Two charged in guard’s murder Roy Jones was shot dead only days before testifying in robbery case BY STEPHEN SHAW Staff Writer DURHAM — Two men ac- cused of a home invasion robbery have been charged with murder and conspiracy in the slaying of Crown witness Roy Jones, who was gunned down three days be- fore he was scheduled to testify. His killers ambushed Mr. Jones, the 28-year-old security supervisor at Pickering’s Metro East Trade Centre, the night of Feb. 4 as he was walking to his Twilley Lane home in Ajax, where he lived with his parents and brother. Mr. Jones was chased by his attackers onto Pickering Beach Road and shot several times just metres from the home, Durham Regional Police said. The killers fled on foot and Mr. Jones was left for dead in the middle of the road, where his par- ents discovered him a few mo- ments later. Mr. Jones was scheduled to testify as a prosecution witness on Feb. 7 at a preliminary hearing in the home invasion trial of Cosmo Joseph Jacobson, 26, a Pickering man who also goes by the name Avi Mundy. At the time of the murder, Mr. Jacobson was free on bail on 11 charges stemming from the June 16, 2000 robbery and forcible confinement of a 47-year-old Pickering mother and her son in their Major Oaks Drive home. Police reports at the time said the victims were bound with duct tape, pistol-whipped and hand- cuffed by three masked men, one with a handgun. They took the woman’s bank cards and forced her to reveal her personal identi- fication number. After an intense six-month in- vestigation by a team of 14 police officers, Mr. Jacobson, who has been held at Whitby Jail since Feb. 7, was charged late Thurs- Pickering beaches get thumbs up PICKERING — Seven of Durham’s 16 public beaches were posted as unsafe for swimmers this week because of high E. coli bacteria levels. The Durham Region Health Department takes weekly water samples throughout the summer and is advising swimmers to stay out of the water at Rotary Park and Pickering Beach, both in Ajax, Lakeview Beach East and West in Oshawa, Elgin Pond in Uxbridge, Kinsmen Beach in Scugog and Bowmanville West in Clarington. The water’s fine for swimming at Frenchman’s Bay West and East in Pickering, Whit- by Beach East, Newcastle Beach Central and Bowmanville East in Clarington, Beaverton North and South Beach and Thorah Centen- nial Park in Brock and Lakeside Beach in Scugog. The Region does not close beaches, but recommends swim- mers look elsewhere for recre- ation. Pickering politicians voted in May to defer a de- cision on the Notion Road Land Use and Urban De- sign Study until the Town of Ajax had dealt with the joint report. Ajax council approved the study earlier this sum- mer. Pickering and Ajax joined forces in 1998 to conduct the study of No- tion Road, which forms part of the boundary be- tween the two communi- ties. The decision to do a study came after J&F Waste Systems proposed the construction of a waste transfer station at 57 No- tion Rd. The company eventually scrapped the idea. The study recommends land use designations and policies to guide future de- velopment within the No- tion Road area. Among the recommen- dations proposed are: re- zoning lands on the east side of Notion, in Ajax, to prestige industrial from heavy industrial; and set- ting up a working group to encourage land stewardship and site improvements. In Pickering, staff are recommending the lands be rezoned on the west side of Notion Road, in Pickering, to allow for a range of land uses, including some in- dustrial, office and com- mercial space. Pickering’s planning committee will consider the staff recommendations for the area at its meeting Sept. 10. Copies of the staff re- port can be obtained from Pickering’s clerk’s depart- ment at the civic complex as of Sept. 7. City council is expected to consider the issue on Sept. 17. Health department goes to the top for help as testing of drug-resistant E. coli strain could come to an end Monday BY SUSAN O’NEILL Staff Writer DURHAM — Durham Re- gion is calling on the Province to help “avert a public health crisis” here as local officials try to con- tain a drug-resistant strain of E. coli bacteria. Durham health officials an- nounced in late May that a drug- resistant strain of E. coli, known as Extended Spectrum Beta Lac- tamase (ESBL), was identified in a cluster of seven patients at a Durham hospital in July 2000. Since then, the Durham Re- gion Health Department has been working with infectious disease specialists at Toronto’s Mount Sinai Hospital to try and contain the spread of the bacteria. But, Dr. Donna Reynolds, the Re- gion’s associate medical officer of health, said as of Monday, the local health unit will no longer have any lab support to continue testing outbreak specimens. She said Mount Sinai Hospi- tal has informed the Region it cannot continue to do the testing due to budget restraints. In an interview Friday, Dr. Reynolds said outbreak investi- gation traditionally relies heavily on provincial labs for support. She said, however, the local health unit “has been trying to get their assistance for over a year” and has had no success. Dr. Reynolds sent a letter to the Ministry of Health seeking its direction earlier this year, but has had no response. So, another let- ter was sent to Premier Mike Harris late Thursday asking for his “urgent attention”. “One of the reasons we sent the letter to the premier is be- cause we had no response,” she said, noting the health depart- ment is looking for some direc- tion as to how they should pro- ceed in containing the bacteria. “Without access to lab ser- vices to identify new cases, as- sess for clinical infection, moni- tor transfer of the ESBL plasmid to other microbes and determine those who have returned to nega- tive ESBL status, the ability to contain and manage this outbreak would be effectively terminated,” stated the letter, which was signed by Dr. Reynolds and Durham Region health and social services committee chairman Larry O’Connor. Dr. Reynolds reported there are cur- rently about 100 people in 13 long-term facilities across the Durham who have been identified as carriers of the bacteria. She noted the “vast majority” don’t have any symptoms. “We have more facilities affected now primarily because of the movement of residents,” she said. When health offi- cials first announced the outbreak in May, only eight facilities were impacted. “Basically in terms of our outbreak investigation, it is ongoing... we’re con- taining the bacteria,” said Dr. Reynolds. “The problem is we require lab support (to provide) ongoing testing to ensure it is contained.” TheGreatEscapeTheGreatEscape / Escape the high cost of housing with a pre-owned home at Wilmot Creek. Let teachers do job they were trained for To the editor: Re: ‘As usual, issue gets lost in rhetoric,’ed- itorial, Aug. 17. As a teacher and a parent I agree hearti- ly with the sentiments expressed in your ed- itorial: “Is the Province suggesting teaching graduates are not up to snuff and require ad- ditional training and testing in order to do their jobs?” New teachers, and new teachers to the province or the region are evaluated several times within their first year of teaching. Also, teachers answer to administration and parents throughout their teaching careers. Teaching is one of the few professions where time and money are spent on your own education, only to be paid below in- dustry standards. Most teachers go into the field out of dedication (you can’t get rich teaching). Other professions, however, keep their members up to date by issuing professional society updates and new information bul- letins for which they get credits when com- pleted, and their licenses are then renewed. Teachers are subject to professional de- velopment ad nauseam to reflect ‘the latest’ in educational theory (most of these ses- sions are well behind the times — but it looks good on a resume and to their admin- istration). I echo the opinion to ‘let teachers get on with the job they were trained for’ — let them teach, not be political pawns. So says the Elementary Teachers Federation of Ontario. Nice idea, but don’t be betting the family farm it’s going to hap- pen any time soon in Durham Re- gion. Firstly, a teachers’ group would have to approach the board, requesting the material be provid- ed. And, Bill Butcher, Durham president of the ETFO, says his group has no plans to approach the board. It’s a good thing, too. The sec- ond step calls for trustees to ap- prove providing the materials. As board superintendent Bev Freed- man stated in a recent story, given the family-values positions taken by our current crop of trustees, pro- viding any information on alterna- tive lifestyles would be a non- starter. That’s too bad. From my way of thinking, if some child is inquisi- tive enough to ask about the issue, all the better. What’s the big deal if someone is a homosexual? Is it that old chestnut about them infecting the rest of us with their deviant ways? I don’t have figures on this, but I’m willing to bet a fair amount of money that heterosexuals raised most homosexuals. For the narrow-minded and ig- norant, here’s a fact you’ll have to get used to — homosexuals are here, have always been here and will always be here. Here’s some other news for you — just because you accept some- one is a homosexual doesn’t mean you have to join them. It doesn’t mean you’ll be recruited into their ‘club’. Who knows, maybe they don’t want you. And, they’re ho- mosexuals, not pedophiles, so they’re not interested in your kids. By the way, the vast majority of pedophiles classify themselves as heterosexual. Being inclusive and tolerant is one of the aims of a public school board. If you want to raise your child to be ignorant and narrow- minded, I suppose that’s your right. But those things have a way of coming back to bite you on the butt. Society is moving toward toler- ance and acceptance. Granted, there are many miles still left to go and large obstacles in the way, but that’s the direction we’re going in. The Archie Bunkers of the world will try to slow the trip down or even derail it. My prediction is they’ll lose. How and why did it come to this point? In late May, local health officials announced a drug-resis- tant strain of E.coli, known as Extended Spectrum Beta Lac- tamase (ESBL) was identified in a cluster of seven patients at a Durham hospital back in July 2000. The problems really began when the Durham Region Health Department started to work with infectious disease specialists at Toronto’s Mount Sinai Hospital to test outbreak specimens. But as of this past Monday, Mount Sinai told Durham it couldn’t afford to continue the testing, leaving Durham on its own. As a result, the premier has been contacted with an urgent appeal for help, only after a letter was sent first to the Min- istry of Health but ignored. The local health unit, once it detects a problem, needs the help of provincial labs for support. Dr. Donna Reynolds, as- sociate medical officer of health, says there are now about 100 people in 13 long-term facilities across Durham who are carriers of the bacteria. She says, “basically in terms of our outbreak investigation, it is ongoing ... we’re containing the bacteria. The problem is we require lab support (to provide) ongoing testing to ensure it is contained.” The key question now becomes: why are the funds not pro- vided to continue testing? Surely the desire to protect public health against an E.coli outbreak is more important than sav- ing a few dollars. That’s a question now for the premier to answer. It’s im- portant to recall this strain of E.coli is not the same one which killed seven and caused thousands to become ill in Walkerton. Still, any E.coli-related illness is a serious health risk and must be dealt with all the care which Durham officials have so far taken. The obvious answer is for the premier to direct Minister of Health Tony Clement to provide immediate funding to Mount Sinai to continue testing. While he’s at it, Premier Harris should demand an answer from Minister Clement as to why Durham’s entreaties to the ministry have so far been ignored. That’s inexcusable. Coun. Johnson has come under fire from some area residents re- cently for bulldozing two roads, the first along a hiking trail and an- other on an unopened road al- lowance, to provide access to a piece of landlocked property he purchased last year. Coun. Johnson has previously maintained he had the necessary approvals to complete the work. When contacted following the protest Friday, he referred ques- tions about the issue to his lawyer John Howes who said his client had all the required approvals in place to build the roadways. Mr. Howes reported the City of Pickering’s solicitor wrote to Coun. Johnson recently asking that the work along Sideline 8 be stopped. However, he said that request was a moot point because all of the work that needed to be done has been completed. Mr. Howes also questioned the need for an investigation into his client’s actions. “I can’t imagine why one would be warranted,” he said. Meanwhile, Mr. Colle said Fri- day, “If this clear-cutting can hap- pen here in Pickering it can happen right across southern Ontario.” He added, the construction of the two access roads “is happening right in the middle of the freeze (on moraine development). “This is a clear abuse of the moraine,” Mr. Colle told the crowd. The MPP also said he’s written a letter to the Ministry of Munici- pal Affairs and Housing asking the Province to “put a stop to (the work) and to restore the trail back to its natural state”. He added if Coun. Johnson doesn’t restore the trail, then the City of Pickering should be re- sponsible for the restoration. “I think there should be a com- plete investigation of what he did and how he did it. He should be brought to account,” Mr. Colle said, adding “I’d like to see Munic- ipal Affairs come and investigate this. It can’t be done by Pickering.” However, Malcolm Allbright, a Prince Albert resident who once farmed the land south of Coun. Johnson’s property, said he doesn’t see any reason why Coun. Johnson should be prohibited from building a driveway to access his land. “There’s land in there and he has a right to get to it,” said Mr. Allbright who added the trail bull- dozed by Coun. Johnson to create a driveway has always been a road and is not part of the Trans Canada Trail. “I don’t see why he didn’t have a right to make a road into a drive- way,” he said in an interview. “The township should have done it for him.” Yet, Dave Martin, co-ordinator of the Uxbridge portion of the Trans Canada Trail, said the path- way is, in fact, designated as part of the nation’s trail system. “The scenic and recreational value of the trail has been de- stroyed,” said Mr. Martin who has asked both Pickering and Durham councils to “remove Mr. Johnson from active participation pending clarification of the legality of his actions”. day with first-degree murder in the death of Mr. Jones, conspira- cy to commit murder and at- tempting to obstruct justice by in- timidating a witness. Police arrested a second sus- pect at 11 p.m. at the Oshawa train station. Sean Anthony Hall, 26, of Brantford, is charged jointly with Mr. Jacobson with first-degree murder and conspiracy to commit murder. He is also jointly charged with Mr. Jacobson with 12 other counts, including robbery, forcible confinement, wearing a disguise and use of a firearm in connection with the home inva- sion in 2000 and a 1999 Toronto mugging in which the victim was robbed of jewelry and sprayed with mace. Mr. Hall also faces a perjury charge alleging he gave false evi- dence at Mr. Jacobson’s prelimi- nary hearing, which was eventu- ally held in April. Information filed in court out- lining the charge of conspiracy alleges the pair plotted to murder Mr. Jones between Dec. 4, 2000 and Feb. 4, 2001. Mr. Jacobson stood impassive- ly in the prisoner’s dock during a court appearance Friday in Os- hawa, sporting a white button- down top, thick sideburns, goa- tee, glasses and afro. Neither he nor Mr. Hall, wear- ing a golf shirt with the words ‘No Limit’ and ‘True Soldier,’ spoke during their arraignment. They were remanded in cus- tody and are back in court Tues- day. Police would not reveal details of the investigation but said forensic evidence played a “major role” in solving the case. “There was some evidence seized from the scene and the break was results from the lab at the Centre for Forensic Sci- ences,” said Sergeant Paul Malik, police spokesman. Sgt. Malik said Mr. Jones’s death devastated his family, po- lice and the community and solv- ing the murder was a top priority. “For anyone to die in that fash- ion it is always tragic. He was a Crown witness and the fact that he was helping the community makes it even more devastating... It’s disturbing,” Sgt. Malik said. The case was also personal for police. Many officers knew and respected Mr. Jones, who lived in Oshawa while growing up, through professional dealings with him in his position at Metro East. Mr. Jones’s parents Alty and Carmen were not available to comment on the arrests. In May, Carmen Jones made an emotional plea for witnesses to come for- ward to assist police. “He was my eldest son who I loved dearly. He was a kind, car- ing and loving son who was never in any kind of trouble,” Mrs. Jones said. “I would not want any other parent to go through the pain or suffering that I am going through.” Homicide Detective Rolf Kluem said he relayed the news to Mr. and Mrs. Jones Thursday and they were “very emotional and relieved. “They’ve been patient and courageous since the start.” The investigation is continuing and other arrests are possible. Mr. Jacobson was out on $10,000 bail, working at a depart- ment store as a sales associate and fashion model at the time of the slaying. Three days after Mr. Jones’s murder, Mr. Jacobson attended Oshawa court for his preliminary hearing. It was postponed until April, but he was taken into cus- tody after one of his sureties pulled his bail and has been de- tained since. To combat funding cutbacks and ever increasing demands, the YWCA recently kicked off its first fund-raising campaign ‘Women’s business is our business.’ The campaign aims to raise $500,000 and although its official kickoff was Wednesday, it has al- ready raised $60,000. Current dona- tors, foundations, agencies and cor- porations will receive letters and phone calls asking to support the hostel. “We’re looking forward to the community supporting us and get- ting behind us and sharing their fi- nancial support with the YWCA,” said Eva Martin Blythe, executive director for the YWCA. “There is nobody else in Durham who does what we do.” The YWCA does have other fund-raisers during the year such as the Women of Distinction Dinner and a golf tournament, but those fund-raisers aren’t enough anymore. And the parched conditions seem unlikely to improve, according to long-range forecasts. “The kind of rains that would have ended this drought don’t seem to be in the cards for the rest of August,” said Dave Phillips. Last week’s hard downpour in Durham, “might have been a million- dollar rain, but it wasn’t the billion- dollar rain it would have been if we’d gotten it three weeks ago.” That’s bad news for local farmers, who were hoping this year would provide a bit of respite, after last year’s cool, overly-wet conditions. “A lot of cash croppers are saying it’s going to be as bad as last year, but for the opposite reason,” said David Barry, president of the Durham Fed- eration of Agriculture. “It’s going to be a desperate situa- tion for a lot of guys. You need a re- covery year after a year like last year.” The two contrasting summers have Mr. Phillips calling on Mother Nature for some moderation. “We’ve seen the two extremes. Now give us something in between. The best weather is normal weather,” he said. It’s been a tough summer for soy, corn and bean crops, said Mr. Barry, though he noted, for those who are able to irrigate corn, conditions might be better. “Most crops, especially corn, like heat, but it has to have water to go with it,” he said. The lack of rain hasn’t been the only problem. Podiatrist- Foot Specialist Your feet are the foundation of your body, and as such weaknesses in the foundation can cause skeletal imbalances. These imbalances usually manifest themselves as painful feet, or other secondary problems such as knee, hip or even low back pain. It is estimated by the Ontario Podiatry Association that 80% of the population will have experienced at least one foot ailment by the age of 50. The elderly often lose or experience a thinning of the fat pad on the ball of the foot. This will cause excessive pressure across the metatarsals, resulting in callus formation. A callus is a thickening of skin and is a protective response to abnormal weight distribution. Treatment for calluses includes soaking the feet in warm soapy water for 10 to 15 minutes, but no longer (excessive soaking will remove the natural moisture of the skin) and then rub the callus with a chi- ropody sponge or pumice stone. Restoring moisture to the skin is best done with a Urea based cream. Persistent calluses are best treated with a pair of orthotics (custom made shoe inserts) to redistribute weight and balance the foot. Corns are also a build-up of skin as a protec- tive mechanism against excessive pressure, however they occur on the toes. It is a fallacy that corns have roots and can be cured simply by excising the lesion. Changing shoe styles to accommodate the front of the foot will lessen pressure and reduce the size of the corn. Arches are under enormous stress and strain and if they lose their flexibility, the foot will no longer be able to effectively shock absorb. This will result in pronation, whereby the long itudinal arch lengthens, rolls inward and collapses. Again this problem is best treated with orthotics. Warts are caused by a virus, can occur on any part of the body, and as they are contagious, should be treated as soon as possible. Warts are most com- mon in children, pregnant women and anyone who walks barefoot where others have walked, for exam- ple, swimming pools. Acompression of nerves running to the toes is called a Morton’s Neuroma. It is caused by pronation, high heels and tight toed shoes. The patient will expe- rience shooting electrical pain to the middle toes with a corresponding numbness to the toes. Pain can be temporarily relieved by removing or changing shoes but long term treatment requires balancing the foot. A fungus flourishes in a warm dark moist environment and will cause athletes foot. It is conta- gious and can affect both the skin and nails. Creams prescribed by your podiatrist are successful at treat- ing the fungal skin but the nails rarely respond. Heel spur pain is a misnomer for a common foot problem known as plantar fasciitis. The patient will invariably complain of pain with the first few steps out of bed in the morning or at the beginning of any activity. As the arch falls due to pronation the foot lengthens and this causes a pull on the plantar fascia ligament, stretching it beyond its normal length. This inflames the ligament’s insertion in the heel bone. Plantar fasciitis is most successfully treat- ed with orthotics. It is my belief, that problems that normally occur in the foot are aggravated by wearing shoes that have no support around the heels or under the arch, leading to an instability. The majority of foot problems can therefore be controlled with a proper custom made shoe insert called an orthotic. This device will rebalance the foot, control pronation, and maintain the foot in a normal functioning position. The wearing of pumps can be made more comfortable with a slim orthotic, without sacrificing too much style. Lastly, seniors are advised to wear running shoes. They are supportive through the arch, and heel counter, and have a sole that shock absorbs well. Shoes should be bought late in the day as the foot tends to swell and if you wear orthotics, always try on any new shoe with the orthotics. In an average lifetime, we will have walked more than 115,000 miles, more than four times the earth’s circumference, yet we have only two feet. We cannot trade them in, so it is best to begin to treat your feet as early as possible, and they support you for a lifetime. In the final, the Power blitzed the Gloucester Hornets 6-0 to claim the Whitby crown in Picker- ing’s last tournament appearance of the season. It was the club’s sec- ond straight tournament win, after a victory in Kingston last month. Mathew Groves started the as- sault with an early marker, before Fabrizio Savari- no, Michael Sarangi and Josip Bosnjak followed with goals to signal the rout. Jesse Trajkovski of Ajax, playing with an injured right leg, stopped a Gloucester kick at centre field and hammered the ball with his left to place the ball, unassisted, over the Hornets goalie’s head for the fifth goal. Trajkovski later delivered a smooth pass to Savarino who scored Picker- ing’s final goal. William Mitchell earned the shutout. Pickering started the tour- ney with a 7-0 win over Whit- by ‘B’. Luke Stedmond of Ajax buried his first of two goals in the first five minutes of play. The on- slaught contin- ued with two goals by Steven Boyle, and sin- gles by Sarangi and Mavrick Purchase.
