Legal bill back before board But chairman says nothing has changed since earlier decision Meals on Wheels urgently needs you PICKERING —Meals on Wheels urgently needs volunteers to ensure shut-ins get a hot, nutri- tious meal. Due to growth in Ajax and Pick- ering, along with the vacation sea- son, more volunteers are desperate- ly needed to keep the service oper- ating. Every week of the year, from Monday to Friday, volunteers stop at homes in Ajax and Pickering. Volunteer drivers are given a set route, usually six to eight address- es, delivering one day a week. Peo- ple are also needed to pack meals, again volunteering once a week. Packers donate a little more than one hour, between 9:45 and 11:15 a.m., while drivers are asked to volunteer the same amount of time, but from 11:15 a.m. to 1 p.m. For more information, call Durham Region Community Care at 905-686-3331. BY MIKE RUTA Staff Writer DURHAM —The bill is back. Three months after the Durham District School Board voted not to pay costs five trustees incurred for outside legal advice, the $8,100 bill has been re- submitted to the board for payment. But board chairman Elizabeth Roy said nothing has changed since the May 21 board meeting, when trustees voted 6-4 against paying it. “The board has made comment on the bill and the paying of it and that is how it stays,” she said in an interview. The Whitby trustee said neither herself nor edu- cation director Grant Yeo approved the legal advice sought by trustees Martin Demmers (Scugog), Paul Crawford (Pickering), Melinda Crawford (Ajax), Susan Shetler (Oshawa) and Cynthia Steffen (Os- hawa). The News Advertiser has obtained a copy of the bill, submitted by lawyer Paul Mack of Mack & Kis- bee in Oshawa. It details phone conversations and services provided to the five trustees between June 13 and Oct. 19, 2001, totalling $8,136.55. An accompanying letter from Mr. Mack to Trustee Roy, dated July 24, 2002, requests “prompt payment of my account within 30 days of the date of this letter.” In an earlier letter dated Sept. 20, 2001, Mr. Mack sent education director Grant Yeo an opinion regard- ing a March 19, 2001 expulsion hearing that prompt- ed the trustees to seek his advice. Some of the trustees involved in the bill, in their comments at the May 21, 2002 meeting, indicated they believe trustees received bad advice from the board’s legal counsel in regard to the expulsion hearing. The stu- dent in question and his parents have launched a $250,000 law- suit against the board, trustees Roy, Doug Ross (Whitby), Nancy Loraine (Brock- Uxbridge), Kathleen Hop- per (Oshawa) and Jennifer Bridge (Picker- ing), Uxbridge Secondary School princi- pal Peter Mor- ris, Mr. Yeo and Uxbridge schools superin- tendent Bev Freedman, claiming, among other things, that the hearing violated the Education Act. Mr. Mack, in the opinion let- ter, states that on behalf of the five trustees who sought his advice, “this letter is formal notification, which must be registered as a complaint on the record, that the process fol- lowed on March 19, 2001 was not in order.” That opinion, he noted, is “di- ametrically op- posed” to the advice trustees involved in the hearing re- ceived, prompt- ing them to con- duct the hearing as a committee. The full board then rati- fied the com- mittee’s deci- sion to expel the student. Trustee Stef- fen in an inter- view said as far as she’s con- cerned the issue is over with in terms of dis- cussing it at the board table. But she said the matter would not go away until the bill is paid. “It will prob- ably end up going to court if it’s not paid for and it should (go to court),” she said.Trustee Steffen main- tained the board should pay the bill. Trustee Ross, who brought the matter out into public and mo- tioned that the board not pay, said in an interview that as far as he’s concerned the issue of paying the bill is dead. “My biggest pet peeve with the board is we keep rehashing things,” he said. “The board has said they’re not paying the bill.” The next board meeting is Aug. 26. Trustee Roy said be- cause the board has voted against paying the bill, the issue cannot be raised again for six months, unless one of the trustees who voted against paying asks for a “vote of reconsideration”. Fearing the West Nile virus (WNV), the Pickering resident called the Durham Region Health Department to report the bird, assuming the crow would be collected and sent for testing once it died. Mr. Rispolie was sur- prised to learn the health de- partment is not collecting dead birds for the next two weeks. He said this is the third ailing or dead crow he has found on his property in re- cent days, and by now he knows what to look for. “It’s just standing there with its head down,” Mr. Rispolie said. “It’s going to die. There’s no doubt about it because I saw the last one do the same thing.” He noticed the crow Tuesday and said in an inter- view Wednesday it hadn’t moved much since then. Mr. Rispolie added he is able to approach the large bird and, instead of flying off, “he’ll kind of hob- ble away, but not really quickly.” Given the num- ber of suspicious birds he’s encoun- tered close to home, Mr. Rispolie won- dered if his area is a hot spot for West Nile virus. He said the health depart- ment should be able to notify resi- dents if there’s an especially high risk in certain areas so they can take precautions. But Dr. Donna Reynolds, the health depart- ment’s associate medical officer of health, said pre- vention is the best cure. “West Nile virus has a foothold in On- tario, so the risk of exposure to WNV is through the bite of the mosquito,” she said in an in- terview. “The precaution we’re asking people to take is to avoid being bitten.” She explained the health department has been asked not to submit for testing dead birds suspected of carrying WNV for two weeks due to the large number of birds across the province being submitted. As of Wednesday morn- ing, Dr. Reynolds said 127 birds across Ontario had test- ed positive, submitted by 28 of the province’s 37 health units. While the health depart- ment is not collecting birds, Dr. Reynolds said Durham residents are still asked to re- port dead or dying birds, es- pecially crows, since the re- gion is plotting their location. If you think you are doing the birds a favour you are misin- formed. They are not domestic animals but wildlife that should be observed at an ap- propriate distance. Feeding promotes de- pendence; the animals can become a nui- sance or worse, not migrate in the fall be- cause there is an easy food source in their summer breeding grounds. Also, bread and popcorn are not exact- ly part of their natural diet and therefore not a nutritious food choice. Please don’t feed the wildlife. Encourage the munici- pality to do as other municipalities have already done and adopt a bylaw and post signs stating feeding the birds is not al- lowed. Editorial &OPINIONS NEWS ADVERTISER AUGUST 16, 2002 A superficial look at the recent World Youth Day celebrations might mistakenly give the impression young Roman Catholics worship the Pope. I say superficial indeed, because any- one who makes an honest effort to learn more about this man and the message he proclaims would recog- nize almost immediately the source of his popularity. In short, he tells the truth. With a stunning clarity and depth, he feeds the human heart the food for which it starves in our modern cul- ture... the truth. Nowhere is this more evident than in his writings on sexuality, family, and love. No, not the vague wishy- washy sentimentality that we’re fed almost daily; the love he describes is the real deal, the total giving of one’s entire self to another; mind,heart,soul and body. That is total intimacy. This should come as no surprise to Christians who allege that God him- self so loved the world that he not only took on a human body but pro- ceeded to use that humanity as the very instrument of the one perfect act of love! If this understanding of love is accurate, then a few realities begin to take on a new and incredible signif- icance. How about marriage itself for starters. Is it any wonder Christianity sees the profound harm of sex outside of marriage and contraception? In each case, the couple attempts to en- gage in an act of complete intimacy while at the same time contradicting the attempt by their very actions! Premarital sex says I give you all of me... but not really, because I don’t want the commitment of being mar- ried. While contraception says I give you all of me... except this part. In the process, the very foundation of the re- lationship is undermined, often with- out the couple even making the con- nection. But marriage is not the only place where we see the indescribable won- der of a proper understanding of love. How blessed are we indeed to have God’s gift of his real body, blood, soul, and divinity in holy commu- nion? Sound ridiculous? Why would Jesus (God), who loves us more than we could ever imitate in our relation- ships with others, withhold from us that same perfect and complete inti- macy? That’s the beauty of commu- nion. Full and total intimacy (soul and body) with God himself! Honestly, the more we listen to what Pope John Paul has said about this God-made-man we know as Jesus Christ the more we can begin to un- derstand a chanting crowd of 800,000. How else can you react when the Province dishes out $25 million for transit improvements, including an expected $13.3 million for Toronto where it’s most acutely needed. But a $6.6 million contribution to York Region and a surprising $5.3 mil- lion for the Region of Waterloo left local politicians smarting. Durham got nothing. “Once again the Province doesn’t realize the GTA goes east of Markham Road,” said Durham Region Chairman Roger An- derson. Whitby Mayor Marcel Brunelle, who is Durham’s lone representative on the 19-member Smart Growth panel, said, “A lot of the commuters in that (GTA) gridlock come from this re- gion.” Mayor Brunelle offered a glimmer of hope for the future. “My sense is this is just for openers.” If the Province is truly serious about creating enhanced tran- sit corridors throughout the entire GTA it has to get serious about Durham Region. The time to get a regional transit sys- tem with more and better buses, wider roads, expanded GO train and bus connections — all requested earlier this year by Durham politicians — is now. Of course, all these goals cost money, but, as Mr. Anderson says, “Durham is the fastest or second-fastest growing region in Ontario.” On Thursday, some politicians, including Durham MPP John O’Toole, said York and Waterloo regions are more ad- vanced in developing a co-ordinated regionwide transit system. “They (York, Waterloo) have far more progressive plans. The further along that integrated line you are, the more favourably the application will be evaluated,” said Mr. O’- Toole. Perhaps a better plan showing a more seamless regional sys- tem will catch the eye of provincial ministers. It could be Durham has to lobby a little harder to get the money for tran- sit which residents here deserve. In decades past, an argument could be made that the heavy population and business growth was in Toronto and points west. But times are changing and the Province should take note. Build now to prevent future problems; don’t wait until the congestion becomes overwhelming. The lack of any funds this time around should mean Durham will be at the head of the GTA line the next time tran- sit dollars are dished out. The 21- year-old Ajax resident is a volunteer with Cana- da World Youth, an internation- al exchange program funded in part by the federal government. Mr. San Martin is a member of a group of 10 Canadian youths who will head to New Brunswick Sun- day, Aug. 18. They’ll meet up with 20 Cubans and do community work. “We’ll work in things like schools. It’s what the community needs. They dictate it and we help out,” Mr. San Martin said. “We’ll largely be working in schools with children.” They’ll be in New Brunswick until November and then head to Cuba until March. The group will be in a rural area and again the com- munity will dictate the projects. Mr. San Martin became involved in the program after taking in a speech. “I went to a presentation given by a girl who had gone. She went two years ago. I ap- plied online. In December, I went to a meeting for an evaluation,” he said. He was called in early June and told he’d been accepted. Mr. San Martin has completed his second year at the University of Toronto, where he’s studying political sci- ence. He’s taking a year off while with the program. Going to Cuba “was my first choice, my preference”, he noted. During a high school history class “I stumbled upon it” and the country’s past is “really interesting to me.” Mr. San Martin is “hoping for a better understanding of develop- ment of the Third World. (905) 668-2770 Open Sunday District councils find agencies having trouble keeping, attracting employees BY MIKE RUTA Staff Writer DURHAM —Seventy- five per cent of Ontario’s health provider agencies have had unfilled positions within the last year, with va- cancies lasting an average of 1.3 months, according to a provincial health care labour market survey. The survey, jointly con- ducted by Ontario’s 16 dis- trict health councils, went to health provider agencies such as ambulance services, community health centres, hospices and public health units, focusing on the state of human resources. “We’re hoping that this is the starting point for future discussions and planning,” Carol Smith Romeril, the Durham Haliburton Kawartha Pine Ridge Dis- trict Health Council’s senior planner, said in an interview. She said while there was a lot of anecdotal informa- tion indicating agencies were having trouble filling positions, the survey for the first time quantifies the problem. Ms. Smith Romer- il described that three-quar- ters figure as “quite a signif- icant number”. The survey offers food for thought, she said, for agencies that have not con- sidered an investment in their employees’ well-being as important. “One of the things that agencies may want to con- sider is the finding that, the agencies that had signifi- cantly lower vacancy rates were found to be successful in what I would call offering supportive human resources strategies,” she said. She added that could in- clude in-house skills train- ing and programs and poli- cies that help employees balance their home and work lives. The survey also found: 71 per cent of the agencies that have had job vacancies believe it negatively affects the quality of health-care services; the most common impacts include longer wait- ing times and changed ser- vice delivery methods; and low pay and offering only part-time employment are considered the biggest rea- sons agencies have difficul- ty keeping employees. The provincewide survey was based upon an earlier probe undertaken in Durham by the district health council, the local training board, Durham Col- lege and Durham Region Health Care Group, a coali- tion of non-profit health- care providers. Ms. Smith Romeril said it’s difficult, and perhaps not relevant, to compare the two studies since the Durham study was broader in scope, covered a different time pe- riod, and went beyond being just a survey. She anticipates visits to the agencies “to ask what it means to them and what they can take from it” as the district health councils dis- tribute the report in their own areas. Erin Murphy-Simpson, 29, of Whit- by was charged in May, after an investi- gation by the Durham Regional Police sex crimes unit, with two counts each of sexual assault and sexual exploitation. She is free on $2,500 bail. A second female employee of Kennedy House, a bookkeeper at the maximum-security detention centre, is facing similar charges for alleged sexual encounters with two male inmates housed at the 80-bed jail. It’s known to house some of On- tario’s worst young offenders serving closed custody sentences for various crimes. During a brief court appearance in Oshawa yesterday by Ms. Murphy- Simpson, lawyer Alan Richter said an application had been filed for the release of the Young Offender records of the complainants in the case. A hearing was scheduled Aug. 27 where the defence will argue it should have access to the criminal backgrounds of Ms. Murphy-Simpson’s accusers. Meanwhile, Mr. Richter had the case adjourned to Sept. 16, when a pretrial conference with the Crown will be held. Mr. Richter is an associate of lawyer Bernie O’Brien, who is defending Ms. Murphy-Simpson. The charges allege the guard had in- tercourse with a “young person” be- tween May 1999 and January 2000 “while in a position of trust or authori- ty,” and sexual relations with a second inmate between May and June of 2001. The other employee, the bookkeeper, is also accused of having sexual relations with the second inmate, as well as a third young offender. Linda Harrison, 41, of Pefferlaw, who was released on $2,000 bail, is scheduled to make her next appearance in the Oshawa court on Sept. 9. Dave Davidson, director for the Durham County Cattlemen Association, said his group is not wor- ried about a decrease in beef sales after reports mad cow disease was a factor in the death of a Saskatchewan man. The deceased apparently caught the disease while eating contaminated meat in Britain. “We’re not too worried because we had that sort of thing a few years ago,” Mr. Davidson said. “There was no such disease in Canada.” Mad cow disease, or Bovine Spongiform En- cephalopathy (BSE), af- fects the nervous system of cows and has no cure or known cause. Creutzfeldt- Jacob disease is its human form, believed to be caught after eating contaminated meat. Mr. Davidson is confi- dent strict Canadian meat inspections and restrictions assures purchasers beef is safe. “We’re way ahead of most countries when it comes to that. We use up- to-date techniques to iden- tify where farms are,” he said. The Canadian Cattle Identification Agency traces individual cows. In accordance with a federal government mandate, any diseased, sick, or contami- nated meat must be identi- fied. With the Animal Trace Back program, cows are given an ear tag before being moved from their original herd. The tag has an identification number which stays with the cow even when it is inspected at a packaging plant. “We have 50,000 beef cattle in Durham and in Ontario there are 30,000 beef producers,” he said. From each cow sold, $2.50 goes toward research to keep Canadians up to date in protecting their beef. He said members of cattlemen associations attend courses and demonstrations on cau- tious practices often, to en- sure a quality product. “After the last BSE scare (in the mid-to-late 1990s) they stepped up provincial and federal (standards),” said Mr. Davidson. “Any country with any BSE scare is not allowed to import.” There are also restric- tions in Canada towards using by-products with bone meal and other feed made from dead animals. He said Canadian laws are rigid and the cattlemen as- sociations like it that way. Of Canada’s beef, 35 per cent is exported. Since 2001, Mr. Davidson said there has been a 6.5 per cent increase in the amount of beef shipped because purchasers are assured it is safe. “We’ve got more people wanting beef than we can produce,” said Mr. David- son. It’s impossible to please everyone. Some just never think they get enough. Some said raise your prices and just give people whatever they want. However, those that requested extras for nothing were so much in the minority or less than 1 in 10, that raising our prices would have been unfair to the majority of our customers and we want to keep our prices as low as possible. But lets say we did raise our prices and gave our staff free rein to give extras rather than upset the customer. What is extra? John Doe orders a blizzard with extra Skor. One staff gives him two scoops. The next time he comes in another staff thinks one scoop is extra and the customer complains he got more the last time he was here. Or how much is extra? Can you imagine a teenager coming in and our staff put two scoops in and he says more and then he wants more again. Where does it stop? If we tell our staff to give one free scoop someone will want two, if we say two free scoops someone will want three. Confusion would rein and we would be out of business. Our solution. First we prepare our products strictly to DQ standards. The amount of product when done to these standards is very generous. What about those who like extra product. No problem! Every extra is charged for. From 39 cents to 50 cents you get a uniform upgrade and it’s the same for everybody. That’s peanuts. That way we keep our prices low for the majority and for a small charge the less than 1 in 10 can have extra. And it’s consistent for all! With this article you can have free extras (whipped cream, nuts, or sprinkles on any soft serve product) till Aug.31, 2002 This is a common perception. Just last year a customer asked for more strawberry on their Banana Split and was told that there was an extra charge and he said he wouldn’t be back. All of the DQ’s in Canada are individually owned. This customer said he’d always gotten extras for nothing at other places. This dilemma has plagued the franchise business for years. Consistency. Some of our competitors are well known for give aways rather than upset the customer. Soon you start giving away products for the wrong reasons rather than the right ones. And some of our customers expect us to do the same. A customer returns a more than half eaten hamburger and says it’s cold. Some stores would give him another. A wrong is rewarded and of course soon it’s abused. Today you blink wrong and the customer wants something free. I don’t buy it. But what about the dilemma of extras? Should we charge for extras or not? The DQ corporation insists that all products be weighed and uniform so that every customer gets the same. Extras much be charged for. offensive in clinching two recent tourna- ment championships. In their most recent out- ing, Aug. 2 to 4, the peewees ran off six wins in a row to claim the Richmond Hill Phoenix Minor Peewee title. Facing the Mississauga Bengals in the finals, Picker- ing used the combined pitch- ing of Matthew St. Kitts, Ste- fan Sawicky, Tyler Bader and Shem Thomas to secure a 9- 4 victory. Earlier in the day, the Red Sox recorded 13-0 victories over both the host Richmond Hill Phoenix in the semifinals, and the Birchmount Bulldogs in play- off action. Pitch- ers Matthew Mc- Dowall and Saw- icky combined for the shutout of the Bulldogs. “The boys are playing excellent baseball and with a taste of victory going 11 in a row over two tourna- ments, their confi- dence is high” said head coach Al Boyle. The Red Sox opened the tour- nament with an 8- 4 win over the Thornhill Reds, edged the Ben- gals 3-2 and then mercied the East York Bulldogs 15-2 to wrap up round-robin play. Leading the way offen- sively during the tournament were Sean Molony, Kevin Wiggers, Peter Colicchio, Sawicky, Thomas, St. Kitts, Joey Lang and Matthew Halket. Steady defence was also a key in the victories. With McDowall rolling to his second win of the week- end, the peewees downed the Va ughan Vikings 11-4 in the final of the recent Byron Spartans run out of gas in Eastern Ontario final against Whitby AJAX —The Ajax Spar- tans mosquito rep team made it all the way to the champi- onship game of the Eastern Ontario Baseball Association finals before running out of gas. Following an exciting semifinal game, Ajax faced Whitby for the title. But the Spartans, drained from the heat and the emotional semis, came out on the short end. No score was reported. Thomas Fearon started on the mound and did a good job before giving way to Wayne Feltham. Big games at the plate were turned in by Kyle Lewis,Andrew Ward, George Halim and Todd Blair. Extra innings were needed in the semifinals against Pickering in what was proba- bly the most exciting game of the year for Ajax. The Spar- tans prevailed 7-6. Colton Kennedy started on the mound and held the Spartans in the game through seven in- nings before turning the ball over to Fearon. After Pickering tied the game in the bottom of the seventh, Lewis belted a single and eventually made his way to third base in the eighth. He then scored the winning run on a passed ball. Fearon had a three-up, three-down inning to preserve the victory, with Brennen Conquer throwing out the last batter. Ajax opened against Mel- rose with Feltham on the mound, tossing a terrific game until he gave way to Lewis, who also pitched well. Halim, Kennedy and Lewis were offensive stars, while Blair and Kristopher Barclay made big defensive plays. No score was reported. The second game ended after five innings with Ajax beating Clarington. Kennedy started and struck out nine. Fearon came on in relief and the two pitchers combined for the shutout. Feltham, Blair and Ward swung hot bats. No score was reported. Brighton was next, with Fearon getting the starting as- signment. He threw well and handed the ball off to Raihaan Patel. The game ended in five in- nings and no score was re- ported. Conquer, Kennedy, Feltham and Barclay were the offensive stars. The Spartans are off to the Ontario Baseball Association championships in Bolton dur- ing the Labour Day weekend.
