Appeals Court reviews Pickering man’s murder conviction DURHAM — Evidence of fraud committed by a Pickering man on trial for killing his wife tipped the scales of justice against him, a law- yer has argued before the Ontario Court of Appeal. Ganesh Raghunauth didn’t get a fair trial because a jury heard evi- dence that led them to conclude the accused man was desperate for money when his wife, Hemoutie (Geeta) Raghunauth, died from a massive dose of cyanide in May of 2000, Russell Silverstein argued Thursday. The lawyer also told the three- judge panel that evidence about frauds carried out by Mr. Raghun- auth may have led jurors to doubt the accused man’s credibility. “The accused is entitled to a fair trial,” Mr. Silverstein said during the appeal hearing, at Toronto’s Os- goode Hall. “When evidence of this nature is improperly admitted ... there’s a real damage done to the fairness of the trial.” Mr. Silverstein is seeking a new trial for Mr. Raghunauth, who was convicted of first-degree murder after a three-month trial in Whitby in 2003. During the original trial, Crown counsel Cindy Johnston put forth a theory that Mr. Raghunauth had two motives for killing his wife: The first was to allow him to marry a woman in New York, with whom he’d been carrying on a torrid affair. The other motive was to cash in on mortgage insurance, a move the Crown said was necessary to help Mr. Raghunauth escape crushing debt. The group is made up of concerned citizens from Ajax, Pickering and Whit- by, as well as former Ajax and Pickering hospital doctors, nurses, other health- care providers, and patients. It is trying to rally support for the hospital’s rede- velopment out of fear the community could lose its full-service hospital. Frank Parrott said he stood by and watched as the Whitby hospital was eroded and he isn’t going to let that happen to the Ajax and Pickering hos- pital. “We’re trying to use what resources we might have to let the community know what the situation is,” he said. The group believes the Ministry of Health has decided that the Rouge Val- ley Ajax and Pickering hospital will not be a major hospital, but rather a sec- ondary hospital where ever-increasing numbers of patients are stabilized and transferred elsewhere, primarily Cente- nary Hospital, for active treatment. “There are a number of things that are happening and not happening that concern us,” Mr. Parrott said. “A number of circumstances both recently and not so recently have brought us to the con- clusion the Ministry of Health, probably some time ago, decided that they want to move towards the east... There’s been a constant dribbling of programs to- wards the Centenary site and away from Ajax-Pickering.” Hume Martin, the chief executive of- ficer and president of the Rouge Valley Health System, said the Ajax site has ac- tually grown over the years, although it is still not keeping pace with the popu- lation growth. “There are always going to be times when services switch back between the two sites... We are gradually and sys- tematically growing that site to meet the population increases,” he said. Mr. Martin welcomes the group’s support in trying to grow the Ajax and Pickering hospital even more through the redevelopment, which would see a new ER, a larger X-ray and cardiac diagnostic department, a brand new ambulatory care unit, and more mental health services. “We need to work together to ensure the hospital meets future needs.” Mr. Parrott agreed. “We’re all fighting for the same thing,” he said. “The redevelopment is essen- tial and it has been for some time.” The group is planning on holding a meeting in each community to give those who want to lend their support or who have questions a chance to meet with them. Legion member Ken Brown says more than 250 signatures are on the petition that was sparked by the beginning of a News Advertiser series of news stories on the need for expansion plans to move forward. The paper is asking that resi- dents let politicians know the project is a must for the community. “Honestly, they were dying to sign this thing once they knew what it’s for,” Mr. Brown states. “We had people waiting to sign.” A letter was sent to Health Minister George Smitherman, Public Infrastruc- ture Renewal Minister David Caplan, and local MPPs Wayne Arthurs and Jim Flaherty. In the letter, the legion noted, “Our members have contributed in excess of $200,000 since the hospital was built and feel very strongly that our veterans and other members of the community should not have to travel to Toronto to re- ceive the health care that they require.” The letter further states, “Why the delay, when the fundraising for the ex- pansion has been very successful? The jury returned a guilty verdict after 30 hours of deliberation. Mr. Silverstein said Thursday that, contrary to the Crown’s theory, Mr. Rag- hunauth was not in dire financial straits when the death of his wife occurred. The Crown introduced evidence about two frauds, totalling thousands of dollars, to support its assertion of the accused man’s desperation to get his hands on money, the lawyer said. But you don’t have to be poor to com- mit fraud, Mr. Silverstein said: “The fact that he committed fraud ... doesn’t sup- port the proposition that he was desper- ately in need of money.” Crown counsel David Finley argued that absent a clear error in law, the Ap- peals Court must defer to the trial judge’s decision to allow the fraud evidence. He also said that even if the court found the trial judge had been in error, it’s not likely the evidence of fraud greatly affected the outcome of the trial. “Even if you assume the evidence of theft was improperly admitted, there’s no likelihood any other jury would have come to another conclusion,” The pros- ecutor said. “It’s impossible.” Mr. Finley said the Crown’s case against Mr. Raghunauth, which included strong circumstantial evidence that he had sought out information about cya- nide and attempted to obtain the poison, was strong enough to convict the man. “The Crown’s case here ... was stagger- ing,” Mr. Finley said. The judges -- Justices Jean Marc Labrosse, Robert Sharp and Eileen Gil- lese -- reserved decision on the appeal. ✦ Crown from page 1 PICKERING — Police have issued an alert after a number of sightings of a nighttime prowler in south Picker- ing. Several reports have come in over the past year of a man who prowls residential areas in the Bayly Street- Liverpool Road area. The latest, according to Durham Regional Police, was Wednesday night. Police say a woman was in her Radom Street home around 8:30 p.m. when she glanced out a ground floor window and was startled to see a man staring back at her. Officers responding to an emergen- cy call arrived on the scene quickly and spotted a suspect, who bolted when he was ordered to stop. The cops flagged down a passing motorist and commandeered his car to chase the suspect. Despite the un- usual tactic, police lost the suspect’s trail. The prowler is described as a black man, 6-foot-2 with a shaved head and a large build. Anyone with information on the suspect is asked to call police at 905- 579-1520, ext. 2528, or Crime Stop- pers at 1-800-222-8477. Pickering prowler elusive PICKERING — Assistance from the public is being sought as police and family members try to locate a Pickering man who hasn’t been seen since Oct. 7. Paul Mappin, 54, of Fairfield Cres- cent in the Brock Road-Hwy. 401 area, left home without his vehicle, police said. He has no history of leaving be- fore but has lately been experiencing some medical issues, which have left police and relatives fearing for his safety. The only trace of the man was an attempt to use a credit card in the Scarborough area Oct. 10, police said. Mr. Mappin is white, 6 feet tall and about 220 pounds with grey hair, brown eyes and long sideburns. When last seen he was wearing black clothing and a black ball cap with the word “Groom” on it. And, because we live in Canada, our costs are covered by medicare. So why isn’t public help given to Canadians afflicted with autism? Durham resident Stacey Haley’s children, Will and Owen, have been diagnosed with autism. Autism often involves communication problems, the inability to form social rela- tionships, make eye contact with others, recognize danger- ous situations, adapt to changes in environment or routine and learn skills and language naturally. According to Canada Autism, without treatment 90 per cent of the people afflicted with autism are placed in institutions or residential facili- ties. Obviously, treatment is key to helping Ms. Haley’s chil- dren avoid being institutionalized later in life. The treatment they’ve received so far has helped them tremendously but it’s expensive and not fully covered by medicare. That is sim- ply not right. Autism is by far the most rapidly advancing childhood disorder in North America. According to Canada Autism, research in this country has been minimal with parents self- funding biomedical research in order to find a cause and a cure. Canadian parents are literally going into bankruptcy to provide their autistic children with suitable treatments and they get little government help. It’s hard to believe this happens in Canada. It’s hard to believe it’s happening here in our own community. We elect our governments to organize and run our com- munities, our provinces and our country. They’re there to help us. So why hasn’t anyone stepped up to help the in- creasing number of people suffering with autism? Why can we get treatment for cancer but not for autism? It makes no sense. Surely any elected official can see the cost benefit of treat- ment over institutionalization. The time for a change in thinking is now because these children’s futures depend on it. I’ve come the realization that govern- ments are after our money. I hear you saying, “But Chris, that can’t be. Our government officials are selfless drivers of democracy. It just doesn’t make sense.” I understand your apprehension, but hear me out. While going to renew my automobile plate I visited a Ministry of Transpor- tation kiosk at the Oshawa Centre. I punched in the codes and numbers with agile precision. There was a slight pause as I pondered whether to accept the one- or two-year renewal sticker. This was my first indication that the government is money hungry as they offered no financial incentive to pay for the two years. Even though they will get interest on having the money one year earlier. After selecting a one-year renewal I was back in business. That was until I got blindsided like a hockey player crossing the blue line with his head down. I stared quizzically at the words on the screen unable to understand what I was supposed to do next. “Please enter your Drive Clean confirmation number,” the screen demanded. Slowly, I started to regain my focus. Clearly there had to be a mistake. I own a 2002 Malibu with 52,000 km on the odometer. Wasn’t Drive Clean for smog-riddled vehicles? I checked the envelope I received from the Ministry of Transportation and sure enough there was a Drive Clean leaflet stating that 2002 cars had to be tested. I left the kiosk and the mall and drove home. I drove down King Street trying to make sense of this as older cars and trucks spewing smoke darted in and out of traffic. Maybe the government wasn’t as perfect as I had imagined. When I got home I started to look into the issue. Apparently governments only like to change things after a good scandal and the Province will now make changes thanks to an exposé that showed On- tario’s Drive Clean program costs mo- torists billions of dollars with exagger- ated results. Three-year-old cars pass the emissions test on the first try 99 per cent of the time. This is the big money grab part “deux.” One of the recommendations would allow drivers two more years before they have to start testing new cars, while ending the exemption for some of the oldest, most polluting vehicles. Dogs need to be fed, bathed, walked and cleaned up after. I cannot begin to understand the responsibility as I am not a dog owner. We as a society have made great improve- ments with stoop-and-scoop responsibility and I see dog owners doing this all the time. What I take offence to is that some dog owners feel that after they have cleaned up after their dog they are free to dispose of this bag wherever they feel, whether they leave it on the sidewalk or throw it into the hedge in front of my home. Take these doggie bags home and dispose of them on your own property. I do not know your dog, love your dog or care to clean up after it. Chris Robinson Pickering Homeowners will absorb brunt of the increases By Keith Gilligan Staff Writer DURHAM — Homeowners may not want to open notices coming in the mail from the Municipal Property Assessment Corporation. Anyone facing a reassessment of more than 11 per cent will see their property tax bill rise. And that’s before the Region and municipali- ties approve budgets in 2006. “Residential property taxpayers will be the ones hit because of reassessment,” said Jim Clapp, Durham’s finance commissioner. Speaking to regional council’s finance com- mittee on Wednesday, Mr. Clapp said the av- erage change in assessment is 11.1 per cent, although residential assessments are increas- ing at an average of 11.9 per cent. For example, a property with an assessment increase of 15.1 per cent will face a regional tax increase of four per cent. “Residential increases and all other classes go down,” Mr. Clapp noted. Industrial property classes are the “big win- ners,” he added, as those classes will drop an average of six per cent. The reassessment will “shift $4.2 million onto residential taxpayers,” Mr. Clapp said. Residential makes up 78 per cent of the tax base and there are 178,000 residential proper- ties. Finance committee chairman John Mut- ton said the Region is facing an 11.4 per cent tax increase before budget deliberations even begin. Factors for the increase include such things as running regional transit and built-in wage increases. “This is another time to remind the depart- ments that this is not a wish-list budget. Re- mind the police of this,” the Clarington Mayor said. Regional Chairman Roger Anderson said, “The (budget) numbers are correct and only if council wants to do the minimum with transit. Hunters ring up gold, silver Ajax boxers top weight classes at Summerhays AJAX — The battling Hunters definitely did the hunting at the Summerhays Boxing Tournament in Brantford recently. What the Hunters turned up were gold and silver medals for the Ajax Boxing Club at the sixth annual event hosted by the Brantford Box- ing Club and sanctioned by Boxing Ontario. The Ajax club sent four fighters to the tournament, return- ing with three gold medals, one silver and two tournament awards. Phil Hunter defeated Salim Juma of the Motor City Boxing Club of Oshawa in the gold-medal bout of the 75-kilogram senior male divi- sion. Hunter handled Juma with ease through the first round. In the middle of the second round, how- ever, Juma’s complaints of exces- sive pushing were met with a dis- qualification by the referee for poor sportsmanship. Hunter won his first bout over Anhtuan Tran of Chris Johnson’s Fighting Alliance (Toronto). Hunter was leading through the first round and, by the second round, Tran’s cornerman threw in the towel. Hunter also earned the Best Boxer Award for his weight class. Phil’s older brother Jack Hunt- er also fared well, mining a silver medal in the 91-kg senior male cat- egory. In a close decision, Hunter lost to Aziam Howes of the McEwan Pro Street Club of Toronto on points in the gold-medal bout. In his first match, Hunter stopped Darby Walsh of the Motor City Boxing Club, delivering a series of vicious power shots, knocking the Oshawa fighter down twice before the ref- eree stopped the contest. Kevin Haddaway also fought his way to gold for Ajax, winning the 69-kg male senior category. Had- daway faced Collin Philips of the London Boxing Club for the gold medal, handling him easily through the first two rounds before the refer- ee was forced to stop the bout after administering a series of standing eight counts. In his first fight of the tourna- ment, Haddaway decisioned Dmit- ry Chalenko of the European Boxing Club of Toronto, 22-18. Haddaway trailed in points after the first round but, in the second and third rounds, he returned with a vengeance. Anthony ‘Tony Yayo’ Francis also fought his way to gold, capturing the 54-kg male cadet ‘C’ weight class and winning the event for the second consecutive year. Francis, 16, faced Kevin Boodoosingh of the Champion Boxing Club of Toronto in the final, winning 31-25. For his efforts, Francis also won the ‘Best Bout Award’ for the tour- nament. Francis opened his title defence against Tim Smith of the Sault Box- ing Club of Sault Ste. Marie. Fran- cis dismantled Smith’s game plan early in the first round after apply- ing constant pressure. Smith was unable to return enough punches to compete with the Ajax fighter as Francis scored a 32-20 decision. Ajax club co-ordinators Brad Gonsalvez, Marcus Price, Masood Raza and Blair LaFortune trained the fighters in preparation for the tournament and coached the fight- ers at the competition. Adam Phamhung captured the silver medal in the male light middleweight category, while brother Eric won bronze in the male featherweight division. Overall, the Canadian junior team finished second, the best results of any Canadian tae kwon do team. The female team placed first overall, with the male team placing second. Ajax martial artists earn medals at Pan Am junior championships Shaq on the Attack Dolphins’ atoms earn lone win over Thunder DURHAM — An Ajax-Pickering Dolphin took great pleasure in pil- ing up points against his former team. Dolphins’ atom running back Shaq Lawrence played for the Scar- borough Thunder tykes last season before moving to Ajax and joining the Dolphins. Lawrence scored a touchdown to help Ajax-Pickering to a 24-0 victory over the Thunder in Central Ontario Minor Football League action last week at Scarbor- ough’s L’Amoreaux Park. All three Dolphins teams are in Newmarket today (Sunday) to meet the York-Simcoe Young Bucs. The atoms (5-2) captured the lone win over the Thunder. Scarborough won 6-0 in the tyke game and 14-0 in the peewee contest. Atom quarterback Jeff McIlravey opened the scoring on an off-tackle trap led by fullback Cole Tudor. Cole also got into the act, scoring the final Dolphins’ touchdown of the second half. The offensive stars and unsung heroes were offensive linemen cen- tre Jackson Harding, guards Erich Ko and Ryan Colvin, tackles Bryan Derksen and Nathan Cheung and tight end Marco Mertsis. The boys created big holes for the running backs. Special teams played a major role in the win as the tandem of snap- per Harding and holder Michael Stobbart allowed kicker Roynelle Meredith to be perfect on point- after attempts, converting all three touchdowns for six points. After running back a kickoff for a touch- down against Markham last week, Denver Wright had a key 25-yard return. The entire defence starred, but the most valuable player nods went to Owen Eccleston, Alexan- der O’Donnell and Connor Pater- son, each with four solo tackles. Jaiden McBride and Alex Horodnyk snagged interceptions. Meanwhile, in the tyke contest, the teams engaged in a hard-fought defensive struggle. After the teams traded posses- sions for most of the first half, the Thunder moved the ball down to the one-yard line late in the half. After two scoring attempts were de- nied, the Thunder ran a trick play, pitching to the right to the running back, who threw a strike to the tight end in the end zone. The Strikers beat rival Picker- ing Cougars in a shootout after the score was tied 2–2 after regulation time. LeShaun Young and Maleik De Freitas scored in regulation, with Matthew Guerriero converting the winning penalty kick. On the road to victory, the Strik- ers went undefeated, winning four games and tying one. The Eagle Cup was the Strikers’ sixth title of the season. The team’s run started with early-season wins at the Niagara Falls and Markham’s ‘Simply the Best’ tournaments. In mid-summer, the Strikers played host to their own tournament, win- ning for the fourth consecutive year, beating Richmond Hill, the top team in York District, 1–0. Guerriero scored the winner. Goalkeeper Ben- jamin Cowman made a stellar save on a breakaway to seal the victory. The Strikers played in the Cen- tral East Soccer League (CESL) pre- mier division, where it captured first place, winning 15 of 16 games with a single tie as the only blemish. This was the fourth consecutive year the team captured its league title and the second consecutive season in which it went undefeated. The team’s last major accomplish- ment of the season was winning the CESL League Cup, beating the Cou- gars 3-1. Roman Bohulevych, Luca Gasparotto and Young scored. The Strikers sported an overall record of 38-0-2. Ajax played strong defence during the season, allowing only 14 goals, scoring 169 goals.
