Province, UOIT nail down deal Police investigation widens Internal task force continues work on misconduct probe By Jeff Mitchell Staff Writer DURHAM –The number of Durham Regional Police officers being investigated for possible misconduct continues to rise as an internal task force works its way through files related to busts made by the Drug Enforcement Unit (DEU). Twelve officers have now been told they could be charged under the Police Services Act (PSA), police spokesman Dave Selby confirmed yesterday. Meanwhile, 37 other cops have been notified they may be called upon as wit- nesses in a total of 97 incidents now being probed. The internal investigation is being carried out in conjunction with an Ontario Provincial Police probe of allegations of criminal activity by DEU officers. “It’s not a criminal investiga- tion,” Mr. Selby said of the inter- nal review. “It’s about conduct, and it’s coming out of the files that were looked at by the OPP.” The DEU has been under inves- tigation since February 2003, when Chief Kevin McAlpine called in the OPP. While results of the OPP probe haven’t been made public, several sources, in- University settles for less than hoped for, but happy with $220 million By Keith Gilligan Staff Writer DURHAM – After much delay, a financing agreement for build- ing projects has been signed be- tween the Province and the Uni- versity of Ontario Institute of Technology (UOIT). The memorandum of agree- ment (MOA) was approved by the university’s board of direc- tors Wednesday night, allowing UOIT to borrow $220 million. University officials had hoped for $305 million, but scaled back their plans, putting off educa- tion and criminal justice build- ings. Gary Polonsky, UOIT and Durham College president, said the MOA means the school can “design projects, build projects, hire staff, fill up programs and students.” Mary Anne Chambers, the minister of training, colleges and universities, said in an in- ter view her government has gone beyond what the previous provincial government agreed to. “The previous government had agreed to support funding for $190 million. The Memoran- dum of Agreement supports $190 million, plus $30 million for the engineering building,” she said. “Actually it’s a better deal.” Of the $190 million, most is earmarked for two academic buildings and the library with the rest allotted to post-con- struction work. Construction on the 42,000- square-foot engineering build- ing would start in the spring of next year and be ready for occu- pancy by January 2006. In both robberies, Tuesday and Wednesday, two men armed with at least one gun entered the busi- nesses and demanded cash be- fore fleeing on foot, Durham Re- gional Police said. On Tuesday around 2:10 p.m., two suspects, both described as white and one armed with a pellet gun while the other was carrying a hammer, walked into a Subway shop on Harwood Avenue near Hunt Street and demanded cash. The man with the hammer broke a glass display case, police said. The two fled on foot after obtain- ing a small amount of cash. The following day two white men, one armed with a black handgun and the other with a knife, walked into a convenience store on Harwood South around noon. They took off on foot after a clerk handed money over. The News Advertiser re- grets the error. cluding the chief, have said the re- port is finished and in the hands of the Crown attorney. The exact nature of the allega- tions has never been revealed. Sources say the OPP reviewed more than 250 files of cases han- dled by the DEU. In the meantime, the chief has established an internal probe to review DEU files for possible mis- conduct that may result in PSA charges. The move has drawn fire from both police officers and civil- ians, but has been defended by the chief. “We take every complaint seri- ously and we certainly want to make sure our people do their jobs properly,” Chief McAlpine said in an earlier interview. During that interview in early July, the chief said about 30 offi- cers had been notified they could be called as witnesses as the force investigates potential PSA charges. At that time, eight cops had been identified as possible subject officers. As the number of potential PSA charges continues to rise, officers caught up in the probe persist in their claim Durham Regional Po- lice brass are engaged in an effort to root out even the slightest hint of misconduct on the part of for- mer DEU cops. Some critics say police brass are resorting to PSA charges to compensate for what they predict will be a finding of no criminal conduct when the OPP report is made public. Former DEU offi- cers have called the task force in- vestigation a “witch hunt” de- signed to save face in the event al- legations of criminal conduct aren’t borne out. One former DEU officer, speak- ing on the condition of anonymity, noted that while the 12-member squad was together, it was not the target of an inordinate number of complaints from the public. Nor were officers targeted for PSA charges or queries by the Special Investigations Unit, he said. Those assertions were confirmed by the chief. “Where’s the problem?” the for- mer DEU cop asked. Bernie O’Brien, an Oshawa lawyer who represents former DEU boss Detective Tom An- drews, continues to question the legitimacy of the parallel probe undertaken by Durham police. “It seems to me it’s unwarrant- ed,” Mr. O’Brien said. “Why don’t they look at their best business practices and change what needs to be changed? To me, it’s just re- dundant. “I don’t know if they’re fishing for charges, but the thing that’s disturbing is the effect it has on the morale of the police service,” Mr. O’Brien said. Durham Regional Police Asso- ciation President Doug Ca- vanaugh said the union has re- tained lawyers to represent mem- bers called in for interviews on PSA charges. He said there’s little the union can do but let both the internal investigation and the OPP probe run their courses. “Our job is to protect the wel- fare and the well-being of our members,” Mr. Cavanaugh said. “We have expressed our posi- tion that if there are going to be interviews, we want to be given a substantial heads-up so we can represent our members.” Mr. Selby said the 12 officers being investigated for possible misconduct haven’t been charged under the PSA. “They’re primary officers in the investigation, which means alle- gations may potentially lead to charges under the Police Services Act,” he said. “(But) just because you’re a primary officer doesn’t mean you will be charged.” Six officers - an inspector and five investigators - have been as- signed to review DEU files, Mr. Selby said. They’re about 80 per cent of the way through those files, he said. The Ministry of Transporta- tion announced Wednesday the expansion of GO Transit routes, including a Hwy. 407 bus rapid transit to the University of On- tario Institute of Technology. “It’s to offer people more choices. It’s a growing market and it’s a fast way to travel be- tween York Region and Durham Region,” said Ed Shea, GO spokesman. Several new routes are being added along the Hwy. 407 bus network that will go from York University through to UOIT and then to downtown Oshawa. Pre- viously the farthest east that network had gone was Pickering. The Hwy. 407 network started a few years ago with students and faculty as its main target since York University was the anchor. But, Mr. Shea said it has grown to include commuters travelling along more northerly routes in the GTA. The new eastern GTA service is scheduled to start Sept. 7 and is to include nine trips through the day each way, starting as early as 6:15 a.m. and running until about 8 p.m. The service will run only week days. Scheduled stops include Brougham, Greenwood, Brook- lin, UOIT/Durham College and downtown Oshawa. Thomas Coughlan, UOIT and Durham College student council president, said students are wel- coming the news. “We say it’s awesome,” he said. “The agreement with GO Tran- sit will definitely make (the schools) more accessible from the city and it goes through Brooklin so it makes it more ac- cessible from the northern part of Durham.” Mr. Coughlan said the added transportation choices are going to help the schools grow. “We have anywhere from 8,500 to 9,000 students and we only have 1,400 residence (spaces) so that shows how many com- muters we have,” he said. “This transit will make it easier to get here and the campus more ac- cessible. “It will help with the expan- sion of our campus.” In addition to the expansion of the Hwy. 407 route, UOIT and GO Transit are embarking on a trial express bus from the Scar- borough Town Centre to UOIT and Durham College. Mr. Shea said the project starts Sept. 7 with two morning buses travelling from Scarbor- ough and two afternoon buses leaving UOIT. The trial came about after joint discussions between the university and GO. They are sharing the cost and the revenue 50-50. P PAGE 6 NEWS ADVERTISER, FRIDAY EDITION, July 30, 2004 www.durhamregion.com Too many questions UOIT, Province must be for thcoming with the public The long-anticipated agreement between the University of Ontario Institute of Technology (UOIT) may now be in place, but the questions have only just begun. Right off the top, let's start with university officials being kept on pins and needles these past few months, wondering about what the future holds and whether there'd be any more provin- cial funding. What should have been a simple process, given the fact that the previous Conservative government had just about all the details on the financing in place before losing office, has been laboriously dragged out by the new Liberal group at Queen's Park. As it is, the new deal reached between the Province and UOIT calls for only $220 million in funding, a far cry from the $305 million the school was after. While Mary Anne Chambers, Minister of Training, Colleges and Universities, defended the amount, saying it was more than the previous government had pledged, the reasoning falls flat. University staff and students must be frustrated the school has to temper its ambitious building plans, postponing future construction at a time when the new university is proving very popular with students and high-tech education is sorely need- ed to keep Ontario business and industry moving forward. "We won't have world-class facilities (available at all times). We may have to extend the learning day," said UOIT president Gary Polonsky, adding the school may have to make do with portables to fit students in. Finally, the public has every right to question the apparent secrecy surrounding the funding arrangement. When the Lib- erals received a report from Ralph Benson weeks ago assessing the UOIT business plan, the ministry agreed to release the de- tails, provided UOIT gave its blessing. UOIT reasoned it was a ministry-mandated inquiry, ergo the ministry should release it. After much coaxing it was finally released to this newspaper late Thursday by the ministry. Now, the university is refusing to publicly release the financial agreement, although Ms. Cham- bers acknowledges it is a public document and says she will do so soon. The public has a right to this information, particularly when we're dealing with public dollars of this magnitude. We acknowledge the frustration UOIT must feel with this sit- uation but we urge them to be forthcoming with the public. As for the government, it is absolutely necessary for the Liberals to stand behind the university and this community and stop play- ing what appear to be political games. Society can’t face abortion truth To the editor: Re: ‘Protesters crossed the line,’ edito- rial, July 18. I was saddened and disturbed to read your editorial. Murder, which in law is the taking of an innocent life, is never a ques- tion of good taste. It is always evil, and there is never anything benign about it. Today’s society of political correctness is afraid of the truth, and angry when it has been brought out so forcefully. Science has long proven beyond any shadow of a doubt that human life be- gins at conception, when a new human person, complete in every detail of body and soul, different from anyone else, liv- ing or dead, has come into being. Nor, is it a question of the value of human life, but the sanctity of human life. The governments we have elected for the past 35 years, federal, provincial and municipal, have been without a doubt pro-choice. To be pro-choice either ac- tively or passively, is to be anti-God, no matter what one professes to believe, since that position is always in favour of abortion, an intrinsic evil that together with euthanasia, embryonic stem-cell re- search and human cloning are the con- stituents of the ‘culture of death’ and products of the contraceptive mentality rampant in our society. There is more horror, violence and graphically disturbing images shown on daily television and in the movies that would make these ‘Show The Truth’ im- ages look like family photos. John E.G. Political interest sparked for some My first experience covering Pickering was Dec. 1 when the mayor and councillors were sworn into office. It is from that experience that the idea for the news series ‘Chang- ing Times’ began to form. I had no idea how diverse Pickering was at the time, but seeing a seven-mem- ber council of all white men stood out nonetheless. Through discussions with other reporters and through a little re- search I found my first reaction was on the right track - women have never been a big player at the coun- cil table in Pickering and in west Durham there has never been a vis- ible minority elected to political of- fice. ‘Changing Times’, a four-part se- ries examining the lack of diversity in elected representatives in both Pickering and Ajax, wrapped up last Sunday in the News Advertiser. The point of the series was not to criticize the current elected officials nor was it to criticize women or members of Pickering’s multicul- tural communities for not playing a bigger role in politics. The point of the series was to ex- amine the issue and spark some discussion. The series could not have run at a better time in Picker- ing. Residents in Ward 2 are head- ing to the polls for a byelection this fall (although it’s not official yet). The byelection presents a perfect opportunity to bring some diversity to council. I am not advocating the resi- dents of Ward 2 vote for someone just because they are a woman or a visible minority, but democracy is best served by having many differ- ent people to choose from and by having different voices at the coun- cil table. I would like to see included in the slate of candidates a woman who knows the community well and who wants to contribute to it because she has lived here for years. I’d also like to see a multicultural commu- nity leader who thinks he can bring a different perspective to the table. I have heard from a 20-year resi- dent of Pickering who is thinking of putting her name forward after reading the series. In addition, the newspaper received a call from a visible minority who is seriously thinking of throwing his hat into the ring because of our editorial on the issue. That was the point. The $190 million didn’t include the engineering building, which Mr. Benson noted was integral to the university’s fund-raising endeavours. “Engineering is fundamental to the mission and objectives of UOIT, and addresses labour market needs in the areas of nu- clear engineering and manufac- turing engineering,” Mr. Benson wrote. “In addition, officials re- sponsible for the fund-raising campaign are of the opinion that not providing engineering facilities would have a signifi- cant negative impact on the ability to raise funds.” Mr. Benson added the univer- sity is in the middle of the first of three major fund-raising cam- paigns, and $50 million from the first initiative should go to debt repayment. The $220 million must be paid back over 30 years. “Everyone hopes we pay it off sooner. It’s like any house mort- gage, you can pay it down soon- er. If we need 30 years, we have that,” Mr. Polonsky stated. He added if the delay in get- ting the approval could be de- scribed in one word “that word is election. Despite its best intentions, the former government just ran out of time.” A series of items had to be dealt with before the deal could be finalized and the previous government, which approved starting the university, didn’t have time, he said. “The new government had a million priorities and as a bonus, it inherited a $5.6 billion deficit,” Mr. Polonsky said. “We’re grateful to the new gov- ernment that it declared pub- licly and often it was a strong supporter of UOIT. It would honour every nickel the previous government com- mitted to.” Mr. Benson found in his re- view “$190 million was insuffi- cient,” Mr. Polonsky said. “In a show of good faith, we, the uni- versity, we backed off $305 (mil- lion) and settled at $220 (mil- lion).” A memorandum was ham- mered out that “took the usual two months to do.” Ms. Chambers said the delay in getting the MOA completed was caused by her ministry, the finance ministry and the univer- sity having to negotiate. Mr. Polonsky noted the educa- tion and criminal justice build- ings are just being put on hold. “Two buildings we had agreed to defer: not cancel, but defer,” Mr. Polonsky stated. “We’re hop- ing, and we have no guarantee, but we’re hoping there will be a capital works program an- nounced in the next couple of years and we will be in the queue. We hope our submission is successful.” While the two buildings are being deferred, Mr. Polonsky said the delay “won’t affect the programs. But after celebrating its 70th Anniversary this year, owner Hersch Nichols is closing the doors of Oshawa Centre’s oldest family busi- ness. “I’ve seen three genera- tions shopping at Dunn’s so we’ve dressed a lot of men,” he says. “I’ll miss the many loyal customers. Hersch admits that it’s been increasingly difficult to compete with the big chain stores. “We were still doing very well and wanted to go out while we were still suc- cessful,” he says. “It’s the right time to retire.” Dunn’s Menswear first opened in downtown Oshawa in February of 1934 at 16 Simcoe St. S. In its early days Dunn's sold strictly suits, pants, sport jackets and topcoats. Business suffered during the war with many men f ighting overseas. As a result the owner turned over the business to the manager at the time who ran the store until 1950 when Hersch bought the business. “At the time I had a store in the Bloor and Ossington area of Toronto,” he recalls. “I found out the store was for sale and knew that Oshawa was a good city. I knew the store was in a good location and that it just needed some personal atten- tion.” One of the first orders of business for Hersch was to expand its line to include shirts, ties, shoes, hats, socks and casual wear. “The store also became too small as business grew,” says Hersch. “So in 1960 we moved to a new location at 36 King St.E. which dou- bled the previous store’s space to 1500 sq. ft.” Less than a year later the Oshawa Centre opened at its present location. While only an outdoor complex at the time, big retailers such as Simpsons (later Sears) and Eaton’s had located at what would become one of Ontario’s largest regional shopping malls. In 1961, Dunn's opened their second location at the Oshawa Centre. For almost a decade both stores served customers from all over Ontario County (now Durham Region) and as far away as Cobourg, Port Hope, Lindsay and Peterborough. As more and more cus- tomers flocked to the Oshawa Centre, downtown businesses suffered and when the OC was enclosed in 1970, Dunn's closed the King Street location. Over the past years Hersch has worked with his wife and children at the store and has fond memo- ries of working both down- town and at the OC but he says all good things must come to an end. “We were successful because we were always competitive,” says Hersch. “We gave the right price and great value. Durham District School Board trustees at a budget meeting voted to untwin the custodial assignment at R. H. Cornish and Prince Albert public schools. That means each will have a full- time custodian this fall. The two schools, which to- gether have roughly 1,000 students, have shared a daytime custodian, and the parents complained their schools weren’t being main- tained at a high enough standard. “We were pleased; we thought it was the right thing,” says Trish Paterson, Cornish’s school council chairwoman. “Unfortunate- ly, it took us a lot of time to get there.” She and Claire Marsh, Prince Albert’s school council chairwoman, ar- gued the two schools were unique twins given their sizeable population. And with no custodian at any given time, they said mess- es took longer to clean up, sometimes creating a safe- ty hazard in the case of slush tracked into the school by students in the winter months. Scugog Trustee Steve Mar tin took up the parents’ cause when they ap- proached the board seven months ago. The issue was discussed at several meet- ings, with some trustees and staff members con- cerned untwinning the Scu- gog schools means untwin- ning any others too, at great expense. Trustee Martin doesn’t see it that way. “I thought (the parents’) argument made sense,” he says. “I don’t see it as an all or nothing.” He agreed the situation of the two schools was unique given their popula- tion. While the board can’t untwin all the schools, “if we can afford to do others in the future, we’ll address that.” Trustee Martin says he believes the move will make a difference in the up- keep of the schools. Ms. Paterson notes the untwinning is not a done deal yet, since it would be ref lected in the board bud- get, to be approved next month. “I would think that if the budget doesn’t get final- ized, this is one of the pro- jects that will get knocked off the table,” she says. Untwinning the two schools will cost the board an extra $24,000 per year. However, it will not mean a Pickering High School (PHS) maintenance pro- ject planned for the coming year will be cancelled. Last month, a staff report indi- cated cancelling the gym f loor refinishing work should pay for the untwin- ning. That drew the ire of Ajax Wards 1 and 2 Trustee Marilyn Crawford, who claimed staff was pitting school against school. The floor project would- n’t be her first choice for spending the money, given the millions in work the school requires, but Trustee Crawford says it’s wrong to take any work away from PHS. “I have to stand for my community and I won’t stop,” she says. Trustees will learn next month what will be taken from the budget to pay for the untwinning. The work of Cyril Cox is on display throughout August PICKERING –The Picker- ing Civic Complex isn't just a place to see politics in action. It's also a venue where residents can expe- rience art. The works of local artist Cyril Cox are on display throughout the building now through Friday, Sept. 3. Cox works in both acrylics and oils to cap- ture the beauty and real- ism of nature and wildlife. The current focus for his work is mostly land- scapes, riverscapes and figurative work. Cox began painting in oils at the age of 14, and studied both graphic art and illustration in the early 1980s. He officially launched his career as a fine artist in 1989 when he was recog- nized at the National Canadian Chrysler Wildlife competition, win- ning best of show hon- ours. Cox is a member of the PineRidge Arts Council, Ajax Creative Arts and the Oshawa Art Associa- tion. That was when they pur- chased Air1, a Bell Jet Ranger 206 heli- copter to help enhance service to the community. Equipped with some of the latest technolo- gy, including a Wescam infra-red camera, a Nightsun 30 million candle power search- light, a DVD burner and video recorder, and a mobile data recorder, Air1 respond- ed to 464 calls in the first five months of operation. The police helicopter is docu- mented to have prevented at least six po- lice pursuits. Air1 is also known as a force multiplier as it allows a smaller force to complete as- signed tasks. The Air Support Unit is staffed by two tac- tical flight officers, constables Jon Hood and Patrick Burke as well as two pilots, Bruce Buck and James Roach. After turning down U.S. schol- arship offers to play baseball two years ago, McConnachie opted to stay home, study at Ryerson Uni- versity and play locally. The 21-year-old utility infielder- outfielder had a change of heart, however. He made his decision to study and play baseball this fall in the States, sending out e-mails to colleges to gauge interest. And, luckily enough, the Ohio Valley College Fighting Scots baseball team, a program on the rise in NCAA Division II play, was wait- ing. "I turned down a few offers in the past, so I felt that this might be my last opportunity at a schol- arship," explains the Ajax resi- dent. "If it doesn't turn out, at least I went down there and gave it a shot. It was tough going to a school without a (baseball) team and no school spirit." Last March, the Ajax Minor Baseball Association product at- tended a tryout at the Vienna, West Virginia campus, and watched the Fighting Scots in West Virginia Intercollegiate Ath- letic Conference action. "I did pretty well," says Mc- Connachie. "They made me an offer and we went from there." Most impressive about the Ohio Valley College baseball pro- gram has been its improvement in each of its three years in Divi- sion II baseball, says Mc- Connachie. The team won one game in its first year in confer- ence play, five the second and, last season, the Fighting Scots came within a half game of a playoff berth after 10 conference victories. "When I went down there for a few days, it was in the middle of their season. I talked to a few of the guys and they were really into it. The coach (Chad Porter) wants it to be a winning program. It seemed like a good fit because I'm a competitive guy myself and I want to do what I can to help the team win." McConnachie begins training with the Fighting Scots in late Aug ust, but until then, he's com- mitted to playing for the Oshawa Dodgers of the Intercounty Ma- jors, as well as his principal team, the Oshawa Legion juniors of the To r onto Leaside league. Playing second base, third base and left field with the Oshawa ju- niors, McConnachie has helped the team to first place overall with a 22-3 record. McConnachie has put together an outstanding season at the plate, hitting at a .4 31 clip while also leading the team in runs and on-base per- centage. "I'm a contact hitter, so I don't strike out too often," he says. This weekend, the top 20 junior squads in the province converge on Oshawa for the Ontario cham- pionships. The Oshawa juniors are picked to capture the Ontario title for a third year, after winning the provincials in 2002 and 2003. "There's a lot of pressure (to re- peat again), but we should be fine," he says. Oshawa opens against the Wa- terloo Tigers at Oshawa's Kins- men Stadium on Friday at 5:30 p.m. McConnachie has played 11 games with the Dodgers this sea- son, playing both second and third base. In those games, he's hit for a .390 average. His first commitment is to the Oshawa juniors, but, if they're eliminated from the provincials, he's more than ready to join the Dodgers, who are starting play- offs shortly. McConnachie says playing with the Dodgers and the Oshawa ju- niors should help him with the transition to college-level ball. "A few guys on the junior team and the intercounty team say the pitching here will prepare me for playing down south. It's pretty good, intense baseball here. They tell me if I can hit the ball here, then I should be able to hit in West Virginia," he says. McConnachie says Porter keeps in touch with him each week, asking about his progress, his training program and his diet schedule. "He's given me a lot of advice to try to get me prepared when I got down there. He's made me feel re- ally welcome." Pickering hurdler tops elite field PICKERING — Pickering Olympian Perdita Felicien con- tinues to show she's the one to beat in Athens next month. In less than a week, the two- time world champion chalked up back-to-back 100-metre hurdles victories at big European meets. Her latest came Tuesday at the DN Galan meet in Stockholm, Sweden. Running in rainy and slick conditions at the site of the 1912 Olympic Games, Felicien beat a field of Olympians in a time of 12 .61. Two Jamaicans -- Bridget Foster and Dellorreen Ennis- London -- finished second and third, respectively. Foster fin- ished second to Felicien at the 2003 IAAF World Track and Field Championships in Paris last August. The 23-year-old hurdler also won gold at the Gaz de France meet, part of the Golden League series of track meets, last Friday. Felicien posted a winning time of 12 .60 seconds. France's Linda Ferga-Khodadin finished with the silver in 12.78, while Ameri- can Jenny Adams was third in 12.84. The victory at Stockholm was Felcien's fifth win in a row at in- ternational competitions. Earlier this summer in Eugene, Oregon, she posted the world's fastest time in the 100m hurdles this year at 12.46 seconds. The time also represented a new Canadi- an record.
