Eyewitnesses to Wednesday’s deadly train derailment in Whit- by described a devastating scene, after two rail cars jumped the tracks just east of the Gar- den Street overpass, dropping massive metal containers onto the road and crushing a minivan below. Two women in the van - 36- year-old Kathleen Elizabeth Kel- lachan of Whitby and her 19- year-old niece Christine Mary Harrington of Keswick, the mother of a young son - were killed instantly, police said. “They would’ve had no chance of survival,” said Sergeant Paul Malik, Durham Regional Police spokesman. There can be little doubt that the consequences of the acci- dent could have been much worse with many other mo- torists on the road. Karl Euler of Pickering, for instance, had a narrow escape. “It was just overwhelming,” said Mr. Euler, who passed under the bridge just seconds before the fiery crash. Councillor wants regulations for animal operations By Danielle Milley Staff Writer PICKERING –Bill McLean wants Pickering to adopt a bylaw to govern pet shops after receiving numerous complaints about sick animals purchased from a local store. The proposed bylaw would reg ulate pet shops and kennels in Pickering and the City coun- cillor said it is very specific in what would be expected of the operations. It would regulate store condi- tions, appearance of the ani- mals, cage size and feeding, as well prevent owners from selling sick animals. It will also require owners to keep a record of ani- mals and forward a copy of that information to the City. “It’s a good bylaw,” Coun. McLean said. “It’s something I’d like to see the rest of the region adopt once we pass it.” He initiated the bylaw in the fall after receiving complaints from residents who had pur- chased pets from or visited Lucky Pets on Bayly Street. He said residents complained about the condition of the store and the state of the animals. People who had bought pets shared stories of expensive treatments for illnesses and ani- mals that had died. “My heart goes out to owners who purchased pets only to nurse them, sometimes to a tragic end,” he said. And unfortunately, says An- drea Maenza of Durham CAS, sometimes this allows for years and years of abuse unbeknownst to family and friends. “Nothing really jumped out and was that obvious,” says Ms. Maenza of the Blackstock child- abuse case, which saw two teenaged boys restrained with ropes and confined to pens creat- ed out of cribs and dog cages. “(The abuse) was hidden really well and no one really noticed what was going on and nothing was reported,” she says. “It was surprising in a way” that such abuse could go on unnoticed in such a small community as Blackstock, she adds. “It was quite subtle, it was hid- den quite well. The boys (aged 14 and 15 at the time of the parents’ initial arrest in June 2001) were convinced they were bad, they thought they deserved what was happening,” says Ms. Maenza, noting the youths sustained “emotional” trauma. “They didn’t have bruises, they didn’t have broken bones - it was more emotional abuse. They had no obvious wounds from what they endured.” These wounds are hard to de- tect but can be uncovered, ac- cording to CAS officials. “There are all kinds of things we suggest people keep an eye out for, such as the way a child behaves - that can manifest in a variety of different ways,” ex- plains Ms. Maenza. “If they’re ex- tremely shy, if they’re afraid of adults, men, women, people of a certain age group... just one of these things isn’t a sure sign of abuse, but a combination of them might be.” Other potential tell-tale signs of abuse may include efforts by parents or caregivers to withhold their children from activities with other students. “If (guardians) don’t allow chil- dren to participate in school ac- tivities such as after-school events or sports or class trips, that may pique the interest of some people,” says Ms. Maenza, again stressing “none of these are absolute, sure-fire indicators” of abuse. And, she emphasizes, the odd bump and scratch aren’t definite signs either. “Childhood is full of bruises; one or two injuries are logical, but not if they’re happening too often,” says Ms. Maenza, advising the public to “pay attention and be really sensitive” to the children around you. Professionals such as teachers, doctors, nurses and child-care of- ficials, however, “have a legal obligation, they are required to report” any suspected abuse cases. They can face charges for failing to report any neglect or mistreatment under the Child and Family Services Act, says Ms. Maenza. For everyone, though, “there is an expectation, almost a duty to report any suspicion of abuse,” she says. “You don’t have to have much details, you don’t need to know names and we won’t report who made the call (to CAS).” There is a chance, however, that if suspicions are correct and abuse is prevalent, those report- ing the mistreatment may have to testify in court during trial. And, if CAS officials investigate a call and no signs of abuse are found, Ms. Maenza stresses, “There’s nothing wrong with that. That means the kids are in a good situation. We rely on every- one out there - you’re our eyes. If you see something, let us know.” If anything positive came out of this incident, says Ms. Maenza, it is the potential for increased awareness of child abuse. “I really hope this case really sparked people across North Durham to what can happen to a child, what people can do to their children,” she says. “If you look at this case, in retrospect, there were a lot of red flags raised, but everyone thought there were good reasons for it.” • See editorial, Page 6 Cop museum needs help DURHAM –Interested in the his- tory of policing in Durham Re- g ion? By Carly Foster Staff Writer DURHAM –In the not-so- distant future, Durham’s diapers, paint brushes and Styrofoam could become steam and electricity. As part of its long-term waste-management plan, the Region is looking at in- cinerating its garbage. “What we create in Durham should be taken care of in Durham,” said Regional Chairman Roger Anderson. “We have to take care of our garbage, and the sooner we do it the better.” Durham’s trash, along with that of York Region and Toronto, is now part of the parade of refuse that’s hauled to Michigan each day. The move came after Yo rk’s Keele Valley landfill closed last summer. And, with a ban on open- ing landfill sites in Durham, the rising cost of cross-bor- der hauling and a goal to cut its garbage in half by 2007, the Region is taking the first steps toward an energy-from-waste facility. That first step is hiring a consultant to prepare a proposal for the Province to consider. If the proposal is approved, the Region will start an environmental as- sessment, which would probably take two or three years. Both processes will involve many meetings with the public, as well as pri- vate stakeholders. “This is just the first step in a long, long process,” said Cliff Curtis, Durham’s commissioner of works. “There are quite a few hur- dles to get through before we start talking to people.” Durham’s closest inciner- ator is in Brampton south of the 407, where 173,000 tonnes of garbage from Peel and Pearson airport is burned each year. “The main advantage of energy from waste (inciner- ation) is it extracts energy from residual garbage, making steam or electrici- ty,” said Peter Watson, manager of waste for the Region. “We can use it for lights in our office, to heat our homes, lights on our streets. “We get to use that garbage material as a re- source one more time.” Despite calls to various environmental groups in Durham Region, none could comment on the pro- posed incinerator. Early estimates on cost of the “state of the art” facility range from $75- to $150 mil- lion, Mr. Watson said, with a plot of land around 15 acres needed to build. No locations are being dis- cussed yet. It would be built big enough to possibly handle garbage from York, Scar- borough, Peterborough or Nor thumberland, although the Region has not ap- proached any of its neigh- bours. come from the store in the past few months had the highly contagious par- vovirus, which affects the intestinal tract of the ani- mals. Naji Majdalani, owner of Lucky Pets, said he has never knowingly sold a dog that was sick. “If somebody gives me a dog that has something and I sell it right away I don’t know (if it’s sick). That’s why I have the quarantine, to keep them for seven days before I’ll sell it,” he said. He added any store that sells hundreds of dogs is going to have a few sick animals. Wednesday morning the store looked to be in good condition with several staff members busy clean- ing cages and mopping f loors. Although the conditions for the animals (mostly puppies) looked crowded, they appeared in good condition. Most puppies had shiny coats free from matting. Employee Nick D’Souza explains this is what every morning is like, not just when the store is receiving unwanted attention. He defends his employer. “They don’t mistreat their animals,” he said. “I work here now, if they mis- treated their animals I wouldn’t work here.” He has three dogs and several other pets. Coun. McLean said on his own visits to the store he was upset with the con- ditions, including dirty cages. He said the reason be- hind the bylaw is not to single out the store but rather to protect animals and to make sure cus- tomers know the history of the animal they are pur- chasing. “I’m not here to put this g uy out of business,” he said. “I’m here to speak up for the people who con- tacted me and the animals who can’t speak for them- selves.” The bylaw is being circu- lated for input and is ex- pected to go to council in Febr uary. Mr. Moffatt, who served three terms on Scugog council includ- ing the last six years as mayor, was officially elected as chair- man of the Durham Regional Police Services Board during Monday’s board meeting. The former mayor, a 66-year- old retired businessman and ed- ucator, was a regional council representative on the board dur- ing the last term and was ap- pointed to the board as regional council’s community representa- tive last year. “It’s going to be a bit of a chal- lenge, there’s going to be a lot of interesting challenges ahead,” says Mr. Moffatt, who will hold the post for one year. He will sit on the board for a three-year term, but the chair is elected every year, explained the former mayor. Mr. Moffatt served as vice- chair of the board last year until September, when former chair Bob Boychyn left to pursue other interests. At that time, Mr. Moffatt was elected as interim chair and was given the official posting on Jan. 12 after he ex- pressed interest in the seat “be- cause I thought it was important for some continuity.” His bid for the chairmanship received unanimous support from the seven-member board. Over the next 12 months, Mr. Moffatt says he will keep a keen eye on the oversight role of citi- zen review boards and will also be looking into complaints filed against the Durham police ser- vice and its officers. Mr. Moffatt has also publicly acknowledged his interest in running for the Durham Federal Liberals in the next general elec- tion, which is expected to take place this spring. Incumbent MP Alex Shepherd has already an- nounced he has no plans to re- tain his seat. Also during the Jan. 12 meet- ing, Gale Mossman, an Ajax businesswoman and community volunteer, was elected vice- chairman of the Durham Re- gional Police Services Board. She has served on the board since May 2002 as a provincial appointee. Ms. Mossman will also lead the board’s governance committee. Other board members include Regional Chairman Roger An- derson (who will lead the board’s labour relations committee), Les Fisher, Bob Nicol and Regional Councillors Mark Holland and Joe Drumm. Did no one see the warning signs? How did this happen? All these questions and more are being asked across Durham Region this week, about the tragic child-abuse case in the ham- let of Blackstock. In retrospect, it's easy to say somebody should have noticed two teenage boys were being abused regularly by their adoptive parents and other immediate family members. For years, the adoptive parents beat, caged and tormented the two brothers, and yet the signs were ignored. Apparently, nobody questioned the appearance of the boys, most notably their obviously delayed social and physical devel- opment. These ‘red flags’ - which might have ended the abuse years before it was finally stopped - were missed by many teach- ers and doctors. To be fair, Children's Aid Society officials say the abuse, which was strictly confined to the boys' home, was well hidden and hard to detect. The family did everything in its power to keep the abuse a dirty little secret. This wall of silence is the reason the adoptive parents were able to continue to abuse these boys for almost 13 years. It was only when the family unit began to crumble that the abuse allegations were raised. It was this splintering that finally ended the torment of these boys, victims who thought they were at fault, that they deserved to be abused. Their mental state is tragic enough, beyond the physical abuse. Their family was to blame and will have to live with their guilt for the rest of their lives. One abuse case is too many, but Andrea Maenza of Durham CAS advises residents to pick up a phone when in doubt; that phone call could save a child's life. Callers can be assured of their confidentiality during the early stages of a CAS investigation, though it may not be maintained if a case proceeds to court. In this sickening incident, we can only hope the parents, who have yet to be sentenced, but who have pleaded guilty to charges of abuse, are punished appropriately. And we can only hope these boys survive and thrive now that they are free from the clutches of these monsters. Shots at Martha Stewart unfair To the editor: Re: 'Make her do hard time,’ Neil Crone column, Jan. 14. I've never read 'Martha Stewart Liv- ing' either, Mr. Crone. Finding that magazine in your bathroom tells me that somebody in your house likes it. So what if people wash their plant leaves? Lots of us do; it keeps the bug infesta- tion down. Threatening Ms. Stewart's physical safety is uncalled for. Your reference to strangling Ms. Stewart and using her "slowly stiffening body" as a table run- ner gave me the creeps. Puh-lease, show me the humour. If, as you say, in- sanity overtakes you while reading a magazine on the can, may I suggest you grab the laundry basket and sort the socks. Since they're not labelled, this should keep your mind busy. Get real. There is nothing offensive about organizing, simplifying, cooking, entertaining and creating. It's called living. And by the way, the criminal charges she is facing do not merit the punishment you suggest. Plotting a life after professional baseball, Nigel Wilson decided to put his energy, and his passion, not to mention his money, into a ven- ture that he's been thinking about - - make that dreaming about -- throughout his baseball career. His new direction will keep him at home in Ajax for the first time in a long while and, hopefully, help a new generation of local players enjoy the game as much as he did. A few weeks ago, Wilson proudly gave me the grand tour of his Home Run Baseball Academy at an indus- trial unit on Westney Road south. It represents the culmination of a life- long goal for the 33-year-old whose career has come full circle since playing his minor ball with the Ajax Spartans Minor Baseball Associa- tion. The outfielder made stops with Major League Baseball's To r onto Blue Jays, Florida Marlins, Cleveland Indians and Cincinnati Reds, before going to Japan to the Nippon Ham Fighters where he was home run king for several seasons. And, now, he's back in town, pur- suing a baseball school that he's al- ways had in the back of his mind, but was finally put into action after putting out e-mails to his old friend with the Toronto Blue Jays, Rob Butler, about his idea. Butler was immediately interested and it took flight from there. Although the spacious baseball facility was in the advanced stages of being completed at that time, it has all the trappings of a big-time indoor baseball facility. In the largest part of the unit, several rows of meshed batting cages, complete with pitching machines, are at the ready. On the one end, there's a set of bleachers. Over in the corner, he points to where a dugout will be built. In the office section, there's a pro shop area, office space, as well as a meeting/party room. Wilson notes his dream didn't come about without a lot of legwork and planning. He looked at many possible sites in which to launch his baseball academy, scouring Durham Region and east Scarbor- ough for three months to find just the right combination of office and playing space. His search led him right back to Ajax. "We looked at everything. We wanted to picture it and see if we could turn it into a major league fa- cility," says Wilson. Now open, the year-round acade- my has already prompted several teams from Toronto to head east to try out the new digs. Not only for baseball, but softball teams have also been signing up to use it since opening on Jan. 1. It opens officially on Jan. 29. Nigel Wilson reaches another dream Editorials &Opinions FRIDAY, JANUARY 16, 2004 ✦ News Advertiser ✦ DAVID STELL, NEWS EDITOR, 905-683-5110 EXT. 249 Editorial Letters to the Editor Al Rivett S t a f f e d i t o r The 30-year-old plumber was heading home from work, when his southbound truck passed the doomed minivan. “As soon as I got out from under the bridge I heard this bang and my truck jumped up in the air,” he said. “Then I saw smoke coming up from behind me like the smoke you saw when the World Trade Center fell.” Mr. Euler and another north- bound motorist rushed to the wreckage and tried searching for the victims before realizing they could not be rescued. “There was nothing left of the van, maybe just a wheel,” he said. CP Railway spokesman Paul Thurston said the accident occurred when three flat-deck rail cars de- railed as the westbound freight train approached Garden Street, just north of Dundas Street, at about 7:45 p.m. “It appears several containers left the track as the train approached the bridge. They slid down the em- bankment on the south side and en- tered the roadway,” said Sgt. Malik. “They sheared off the guard rail. Two of them ended up on Garden Street on the south side of the over- pass. Seven containers (from the cars) fell off the bridge,” he said. Flying debris struck a second ve- hicle passing under the bridge at the same time, but no one in that vehicle was injured and damage was minor, he said. The train cars were each carrying 10 to 14 trailer-sized containers - each between 20 and 40 feet long and weighed between 15 and 25 tonnes - which tumbled to the road in a heap of twisted metal. Local resident Derek Glass felt the impact of the crash and ran out of his home as the last three or four railway containers spilled over onto the street. “I ran down onto the road to look for victims because it’s a busy street,” he said. “At one point, I was underneath the bridge and had to duck back under because debris was still falling from it onto the road,” he said. “All I could see was the front wheels under the (railway) cars. I couldn’t tell if it was a car or van.” The accident sparked a massive, full-tier emergency response as dozens of police, CP Rail police, fire- f ighters, paramedics and other emergency personnel rushed to the scene. Garden Street was cordoned off and residents were told to stay in their homes due to initial, but un- founded, concerns of potentially hazardous materials on the train. “There was originally some con- cern about chemicals but it was de- termined there was no need for an evacuation,” said Sgt. Malik. Emergency personnel were kept back 100 metres from the point of impact as Whitby firefighters put out the fire sparked by the crash. Rescuers worked in -30 C temper- atures but were prevented from reaching the victims in the van due to the heavy debris from the train. Large cranes were brought in to remove pieces of the train cars and containers from the four-lane road and the embankment. The task began yesterday and is expected to continue for several days, police said. Brock Winter, vice-president of field operations for CP Railway, de- scribed it as a freak accident and promised an “aggressive investiga- tion” into the crash. “CP railway wishes to express our sadness and our sincere condo- lences to the family and friends of the two women. These two young women lost their lives in what can only be described as a most unusual railway incident,” Mr. Winter told a news conference yesterday at Durham police headquarters in Os- hawa. “It is a difficult day for everyone associated with the families (of the victims) and their communities, and indeed for everyone that Canadian Pacific Railway employs.” Train 239 was carrying 40 cars stacked with containers of various consumer products from Port of Montreal to Toronto when the last two cars derailed just east of the Garden Street overpass. The locomotive was travelling within the permitted speed limit of 50 miles per hour, or 80 km/h, said Mr. Winter. He said it’s too early to say what caused the derailment. “It’s premature to speculate. We don’t know the cause at this time. There is a comprehensive investiga- tion occurring and once we have the final results... we will obviously share those,” he said. For residents living near the tracks, who have had concerns about a disastrous train accident for years, their worst fears have been re- alized. Some said they had growing con- cerns about the safety of the over- pass, which is often used by children as a short-cut to nearby schools. Investigator Tom Griffith of the Transportation Safety Board, the lead investigative agency, said the investigation could take six months or more. Neither human error nor mechan- ical problems have been ruled out, he said. The Durham police collision inves- tigations unit is also conducting a parallel probe focusing on the traffic fatalities. Sgt. Investigation could take up to six months ✦ Investigation from page 1 Ajax hospital already meeting guidelines AJAX –New provincewide infection control standards won’t have a big impact at Rouge Valley Ajax and Pickering hospital. “At Rouge Valley we were already following some, if not all, of those directives to keep the community safe,” said Katie Cronin-Wood, direc- tor of communications. The new standards, which include require- ments for gowns, gloves and handwashing, are now in place at Rouge Valley’s two sites. Wo rk on the recently completed standards began in November by the Ontario infection controls standards task force and will be reviewed every six months. The task force gathered information from hospi- tals across the province, including Rouge Valley. The hospital shared how it handled both outbreaks of severe acute respirato- ry syndrome (SARS), Ms. Cronin-Wood said. Yet fireplaces continue to hold a special place in the hearts of Canadians for the ambiance and warmth they can provide on chilly winter evenings. Like many other household technologies, fireplace designs have evolved dramatically over the years. Perhaps the most popular option today is a well-designed, energy- efficient gas fireplace, which can be installed as a completely new unit or as an insert in the cavity of an existing wood fireplace. Today’s gas fireplaces produce a realistic yellow flame that mirrors that of a wood-burning stove. They produce fewer emissions than a conventional wood fireplace, are more convenient and safer to use, and are mess-free. Buyers should be aware, however, that not all gas fireplaces are equal. Some designs are extremely efficient, provide substantial heat and produce fewer greenhouse gas emissions. Others can be very inefficient and can cause indoor air quality problems. Fr om an energy efficiency perspective, look in the manufacturer’s literature for Canada’s EnerGuide Fireplace Efficiency rating-the higher the number, the better. Some units have ratings as low as 30 per cent, but the most energy-efficient units currently achieve ratings in the 50 per cent to 70 per cent range. Natural Resources Canada’s Office of Energy Efficiency publishes an information booklet that can help you make an informed choice about your new gas fireplace. The Government of Canada has issued a challenge to all Canadians to reduce greenhouse gases emissions. Choosing energ y-efficient gas fireplaces is one way to help reach that goal. The Pickering resident and cadet was named top pilot in Ontario upon completing his cadet power flight course last summer. The 18-year-old University of To ronto student has been a member of the Pickering Kinsmen Squadron for five years. The organization for 12- to 18 -year-olds teaches physical fit- ness, leadership skills and aviation. The Department of National Defence funds the program. Mr. Sirek had been involved in other organizations as a child and when the cadet program started in Pickering he jumped at the chance. “Since I was a small child one of my dreams was to be a pilot,” he said. Mr. Sirek achieved that dream in 2002 when he received his glider pilot’s licence. The course last sum- mer gave him his power pilot’s li- cence, so he can now fly a single-en- gine aircraft. “Flying in itself is an amazing thing because you’re above the Earth and in control of the aircraft,” he said. “There isn’t a lot of people around. It’s an exhilarating feeling.” Mr. Sirek tries to hit the sky at least once a month. He flies out of Oshawa airport and glides with the cadet pro- gram in Markham. His commanding officer Major Pauline Blight wasn’t surprised Mr. Sirek did so well in the course. “He is very diligent in making sure he does very well,” she said. “He is a very intelligent person.” Not only was he named top pilot in Ontario after the course, he also re- ceived an award for earning the top mark on the written Transport Cana- da test, for obtaining the top flight test results, and top overall perfor- mance. With that achievement com- plete, Mr. Sirek is now working on an- other goal. “I’ve always known I wanted to do two things in life: to become a pilot and become a doctor,” he said. “I’ve got one down and am working on the other.” Becoming a doctor is a fallback ca- reer for Mr. Sirek since he can’t be- come a commercial pilot because he wears glasses. He plans to do a lot of his medical training with the military. After retiring from the cadet pro- gram when he turns 19, he would like to become an officer and teach others how to fly. He’s taken a lot out of the cadet program and would like to give back. He also plans on buying his own aircraft one day. “I hope to have a plane with skis and pontoons so I can fly to my cot- tage,” he said. Losers of their last four in a row and now in the basement of the OHA Ontario Provincial Junior 'A' Hockey League's South Confer- ence standings, the Panthers be- lieve back-to-back outings against the Axemen could pull them out of their funk. "It's huge," says Panthers' head coach John Winder of the home- and-home series. "The games are going to be a real test for us. We're comparable teams. I know we're down near the bottom, but either of us can beat the other on any given night. We're hoping we'll win it." The first game goes at the Pick- ering Recreation Complex tonight (Friday) for a 7:30 p.m. faceoff, before the Axemen return the favour, hosting the second game at the Ajax Community Centre on Sunday at 3 p.m. Alas, the Axemen and Panthers are duelling for little more than bragging rights, not to mention the ignominious honour of not finishing last in the conference this season. This weekend's games also rep- resent the final contests in the six-game season series between the two clubs. So far, the meetings have resulted in a saw-off, with each team recording two wins. The Axemen (12-27-2-2 for 28 points) currently reside in eighth place in the South standings, one point ahead of the cellar-dwelling Panthers (10-24-7-0 for 27 points). Wins over Ajax on the weekend could position the Panthers a lit- tle better for the playoffs, which will get under way in mid-Febru- ary. But, they’re destined to draw a top seed from either the South Conference (St. Michael's, North Yo r k, Wexford) or from the North Conference (Aurora, Newmarket or Stouffville) in the first round of the post-season. The Panthers made one roster move prior to the league-wide trade deadline last week. The club has brought in former Trenton Sting netminder Brian Scher- mele. The Panthers recently brought in John DaPonte, a pick- up from the Brampton Capitals, but he has since been released to make way for Schermele. "He was the number-one goal- tender for Trenton (of the league's East Conference), but they picked up a goaltender from the (Ontario Hockey League)," says Winder, who plans to start Schermele tonight (Friday) at home against the Panthers. The Pickering juniors came off a weekend that included losses to the Thornhill Major Islanders (6- 5) and the St. Michael's Buzzers (11-2). The setbacks had the net effect of putting the juniors in the conference cellar. With the loss to St. Mike's, the juniors dropped the season series to the Buzzers, losing all four meetings. Including this weekend, the Panthers have eight games re- maining in the regular-season schedule.
