The conviction marks the second time this year the former Pickering resident has been found guilty of murder. Jurors returned with guilty verdicts Tuesday evening after being sequestered for deliberations since Monday after- noon. Mr. Pearson, 25, was found guilty of sec- ond-degree murder in the Jan. 26, 2008 killing of Mr. Warne, 19, who was shot in the head during a robbery in his base- ment apartment on Hollyhedge Drive. The jury also found Mr. Pearson guilty of aggravated assault on Mr. Warne’s landlord, who was shot in the arm when intruders burst through a door, intent on robbing Mr. Warne of marijuana. Mr. Pearson is already serving a life sentence for the murder of Khristian Ott- ley, who was shot in the back during an ambush in Pickering on Jan. 14, 2008, less than two weeks before Mr. Warne was murdered. A jury found Mr. Pearson guilty of that killing last spring. Jurors in the latest trial, which began in mid-November, were not made aware of Mr. Pearson’s previous murder convic- tion. A sentencing hearing is scheduled for Jan. 18. The second-degree murder con- viction carries an automatic life sen- tence, but Superior Court Justice Bruce Glass must determine parole eligibility. The minimum term for second-degree murder is 10 years. Final two stolen bulldog puppies recovered; Ajax man charged with theft of four dogs RekA Szekely rszekely@durhamregion.com AJAX -- The final two English bulldog puppies missing after an Ajax pet store was broken into on Monday have now been reunited with their owner. Four 10-week-old puppies, valued at $2,000 each, were stolen from The Puppy Place at 33 Harwood Ave. S. in the early hours of Monday. After the puppies appeared for sale on the website Kiji- ji, police recovered one after arresting two suspects at a Toronto restaurant and another after a search of an Ajax home on Monday. The remaining two missing puppies were found Tuesday in downtown Toron- to. Police say they were being held by an associate of a man facing charges in con- nection to the theft. Pet store owner Edison Correa said he was reunited with the last two puppies on Tuesday night after he went to pick them up from the police station. “Happy, I was real happy,” he said. “They’re doing great.” One of the missing dogs recovered Tues- day is named Bella, and Mr. Correa and his wife had intended to keep her as their pet, so they were especially heartbroken about her disappearance. Bella has a condition called cherry eye and she couldn’t be treated with the appropriate medicine while she was miss- ing. “My dog has a small infection in the eye, I’m taking her to the vet right now,” said Mr. Correa. As for the future of the puppies? “The puppies are still for sale and Bella is going to stay at the store for us and every- one,” he said. “People already love her.” Originally identified by police as a Toronto resident, 37-year-old James Col- ley of Westray Crescent in Ajax has been charged with breaking and entering, pos- session of property obtained by crime, possession of break and enter instru- ments and driving while under suspen- sion. He appeared in court on Dec. 6 and was remanded into custody. His next court appearance is on Dec. 8. The second person arrested at the res- taurant on Monday was released without being charged. Pickering youth charged OSHAWA -- Seven suspects were charged after cops executing a search warrant Tuesday in south Oshawa seized drugs and a sawed-off rifle. A 17-year-old Oshawa male was arrest- ed for drug and weapons offences and two Whitby youths, both 17, were also picked up on drug charges during the 5 p.m. raid on a home in the Park Road South and Lakeview Avenue neighbourhood, Dur- ham police said. Cops seized a sawed-off rifle, crack cocaine and marijuana, and $1,000 in cash. The crack was stashed in the mouth of a stuffed animal on a bookshelf, police said. Four others, ranging in age from 18 to 22 and are from Oshawa, Whitby and Pickering, were busted for drug posses- sion. The City recently approved a staff report calling for 10 properties sched- uled to be torn down by Transport Cana- da to instead be leased by the City. Four would be examined for long-term use by Pickering while six would be held for a short time to see if there is interest from private buyers. The latter include Brophy House at 4355 Brock Road, a classic Ontario frame house at 140 Seventh Concession Road and a unique plank-on-plank home at 5245 Sideline 28. The price is certainly right as the hous- es are virtually free. But there is a catch: if you buy one of the houses, you have to move it off of the lands and that's a pric- ey proposition. The houses are on federal government lands expropriated decades ago for an airport that's never been built. The ongoing saga of whether an airport will be built and, if not, what is to become of the lands has been the overriding issue in the city. Time has not been kind to the hous- es and their condition has deteriorat- ed over the years. Others have simply been demolished. Some of these struc- tures are important pieces of our past. With unique architecture and stories to tell, these are houses that should be pre- served. “I give kudos to the City of Pickering and the people still fighting at that level, but it is cold comfort,” said Mary Dela- ney, a resident of Brougham for more than 30 years and founding member of Land Over Landings, which wants the Pickering airport lands turned into a land trust. “These homes that anywhere else would still be viable are now being torn down and that is a testament to the suc- cessive levels of bureaucracy that have destroyed this town.” She says it’s been disheartening to watch the beautiful old homes fall into disrepair. While Pickering taxpayers are on the hook for the costs to protect the 10 properties, an estimated $31,000, in the grand scheme of things this is not a lot of money. If there is a chance that these homes can be saved, it's well worth the invest- ment. -- Pickering News Advertiser It’s that time of year again; as the days remaining in 2011 tick down, we start to look back on the year that was. This week, Face- book released its top status update trends of 2011 and it’s a great snapshot of what inter- ests people around the world. The No. 1 global topic was the death of Osama Bin Laden, which interestingly was only fifth on the list of top trending news topics on Twitter, garnering fewer mentions than the royal wedding of William and Kate. I would guess that was more related to the fact that people perhaps tweeted a few times in connection to the news of Bin Laden’s death, but perhaps they tweeted through- out the wedding, judging the clothes, the crowds and the ceremony. The second biggest trending topic on Facebook was the Green Bay Packers win- ning the Super Bowl. Other top topics were the Casey Anthony verdict, Charlie Sheen, the death of Steve Jobs, the royal wedding, the death of Amy Winehouse, Call of Duty: Modern Warfare 3, the beginning of military operations in Libya and Hurricane Irene. Even more interesting for me, as a report- er, was a list of the most shared news sto- ries of the year. The list once again affirmed people have an insatiable appetite for soft news. The most shared article was a fantastic graphic by the New York Times which com- pared the earthquake and tsunami damage at the Fukushima nuclear plant with what was there before. Beyond that, topics such as animals, parenting, babies and the zodi- ac dominated the list. The second most-shared article was a CNN piece on what teachers really want to tell parents and No. 3 was also from CNN, a reassuring article that people’s zodiac signs were not changing. Parenting stories filling status updates included a CNN article entitled ‘Parents don’t dress your girls like tramps’ which was the fourth most-shared article in the world this year, a Huffington Post article called ‘How to talk to little girls’ came in 12th and Amy Chua’s infamous Wall Street Journal article ‘Why Chinese moms are superior’ was 14th. A Toronto story about a couple trying to raise a genderless baby finished 11th and a video of twin babies having a gibberish con- versation nabbed 15th place. Among the top 10 were three animal arti- cles, including the story of a dog mourning a Navy SEAL killed in Afghanistan, a Japanese dog refusing to abandon his injured friend after the earthquake and news that a giant crocodile was captured in the Philippines. While the Packers winning the Super Bowl resulted in heaps of status updates, none of the team’s players made the list of most mentioned sports figures. The list was dominated by soccer players includ- ing Leo Messi, Cristiano Ronaldo, Ricardo Kaka, David Beckham, Andres Iniesta and Cesc Fabregas. And although Bieber fever remained high on Twitter, making Justin Bieber the top Twitter trend of the year, he didn’t even make the top 10 list of musi- cians on Facebook, where Bob Marley fin- ished a respectable No. 2 to Rihanna. On Dec. 3, Santa’s helpers met up near the Ajax-Pickering News Advertiser’s offices on Commercial Avenue in Ajax, where a warehouse held the boxes to be delivered to local families. Many of the more than 120 volunteers were children themselves, members of local Scout and Guide troops. Others were volunteers from the local commu- nity. For 15-year-old Jordan Plummer, a member of the 1st Greenwood Rang- ers, this was her first time deliv- ering gifts. Her mother, Bren- da Plummer, was also spreading the Christmas cheer. Jordan said her Ranger leader came up with the idea and everyone was excited about delivering gifts. “Everyone deserves a great Christmas,” she said. Sixteen-year-olds Mitchell Unsworth and Keri Warr are members of the 16th Ajax Venturers and they’ve both been delivering gifts for the Santa Fund for about seven years, since they were Scouts. “We like helping out the community,” said Mitchell. Keri explained that several Scouts will ride with each parent driver and they’ll take turns delivering presents. Often kids answer the door. “They’ll come to the door and they’ll be all excited as soon as they see the pres- ents,” said Mitchell. “That’s the reason we do it because I enjoy getting presents at Christmas and I’d hate for them not to have the same feeling.” Keri’s father, Paul Warr, is a Ven- turers advisor and said he thought it was good for the kids to deliver the gifts. “I think it just shows them the spirit of giving as much as anything, giving to the com- munity and help- ing out,” he said. Jodi Raymond, assistant circulation manager for the News Advertiser, played general, handing out route maps and assigning deliveries to the numerous volunteers. “I was really, really pleased with the turnout this year, it was one of our big- gest years yet,” she said. “Everyone was in such a festive mood with Santa hats and playing Christ- mas carols in their cars as they were delivering.” Ms. Raymond said about 90 per cent of the gifts were deliv- ered over the week- end with just a few left over from folks who weren’t home. While the presents are being delivered, fundraising for next year’s gifts is ongo- ing. As of Monday, $942,273 had been raised on the way to a $1.6 million goal. This is the 105th year for the fund, which is aiming to deliver 45,000 gift boxes to disadvantaged kids across the GTA. The definition of “residential use” found in section 1(ee) of By-law No. 44-2008 is hereby amended by adding the words “a retirement residence” following the words “a mobile home”. Therefore, Section 1(ee) of By-law No. 44-2008 is hereby amended to read as follows: (ee)“residential use” means lands, buildings or structures used, or designed or intended for use as a home or residence of one or more individuals, and shall include, but is not limited to, a single detached dwelling, a semi-detached dwelling, a townhouse, a plex, a stacked townhouse, an apartment building, a mobile home, a retirement residence and a residential dwelling unit accessory to a non-residential use; 2. The definition of “retail use” found in section 1(ff) of By-law No. 44-2008 is hereby amended by deleting the words “and retirement homes” following the words “private lodging”. Therefore, Section 1(ff) of By-law No. 44-2008 is hereby amended to read as follows: (ff)“retail use” means lands, buildings or structures used or designed or intended for use for the sale or rental or offer for sale or rental of goods or services for consumption or use and, for greater certainty, but without in any way limiting the generality of the foregoing, shall include, but not be limited to, food stores, pharmacies, clothing stores, furniture stores, department stores, sporting goods stores, appliance stores, garden centres, automotive dealers, automotive repair shops, gasoline service stations, government owned retail facilities, private daycare, private schools, private lodging, private recreational facilities, sports clubs, golf courses, skiing facilities, race tracks, gambling operations, medical clinics, funeral homes, motels, hotels, rooming houses, restaurants, theatres, facilities for motion picture, audio and video production and distribution, sound recording services, self-storage mini warehouses and parking garages; 3. Section 1 of By-law No. 44-2008 is hereby amended by adding the following after the definition of “retail use”: (ff.1)“retirementresidence”meansaresidentialbuildingortheresidentialportionofamixed-usebuildingwhichprovidesaccommodation for persons of retirement age, where common facilities for the preparation and consumption of food are provided for the residents of the building, and where each unit or living accommodation has separate sanitary facilities, less than full culinary facilities and a separate entrance from a common hall; (ff.2)“retirement residence unit” means a unit within a retirement residence; 4. Section 11 of By-law No. 44-2008 is hereby amended by adding the following after section 11. (3): Retirement Residence Unit 11.1 (1) The development charges imposed on a retirement residence unit under section 8 shall be payable at the rate applicable to an apartment of one bedroom and smaller. 5. Section 15 (1) and 15 (2) of By-law No. 44-2008 are hereby repealed and replaced with the following: 15 (1) The development charges imposed under sections 12, 13 and 14 shall be phased and shall be payable in the amounts applicable at the date of payment as set out in the applicable column of Schedules “C”,“D” and “E”. For greater certainty, the columns contained in Schedules “C”,“D” and “E” apply to the following periods: (i) Column I -June 1, 2011 to June 30, 2011 (ii) Column II -July 1, 2011 to June 30, 2013 6. Section 15 (3) of By-law No. 44-2008 is hereby repealed and replaced with the following: 15 (2) The development charges described in Column II of schedules “C”,“D” and “E” shall be adjusted annually in accordance with section 24 of this by-law to the date of payment. 7. This By-law shall come into force on November 23, 2011. NOTE:By-law No. 64-2011 applies to all lands in the Region of Durham, with the exception of lands that are owned by and used for the purposes of the Region or a local board thereof, a board as defined in section 1(1) of the Education Act and an area municipality or a local board thereof in the Region. As well, By-law No. 64-2011 in regard to water supply and sanitary sewerage services does not apply to the development of lands located within the Seaton Community, as shown in Schedule “F” By-law No. 44-2008. A Key Map has not been provided because By-law No. 64-2011 applies to all lands in the Region of Durham, except as more particularly set-out above. When Garney Gunn called to say he’d found what he figured was a rare Ross’s goose near his home in Courtice, my husband answered the phone. I was work- ing away in my office and didn’t hear it ring. But when Dennis came and asked if I wanted to go check out the bird, swimming in a storm water retention pond, I gladly agreed. Good excuse for a break from editing late on a Fri- day afternoon, even if our quarry turned out to be a much-more- common snow goose. Neither of us had ever seen a Ross’s goose before, so I spent the drive studying the pictures in our Sibley field guide and reading aloud how to tell these two pure white, Arctic-breeding species apart. Before I knew it we were pulling up alongside the pond, where the bird in question was paddling about in a flock of Can- ada geese, with Garney studying it through a telescope. We jumped out of the car, bin- oculars in hand, and with the lowering sun behind us creating ideal lighting, began admiring the bird’s pristine snowy plum- age, set off by black wing tips folded above its tail, and small black eyes. And a blue-grey and pink bill, one of the best identify- ing features in telling Ross’s from snow geese. They say the former never has a black “grin patch” on its stubby little bill as the lat- ter does on its slightly longer one, and this bird didn’t. But the species is so unusual in Durham that we examined every detail over and over, comparing each possible field mark to pic- tures in the book. Ross’s geese are the same size as mallards, and when a mallard flew in at the edge of the flock, I spent long minutes staring back and forth through the scope. Garney was confident it was a Ross’s. He’d been painting walls all day, and had gone out to run an errand when he spotted this bright white bird in the pond. Intrigued, he’d rushed home to get his scope and camera, and since he didn’t know who else to call, phoned me. I’m so grateful he did. There we stood, three birders who had never dreamed we’d get a “lifer” in early December at the corner of Nash and Courtice roads. Gar- ney was shivering away, because he hadn’t thought to grab mitts or a warm coat while he was home, he was so excited about the bird. At dusk we watched the flock take off, circle over and head toward a cornfield, the Ross’s goose half the size of the big Can- adas. Hearing later that a Ross’s --the same one? -- had been seen at Second Marsh five days before put to rest any lingering doubts about the sighting even being possible. But with one in seven Canadian men having prostate cancer during his lifetime, it's important for men to start taking charge of their health in 2012 and talk to their doctor about prostate cancer prevention and screening options. A recent survey commissioned by Mayo Clinic revealed a gen- eral lack of knowledge regarding the prostate-specific antigen test (PSA), a screening option used for physicians to determine a patient's potential risk of developing prostate cancer. The test measures the amount of PSA, a protein produced by cells of the prostate gland, in the patient's blood. A surprising 50 per cent of Men, take charge of your health in 2012 on a regular basis, they feel brighter, more energized, happier and more productive. This year, make weaving activity into your day a top pri- ority. Some creativity may be necessary, but there are many ways you can get moving. Follow these five tips from Mayo Clinic to get you moving in 2012: Walk-and-talk meetings—Before meetings, ask the oth- ers who are planning to attend if they would be willing to walk while discussing agenda items. If someone needs to take notes, walk for the first part of the meeting to bounce ideas off one other, then sit down to record what you need to. Not only does this provide some activity in your day, it will often keep you more alert and focused on the task at hand than if you are stuck in a chair for an hour or two during the discussion. Pace while on the phone—If you spend considerable time on the phone, pacing can be an easy way to infuse quite a bit of movement into your day. If you're not on a wireless device, you may need to ask for a longer telephone cord. Identify times in the day to move—If you must sit to do your job, identify times in your day where you can move. For example, go for walks during breaks and find a co-worker to join you. If someone accompanies you, it's often easier to stay motivated and continue being active. Check into your company's programs—Many employers provide free or reduced-cost memberships to health clubs. Take advantage of them. More companies are also investing in equipment their employees can use to stay active during the workday, such as treadmill desks, portable stepping ma- chines and company-owned bikes made available to employ- ees. Remember, too, that in addition to daily activity, you can take many other steps to stay healthy. For example, eating a well-balanced diet, getting enough sleep and not smoking can all go a long way to maintaining your overall health. One hotly debated question has been the PSA test's accuracy as a predictor of the need for a biopsy and future development of low-risk can- cer. A Mayo Clinic study, released this past October, found a clear link between the test and next steps in the prostate cancer continuum of care. “The decision to get a PSA test done is best made by the patient in consul- tation with their doctor, as there isn't always an easy answer,” advises Dr. R. Jeffrey Karnes, urologist at the Mayo Clinic. Preventative steps to take now While screening tests are typically considered at the age of 40 and over, there are steps most Canadian men can take now. Everyday actions like drinking more green tea, and add- ing fish and soy to their meals have been linked to keeping the prostate healthy. Interestingly, 73 per cent of men have not considered adding soy to their diets to help reduce risks. There's an important nutrient in soy called isoflavones, which has been linked to fighting prostate cancer. If eating tofu isn't appealing, try add- ing peanuts, kidney beans, chickpeas and lentils to meals—all these foods contain isoflavones. Simply put, the 21-year-old Whitby native has traveled quite the road in his young hoops career, one that most recently has him scoring the ball seemingly at will as a star guard with the Durham Lords men’s basketball team. Gagliardi began playing ball as a young kid, moving on to the rep level in Whitby where he once scored 63 points in a single game, and then Sinclair Secondary School, where he spent the first two years of his high school career. From there it was off to the National Elite Development Academy in Hamilton, before a return closer to home landed him in Ajax with the Pickering High School Trojans. There he helped the squad to an OFSAA bronze medal in his lone year. Among all that were a couple of stints with Canada’s national program, highlighted by a bronze-medal victory at the FIBA Americas U19 tournament. Then it was off to post-secondary, as Gagliardi earned a scholarship to Canisius College in Buf- falo. When things didn’t go anywhere close to planned south of the border, Gagliardi made the quick decision to return home and ponder the next step, which turned out to be with the Lords. While not a young man of many words, Gagli- ardi said one constant has been there during his journey that has defined his success. “I get in the gym a lot. Get extra shots up. In those extras hours I work hard on my game and it’s been paying off,” he said in a recent inter- view. The support system around him, and the ben- efit of learning from some pretty great coaches along the way haven’t hurt either. “My dad, he’s pushed me a lot with basket- ball. He’s been my individual coach my whole life. I played for an AAU team, Grassroots, and they helped me get my scholarship. Ro Russell, he makes you more of a mentally tough player. He knows how to win. He’s a very successful coach. The junior national coach Greg Francis, he helped my game a lot and also Mike Gorden- sky, he also helped, giving me more confidence in my game.” Looking back on all of his past experiences, Gagliardi speaks fondly on his time at Pickering as he sought out the scholarship opportunities, but perhaps the most memorable, for a variety of reasons, would be his time with the junior national program under Francis. After all, the time spent with that program allowed Gagliardi to visit parts of the world he otherwise might have never seen. “It was real good. You see a lot of good play- ers and get to travel the world. It’s a great experi- ence. Went to Germany, Argentina, France and New Zealand,” he says in looking back. Now, looking ahead, Gagliardi hopes to con- tinue his solid play during the early going of the Lords’ season. Through 10 games, the Lords have gone back and forth at 5-5, but Gagliardi has been quite consistent, making an impact on offence every time out. Just recently he had a string of three consec- utive 30 point games and on Tuesday scored another 22 in a Lords victory over Loyalist Col- lege, 86-66. Thanks to his impressive first half, Gagliardi heads into the Christmas break as the OCAA leading scorer, averaging a cool 25.2 points a game and leads the Lords with five rebounds and three steals per game as well. At .500, though, the sharpshooter feels things could be better for the Lords in the second half. “Right now I think we could be doing bet- ter. We’re just not consistent right now with our play,” he says, adding that the hope is things will change in that regard come January when the team returns to the court. These tests are within the Skate Can- ada StarSkate program. Tayler Cleland passed her gold skills test and Jacquelyn VanRooy completed her gold dance tests. The girls’ coach, Margret Long comment- ed, “I am proud of both girls for their accomplishments. A gold level achieve- ment comes with many years of dedica- tion to the sport. Both of these girls have worked extremely hard to attain this high honour.” Cleland, 13, a Pickering resident, has been skating since she was three years old. In addition to skating with the Ajax Skating Club four times a week where she is now one of the youngest skaters at the club to have passed a Skate Canada gold test, she also volunteers with the Ajax Ris- ing Stars Special Olympics skating pro- gram. She attends Grade 8 at Gandatse- tiagon Public School where her favourite subjects are gym and language. Cleland hopes to become a figure skating coach one day so that she can share her love of skating with younger skaters, and per- haps one day go as a coach to the Special Olympics Ontario provincial games. Her best skating memory is of sharing the ice with Kurt Browning, Shae Lynne Bourne and Gary Beacom during summer skat- ing at the Granite Club. Her coach says, “Tayler is a young, aspiring skater who wants to succeed in her skating career. She is determined and works hard.” VanRooy, 17, also a Pickering resident, has been skating since she was three. She competed both as a synchronized skat- er, most recently on the Ajax Ice Waves synchronized skating pre novice team, as well as in singles competitions for the past seven years, but stepped down this year to focus on her singles skating and her studies at school. She is a Grade 12 student at St. Mary’s Catholic Secondary School. She hopes to attend University of Guelph next year where she can work towards her dream of becoming a vet. VanRooy credits the hard work and dedi- cation that she has learned from skating as helping to prepare her for the future.
