronto you hear people talk about local bands from here.” Admission gives visitors access to a different world as artists trans- form the stable area into an Art Vil- lage featuring Ajax artist Geordie Lishman’s work. “This is a good way of showcas- ing local artists. The Ontario Junior Hockey League club held a spring pros- pect camp last week, providing a chance for new owner Steve Tuchner, along with head coach Mike Galati, to accomplish a couple of goals. The first, to unveil and share a new attitude and vision for the hockey club. The second was to gauge the tal- ent level of young players look- ing to break into junior hockey. Galati said that both goals were met, and in fact, were exceeded on both accounts considering the positive comments received and the talent showcased on the ice for the week-long camp. “The camp was so well orga- nized,” said Galati. “Steve was great with the parents and kids. With the amount of kids we had, people now want to play here and it’s obvious, so that helps. “When the word gets out and they see how things are going to be, it’s just going to make life easier on the staff.” Including the on-ice evalua- tions, the team also unveiled the new dressing room to the pros- pects and veterans who stopped in for a look. Off-ice there were guest speakers throughout the week passing on their knowledge to the young hopefuls. In total, the camp attracted 130 players, whittled down to 36 for the final day of camp. “The numbers were great. That shows kids want to play here which is a good sign,” said Galati. “The quality was pretty good as well.” Galati predicted that 20 play- ers from the prospect camp will get an invite to the main camp, which is scheduled for mid- August. The Panthers are coming off a season in which Galati started as the head coach, but was fired by previous owner Rob Stein in late November. They posted an 11-37-1 record overall, and made the playoffs under a late-season push by head coach Dan Camer- on. They were eliminated in the opening round by the Toronto Lakeshore Patriots. When the season concluded, Tuchner purchased the team, inserting Galati back as the head coach. lacroSSe Ironheads set to go in home opener tonight ajax Jr. B lacrosse club has huge changeover of players Brad kelly bkelly@durhamregion.com AJAX -- Depending which side of the ball they are on, it should be an interesting start to the sea- son for the Ajax Ironheads. The Jr. B lacrosse club gets things going tonight when they host Halton Hills at the Ajax Com- munity Centre at 8 p.m. in the home and season opener. When the club is on defence, fans will recognize many of the returning players. When they transition to offence, it’s best to refer to the program to identify the players. The top five scorers from a sea- son ago are no longer with the lacrosse club, having moved on to a higher level, or, in the case of leading scorer Brock Levick, trad- ed. The moves have translated into a huge turnover. “It’s not at all what we were expecting,” says head coach Ron Reed. “It’s a big changeover. We had the potential to have 18 returning players and lost a lot of them.” Moving up to the Jr. A level are Eric McDermott, Tyler Roche and Gage Board to Brampton, while Kenzie Smith is in Barrie. Levick, who led the team with 33-38-71 point totals last sea- son, has been traded to the Clar- ington Green Gaels. In return for Levick, the Ironheads have acquired the rights to six play- ers in total, including two off the Green Gaels roster from last sea- son, Adam Kelusky (20-27-47) and Dan LaFontaine (0-7-7). The deal also included four players off the Whitby Warriors Jr. C team coming to the Ironheads, includ- ing second leading scorer Shane Takahashi, Jason Heickert, James Malloy and Chris Martin. Reed expects all of the new players acquired in the trade in the lineup for the season open- er, with the exception of LaFon- taine. In goal, Kadyn Pack returns, and he will be backed up by Matt Laws, who played midget with West Durham last season. While it will be hard to replace the scoring punch that has been lost, Reed says the players acquired in the trade, as well as newcomers Brandon and Ryan Morley, brothers from Uxbridge, Riley Martinell, who played midg- et in Peterborough last season, and affiliated players from last season Robert Grant and Patrick Morgan will help fill the holes. But until the entire roster is in place, with some players still away at university or college, there will be some juggling in the early going. “Once everyone gets back we feel we should be very competi- tive,” Reed predicts. “Defensive- ly we should be very sound. We managed to keep a lot of our kids on the defensive side of the ball. The tournament was held in Etobicoke and hosted by the Toronto Avalanche of the Greater Toronto Hock- ey League. Pickering advanced to the final by downing the Humberview Huskies 2-1 in overtime in the semi- final. The Panthers had trailed 1-0 into the third period when Jeremy Spi- ers forced the puck over the goal line during a net- front scramble. Early in overtime, Spiers fired a brilliant backhand for the winner. For his efforts, Spi- ers was named the game’s MVP. The opening day of the tournament saw the Pan- thers defeat a strong team from Wheatfield NY 5-3. Noah Faigal earned game MVP for his two goals and strong defensive play. In the second game of the day the Panthers lost a very physical contest to the Guelph Storm 2-1. Paddy Teggart earned game MVP honours for his strong two- way play. In the early game the fol- lowing day the Panthers downed the host Toron- to Avalanche 6–1. David Lepka with two goals and an assist earned the game MVP medallion. To reach the Sunday playoffs the Panthers had to win their final game against a strong North Bay Trappers team by a five- goal margin. The Panthers rushed to a 6-0 margin going into the third peri- od before giving up three quick goals to close the margin to 6-3. After a time- out the team connected for two more goals to achieve the five-goal margin. Jake Gilmour took the game MVP honours for his two goals and two assist effort. The final pitted Pickering against Stoney Creek. This game was scoreless until the third period when Pan- ther captain Jake Gilmour pushed the puck over the goal line following a goal- mouth scramble. Stoney Creek were unable to get the puck past game MVP Jon Kope who recorded the shutout. Panther Paddy Teggart potted the empty net goal to seal the deal.
