And a panel of Ontario Court of Appeal judges has ruled Marlon Maragh will serve out the 18-year penitentiary term given him by a Durham judge, calling the sen- tence “manifestly fit.” Mr. Maragh, of Scarborough, was 21 when he and another young man were arrested by Durham po- lice following the shooting which occurred when a dispute broke out during a pickup basketball game in a crowded gymnasium at Pine Ridge Secondary School. One young man was shot four times in the chest and a stray bullet grazed the cheek of a 13-year-old girl dur- ing the melee. Three suspects fled in a car and tried to elude police but crashed the vehicle and ran from the scene. Two of the three were eventually rounded up by police. During a jury trial in 2003 the Crown introduced evidence that included confessions Mr. Maragh made to cell mates at the old Whitby jail, one of them an under- cover cop. At trial Mr. Maragh testified an- other man had been the shooter and that he’d lied about his in- volvement to bolster his image among his fellow inmates. He was found guilty of several charges including attempted mur- der, weapons offences and flight from police, and sentenced by Su- perior Court Justice Bruce Glass to 18 years in prison; given credit for time in custody awaiting trial, he was left with 12 years and eight months to serve. But after his encounter last month, that’s all changed. Ryland’s owner, Vlasta Sedlacek, and her daughter, Hana Sedlacek, took him on their usual route in early September. The women and the ten-and-a-half-pound, 19-month- old maltese-bichon cross, saw a 12-year-old rottweiler named Deacon, who was also on a leash, with his owner, Shawn Callan. Hana said she never allows Ryland near “questionable” strays or dogs that snarl or growl, but when Mr. Callan said Deacon was friendly, she brought him closer. As soon as the two were within reach, Hana explained Deacon grabbed Ryland just below the neck on his back. “The attack was so vicious that (Deacon) tore Ryland off my leash and picked him up in the air by the grip of his jaw,” Hana said. “The dog made an attempt to shake Ryland as if to want to break his neck.” Mr. Callan quickly restrained Deacon, and that’s when he dropped Ryland, who, Hana said, “screamed in agony” for around 30 to 40 seconds. He was then rushed to the Whitby Animal Hospital, bleeding all over Hana’s shirt. The bite was so deep that it damaged Ryland’s internal organs, which caused fluid and air to collect around and outside his lungs. He had surgery after being transferred to an animal hospital in Toronto, and was hooked up to an intravenous, oxy- gen supply and chest drain afterward. “We were beside ourselves,” Hana said. “I couldn’t function for a week.” Mr. Callan feels terrible about what hap- pened, and said Deacon has never acted aggressively around animals - or small chil- dren for that matter - in his life, and neigh- bours even call him a “gentle giant. “I have taken responsibility for it and I do feel bad about it,” he said. “I really do. But they’re animals.” Lindsey Brenner, supervisor of Pickering Animal Services, explained rules were set out for Mr. Callan following the attack, known as the Order to Restrain (under the responsible pet ownership bylaw) to follow. They included making Deacon wear a muzzle in public, using a leash no longer than two metres, and he can only be walked by persons older than 16 years of age. Ms. Brenner said “right from day one, they’ve been very co-operative.” But Hanna said her veterinary bill is close to $5,000, and hopes Mr. Callan will pay the costs. “I’m stuck in this situation to save my dog’s life,” she said. “I had to pay this money, but I had no choice but to pay it.” The veteri- narians that treated Ryland said surgery was necessary for him to survive. The municipal bylaw doesn’t address fi- nancial compensation, so Hana plans to take Mr. Callan to civil court. He said that’s up to her, but didn’t want to discuss finances. Mr. Callan is remorseful for what hap- pened, but doesn’t feel completely responsi- ble. He said in most cases, people walk their dogs around him at a safe distance because “people are intimidated by his looks, obvi- ously.” For this reason, he usually doesn’t approach other dogs. He also said Hana hit Deacon on the head with the plastic part of the retractable leash during the attack, which he feels aggravated the situation. He also feels Ryland’s retract- able lead didn’t help. “I find retractable leashes are a waste of time because when your dog’s retracted out 10 feet, there’s no way you have control of your animal,” he said. Ms. Brenner shared tips for owners of both big and small dogs. She said dogs and cats should always wear a leash, which is a Pickering bylaw. If owners are not familiar with or nervous around a dog, they should keep a safe distance or cross the street. She said it’s also important to remember some dogs experience animal-on-animal aggression. “It is quite common you may find a dog that hates other dogs but loves people,” she said. She added when people say ‘that could have been a child’ in similar situations, it could have been, but is not always the case because they can simply dislike other dogs or cats because natural predatory instincts kick in. Hana also believes Deacon should be neutered since it makes dogs less aggressive. But Mr. Callan noted Ryland isn’t neutered either; plus, Deacon’s now 12 years old. “He’s not long for the world either,” he said. “He’s in good health, but large dogs, they don’t live that long.” Ryland is recovering nicely, but is nervous around big dogs now. Hana thinks Deacon is very aggressive and that stronger laws re- garding rottweilers are necessary. She even came to a Pickering executive committee meeting recently to share her concerns. Appeal Court jus- tices Karen Weiler, James MacPherson and Paul Rou- leau disagreed, ruling the trial was fair. They also dismissed the sentence appeal, which counsel had argued was ex- cessive. “A young man was shot four times in a crowded school gymnasium. He was re- leased Thursday partly due to the lack of beds. “He’s done remarkably well,” said his wife, Marsha Nedham. “All the doctors are amazed at his progress.” But Mr. Nedham still has a long way to go. His wife said his left arm is getting better, but his right is still badly burned, and he’ll wear bandages for at least another year. He received skin grafting on both arms, and his elbow is also badly damaged from infection from the burns. Even after returning home, Mr. Nedham will receive home care every other day and has to go back to St. John’s three times a week. Ms. Nedham said she’s been “blown away by all the kindness and prayers.” She said friends, neighbours and even people she’s never met have shown warm sup- port, and seven different churches have kept the fam- ily in their prayers. “People have just been wonderful, supportive and caring,” she said. “It just goes on and on.” Although Ms. Nedham is relieved her husband’s home, the financial woes have not subsided. Ms. Nedham now works two jobs to keep the household running. “My husband hasn’t worked for two months,” she said. “No money’s com- ing in from him. I’ve been just holding it together. I wasn’t intended to be the breadwinner.” On top of the everyday household costs, Ms. Ned- ham said since her husband didn’t have insurance and she fears the bills for his medication. He also has to eat mass amounts of food since he experienced ex- treme weight loss. “You have to fight and look after your family and that’s what we’re going to do,” she said. Evidence gathered during the arrest led in- vestigators to conclude the suspects, one of them free on bail at the time of his arrest, may have been involved in similar incidents across Ontario and Quebec, Durham police said. The evidence included what appears to be intelligence gathered at various big box stores, including information on card technology in each site and even descriptions of staff at each location. “This is a very sophisticated group,” said Durham police fraud detective Jeff Caplan. Information gathered during the Durham bust could reveal other incidents in which the suspects have been involved, he said. “It’s gone out to the financial industry and all point of sale providers,” Det. Caplan said. Investigators with Durham’s major fraud unit got involved Thursday when workers at a Sobeys store on Wilson Road North in Oshawa reported the theft of three point-of-sale debit card terminals. Police say three suspects then tried similar thefts at a Sobeys store in Ajax, where an em- ployee witnessed the attempts and assisted responding police officers in capturing one suspect; two others fled. Cops located a vehicle believed to be used by the suspects in the parking lot and staked it out, then busted a man who approached the vehi- cle. During a search of that car police found the three terminals stolen from the Oshawa store and evidence compiled in notebooks they say points to similar crimes in Ontario and Que- bec. Arrested on charges of fraud, possession of stolen property and conspiracy to commit an indictable offence were Sebastian Bihari, 32, of Canlish Road in Toronto and 23-year-old Brian Vukovic of Finch Avenue West, Toronto. Mr. Bihari was free on bail for similar offences in the Niagara Region at the time of his arrest and is also charged with breach of recognizance, police said. EDITORIALS & OPINIONS durhamregion.com Sliding voter turnout a concern While it must be conceded the recent provincial election was hardly a barn-burner -- the electorate did not get particularly energized over any major issue save faith- based funding -- the final voter turnout of just 52.6 per cent was worrisome. That nearly one of every two eligible voters chose not to cast a ballot could be a sign of many things. It could mean Ontarians are not really engaged by provincial politics. It might signal that not enough people were upset with the government or excited by the opposition parties to get out and vote. It’s possible politi- cal cynicism and apathy has reached an all-time high. The bottom line is this provincial election resulted in the worst turnout in Ontario history and continues a trend that has seen voter participation slide from nearly 65 per cent in 1990 to just over 50 per cent today. Turnout in the seven ridings of Dur- ham-Northumberland ranged from a high of 59.3 per cent in Haliburton-Kawartha Lakes-Brock to an embarrassing 48.9 per cent in Oshawa. And this happened on a day when the weather was relatively decent across Ontario and when the polls were open for 12 hours, an hour more than in past elections. Turnout should have at least reached the 2003 total of 56.9 per cent. But it did not. Despite plenty of media coverage and candidates working hard to get out the vote, the numbers tell a story that doesn’t bode well for democracy in this province. Politicians must take advantage of every technological ad- vancement they can think of to connect with voting age Ontar- ians in future. This is a hands-on, wired age where members of the public want to be heard and listened to not just preached at. People want a real say when it comes to making policy and getting parties to tune in to what interests and concerns them. Traditional platforms with wild and unsustainable promises aren’t being bought by most voters. Parties have to connect in a more human and honest way if they want to keep people com- ing to the polls. While proportional representation is an answer Ontarians don’t want, it will be up to the four major parties to work to rebuild trust and interest in the system before politics here be- comes irrelevant. Keep dogs leashed in conservation area To the editor: Attention dog owners. Throughout the summer, my family has gone hiking in the Greenwood Conservation Area on a regu- lar basis. During these hikes, which included small children, we were continuously assaulted by overly excited large dogs that were not on leashes. The standard response/excuse given by the owner (usually nowhere to be seen when the dog first appears) is ‘Oh, he/she is very friendly, they won’t hurt you.’ Unfortu- nately, that phrase means nothing to our preschooler and tod- dlers who are the ones being (from their point of view) mauled and attacked. After asking one such owner to put their dog on a leash, I was told rather rudely, ‘No, I don’t think so - it’s a dog park.’ A quick call to the Town of Ajax confirmed my suspicion that it is not a dog park, that it is, in fact, a people park. The hiking trails are meant for people and if their dogs happen to tag along, fine, as long as they are on leashes. There is a large leash-free zone located at the Church Street North location. Ap- parently, the park is patrolled on a regular basis. Perhaps that could be more frequent? Us non-dog owners should be able to walk through this public park without feeling intimidated by free-running dogs who are “friendly” (undoubtedly until they are provoked or frightened). Cathy Haynes Ajax A dmittedly, I am a bit of a bleed- ing heart. I have a certain affec- tion for stories that tug on the heart strings. My mother says I’ve always been a little sensitive. I like songs with lyrics that make you think and movies that leave you with a tear in your eye. I sup- pose that is why, whenever we receive a call about a sick animal or a struggling child, I jump at the assignment. Nothing better serves to remind you how precious life is than hearing the story like that of the DesLauriers fam- ily. Tracy and Kevin DesLauriers have a 20-month old son who suffers from a rare disorder, which causes his immune system to be severely compromised. Even though they face so many stresses in their lives, not the least of which is the tremendous financial bur- den of meeting Parker’s needs, the fam- ily hasn’t let this situation get the better of them. This past summer I wrote stories about injured geese and a seagull that met its untimely death. That people care enough to tell us stories about at- tempts to help these animals is heart warming. They are a gentle reminder of the good that is still out there. And the response is even more touching. With these types of stories we receive more calls and e-mails than any other type of story. I guess when push comes to shove, that is why I love writing them. I might not have the means to di- rectly help someone or some animal, but I can write a story informing people about a need or a situation that needs to be addressed, and hopefully some- one out there that can read it and re- spond. This is what I hope happens with The Humane Society of Durham Region. I recently interviewed Ruby Richards at the Humane Society. I first met Ruby in January of 2006 when I wrote a story about how it desperately needed a new home. Well, that situation has only become worse. It has more animals than ever. Cats are in every corner and, as a result, in the last two weeks, 17 cats passed away because the staff had no way to stop the spread of a virus. Even though it was bequeathed the money to buy land and hopefully build a space that would better fit its needs, red tape had bogged down its attempts to purchase land. It appears, despite the good work the Humane Society does, no one wants this facility in his or her municipality. But, hopefully, like in the case of many of these types of stories we do, the story will get out there and some- one in this region can help. Erin Hatfield’s column ap- pears every third Sunday. Erin Hatfield staff writer Nothing better than a story that gives a good tug on the heart strings MNR says the big animals don’t seem to be a big concern this year By Chris Hall chall@durhamregion.com DURHAM — Motoring along a concession road north of Port Perry in late summer, Joan Nor- ton wasn’t surprised when she and her husband noticed a hefty- sized black bear in a nearby field in the early evening light. But the sighting has raised some flags for Ms. Norton, who describes the discovery on Scu- gog Line 8 as her first encounter with a bear in this area. “We stopped and looked at it, we watched it for a bit,” recalls Ms. Norton. “I knew they were around, but that was the first one I had seen.” Wandering about the field, just on the outskirts of a near- by clutch of trees, the bear was about a quarter-mile from the road and the Norton’s vehicle. After fixing its gaze on the fam- ily for a short time, the animal shuffled off. “It looked at us for awhile, watched us for a bit, and then it wandered back into the bush,” says Ms. Norton of the medium- sized animal, observed a short distance from the Hwy. 12 inter- section. “I’ve heard lots of stories about bears, but that was the first time I’ve seen one.” As it turns out, the Norton family, who reside on Hwy. 12, just south of Greenbank, are among the relatively few who have reported bear sightings this summer. According to Peter Waring, the Ministry of Natural Resourc- es’ (MNR) area supervisor for York and Durham, the number of calls relating to bears has dropped dramatically from last year. In 2006, says Mr. Waring, the area he oversees, Aurora district, which includes the Scugog and Uxbridge areas, a few more than a hundred calls were placed to MNR officials regarding bear sightings. So far, as 2007 reaches the three-quarters mark, only about 40 or so calls have been made to the MNR relating to bears in the area. “It’s been quite a quiet year so far, there’s really been no is- sues. There has been a relatively low number of calls,” says Mr. Waring, pointing out the bulk of the calls the MNR has received have been mostly confined to the northern stretches of his Au- rora district. “There haven’t really been any bears in wrong places, in trouble,” he says. The only local incident he can point to is an altercation be- tween a young girl and a bear in the Udora area earlier this year. In that case, the girl “surprised the bear” and startled it, caus- ing it to take a swipe at her, says Mr. Waring. No injuries were re- ported. In Scugog, the last bear-relat- ed call came a handful of years ago when a bear meandered into the downtown Port Perry area. It climbed a tree by the Scout Hall on Simcoe Street and was later tranquilized and removed from the area. “We’ve had a very, very low number of calls this year,” reiter- ates Mr. Waring, noting his sur- prise at that fact. Among wildlife officials, there was some con- cern that bears would be out and about, scavenging for more food, due to extremely dry conditions in northern Ontario, he adds. The recent sightings in the northern reaches of Scugog, however, do not surprise him. “They’re there, but we don’t believe there’s a large number of them. They’re indigenous to Ontario, they’re part of the land- scape historically and we have to find a way to live with them,” says Mr. Waring. But, for the mo- ment, Beal’s back in Pickering and making the most of it, and hoping that he can land back with the Ontario Hockey League’s London Knights in the near future. It all started at the London Knights training camp last month. On the first day on camp, Beal suf- fered a setback in the form of a knee injury. That injury kept him off the ice for more than one-and- a-half weeks. Then, just when he started back skating and was set to play in a Lon- don Knights’ league game against the Sudbury Wolves on Friday, Oct. 5 hard luck struck once again. This time it struck in the form of a car accident the Wednesday before. While travelling with three team- mates back to his accommodations after a Knights’ practice session, the car he was riding in was rear- ended. While the driver escaped unscathed, having seen the colli- sion coming in the rearview mirror and braced himself for the impact, Beal, who was riding in the back seat, and another player weren’t so lucky. They both suffered whiplash and a low-grade concussion in the aftermath. Beal and the other players were transported to St. Joseph’s Hospital in London as a precaution, where they were treated and released. But, it was another injury for Beal to endure. “I couldn’t move my neck for four of five days,” says Beal of the ordeal, adding the concussion wasn’t seri- ous. After convalescing for less than a week, the Knights sent Beal back to the Panthers to get some con- ditioning and some game action. He was in the lineup for Pickering in last Tuesday’s game in Oshawa against the Durham Fury. “I was feeling a lot better, just a little tight in the back of my neck,” he explains. The Panthers suffered a 6-5 loss to the Fury but, individually, the third-year Panther was well enough to play and he performed extremely well. Beal scored twice and added two assists in a domi- nating performance while playing on the team’s top line with wingers Brad Fleishman and Jamie Mac- Queen. “It felt great. It was my first game since last year’s playoffs, so it felt good to get back in the lineup,” he says, adding that his Knights’ coaches implored him to score four goals; he responded with four points instead. Beal makes no apologies for wanting this to be a short stint with the Panthers, hoping to be called up to the Knights in the near future. In fact, he may play in today’s (Sun- day) game in London against the Ottawa 67s. “They want me to get back into shape and get in some games,” says Beal of London’s plans for him. “I’m not sure whether I’ll be (in Pickering) for the year or not.” He’s enjoyed the OHL experi- ence in London, playing under head coach Dale Hunter and former Pickering Panthers’ head coach Pat Curcio, who joined the Knights as an assistant coach this summer. Another former Panther, Cody Smith, also made the Knights out of training camp this year. “Pat’s been really good at keep- ing me going and working hard,” says Beal. “He’s a good coach and a good guy.” But, don’t get the idea Beal would be heartbroken if playing for the Knights doesn’t work out and he ends up staying for the remainder of the season with the Panthers. “No, it wouldn’t be bad at all,” says Beal. “I like the team, I like the coach, so it would be good.” Chad Beal Ajax Thunder roars to solid soccer season Under-11 boys go undefeated, win Cup and league crowns and three tournament titles AJAX — One can only describe the Ajax Thunder boys’ under- 11 rep soccer team’s season as a thundering success. The Thunder finished its first season in the Central East Soccer League’s Division 1 with an over- all mark of 15-0-1, which almost equalled the team’s unblemished mark of three seasons ago, a per- fect 16-0-0 compiled during the 2004 summer season. The Thunder lost its bid for a perfect season on its second-to- last league game of the season, playing to a scoreless draw with the Darlington Ninety-sixers. Thunder head coach Justin Terry notes an undefeated season is nonetheless a solid achieve- ment. “The boys worked very hard,” notes Terry. “To be undefeated in this division is something we’re very proud of.” Moreover, in the Thunder’s 16- game campaign, it gave up only eight goals, while scoring a divi- sion-high 53 goals in league play. The Thunder’s undefeated re- cord also added up to a Cup and a league championship this year. As for tournaments, the Ajax under-11s emerged as champi- ons at three tournaments this season: the West Niagara Invi- tational, Ottawa’s Kickin’ in the Capital, and the coveted Robbie International. The Thunder is now looking toward next season when the team will play full-field, 11-on-11 matches for the first time in 2008. Ward 2 local Councillor Joe Dickson will soon have to vacate his Ajax council seat following his success in the provincial election. “It’s my feeling and I think it reflects the feeling of all or most of council, that with three years left in the term, a byelection is the only real ap- propriate route,” said Mayor Steve Parish. The other option avail- able for council is to appoint someone to the vacancy. Christie McLardie, the Town’s communication’s manager, said the process to fill a vacancy is dictated by provincial legislation. Once Mr. Dickson’s election as an MPP is official, council will declare the seat vacant, which would most likely hap- pen on Oct. 22. From then, council would have 60 days to decide on what process to follow. That would fall on Dec. 21. If the byelection route is cho- sen, the nomination period would run for 60 days and that would be fol- lowed by a 45-day campaign. Ms. McLardie said considerations that will affect when a byelection could be held include hold- ing a campaign in January and February, the possibil- ity of people travelling south during the winter, the school March break, which next year falls from March 10 to 14, and the Good Friday and Easter Monday weekend, which is March 21 to 24. Staff will be preparing a report for council, pointing out “factors such as the ac- curacy of the voters’ list and the overall logistics involved in conducting an election,” Ms. McLardie stated. The staff report would probably be presented in No- vember, she added. “Even if we act on it as quickly as we possibly can, we can’t have an election be- fore early to mid February,” Mayor Parish stated. A byelec- tion “traditionally has a low turnout,” so “we want to make it as easy as possible on the candidates, to get known as easy as possible,” Mayor Parish said. “March seems to me to be the best of the choices we have. I think the candidates would be grateful for that.” What makes an appoint- ment appealing is there’s no cost, he noted, saying a byelection would cost tens of thousands of dollars. “The cost would be the only factor in favouring an appointment,” he said, but noted there are three years left in the term. “There are two or three candidates who have run in that area before,” Mayor Par- ish said, adding it wouldn’t “be fair” to appoint one per- son over another. “If it was in the last year (of the council term), it would be appropri- ate. But with three years to go, it’s not the way to go.” A representative “shouldn’t be chosen by six people. It’s the people who live there and pay taxes” who should de- cide,” Mayor Parish stated. While attending Mr. Dick- son’s victory party, Wards 1 and 2 Regional Councillor Scott Crawford said he’d “of course” support a byelec- tion. “There’s more than three years left to go in the term. To me, it’s a no-brainer. I could see a slate of six to seven names,” Coun. Crawford said. Michel Saikali Owner/Manager In order to reduce emissions, modern engines run at a higher NTP (normal operat- ing temperature) than older engines. Thermostat: A part in cooling system, (like a gate) that is a responsible for keeping the engine running at NTP. When starting a cold engine, the thermostat will be closed. Coolant circulation to the radiator is prohib- ited. As the engine heats up, temperature rises. As it reaches a preset value, the ther- mostat will start to open and let the coolant circulate to the radiator where it cools off, preventing overheating. Simple!!! A matter of fact is thermostats have a certain life time span. As they malfunction, they may open too soon and wider, result- ing in a longer warm up time and not reach- ing NTP, or too late and narrow, resulting in overheating. In older carbureted vehicles, cold started engines needing more gas to per- form, before reaching NTP is achieved by closing the air passage to the intake manifold by means of the choke. The thermostat was still needed to regulate NTP. If the choke sticks closed or partially closed, after the engine warms up, the engine will be sucking way more gas than it should. As a result, not all gas will be burned and combustion will be incomplete. Incomplete combustion produces lots of harmful emissions. Modern vehicles use electronic fuel injection to control emissions ad maxi- mize power, through the use of computers (ECM) and different sensors and actuators. Depending on the information the ECM receives, it processes certain orders to be executed by different actuators. One of the very important inputs to the ECM is the en- gine temperature. ECM sees a colder than NTP engine and will order a richer mixture, resulting in more gas consumption and higher emis- sions levels. SAVE BIG ON GAS!!!
