In a decision that has "devastat- ed' the loo law enforcement com- munity, the province's Special Inves- tigations Unit concluded there are "reasonable grounds" to believe the officers involved in the Dec:. 28. 1998 shooting are "criminally re- sponsible for their actions;' said SIU Director Peter Tinsley at a press con- ference Wednesday in Toronto. The most serious charge was laid against York Regional Police Con- stable Randy Martin. He has been charged with second-degree murder 44, who was shot at least three times and died in front of the family's rural home. "I've concluded that he intended the death of Tiny Romagnuolo;' Mr. Tinsley told reporters. 'lliere was an intentional application of force which could reasonably he expected to cause death" It is the first time: in the nine-year history of the SIU that it's laid a mur- der charge against a subject officer. The teachers' union recently released the results of a provincewide survey of Catholic schools that indicates the "vast majority" of On- tario Catholic students are in classes that are larger than the aver- age size set out by the Province in Bill 160, says Mike O'Connor, president of OECTA's Durham elementary unit. The OECTA sur- vey found 60.1 per cent of elementary students and 65.1 per cent of secondary stu- dents are in classes that exceed the aver- age class sizes re- quired by the govern- ment. Under Bill 160, school boards were required to ensure board -wide aggregate average class sizes of 25 in elementary schools and 22 at the secondary level. But, the union maintains aggregate averages "impose no limits on class size" and "are no guardian of educational quali- ty.. According to OECTA's survey, the average class size in Durham's elementary schools is 25.33 and 22.34 in the region's secondary schools, Mr. O'Connor says. He notes the sur- vey results did not in- clude responses from all of the school board's teachers. But, "A survey based on incomplete information is rather faulty," says separate board director Grant Andrews, noting the board released its re- port on class sizes last December which indi- cated it met the Province's new re- quirements set out in the Education Quality Improvement Act. That report stated the average class size at separate elementary schools in Durham is 24.57 while the aver- ... .+ 014 . age in area high schools is 21.71. And while those figures were calculat- ed last fall, Mr. An- drews says even if students moved into the board throughout the year, "I really doubt that there would be any significant dif- ference." Children are taught at an early age not to play with matches or set tires. Yet, every year at about this time, grass fires break out all over the region. In the pact week dozens of fires have been reported across Durham. It's not just youngsters at fault. however. Some adults, thinking they have the situation well in hand, decide to start their own 'controlled' burn. While it's never OK to light fires with- out first securing a permit and permis- sion from the local fire department. many 'controlled' hums become un- controlled in a hurry as factors like wind and weather conditions cause a fire to spread. Each local fire chief puts out the words of warning every spring. Yet, each week reports come in of grass fires burning away. What's needed is a bigger threat to those who choose to start their own blaze. Ontario fire regulations do not allow for 'controlled' burns. A permit and permission must be secured. How- ever, those who do burn without rc- ceiving the go-ahead from the fire de- partment are subject to fines and charges depending on the severity of each blaze. In Uxbridge, for instance, violators are charged $3OU per hour for each fire truck called to a burn and $150 per half-hour after the first hour for each truck. There may be additional costs attached to fighting a non -allowed fire. Other Durham municipalities also have regulations against burning with- out permission and one is currently considering penalties for reckless fire starters. Perhaps a region -wide policy will come into play eventually, especially when and if municipal fire depart- ments are amalgamated into one re- gion -wide department. For now, however, those tempted to burn off grass and refuse should under- stand there will be a penalty to pay if they're caught lighting up or if their fire gets out of control. The only common-sense approach to take is to follow the advice your mother, teachers and the fire depart- ment gave you when you were just a child: don't play with matches and learn not to burn. We border the hydro corridor on the north. The original location for the hydro lines, at the south of the corridor, was a concern but did not directly impact us. The fall -hack option to move the lines to the cen- tre of the corridor now impacts res- idents on both end; of the corridor. Pickering council must under- stand that the final location of the hydro lines within the corridor is not the issue. The fact council is considering this is the issue. Less than 60 years ago people like you and 1 left their families by the thousands. They sailed over rough oceans, endured seasickness, and were shot at the minute they landed on the beaches overseas. While I was not there, I can safely speculate the questions being asked once Adolph Hitler began invading country after country. How could any- one let this go so far? Why didn't someone do something sooner to stop this lunatic? Being raised in a home of parents who survived the horrors of the war and having experienced first-hand the destructive forces of a dictatorial regime (I spent six uncomfortable weeks in Communist Poland and Czechoslovakia in 1971), I am, per- haps, more sensitive to the warning signs of dictatorial ways than most. So impressed was I by that visit that I = ' Henry <- - Zaczek Opinion Shaper made myself a promise to do whatever I could to fight preemptive battles to preserve my freedom long before the need for bloodshed ever emerged. While today's media have no claim to sainthood, many of today's preemp- tive battles are fought by people such as Terry Milewski. If not for this dis- tinguished reporter, few Canadians would know how Prime Minister Jean Chretien defended fellow dictator Suharto's ego at the expense of Cana- dian protesters' physical well-being. What many people still do not know is the disciplinary action taken by the CBC against Mr. Milewski. The man- agement of the federally -funded broadcaster decided to play politics and issued him a suspension, without Pay. Officially, they took objection to his alleged e-mail reference to the current federal government as being the "force of darkness". It is my opinion that their reason had everything to do with the fact that Mr. Milewski was relentless in reporting on the infamous pepper spray incident. Whatever the words, Mr. Milewski as a Canadian citizen was fighting for his country's freedom now, long before Mr. Chretien's gang paves the way for future generations of Suharto clones. So, before this Opinion Shaper's column is deemed to be "illegal" by the governing Liberals, ask yourself this: Compared to the bullets that our brave veterans faced, how hard is it for you to write to your local or national newspaper and demand that Mr. Chre- tien and the CBC publicly apologize to Mr. Milewski? Anything less leaves the door wide open for today's dicta- tors to chip away at those cherishec freedoms for which so many gave up their lives. Pick - . Fr—. improving the "downtown" core. Adults walk the corri- dor and use it for fitness. Relocation of the hydro lines from Kingston Road will compro- mise these communities, bringing numerous poles and low-lying lines, causing culling of mature trees which enhance the area. , Relocating the Kingston Road lines to this corridor would be a had decision. Council must not allow it. 'Members of council appeared to j be uninformed about the impact on the Maple Ridge and Enclave com- munities and the options open to council. We ask that council recon- sider all optionsdiscussed at the March 6 meeting before proceed- ing any further. Those options: a) Bury the lines along Kingston Road as part of the downtown im- provement project; b) Relocate the existing lines to the corridornorth of the Maple Ridge and Enclave communities and string the lines down the exist- ing Brock Road poles; c) Bury the lines in the corridor. Burying the lines along Finch Avenue as that road is widened was not discussed at the meeting. This option may resolve many of the is- sues that currently exist. Council, while moving forward on projects to improve other areas, appears willing to compromise the esthetics of the Maple Ridge and Enclave communities. This is dis- turbing. We border the hydro corridor on the north. The original location for the hydro lines, at the south of the corridor, was a concern but did not directly impact us. The fall -hack option to move the lines to the cen- tre of the corridor now impacts res- idents on both end; of the corridor. Pickering council must under- stand that the final location of the hydro lines within the corridor is not the issue. The fact council is considering this is the issue. While I was not there, I can safely speculate the questions being asked once Adolph Hitler began invading country after country. How could any- one let this go so far? Why didn't someone do something sooner to stop this lunatic? Being raised in a home of parents who survived the horrors of the war and having experienced first-hand the destructive forces of a dictatorial regime (I spent six uncomfortable weeks in Communist Poland and Czechoslovakia in 1971), I am, per- haps, more sensitive to the warning signs of dictatorial ways than most. While today's media have no claim to sainthood, many of today's preemp- tive battles are fought by people such as Terry Milewski. If not for this dis- tinguished reporter, few Canadians would know how Prime Minister Jean Chretien defended fellow dictator Suharto's ego at the expense of Cana- dian protesters' physical well-being. What many people still do not know is the disciplinary action taken by the CBC against Mr. Milewski. The man- agement of the federally -funded broadcaster decided to play politics and issued him a suspension, without Pay. Officially, they took objection to his alleged e-mail reference to the current federal government as being the "force of darkness". It is my opinion that their reason had everything to do with the fact that Mr. Milewski was relentless in reporting on the infamous pepper spray incident. Whatever the words, Mr. Milewski as a Canadian citizen was fighting for his country's freedom now, long before Mr. Chretien's gang paves the way for future generations of Suharto clones. So, before this Opinion Shaper's column is deemed to be "illegal" by the governing Liberals, ask yourself this: Compared to the bullets that our brave veterans faced, how hard is it for you to write to your local or national newspaper and demand that Mr. Chre- tien and the CBC publicly apologize to Mr. Milewski? Anything less leaves the door wide open for today's dicta- tors to chip away at those cherishec freedoms for which so many gave up their lives. Pick - . Fr—. improving the "downtown" core. However, there is no value to Pickering if counciloc compromises the esthetics of exist- ing communities in the press. Maple Ridge and the Enclaves arc two of Pickering's most highly Th regarded communities. e homes have some of the highest market values in Pickering. The number of homes here has grown significantly and two sc:hoxols now border this hydro corridor. Children play in the corridor and use it to get to and from school. Adults walk the corri- dor and use it for fitness. Relocation of the hydro lines from Kingston Road will compro- mise these communities, bringing numerous poles and low-lying lines, causing culling of mature trees which enhance the area. , Relocating the Kingston Road lines to this corridor would be a had decision. Council must not allow it. 'Members of council appeared to j be uninformed about the impact on the Maple Ridge and Enclave com- munities and the options open to council. We ask that council recon- sider all optionsdiscussed at the March 6 meeting before proceed- ing any further. Those options: a) Bury the lines along Kingston Road as part of the downtown im- provement project; b) Relocate the existing lines to the corridornorth of the Maple Ridge and Enclave communities and string the lines down the exist- ing Brock Road poles; c) Bury the lines in the corridor. Burying the lines along Finch Avenue as that road is widened was not discussed at the meeting. This option may resolve many of the is- sues that currently exist. Council, while moving forward on projects to improve other areas, appears willing to compromise the esthetics of the Maple Ridge and Enclave communities. This is dis- turbing. A third officer, York Constable Michael Hoskin, is charged with as- sault with a weapon and careless use of a firearm. They were informed Monday they were to be charged and, in a move which has infuriated the lawyer representing Const. Robins, warrants were issued by the SIU for their arrests Tuesday. ..It was absolutely unnecessary and unjustified;' said an angry Harry Black, "and probably, in my opinion, there was no legal basis to obtain ar- rest warrants for any of these men:' Const. Robins surrendered, along with the two York officers, at SIU of- fices in Toronto at 9:30 a.m. Wednes- day. A former York Region officer, Const. Robins transferred to the Durham Region department in 1992 and worked in 26 Division, assigned to general patrol, at the time of the shooting. He is currently assigned to light duties. His lawyer said the officer is "devastated" by the allegations. "He's obviously had better days than today, but he will have better days when it's over:" Mr. Black said. "He has go( a huge amount of support from his wife, his family and the per lice association" Indeed, in a powerful shorn of support of their accused colleagues, dozens of York and Durham police officers were present at separate bail hearings in Oshawa and Whitby for the three officers. The criminal division of the Crown Law Office of the Ministry of the Attorney General has taken over the case and assigned two prosecu- tors, John Corello and Howard Lei- bovich. During the 20 -minute bail hear- ing, lawyers for the two officers waived a reading of the charges and Mr. l,eibovich read a summary of the allegations against them. A publication ban prevents re- porting the details. Cons[. Robins was released on $5,M) hail, without a deposit, and his wife Patricia signed as surety. Const. Hoskin's hail, meanwhile, was set at $50)1), though he was re- leased on his own recognizance, without a surety. Several conditions were attached to their release, granted by Justice of the Peace Brenna Brown. They must surrender their passpcxts to the SIU, they must not associate with one an- other, nor with members of the Ro- magnuolo family, and they must not possess a firearm, ammunition or ex- plosives. Both officers have been re- assigned to administrative duties. They will appear in court on May 3. Those in attendance included Durham Chief Kevin McAlpine, who quietly exchanged words in the courtroom with Mrs. Romagnuolo, and later gave a statement to re- po ners outside the courthouse. "I just expressed our condolences to the family. This is a tragedy and no matter who is responsible, their fam- ily has had a tough time, as have (members of the force)," said the chief. "She thanked me:" Chief' McAlpine said the "tragic events" have had a "devastating im- pact' on the officers involved, their families and the Durham department - "This has probably changed their lives forever." The chief said he spoke personal- ly with Const. Robins and has "as- sured him that he has our full support and continuing confidence as the court process unfolds:' Asked about the impact on i morale of police offices in the wake of the charges, Chief McAlpine said "certainly the circumstances are dif- ficult to deal with in terms of mem- bers focusing on our work," but he expects officers will not change the way they do their jobs. This much has already been made public about what took place at the 17 Sidcroad home the night of Dec. 28. Constables Martin and Hoskin, accompanied by Durham Region constables Robins and Nancy George, named by the SIU as a "wit- ness officer;' went to the Romagnuo- lo's Sunderland home to investigate threats allegedly made against Const. Hoskins by Enzo Romagnuolo - the oldest of the family's three sons. In minutes, things went horribly wrong- Const. Martin was wounded by a bullet from his own gun. Tony Romagnuolo lay dead on the pave- ment and his 17 -year-old son Rocco seriously wounded. A tight-lipped Mr. Tinsley refused to say what led officers to pull their autornatic handguns from their hol- sters. But police sources have sug- gested the sudden appearance of the family dog, reportedly edly a pithull. may have caused the officers to draw their guns. They also included a Crown attor- ney suggestion that Enzo grabbed for an officer's gun and a defence lawyer's assertion that Rocco was "thrown to the ground" and 'just simply shot- by an officer. Enzo is charged with uttering threats, assault causing bodily harm and assault with intent to resist arrest. According to the SIU, three of the officers, all except for Const. George, discharged their 40 -calibre semi -au- tomatics service pistols. There were no guns found in the Romagnuolo home. The bullet that hit Const. Martin's nose left a wound that required 30 stitches to close, Rocco Romagnuolo was hit in the abdomen by a single bullet and has had to undergo several operations. Bail for officer charged with'murder SY LESLEY MCMASTER Staff Writer The fust police officer ever to be charged with murder by a Special Investigations Unit plans to "vigor- ously defend" himself. At a hearing in Whitby court Wednesday, York Region Constable Randy Martin was released into the custody of his wife, Nancy, on $10,000 bail. He faces a charge of second-degree murder in connec- tion with the December shooting death of Sunderland contractor Tony Romagnuolo. Among the conditions of his re- lease were that he have no contact with Durham Regional Constable Nancy George, a witness officer in the incident, and any members of the Romagnuolo family. He was also ordered to have no contact with or possession of any firearms, ammunition or explosives. Crown attorneys pointed out Mrs. Martin is also a police officer. It isn't the first time the 14 -year veteran has been probed by the province's SILT for shooting a civil- ian. In 1992, Martin was cleared by the SIU in the shooting of a Keswick man, who was wounded after he threatened his neighbours and Const. Martin with a firearm. In that case, the accused actually apologized to Const. Martin for forcing him to fire his weapon prior to the SIU ending its lengthy inves- tigation without laying charges. After Wednesday's bail hearing, defence attorney Brian Greenspan told reporters his client was "look- ing forward to having the opportu- nity to vigorously defend the charges" Mr. Greenspan refused to specu- late on what the charge could mean for police officers in the future, but said Const. Martin's family "is opti- mistic and looks forward to the truth emerging. "It would be premature to say anything more at this point" Const. Martin is one of three po- lice officers - two from York Region and one from Durham - facing charges in the Dec. 28 incident. Those charges were announced this week. Officers called on the Romagn- uolo home in Sunderland to talk to the family's eldest son Enzo, 20, about an alleged threat he made against one of them. Within min- utes, the incident turned ugly with Tony Romagnuolo, 44, fatally shot, his 17 -year-old son Rocco seriously injured and Const. Martin wounded by a bullet from his own gun. In the championship game, the Panthers dropped a 3-1 decision to Whitby. Taylor Gray scored the only goal, assisted by Bobby Clark. The OHA Ontario Provincial Ju- nior 'A' Hockey League East Confer- ence champs were swept in the best - of -seven league semi-final playoff series by the Bramalea Blues. The Western Conference titlists delivered the knockout punch with a 2-0 victory over the Panthers at the Pickering Recreation Complex. Bramalea will play the winner of the Collingwood Blues -Milton Mer- chants series in the league's hest -of - seven championship final. Milton currently leads that semi-final series three games to two. Once again Tuesday night, the Panthers threw everything but the kitchen sink at the Blues in an at- tempt to get hack in the series. This time, outstanding goaltending by Bramalca's Nathan Marsicrs kept the Panthers from inflicting any damage on the Blues, who were outplayed and outshot 40-24. "Marsters played an excellent game for them;" conceded Panthers' head coach Rod McGillis. "He was making the stops for them. He was the difference for them.
