Dr. Douglas F. Waller, 59. surrendered to detectives at Durham Regional Police head- quarters late Thursday after- noon. He was charged with four additional counts of sexual as- sault and two counts of sexual exploitation. The latest charges come in the wake of new complaints from four more former male paticnts. Police said the alleged vic- tims, men and boys who were aged 16, 17. 19 and 35 at the time of the incidents. Durham school board butts out teen smoking ban push A proposal that Durham's public school board lobby the Province to make it illegal for young people to smoke has gone up in flames. Despite protests from Pickering Trustee Paul Crawford, who sug- gested the Durham District School Board write Queen's Park, standing committee chairman Bobbie Drew recommended the board postpone the issue indefinitely. Her motion passed 6-4. Trustee Crawford wanted the board to urge the Province td amend the Tobacco Control Act so it would be illegal for people under 19 to smoke unless they did so on private property with the owner's consent. That Act currently outlaws the purchase of cigarettes by under- age teens. But, most trustees felt the issue is outside the board's mandate. Trustee Crawford maintained the board had followed "incorrect" procedure since an ad hoc commit- tee charged with coming up with a letter for the board to review never did. Instead, the committee also recommended the letter be post- poned indefinitely. "My point is on procedures;' he said. ' The committee was given a task and that motion and the actions that follow it have to be complet- ed." The assaults allegedly took place in Dr. Waller.S office at the Oshawa Clinic between 1989 and 1997. Three of the four former patients arc from Oshawa. while the 17 -year-old is from Port Perry, police said. Dr. Waller, of Pickering. was arrested last July after a 13 -near -old Whitby boy told police he was sexually assaulted in The Bay's washroom at the Oshawa Centre. In the wake of media re- ports about the case, six other alleged victims filed complaints with Durham's sexual assault squad alleg- ing sexual acts including fondling and fellatio were performed during medical visits. Those allegations span a period from 1987 and in 1998. After his arrest Thurs- day. Dr. Waller was re- leased on the bail terms previously granted by a justice of the peace. Under court -imposed conditions restricting his medical practice, he is per- mitted to work at Lak- eridge Health Oshawa, but cannot examine patients unless they are accompa- nied by an adult at least 21 years of age. In total, he is now charged with 11 counts of sexual assault, three counts of sexual exploitation and one count each of indecent assault on a male and sexu- al interference. A ban on publication imposed at the original bail hearing prohibits the publi- cation of any details about the case. Clarence Charles Jones, 22, is charged with attempted murder and ag- gravated assault in connection with an attack last November on 47 -year-old Iain Thomson. Following a pretrial in the judge's chambers Wednesday, assistant Crown attorney Susan Stothart and defence counsel Christophe Preobrazenski both suggested Mr. Jones be sent for an as- sessment before the charges are ad- dressed. The accused had earlier indicat- ed he wished to plead guilty, but Justice Norman Douglas agreed not to accept the man's plea and instead ordered him to undergo a 30 -day assessment before returning to court. "In terms of the allegations them- selves they appear to be motiveless, or out of the blue;" Ms. Stothart said in rec- ommending an assessment. Mr. Preobrazenski said there was no history of trouble between his client and Mr. 'Thomson prior to the Nov. 20 inci- dent and added Mr. Jones also wants some help to explain his actions. The desire for an assessment "is def- initely coming from within (Mr. Jones)," Mr. Preobrazenski said. "He wants to understand why he did this." At the time of the attack, Mr. Jones was serving a 90 -day sentence for pos- session of stolen property. Mr. Preo- brazenski said while his client has a his- tory of committing property crimes "he's never hurt anyone before. "He truly wants to deal with this and get on with his life:" Mr. Thomson was taken to the Guelph General Hospital for treatment of a serious wound to his neck, then transferred to Hamilton General Hospi- tal where he was initially listed in criti- cal condition. However, that meeting has been cancelled because the Region is still waiting for information from the provin- cial government regarding downloading costs, reports Oshawa Councillor and fi- nance committee chairman Brian Nicholson. He explains the commit- tee can't make any decisions on the budget until the Province comes through with those figures. "We have no control over those numbers." he said in an interview following Wednes- day's council meeting. Coun. Nicholson noted if the Region saves money on provincial downloading this year the budget process will be relatively easy. '111 Province's numbers will tell us how quickly (council can complete the process)," he said. Those figures, which will outline the Region's share of social assistance, social housing and GO Transit costs, will also determine whether taxes go up or down j this year. The Province will decide whether the people of Durham get a tax hike or not," said Coun. Nicholson. Durham raised its share of property taxes by 1.4 per cent last year and in January had proposed a 1.5 -per cent tax increase for 20(10. But, the Region is now aiming for a zero -per cent tax hike this year. "We're still in line for a maximum zero tax hike," Coun. Nicholson reported. "If the Province does not beat us up again financially there's no doubt in my mind we'll have a zero -per cent tax hike or even a tax reduction. But if they sec: us as a cash cow, as they have in the past, that will force a tax hike." Congratulations! "I just felt I had to do this;" says long-time family friend Linda Higgins. The Pickering resident says her husband has known Ms. Lubsey's father all his life and the families are best friends. Like her many friends in Ajax and Pickering who fondly remembered Ms. Lubsey, Ms. Higgins was shocked to learn of her death. "She used to call me Aun- tie Linda, she was such a sweetheart," she says. "Every time I think about it I can't believe it." Ms. Lubsey had returned to her native Jamaica with her family last September for an extended visit. Regional Municipality of Durham, Various improvements are being considered to improve the pavement condition and operation of Highway 7, consistent with current Ministry of Transportation standards, policies and practices for 2 -lane highways. The major improvements to Highway 7 are anticipated to consist of: • pavement rehabilitationiresurfacing: • geometric improvements: • intersection and operational improvements (including traffic sinal system removal and replacement at Lakendge Road, new ir.S is sgnats at Wes" Road and realignrnent and signalization of Ashburn Road); • electhcaltillumirwtion upgrades: • provision of a westbound and an eastbound truck climbing lane; • drainage improvements inducing minor structural repairs to crossing culverts: and • rehabilitation of the asphalt riding surface of the East Duffin Creek structure. The proposed improvements to Highway 7 will be completed within the existing Highway right-of-way. No additional property wit be required. The Study was corttpleted in accordance with the approved process for Crass Environmental Assessments for Provincial Transportation Facilities, 1999, (Group 8). The Transportation Environmental Study Report has been completed and placed on the public record with the Ministry of the Environment for public review and comment. Election not needed in near future Liberals still have plenty to do during this mandate Depending on your perspective, the rumour the Liberals are pianning to hold a fall federal election is either completely foolish or totally arrogant. They haven't even hit the three-year mark in a mandate which can stretch up to five years. and there's rampant speculation we'll be sent to the polls before the snow flies. Why? It would be a foolish decision be- cause opposition parties will argue the election is unnecessary, a waste of money and a naked grasp for power by the ruling party. It comes across as an arrogant no- tion since voters have been known to punish majority governments which jump the gun before they've spent four years in power. Finance Minister Paul Martin and Mr. Chretien must get to- gether before the next federal budget to send more funding to the provinces for health care. The Peds must show us they have some idea about where our money is going. The Auditor -General has once again pointed out billions go a -wasting and the government still has to deal with the unresolved fallout over missing funds from the Human Resources de- partment. Hiking and other forms of walking remain the favourite recreational activity of Canadians everywhere, not surprising con- sidering such factors as cost, ac- cessibility and ease. But those same factors and others are also changing the face of recreation for people in Durham Region and the rest of the nation. As the population grows older, people are increasingly trading in their hockey sticks for golf clubs, football helmets for hiking bots or tennis racquets for gardening gloves. "The great thing about leisure and recreation is it's different things to different people." says Barry Read, who has taught a course on Canadian sports history at Durham College for the past 14 years. "The folks who were run- ning or playing racquet sports in the seventies, or weightlifting in the '80% might be playing golf today." According to a 1998 physical activity monitor done by the Canadian Fitness and Lifestyle Institute, walking remains the most popular activity among adults over 17, with 86 per cent participation reported in both Canada and Ontario over the pre- vious year. "Generally speaking, people's interest in trails is something we hear about a lot," says Morrow, who has held his post since 1986. "There's a constant need for trails." One of the more popular areas for people living in lakefront communities in Durham Region is the Waterfront Trail, which was developed six years ago. "Without a shadow of a doubt, that trail is used year-round when its accessible," says Morrow. Walking aside, Canadians re- main generally inactive. The 1998 study revealed 63 per cent of adults in Ontario were considered insufficiently active for optimal health benefits. The number has improved from 79 percent in 1981. "Certainly more and more people are conscious of physical fitness, health and diet," says Port Perry resident Bill Derby, who worked at Durham College from 1968 to 1988 and helped start the sports administration program. "I tend to think more people are getting involved in lifetime sports, especially young people." The need for an improved, level of fitness was first recog- nized by the Canadian govern- ment in 1943, when the Physical Fitness Act was passed. It ended up being implemented to a limit- ed degree by the provinces through the school system. . "That was the result of a lot of unfit recruits for wartime," says Read. "The intent was great, but it didn't translate into results." Four decades later, the 1981 health and diet Canada Fitness Survey was the First study of physical recreation habits and health status of the en- tire population. Among its find- ings were: • 11.5 -million Canadians (51 per cent of those over age nine) were physically active (three hours per week, at least nine months per year); Golfing, cycling and swimming are all expected to experience growth in popularity over the next 25 years • Men and women were equal- ly active, a change since 1971 when men were more active; • Walking was the favourite activity. followed by bicycling, swimming, jogging and garden- ing; The study also determined that 78 per cent of Canadians wanted to increase their participation lev- els, recognizing the importance to physical and mental well- being. Acting on orders from region- al politicians the board shaved the budget during a closed -door session of Thursday's monthly meeting at Whitby Town hall. "We believe we can spread the pain of the $807,000 across the budget... Various individual squads and projects will all feel some pain, but we won't have to close down any operations," 1999 Chief Kevin McAlpine told re- porters when questioned how the budget was trimmed. The force recently presented Durham Regional Council's fi- nance committee with a budget of just over $72 million, but was told it was too high. Most departments have been told to hold the line this year but the police force was allowed to increase spending by 0.5 per cent, due to staffing require- ments. The force budget includes a plan to hire 20 new officers in this, the third year of a five-year staffing plan designed to reduce the department's ratio of citizens to police to 750 residents for every officer from 790 to 1. The department says it also needs more money to build a new police station in Whitby. The budget -cutting won't impact on a $500,000 plan to operate a year-round police helicopter, which the force plans to buy or lease. Keynote speaker Phyllis Gordon, commissioner of the Canadian Human Rights Commission, noted that technological tools like the Internet are helping incite racism and hate today. But. The program, which includes dental treatment for people on income support and a screening initiative aimed at all school -aged children, is currently ad- ministered by the Region and the On- tario Dental Association, reports Brock Councillor and Durham health and so- cial services committee Chairman Larry O'Connor. The Region looks after the adminis- tration of 70 per cent of the program while the ODA is responsible for the re- maining 30 per cent. But, the Region passed a resolution last December to end its contract with ODA and assume full responsibility of the program April 1. However, after hearing concerns about that decision from area dentists Wednesday, Oshawa Mayor Nancy Dia- mond said she'll introduce a motion to rescind that resolution on April 5. Dr. Jack Cottrell, who addressed council on behalf of Durham dentists, asked politicians to revisit their earlier decision and call for tenders on the ad- ministration of the program_ He maintains ODA can administer the program at a lower cost to taxpayers. And, although the Region reports the administrative changes will be cost-neu- trai, Dr. Cottrell contends there's no evi- dence to support that. ODA "could ad- minister all Ontario Works dental ser- vices for a total a cost of $35,000" Coun. O'Connor reports the cost for the Region to administer the entire pro- gramis estimated at approximately $40,000. He argued, '"I'here is no need for an administrative function being handled here to go through a (Request for Pro- posals) process... Why wouldn't we do it in house when we have the ability to do it in houseT' But, Dr. Cottrell questioned, "How much more money will be diverted from dental treatment to administration'1" However, Coun. O'Connor said, "By keeping it in house, there is a level of ac- countability that only happens when there is a publicly -elected body (admin- istering the program)" If Coun. The game is scheduled to start at 7 p.m. on the Delaney Pad. The Lightning may also play the Russian national squad on Saturday, April 1.
