After a lengthy court process, a Provincial Offences Court judge has ruled John Tennant must restrict repairing lawn mowers to inside his garage. Mr. Tennant, 82, and his 81-year-old wife Jean, were taken to court for contravening a Pickering zoning bylaw in regards to running a business from home by selling used lawn mowers in an area where it’s not permitted. The long-time Pickering resident claims fix- ing lawn mowers and bikes for neighbours is only a hobby. He says the most he’ll accept in the form of payment is a cup of coffee and insists he doesn’t sell them. “Seniors know where they can get a cheap fix,” he said in an interview from his home. The judgement was a relief for the Pickering resident who feared having to give up his life- long hobby. “How can you change a man who’s 81?” he said last year when he was first charged. His acquaintance, Ken Booker, has stood by the Tennants throughout the process and said he wouldn’t call Mr. Tennant’s repairing small engines a hobby. “It’s his life,” he said from the Tennants’ home. Mr. Booker first heard of Mr. Fix-It about five years ago and asked him to repair his lawn mower. “When he finished, he said, ‘No charge’,” he said. “He did some work another time and I gave him a large bottle of maple syrup.” The seniors have been treated unfairly. Valid July 30 to Sept. 15, 2009 Feds considering re-renting commercial property: spokesperson BY KRISTEN CALIS kcalis@durhamregion.com PICKERING -- A needs assessment study and due diligence review required before any decision on a possible Pickering air- port can be made still haven’t been com- plete, says a Transport Canada spokes- person. The two studies are required in order for the federal government to decide whether to proceed with a federal envi- ronmental assessment, said Paula Fair- fax in an e-mail. “It is important to note that no final decision on the building of an airport at Pickering can be made until a federal Environmental Assessment process has been completed,” she said. Although Transport Canada has said in the past the two studies were set to be completed as early as this year, there’s been no word on them yet. “A final date for the completion of the study and review has not been deter- mined,” Ms. Fairfax said. “The timing for this is difficult to predict.” In 1972, the federal government announced it would expropriate 18,600 acres in north Pickering for the possibil- ity of a future airport. Since expropriation, residents have been renting from the federal govern- ment. The anti-airport group Land Over Landings (originally People Or Planes) has continuously argued an airport isn’t needed and the prime farmland sitting in limbo should be used for agricultural purposes. Residents have called the News Adver- tiser recently after seeing activity on the federal lands and weren’t sure what was happening. Ms. Fairfax confirmed there has been some activity on the land, and said “Transport Canada may consider re- marketing vacant commercial properties based on an analysis of various factors,” such as: required capital improvements; marketability; demand and benefit to the surrounding demographic environment; and revenue and expense forecasts. “Some recent examples of successfully re-rented commercial properties include the Brougham General Store and the Fin- ishing Shoppe,” she said. However, Mary Delaney, Brougham resident and Land Over Landings mem- ber, said although she wasn’t absolutely sure, she could only think of two vacant commercial properties in Brougham: the former antiques store and the former Becker’s convenience store. As for the homes, Ms. Fairfax indicated any activity taking place on residential properties is a result of Transport Cana- da’s responsibility for its upkeep as land- lords. Ms. Delaney said residents have noticed more maintenance on the properties in the past four years, and attributes it mostly to the work of Ajax-Pickering MP Mark Holland. “It has made a big difference,” she said. The EA lays out the case for building an energy-from-waste facility on Osbourne Road in Clarington. Durham Region wants to build the facility, which would initial- ly burn 140,000 tonnes of trash annually. It could eventually burn 400,000 tonnes. Filing the EA is the next step in the process, as the MOE will review the document and decide if the incinerator can be built. “I’m confident we’ve done a complete and thorough envi- ronmental assessment,” says Cliff Curtis, the Region’s works commissioner. “It’s safe for the environment and for people. What the minis- try does, I can’t prejudge it. “I believe the science is fine.” Linda Gasser, a Clarington resident opposed to the incin- erator, dismisses Mr. Curtis’s claim about the science. “They’d like to believe the sci- ence is fine. There are areas they haven’t proven the science is fine,” she says. Regional councillors approved building the incinerator on June 24 and the final EA includes “comments we received from the public. There was minor tweaking, minor edits and now the document is ready to go,” Mr. Curtis states. Regional officials notified pro- vincial staff that the EA would be filed on July 31, Mr. Curtis says. “We gave them notice four weeks ago.” The MOE will post the EA on the Environmental Bill of Rights website by Aug. 7 and the public will have seven weeks to review and submit comments. “The public can comment directly to the ministry,” he says. The ministry then has five weeks to review the comments and the EA document. “If they make any changes to the document, they have to repost it for five weeks.” That takes it into late Novem- ber or early December. “Sometime after that, they’ll make a decision,” Mr. Curtis notes. “The earliest they have to make a decision is the end of the year. Most likely, it will be next spring.” A number of issues were raised during Regional council meetings on June 16 and 24, Ms. Gasser says. “There’s a huge range of issues we have concerns with,” Ms. Gasser says, such as the impacts on human health. The science hasn’t been devel- oped for some issues, such as nano-particles, the mixture of chemicals coming out of the stack and the “synergistic effect of what chemicals are coming out,” she adds. She and others plan to con- tinue to raise issues during the EA review period, Ms. Gasser states. I work retail in Pickering but we don’t have that problem. Most of the time the stores are too warm, according to our customers. When you work in a store, it doesn’t feel cool until you go outside. Most of the stores don’t have control over the ther- mostat. I have never been in any store whether it’s a grocery store or variety store and be cool when shopping. Just try using a sweater. Pickles and fruit cups for starters. We do grow our own fruit, cucumbers and beets, etc., so why are our grocery stores importing them from these coun- tries? What happened to support your local farmers? Plus, remember the milk scandal and the poisoned dog food from China! Come on all you food chains, support your own country. I must admit $1.99 for a one litre jar of sweet pickles looks good beside $3.29 for the same thing put out by Bicks but I paid the Bicks price. I refused to buy any of those foods from outside of Canada. Don’t forget other countries still use DDT to spray their crops. It’s been banned here for a while and with good reason. Barb Cullingworth Newcastle POLICING Mobile command vehicle comes at a cost for taxpayers To the editor: Re: Mobile command vehicle another tool in police chest, editorial, July 24 I must disagree with the statement that the mobile command vehicle “costs tax- payers absolutely nothing since it is entirely funded by the ministry’s grant program.” In your story the reporter implies that the Civil Remedies for Illicit Activities Program, targets only organized criminal activity. In reality this program targets any tax- payer that happens to run afoul of any law or regulation whether or not a crimi- nal conviction was handed out. Under Ontario Premier Dalton McGuinty, the Remedies for Organized Crime and Other Unlawful Activities Act was changed to Ontario’s Civil Remedies Act, which now allows police and prose- cutors to seize private property. This change on first glance appears to benefit the public, but in reality has cre- ated a policing for profit mentality by the politicians and police chiefs across Ontario. The downside to this new direction that law enforcement has taken, is the crimes, such as the ongoing vandalism that is occurring in downtown Whitby, is being ignored. Police are told to deal with the more profitable aspects of law enforcement. This in turn, allows the purchases of expensive toys such as mobile command vehicles which do more to bolster the public image of police chiefs rather than increase public safety. Steve Smith Whitby Recession may finally be coming to a bitter end After more than 20 months of continu- ous economic pain, could the recession, which started in December 2007, finally be over? It all depends on who you ask. If you’re an optimist, you can turn to the Governor of the Bank of Canada, Mark Carney, who will tell you emphati- cally, that, yes, the recession is definitely over. Mr. Carney cites projections of eco- nomic growth of 1.3 and 3 per cent for the third and fourth quarters of this year after a downturn of minus 3.5 per cent in the second quarter. Not so sure is federal Finance Minis- ter Jim Flaherty, who sees an economy that has stabilized and that there are the beginnings of a recovery, “but I wouldn’t put it any stronger than that.” Mr. Flaherty is right to be cautious, hav- ing been burned in the not-so-distant past when he showed overconfidence in his economic plans. Last fall, he stated Canada was in no danger of going into deficit just before it became necessary to bring in a budget plan that was about $30 billion in the red. Then, several months later, he had to revise his figures when revenue figures were even worse than expected and the deficit climbed to about $50 billion. With that sort of track record, it’s not surprising Mr. Flaherty, also the Whitby- Oshawa MP, would be a little sheepish about declaring the recession dragon slain just yet. But Mr. Carney doesn’t have to be so cautious. He doesn’t have to face the electorate, doesn’t have the opposition breathing down his neck, and can look at a mountain of raw data to support his contention that good economic times are just around the corner. The dictionary definition of a recession is two straight negative economic quar- ters and we have gone through more than six straight quarters of negative growth. In fact, this has been the longest slide since the great depression of the 1930s and the worst economic downturn since the trough of the early 1980s, when inter- est and inflation rates hit double digits. So, any happy recovery talk, especial- ly from Mr. Carney, must be taken seri- ously. He backs it up and credits mas- sive government investment in the pri- vate sector over the first half of the year with getting our economic engine turn- ing once again. If too many staff, students absent due to flu, schools might be closed, say authorities DURHAM -- School boards are spending the summer fine-tuning pan- demic plans in prepara- tion for the return of stu- dents in September and are even considering the worst-case scenario of closing schools if too many students and staff are absent because of the H1N1 virus. “We have a process in place in the event that we need to have school closures, “ Mark Joel, a superintendent with the Durham District School Board, said. School boards are work- ing in conjunction with local public health units on pandemic plans. Con- tained in the plans are “trigger points” for step- ping up responses. For example, if 20 per cent of students or staff are absent at a Durham school, pub- lic health would be noti- fied and consideration would be given to closing the facility, Mr. Joel said. This is similar to the plans of other GTA boards. “We would then look at whether we could safe- ly manage the kids or not and whether public health wanted to close down to stop the spread or an out- break,” Mr. Joel said. There has been much international debate over the value of closing schools in a pandemic. The World Health Organi- zation has said the mea- sure could help slow the spread of the virus, but noted the decision is up to each country. Canada’s Chief Public Health Officer Dr. David Butler-Jones said yester- day that school closures are difficult to advocate for public health reasons in most Canadian com- munities where both par- ents work outside the home. “The point is clearly to reduce disease and obvi- ously to reduce severe disease and mortali- ty but also to reduce the social disruption and the impact that that has then on health and everything that goes with it, “ he said during a conference call. Dr. Butler-Jones said it could be better to keep kids in school and make sure they are doing things like washing their hands regularly rather than send them away to congregate at shopping malls. Ontario’s Chief Medi- cal Officer of Health Dr. Arlene King said that because those under 50 are most at risk from the virus, it’s important for both students and teach- ers to stay home if they are ill. Mrs. Tennant was so upset after the last court appearance that she collapsed and was taken to hospital, he said. Although Mr. Tennant’s bylaw issues are settled, his legal ones are not. Resulting from an incident in the courtroom, Mr. Tennant has been charged with one count of assault of a peace officer and one count of threatening bodily harm. Officers from the Whitby detach- ment will be out in full force patrolling the hundreds of kilo- metres under their jurisdiction, targeting drunk drivers, aggres- sive motorists and seatbelt infrac- tions. OPP-patrolled roads in Durham Region see a high volume of traffic each summer weekend and that’s increased during holidays, police said. Officers on patrol will be watching out for aggressive driv- ers and RIDE (Reduce Impaired Driving Everywhere) stops will be set up to nab drunk drivers. Police are also promising patrols on waterways and trails. Durham Regional Police conducted a four-month fraud investigation, dubbed Project Spiral, that centred in Ajax and Pickering. The investigation began in mid- March and focused on fraudulent ‘advance fee loan’ scams using online financial com- panies. Police say the loan targets were indi- viduals with poor credit histories. Applications were submitted through Internet sites claiming to be loan compa- nies. All applications were approved, pro- vided the victim submitted a financial secu- rity for the loan. Victims were then required to send in more money until they couldn’t send any more or requested a refund. Nei- ther a loan nor refund was ever received, police say. Durham fraud unit detectives found 23 fraudulent loan companies online, many with an almost identical website design. Many required a minimum loan of $10,000 and deposits were usually about $1,000. Many of the victims are from the United States and heard of the lending opportu- nities through local newspaper advertise- ments or website searches. Investigators believe there are hundreds of victims and know of more than $500,000 in lost deposit money. They believe the opera- tion has been going since at least 2005. During the investigation, police also seized more than $24,000 in cocaine and crack cocaine, and two loaded handguns. Leticia Newman, 32, of Glenanna Road, Pickering; Leighton Miller, 34, of Falby Court, Ajax; Kadiata Coley, 31, of Gillett Drive, Ajax; and Christopher Coombs, 35, Gillett Drive, Ajax, have all been charged with conspiracy to defraud the public of over $5,000 and defrauding the public of over $5,000. Mr. Miller has also been charged with careless storage of a firearm, possession of a loaded restricted weapon and unauthor- ized possession of a firearm. Ms. Newman has also been charged with the same gun charges as Mr. Miller, plus two counts of possession of cocaine for the pur- poses of trafficking and two counts of pos- sessing forged credit card data. Ms. Coley and Mr. Coombs are both charged with concealing fraud and laun- dering the proceeds of crime. All four were held for a bail hearing. The investigation is continuing and inves- tigators encourage other victims to come forward. Nichelle, the eldest of the two at 14, is making her fifth trip to Pennsylvania this week, while younger sister Kendra has qualified for a second straight year. The North American Youth Track and Field Championships in Hershey, Penn- sylvania annually features more than 500 of the best young track and field athletes on the conti- nent. Success has followed Nichelle to the meet, where she has returned to her Ajax home with two golds and one silver as the result of running the 4x100m relay, and a gold on another occa- sion went she went solo in the 100m. At this weekend’s meet, she will again be passing the baton in the relay. “When I first went I was nervous because I had never went before,” she says of being a vet- eran performer at the meet. “Now when I go, it’s just fun.” This year marks her final year of eligibility for the meet due to age restrictions. Training with the Bramalea Bullets three times a week, she travelled internationally back in February to Jamaica for a meet, resulting in mixed results. Her 4x100m relay team was fourth, while the 4x200m team was seventh. In September she will enter Grade 9 at Pickering High School, where she will join the OFSAA champion track and field team. But she is undecided if track and field will be the sport of choice, as playing rep soccer in Richmond Hill may also give her some future options. C LACROSSE Patriots face elimination against Lakers LAKEFIELD -- The West Durham Patriots have a lot of work to do if they want to extend their season. After losing 10-3 to the Peterborough Lak- ers Tuesday night, the Jr. C lacrosse club finds itself trailing the best-of-five series two games to none with Game 3 scheduled for tonight in Peterborough. A dreadful six-minute span in the first period of Tuesday’s game, followed by a rough second period sealed the Patriots’ fate in Game 2. The Lakers, who had to play host to the game in Lakefield, rather than their usual home con- fines of the Memorial Centre in Peterborough, scored the first goal of the game at 9:09, and by the 15:08 mark of the first period they had taken a 4-0 lead. Dakota Watson scored West Durham’s first goal of the game just under three minutes into the second period, with assists going to Todd Nakasuji and Kyle Kropman. However, the Lakers answered back soon after, making it 5- 1. Following a George Jimas goal for the Patri- ots, the Lakers went on another run, scoring four times before the end of the period to take a comfortable 9-2 lead into the third. Spencer Takada, who along with Ian Duffy set up Jimas’ goal, tallied the third and final Patriots marker of the night. It came early in the third, on the power play, from Nakasuji and Jimas. While that goal was the only Patriots goal scored with the man advantage, the Lakers made the best of their seven opportunities on the power play, scoring four times. Better special teams play in Game 3 will be paramount if the Patriots hope to extend the series to a Game 4, which would be hosted by the Patriots Aug. 4 at 8 p.m. PONY RESULTS Ajax Pony Club hosts Central Ontario Qualifier AJAX -- The second Central Ontario Qualifier for the regional show jump- ing finals were held at the Audley Road Stables near Ajax, hosted by the Ajax Pony Club. Selection for the regional finals will be based on scores achieved at this meet and two other qualifiers, one in June and the other coming up in August. In this show, four divisions of pre- entry riders competed in two classes each: a single round plus jump-off class, and a medal class judged on equitation both over fences and at various gaits on the flat. The higher divisions competed in three classes each, a single round plus jump-off class, a power and speed class and a medal class to determine a champion and a reserve in each divi- sion. Pre-Entry Division A-2 In the single round with jump-off class, the winner was Victoria Papp, of the Ajax Pony Club, riding Twist of Fate. Saskia Kersten, of Ajax, won the medal class on Cherry Dreams, with Papp third. Papp was division champion, and Kersten was the reserve.
