Car Company Flying tragedy results in $5,500 fine TRUCKER CONVICTED IN HWY. 401 ACCIDENT WHICH KILLED TWO Staff writer Family members of two women killed when a pair of truck wheels crushed their car in 1996, reacted with anger and disbelief after the dri- ver of the truck was fined $5,500. "If killing two people doesn't make the maximum fine, I don't know what will," says Johanne Savourin, whose mother Robina Campbell, 58, and sister Mary Louise Jessiman, 40. were killed in- stantly when a dual wheel and hub assembly flew off the trailer of the westbound transport on Hwy. 401, bounced over the centre median and slammed into the eastbound car in which they were passengers Dec. 28. 1996. The two, along with Mrs. Camp- bell's husband Gordon, who was dri- ving, and Mrs. Jessiman's 14 -year- old son and 15 -year-old daughter, were headed to Montreal to visit Ms. Savourin when the collision oc- curred near the Harmony Road over- pass in Oshawa. Tractor trailer owner/operator Louis Lauzon from Orleans, Ont., was convicted Thursday under the Highway Traffic Act of operating an overweight vehicle and failing to en- sure his commercial vehicle con- formed to standards. Justice of the Peace Mary de Munnik sentenced Mr. Lauzon to Flying truck wheels which smashed into this car and killed two people in December, 1996 resulted in a conviction of the truck's driver Thursday. Louis Lauzon, of Orleans, Ont., was fined $5,500. $500, up from the $100 to $200 sug- gested by Crown attorney Grant Kel- ly for the overweight charge, saying although the overweight axle did not cause the accident, Mr. Lauzon had been convicted of the offence twice before. She sentenced him to $5,000 for the second charge, the maximum penalty for which is a $20,000 fine or jail time. "I'm glad he was found guilty, but I really believe he should have received the maximum penalty and I feel cheated with $5,000;' Ms. Savourin said adding she feels the amount of the fine will not serve as a deterrent for other truck drivers. Defence counsel Anthony Little, during sentencing recommenda- tions, asked that no jail time be giv- en, explaining Mr. Lauzon has re- cently learned cancer has returned to his chest after 12 years of remission. He is scheduled Friday to begin nine bouts of chemotherapy, followed by radiation therapy, Mr. Little said. While Judge de Munnik said she would feel "remiss;' in not assigning jail time, under the act, only a fine or jail time can be assigned, not both. Mr. Lauzon, during his trial testi- mony, apologized to the family and Judge de Munnik said she believed he was truly sorry for what hap- pened. "I heard Mr. Lauzon break in his heart and in his voice and turn to you and tell you how sorry he was," she said to the family gathered in the courtroom. During the trial, experts testified a lack of oil in the bearings caused a double -wheel assembly to fall off. Judge de Munnik accepted this explanation in her judgment, pointing out only one hub had an ad- equate amount of oil, while one was "bone dry." Checking the oil levels is some- thing Mr. Lauzon contended he did before leaving on the trip from Or- leans. Court heard there were a number of other safety defects on the rig in addition to the lack of oil including cracks in major structural compo- nents, several air leaks in the brake lines, poor routing of the air lines and two loose bolts holding the brake drum to the wheel assembly. Before finding Mr. Lauzon guilty, Judge de Munnik said "there has ei- ther been some forgetfulness or, more likely in this case, careless- ness" on his part. But while the trial has come to a close, the pain has not ended for members of the victims' family, who held hands in the courtroom and sobbed as the judgment and the sen- tence were handed down. Instead, Toronto Police Sergeant Frank Johnston "reinforced" his in- tention to arrest Mr. Hall — then the S,ugog mayor and a member of the Durham Regional Police Senices Board — and asked whether he un- derstood the charge. "Yeah, I sure do. I'm in a real spot. Do you know who I am? I'm the mayor of Port Peng and I sit on the police commission board;' the officer quoted Mr. Hall as saying. "I'm only three blocks from my home — can you cut me some slack?" Mr. Hall, 68, was stopped by the off-duty officer after a motorist was seen driving erratically and leaving the scene of an accident Nov. 13, 1997. Ms. Beare testified she suffered injuries to her left arm, shoulder and neck. As Mr. Hall — who testified he doesn't recall the collision — contin- ued along Hwy. 7A, court heard Sgt Johnston pulled ahead of his vehicle and slowed, bringing both cars to a stop. Sgt Johnston said he detected alcohol on Mr. Hall's breath and asked why he didn't stop at the acci- denL "Well, I guess I had a bit to drink," Mr. Hall told the officer. Mr. Hall then "explained four or five times who he was:' though the officer said he was not influenced by the public official's position of pow- er. "I understand, do what you have to do;' he quoted Mr. Hall as saying. Mr. Hall testified he was on his way home from a luncheon at the Liverpool House in Pickering with Pickenng Mayor Wayne Arthurs, a meeting arranged to discuss their candidacies for regional chairman. Mr. Hall was defeated as mayor in the municipal election throe days ear- lier, though at the time he still held his seat on the police services board. On the day of the incident, Mr. Hall said he was fighting a cold and had taken two doses of cough medi- cine prior to meeting Mr. Arthurs. There, over the course of the af- ternoon, he testified the pair drank and ate while discussing which of the two would run for the chairman's po- sition. Mr. Hall insisted during testi- mony he was not drunk when he left the restaurant, though he may have been `tired" from the long election campaign and his cold. Under cross-examination by pros- ocutor Greg Regis, Mr. Hall denied any recollection of the accident, and suggested he "must have dozed of at the wheel. Mayor Arthurs testified for the de- fence, supporting Mr. Hall's evi- dence and saying his former council colleague showed no affects of alco- hol when the two left the restaurant about 4 pm. And, should the July 22 ruling stand, Mr. Andrews says separate school boards in Ontario may choose not to exercise their right to tax. "Why would we tax? The 70,000 -member feder- ation, which replaces the On- tario Public School Teachers' Federation (OPSTF) and the Federation of Women Teach- ers' Associations of Ontario (FWTAO), holds its first gen- eral meeting in Toronto next week. And Maret Sadem-Thomp- son, who was president of FWTAO until the union merged with OPSTF in July, is one of three candidates in the running for president of the new union. "Together, educational professionals in elementary public schools in Ontario have a unique opportunity to determine the future of public education," Ms. Sadem- Thompson said in a statement announcing her candidacy. "The voices of individual members, of local leaders and of the provincial executive elected (next week) must dri- ve the vision and focus the actions designed to defend members' rights while assur- ing the public that education in our elementary schools is world-class." More than 800 delegates will attend the meeting, run- ning from Tuesday through Friday at the Westin Harbour Castle Hotel, to establish policies for the new federa- tion and elect a new execu- tive. Two people Draft school board budget unveiled Monday The Durham Catholic District School Board will unveil the first draft of its budget for the 1998-99 school year at a special meeting Monday. Board trustees and of- ficials are expected to discuss the highlights of the new funding formula and review spending in each area at the 7:30 p.m. meeting. The budget for the 1998 short -year period, which covers Jan. 1 through Aug. 31, will al- so go before trustees for final approval. The second draft of this year's budget will be discussed at an Aug. 31 meeting and will go to the board for approval Sept. 8. School boards have until mid-September to submit their final budgets to the Province. Monday's meeting will be held at the Catholic Education Cen- tre, 650 Rossland Rd. W., Oshawa. Since the death penalty was struck down in a 1976 vote in Parliament, there have been repeated calls for a free vote in the House of Commons on its reinstatement. The last vote took place in 1987 and resulted in a 148-127 decision against bringing back the death penalty. The last murderer executed in Canada was in 1962 when a cop killer was hanged at Toronto's Don Jail. Some have also suggested there be a national referen- dum — at the same time as a general election — asking a simple question: 'Do you favour the death penalty for those convicted of killing police officers and prison guards and for those convicted of first-degree murder?' Polls taken over the years have consistently shown 70 to SO per cent of Canadian adults favour the death penalty in these instances. Serial killer, including Clifford Olson and Paul Bernardo, come to the fore whenever the discussion gets heated. And while it's important to take Mr. Runci- man's remarks seriously — he was backed up by his col- league Attorrtev General Charles Hamick — it's important to note the federal government will decide if the issue ever comes to a vote again. Unlike the United States where each state decades whether or not to have the death penalty on its books. Canada decides such matters at the federal level. The Liberals have shown little interest in raising the issue again. AJAX STAFF WRITER Plugged in, but not yet turned on My New Year's resolution crashed and burned last Friday. I caved and returned to the TV world. On Aug. 7, seven months after I un- plugged my TV and took it to by brother's house (the brother who's a member of the rich -people's golf club), I gave in, although not without some serious soul searching. In that time, I missed the final episode of Seinfeld (from what I heard, I didn't miss much), the Stanley Cup playoffs, the World Cup (yawn), the final episode of Homicide and, sadly, most of the Boston Red Sox run for the wildcard spot in Major League Base- ball. Since getting the tube back, I've made a deliberate attempt to avoid watching it. In fact, aside from last weekend, I haven't watched TV, nor have I felt the need to. During my unplugged period, I read about two dozen books, including a three- part, 3,OWpage history of the U.S. Civil War by Shelby Foote. Had I been plugged in, all those books would more than likeh have gone unread and I would have been all the more stupid for it. When I told others about my unplugged adventure, many looked at me like I had two heads — and each uglier than the other. Some questioned my sanity. ("What' You've got cable TV and you're not watch- ing it'? Are you nuts!") Others just couldn't believe anyone would willingly go without television. Most, however, said there was no way they could give up TV for a day. Aside from the final two weeks, when I started caving, I didn't miss the tube. I don't want to sound preachy, but you'd be sur- prised at how much time is wasted watching TV and how much garbage is on the tube — World's Scariest Animal Attacks, Jerry Springer, Extreme Games. During my sabbatical, I cleaned the Love Den more often, ate more and exercised less (thus my even larger belly). There were no withdrawal symptoms when I unplugged, primarily because it was my decision. If the TV had gone on the fntz, I likely would have climbed the walls. While I was unplugged, I didn't listen to the radio very often, so I often felt as if I was in an information void. It wasn't until I got to work and looked at a daily paper that I found out what happened in the world the day before. Considering some of the things making the news — the Monica Lewinsky- Bill Clinton soap opera. Ginger leaving the Spice Girls — it wasn't much of a void. There's no one reason for my decision to plug in again. I just felt like it. I don't regret my decision, mainly because I lasted far longer without TV than I expected. Now that it's back, I don't get the urge to just tum on the TV, sit back for a few hours and vegetate. And, I'm bound and deter- mined to keep it that way. DNA called for the shutdown of the four 'A' reactors at Picker- ing and three at Bruce in a sub- mission presented Tuesday after- noon to a legislative committee conducting public hearings on Bill 35, the proposed Energy Competition Act. Ontario Hydro ordered the in- definite shutdown of the problem - plagued 'A' reactors last August so the utility could concentrate its resources on improving the oper- ation of its other, newer 12 reac- tors. Currently. Hydro plans to begin restarting the Pickering re- actors in 2000 and the Bruce units in 2003. DNA maintains the future of the 'A' reactors is the underlying issue that affects all the other questions about market domi- nance, competition and environ- mental protection the new legisla- tion is supposed to address. According to DNA. Hydro's continued commitment to restart- ing the old reactors under its Nu- clear Asset Optimization Plan (NADP) is driving up costs, in- creasing fossil emissions, pre- venting the development ofclean- cr. safer energy sources and un- dermining future competition. "The NAOP plan gives us the worst of all worlds." states the DNA submission, "a medium- term commitment to dirty coal and an ongoing commitment to risky. expensive nuclear power. The restart of Pick- ering 'A' and Bruce 'A' is a funda- mental pillar of Ontario Hydro's plan to maintain market domi- nance in the new millennium" If Hydro wants to restart the reactors, says DNA, it "should pay a corresponding price in terms of future risks, and carry the burden of its nuclear costs.... the stranded debt is essen- tially, just a subsidy for its old, ex- pensive, dirty nuclear and coal stations. As the stranded debt be- comes larger, the market will be- come less effective, and Ontario Hydro's effective monopoly will be enhanced" DNA also points out that the shutdown of the 'A' reactors would eliminate a large portion of Hydro's generation capacity and reduce its domination of the elec- tricity marketplace, one of the goals of Bill 35. DNA is also calling for changes to the provincial legisla- tion to: * Establish a quota for providing energy from renewable sources which all electricity producers would have to meet, as exists in some U.S. states and in Europe; * Establish an extra charge on electricity to pay for funding of research into and development of energy conservation and efficien- cy. * Place cap, on fossil emissions and radioactive emissions, * Provide for 'labelling' to identi- fy to consumers the sources of energy being purchased, so they can choose to buy from 'green' sources', * Create an independently -con- trolled fund to provide for the de- commissioning of Hydro's nu- clear reactors and the manage- ment of nuclear waste from them.
