HomeMy WebLinkAboutNA2007_04_01 Offences a breach of trust, judge notes By Jeff Mitchell jmitchell@durhamregion.com DURHAM — A disgraced Dur- ham cop will wear an electronic monitoring device while he serves a term of stringent house arrest, a Superior Court judge has ruled. Te rrance “Ben” McColm, 43, will be confined to his Port Perry house for all but one hour a day for the first 11 months of his 21-month sentence after being found guilty of four criminal charges relating to possession of stolen cars and insur- ance fraud. “The public needs to know Mr. McColm did not get preferential treatment because he is a police officer,” Justice David Salmers said in announcing the sentence Friday afternoon. “It will be very unpleasant for him and a very severe restriction of his liberty.” The judge added he was impos- ing the extra measure of ordering electronic monitoring in light of the fact Mr. McColm engaged in crimi- nal activity while working as a cop and that he has never accepted re- sponsibility for his transgressions. “I’m not satisfied he would ob- serve all conditions of a conditional sentence,” Justice Salmers said. Mr. McColm and his co-accused, Mississauga auto body worker Joselito “Joey” Abad, were found guilty after a jury trial in Whitby in December. They found Mr. Mc- Colm guilty of two counts of posses- sion of property obtained by crime, a count of mischief and one count of fraud over $5,000. The charges arose from a police investigation begun in the spring of 2003, when a fellow cop at the Pickering station became suspi- cious of the Mercedes Benz with expired dealer plates Mr. McColm drove to work each day. Police arriving at the Brougham Hardware Store on Hwy. 7 found the front door glass shattered and the store ransacked. They set up a perimeter with the assistance of York police and brought in a canine team, quickly rounding up two suspects -- one in a field and the other hiding in a shed. Three other males were appre- hended a short distance away by officers patrolling the perimeter. Four adults and a youth have been charged with offences in- cluding break and enter, theft, wearing disguises and weapons infractions. The adult suspects who can be named are Matthew Leonard Dewling, 18, of Gilmore Drive in Ajax; Gregory Heney, 19, of Glen Cameron Road in Thorn- hill; Randall Wilson, 18, of Black- burn Crescent, Ajax, and Jordan Gomes, 19, of Elm Street, Ajax. Also charged is a 15-year-old Ajax boy. Ownership papers and keys relating to the SUV were found inside Mr. Abad’s office, the jury heard. Mr. McColm testified he had no knowledge the vehicles were stolen and that he had not engaged in an insurance scam by making a false report of the Pathfinder’s theft. The jury clearly did not believe that testimony, Justice Salmers said in hand- ing down sentence Friday. “This testimony made no sense. The jury rejected it and I rejected it,” the judge said. “Mr. McColm either knew or was wil- fully blind to the fact the Mercedes Benz and the (Toyota) van were obtained by crime.” Mr. Abad was found guilty of three counts of possession of property ob- tained by crime and sentenced to 15 months of house arrest. The judge gave Mr. McColm a stiffer sentence because of the greater number of offences and the breach of trust he committed by en- gaging in criminal activity while he was a police officer. “The public reasonably expects a higher standard of behaviour from po- lice officers,” Justice Salmers said. “It is highly likely that as a result of these offences Mr. McColm’s career as a police officer is over.” The stringent restrictions in place for the first 11 months of Mr. McColm’s conditional sentence will be lightened only slightly for the final 10 months, when he’ll be allowed periodic absences from his home to seek work. He’ll be on probation for two years following the completion of his sentence. Mr. McColm will also face disciplin- ary action from the Durham police; he’s been on paid leave since his arrest in early 2003. DRT unveiled one of its 30 new low-floor, clean diesel buses Wednesday at Regional headquar- ters in Whitby. “When Regional council envi- sioned creating a new Durham- wide transit system we knew it wouldn’t be easy,” said Durham Regional chairman Roger Ander- son. “We began with the modest foundation of our previous local systems, with an aging fleet and a helpful partner in GO Transit.” Many improvements have been made in the first year, according to Mr. Anderson, and the 30 new buses will help DRT reach its ob- jective of connecting communi- ties within Durham and beyond. “We are working hard to make our transit system a viable, reli- able and convenient alternative to the car,” Mr. Anderson said. “These new vehicles will substantially im- prove the comfort and accessibil- ity of the bus fleet that serves our Region today.” The new buses are now on the road and enable DRT to retire 24 older, less environmentally friend- ly buses, said Wayne Arthurs, MPP for Pickering-Ajax-Uxbridge. “These new buses allow you to take some aged fleet off the road and maybe give you some spare parts to work with,” Mr. Arthurs said. “They will not only make it a more efficient system but allow you to expand.” “This is a great day for public transit users in Durham Region,” said parliamentary assistant Phil McNeely on behalf of Transporta- tion Minister Donna Cansfield. The 30 new buses come at a cost of $14 million, paid for largely in part by the Province, through gas tax revenue and $10.6 million in one-time transit vehicle funding. The buses offer people in wheelchairs a ramp to help them board. DURHAM — In the first six months of the green bin pro- gram, the Region issued 289 re- placement bins. According to Steven Jedinak, a waste technician, bin replace- ment due to damage or defect isn’t a chronic problem, but is something the Region is moni- toring. Although the warranty on the Region’s green bins is five years, Mr. Jedinak said in minus 25 de- gree weather cracks can occur if the bin hits the hopper or is dropped on the ground. Contractors have been told to do their best to avoid cracking the bins. They are also asked to place the bins on their side when they have been emptied. Damaged bins can be returned to the Region’s sorting facility on Garrard Road in Whitby, Monday to Friday from 8 a.m. to 5 p.m. If someone witnesses a col- lector blatantly destroying a bin they are asked to call the Region at 905-668-7711. The video of the little girl, who cried out as she was restrained and assaulted by an adult man, was among an exten- sive cache of child porn in the posses- sion of Friedrich Wilhelm Strohmeier when Durham police raided his Terrace Drive apartment in November 2006. Ontario Court Justice Joseph De Filip- pis sentenced the landed immigrant from Germany to 18 months in jail after accepting a plea of guilty to a single count of possession of child pornog- raphy. It’s believed to be the harshest sentence yet in Durham Region for a conviction of simple possession of child porn. “It’s the strongest sentence I’m aware of,” said Durham police Detective Andy Bussanich, who executed a search war- rant at Mr. Strohmeier’s home after the man’s nephew alerted police to the presence of pornographic images on a computer. In court Thursday Crown counsel Kent Saliwonchyk told the judge that search yielded several computer hard drives that held a huge collection of pornography: approximately 30,000 still images and 378 video clips, some of which were duplicated. Computer equipment seized at the home repre- sented a vast amount of memory mea- sured at 1.2 terabytes, Mr. Saliwonchyk said. “To put that in perspective, that’s roughly 29 or so laptops,” the prosecu- tor said. In court Thursday Justice De Filippis viewed a sampling of those videos and images, including 150 stills and 15 video clips. Court staff were excused from the room during the playing of the im- ages, which depicted the brutal abuse of young children. The judge interrupted the clip in which the child wailed out while being abused: “I think we get the point,” he said. As the material was played Mr. Stroh- meier, 48, sat silent, his expression blank. His eyes would dart occasionally toward the large screen upon which the images were being shown, then back to the floor of the prisoner’s dock in which he sat. Justice De Filippis sentenced Mr. Strohmeier, a cabinet maker and com- puter technician, to 18 months in jail, giving him two for one credit for the four months he’s already spent in custo- dy. He’ll be on probation for three years and has been placed on the national sex offender registry for 10 years. EDITORIALS & OPINIONS durhamregion.com Health-care fix needed at Lakeridge While the Dalton McGuinty Liberals righted some wrongs in the recent provincial budget -- especially when it comes to such issues as boosting the mini- mum wage to $10.25 per hour and providing more for the poor -- one glaring omission stood out for Durham’s citizens. That was the provincial government’s failure to come to grips with a serious funding shortage at Lakeridge Health, the four- hospital site that is a primary health-care provider for more than half-a-million citizens. A decision to provide Lakeridge Health with $8 million in funds to balance its budget conditional on the corporation finding an equivalent amount of savings doesn’t do anything to sustain or improve health care in Durham. What it most definitely does not do is address the chronic health-care funding imbalance Durham has faced for decades and continues to deal with. What’s especially galling is the hundreds of dollars paid by each Durham taxpayer yearly to fund Mr. McGuinty’s health- care premium to improve care across the province. Despite this “found money” the Ministry of Health and Long-Term Care has not found the cash necessary to keep Lakeridge Health on a sound financial footing. Lakeridge has faced an economic squeeze almost since it was created out of health care restructuring by the former gov- ernment of Tory Mike Harris back in 1998. The corporation has worked hard to find efficiencies and works at a highly efficient clip to provide the services needed by this fast-growing region. In spite of local efforts, it seems Queen’s Park isn’t listening when a plea for funds is made to provincial paymasters. The latest budget provided Finance Minister Greg Sorbara with the opportunity to fix a system that is broken, but he chose not to act. It puts in jeopardy needed mental health services that are on the chopping block while Lakeridge Health bal- ances its books. Some of our most needy citizens will pay the price, which just isn’t fair. With an election just six months away, when provincial can- didates ask for your input and campaign for your vote, make sure they have a plan to provide and deliver sustainable fund- ing to Lakeridge Health. Tell them our health depends on it and assure them your vote will ride on whether they vow to fix the problem. We’ve waited too long for a long-term solution. Thanks for all the help To the editor: On Tuesday, March 6, on a return drive from Ottawa at 5:15 p.m., my car slid through a stop sign at the corner of Solina Road and Concession 7, did a 180-degree turn and ended up in a snow-filled ditch. At that point three people stopped and endeavoured to push the car out, but the tires had no purchase in the deep snow. One lady kindly allowed me to use her cellphone to call CAA for a winch out, and I settled in for the 50 to 120 minute stated wait. I cannot believe how many people stopped over the next hour to offer help. Young people, older people, ladies and men both. It warmed my heart (and it was COLD outside!) to see the number of offers -- it must have been close to 20 people who stopped! I just wanted to thank all those individuals and commend the people of Durham for their kindness. I would like to point out that last year, in a warmer month, I had a flat tire on Hwy. 407 pulling off on the side of the road, next to an exit ramp. Not one person stopped to help me change my tire that day. I am so happy to be living in Durham Region! Kim Pileggi Brooklin Province should ensure burning technology is safe before putting it into practice G arbage. Nobody wants it but we all produce it. Now Premier Dal- ton McGuinty wants to inciner- ate it. Mr. McGuinty came out this week and proclaimed incineration as a pos- sible solution to our looming garbage crisis. With the GTA currently trucking its trash down to Michigan we have a limited amount of time to come up with a clean solution to this rather stinky problem. The Ontario government is allowing municipalities to fast-track garbage-in- cineration pilot projects in the hopes of pushing the technology forward. The premier says he wants to use and de- velop new technology that would allow the gas produced from burning trash to create energy, of which the Province is in short supply. While this sounds good, there’s a catch. In order to capitalize on this technology the Province wants to fast- track through procedural hoops. Why? Apparently Mr. McGuinty wants to be- come a leader in incineration because, he says, otherwise, Ontario will be left behind when it comes to garbage dis- posal. I’m all in favour of reducing the amount of trash we produce and so far the Region of Durham has done a com- mendable job in getting our recycling program up to snuff. However, there is still a lot of plas- tic, Styrofoam and other materials that we have no choice but to throw into a garbage bag. Shouldn’t we make a con- certed effort to limit our use of these materials? Companies should be en- couraged to reduce their use of these materials because if they’re not using them that means we don’t have to burn them. I’m sure incineration technology can be beneficial but alarm bells go off when I hear the premier talk about fast- tracking the technology. Incineration’s been around for a few years so I don’t see us falling behind if we decide to fol- low the proper procedures to put it in place. After all, if you live in Clarington, which is being considered for the in- cinerator, wouldn’t you rather know the technology is safe before it’s in use? Mr. O’Leary suffers from Chronic Inflammatory Demyelinating Poly- neuropathy (CIDP), a rare disease of the peripheral nervous system that causes gradual weakness and loss of sensation in the arms and legs. “My walk will hopefully bring at- tention and raise awareness about a disease that even a lot of medical officials don’t know about,” he said. But, Mr. O’Leary’s story starts long before he was diagnosed with CIDP. He was born with Charcot Marie Tooth (CMT), an inherited neurological disorder that affects the nervous system. Over time it causes the loss of muscle strength in the feet, legs, hands and dia- phragm. “When I was a kid I was always tripping over my own feet,” Mr. O’Leary said. It wasn’t until Mr. O’Leary was 40 years old that a neurologist was able to diagnose him with CMT. The dis- ease isn’t fatal and Mr. O’Leary con- tinued to make his way through life, running a drama school in Pickering for 10 years until one morning, in 1999, he woke up and was unable to move. His son got him to a hospi- tal, but the doctor sent him home. The following morning he awoke unable to even speak. He spent six weeks in Toronto Western Hospital, unable to move until he was sent to the Lyndhurst Rehabilitation Cen- tre. “I literally had to learn to walk again, talk again and write again,” Mr. O’Leary said. He was diagnosed with Guillain- Barre Syndrome (GBS), an inflam- matory disorder of the peripheral nerves, that causes the rapid onset of paralysis of the legs, arms, breath- ing, muscles and the face. “It is probably one of the toughest diseases to diagnose and there are probably a lot of people out there who have it and don’t know,” Mr. O’Leary said. In 2005, a specialist in London, Ontario, diagnosed him with CIDP. It’s similar to GBS except most people will recover from GBS while there’s no cure for CIDP. In Canada there are only 578 registered patients suffering from GBS/CIDP, diseases listed under the group of muscular dystrophy. “My muscles are weak, my bal- ance is shot and I have no feeling from the knee down,” Mr. O’Leary said. Despite these obstacles, on April 3, Mr. O’Leary’s 67th birthday, he will attempt to walk from Bowman- ville to the national conference for GBS/CIDP at the Delta Airport West Hotel on April 21. “If I pace myself, hopefully I can get somewhere,” he said. “If I do complete it, the walk will take me from the 3rd to the 20th.” Mr. O’Leary leaves the Bowman- ville Town Hall at 9 a.m. He said the Clarington fire department is escorting him out of town and he hopes that in Ajax friends and fam- ily will walk with him. According to Mr. O’Leary, there will also be representation from the offices of Durham MPP John O’Toole, Bev Oda, Durham MP, and Susan Keast, director of the GBS/CIDP founda- tion when he starts his journey. The Durham Gaelic Football Club invites families with kids of all ages to take part in its second program of free Irish (Gaelic) foot- ball clinics. The program helps kids build co-ordination, ball work, and team skills that are ap- plicable to all sports. Irish football is a fun, non-con- tact sport for all ages. It’s a fast- paced, free-flowing game that combines skills from soccer, bas- ketball and volleyball. It’s played widely in Ireland, on a magni- tude similar to hockey in Canada. It provides great conditioning, with little equipment - just soc- cer cleats or running shoes. The Durham club, which celebrated its 17th anniversary, currently operates competitive adult men’s and ladies’ teams as part of the To ronto Gaelic Athletic Associa- tion. Funding from the Ontario Trillium Foundation allowed the club to lay the groundwork for this program. Club spokesperson Elaine Healy points out that “you don’t have to be from the Durham area to participate. Sign up in October and you could be the next Pickering Star! durhamregion.comP PAGE 18 THE NEWS ADVERTISER, April 1, 2007 By Charles McGregor Special to the News Advertiser DURHAM — Snowed out the first time by a late-winter blizzard, Durham Region’s MADD chapter recently cel- ebrated early spring weath- er on its annual “Meet and Greet and Awards Night” in Oshawa, distribut- ing hon- ours to winners in a number of categories. “Volunteer of the Year” Eva Gainer was nominated for being someone “who can always be counted on to at- tend presentations and give ‘Her Story’ about life after losing (her) husband and youngest son to impaired driving,” the citation read. “When Eva tells her story she holds her audience’s complete attention and de- livers a very powerful mes- sage.” Runner-up in this catego- ry was Colin Feeney, who, “Despite his own challenges as a victim of an impaired driver, is always more than willing to help out to sup- port MADD’s mission.” This includes his involve- ment in community dis- plays, the MADD Durham Auction, the Hailey Mellis “Home Runs for MADD” event, the Santa Claus Pa- rade and the Red Ribbon Campaign. “Community Hero” win- ner Jill Coombes was com- mended for her efforts in attempting to take an im- paired driver off the road through a 911 call. The cita- tion noted she testified in court and although the ac- cused was acquitted, “her courage has made this man fully aware of impaired driving. Anyone who takes an impaired driver off the road with a 911 call is truly a hero,” the award citation concluded. R unner-up Phillip Bouchard was nominated for calling 911 from his car when he saw another motor- ist “driving all over the road.” The driver was arrested and charged with impaired driv- ing, preventing “what could have serious accidents,” the citation said. Rogers Cable TV was awarded the “Media of the Ye ar” award for its contin- ued support of the MADD Durham Chapter and the issue of impaired driving. “Every opportunity is taken advantage of by this station to promote public aware- ness to the dangers of drink- ing and driving,” the citation read. Teenaged students Nicole Cooke, Katie Lavio- lette and Jesslyn Lewicki from Dennis O’Connor High School were honoured with “Student Recognition Aw ards” for creating “a de- licious alcohol-free drink” which was declared winner of an “Ultimate Mix-Off” competition designed to de- liver an anti-drinking mes- sage to high schoolers “and promote alcohol-free alter- natives for celebrations.” Thirteen-year-old Hailey Melless was a repeat win- ner in the Student Recogni- tion Awards for being “an incredible young lady who has used her athletic abil- ity and passion for sports to raise awareness and a total of $4,000 for MADD.” A keen ballplayer, Hailey hit 318 home runs in her fam- ily-organized “Homeruns for MADD Durham” event in October. The final award went to Sgt. Glenn Courneyea of Durham Regional Police Services as MADD Durham’s “Police Officer of the Year.” Sgt. Courneyea, head of the DRPS Collision In- vestigation Unit, also has a “strong commitment to stopping impaired driving in Durham Region,” the ci- tation read. The police of- ficer, who credited fellow members of the force with making the RIDE program a success in the area, is also a lecturer to young men and women enrolled in the Po- lice Foundation Course at Durham College in hopes of serving as career police officers.
