A judge has quashed the careless
driving conviction of a GO Transit
bus driver who struck and killed a
Pickering woman a year -and -a -half
ap-
For reasons that will "haunt him
for the rest of his life;' Walter Mc-

nessian as she crossed the intersec-
tion at Hwy. 2 and Glenanna Road,
said Judge Donald Halikowski.
However, he cited confusion over
the most "critical issue" in the case
— where the woman was when the
bus began to turn — m his decision
to overturn the lower court convic-
tion. A contrast of emotions — vin-
dication and devastation — filled the
Oshawa courtroom as the families of
the driver and the victim, seated in
opposite rows, listened to the ruling.
Mr. McCall, 66, of Oshawa, was
found guilty and fined $800 by Jus-
tice of the Peace Brenna Brown fol-
lowing his trial in provincial of-
fences court last year.
Court heard Mrs. Ohannessian,
26, was walking her dog, Cain, about
7 am. on Oct. 23, 1996 when she
was struck by the bus while crossing
to the north side of Hwy. 2.
She felt under the wheels of the
bus and was crushed.

Burglars cut hundreds of phone lines
DICKERING BUSINESSES LOSE PHONE, FAX LINES FOR A DAY
PICKERING — About 40
Pickering businesses were left
without phone and fax access
Monday after Bell junction boxes
were gutted by burglars breaking
into two firms.
Culprits broke into the Bell
boxes in the area of 860 Brock Rd.
S. sometime after I I p.m. Sunday
and cut approximately 400 phone
lines.
They then apparently forced
open the front doors of at least two
area businesses, disabled their
alarms, and took a small amount of
cash, according to Durham Re-
gional Police spokesman Pat
Robinson.
. Area firms were without their
lines all day Monday.
"It's causing a huge economic
impact to those businesses that
don't have the use of their phones
and fax fines down there, said Ms.
Robinson.
Damage to Bell equipment was
estimated at thousands of dollars.

Pickering tax bills
delayed, but you'll
likely pay more

PICKERING — The good
news is your property taxes won't be
due near the end of June as usual.
The bad news is the delay will prob-
ably cost you money.
The Town has had to cancel its
June 25 and Sept. 25 final tax in-
stallment due dates because the in-
formation it needs to be able to de-
termine how much individual resi-
dents must pay will not be available
in time.
Final tax rolls from the Province
containing assessments on individ-
ual properties have been delayed by
the implementation of the new Fair
Assessment tax system being put in
place across Ontario, and are not ex-
pected to arrive. before the end of
June. As well, the appeal period on
the new assessments has been ex-
icrided to the end of July.
And, since changes in municipal
financial responsibilities resulting
from provincial downloading in ar-
eas such as social services and infra-
structure have yet to be sorted out,
Pickering and other municipalities
have not yet been able to draw up
their 1998 budgets.
The interim tax levies Pickering
residents paid Feb. 24 and April 27
were based on last year's taxes and
the old assessment system.
New tax deadlines will be an-
nounced once the new assessments
ate available and the 1998 budget is

However, a further complication
has also arisen which is expected to
cost taxpayers money.
Because of the assessment and
downloading delays, local munici-
palities have been allowed to tax
than residents on an interim basis for
tip to half the amount they paid last
year, which is what Pickering did for
its first two tax installments. At the
same time, Durham Region has been
permitted to collect tip to 82 per cent
of its 1997 Levy on an interim basis,
in recognition of the additional re -

sponsibilities it is undertaking,
and Durham has elected to col-
lect that 82 per cent. However,
Pickering, as the local municipal-
ity, collects the taxes on behalf of
both the Region and boards of ed-
ucation and they collect their
share from Pickering. But since
the Town is only being allowed to
collect 50 per cent of last year's
levy, it's having to finance the
Region's extra share itself.
"We are in fact financing the
Region through our own borrow-
ings," Town director of finance
Gil Paterson told Pickering
Council Monday.
The whole mess is costing the
Town about $900 per day in bor-
rowing costs and lost revenue, ac-
cording Mr. Paterson, and could
add up to about S 100,000.
Municipalities across the
province are lobbying Queen's
Park to rectify the discrepancy
between what local municipali-
ties are being allowed to collect
and what they have to turn over to
regional governments. So far
there has been no explanation for
it, according to Mr. Paterson.
"It's so obvious I can't believe
obligations
it was just missed," he notes.
"We're caught between the
proverbial rock and the hard
place•"
Ward I Regional Councillor
Maurice Brenner wondered what
the Town could do to make the
Province pay for Pickering's fi-
nancial loss. `"Iihey're causing us
to borrow because of their incom-
petence," he said.
Mayor Arthurs told the fi-
nance director not to write any
cheques to the Province if
Queen's Park asks for money for
anything. He admitted, however,
that situation is unlikely to arise.

Judge Halikowski found there
was "no evidence to suggest this
conclusion."
Judge Halikowski said the dri-
ver's failure to see the pedestrian
does not in itself amount to care-
less driving. He said the evidence
was unclear on whether the bus
was already into its turn when
Mrs. Ohannessian began to cross
from the centre median.
Judge Halikowski said he was
"mindful of the emotional im-
pact" the case has had on Mrs.
Ohannessian's family and wid-
ower, Shant. and acknowledged
their "continuing grief that is be-
ing experienced."
He then added, "For reasons
that will haunt Mr. McCall for the
rest of his life, he looked for but
did not see Mrs. Ohannessian"
Mr. McCall had an "unblem-
ished" record and was four
months away from retirement at
the time of the tragedy.
"Certainly he feels some vin-
dication, but as the judge said the
tragedy will haunt him for the

rest of her life ahead of her," Mr.
Greenway said of Mrs. Ohan-
nessian.
The judge's decision left Mrs.
Ohannessian's family angry and
"devastated," her mother Jean
Bickley said. "We have to live the
rest of our life without Shirley.

At a recent meeting, councillors de-
cided to send Queen's Park a list of
changes Pickering wants made to the
draft legislation, but rejected a resolution
supported by three councillors to refuse
to endorse the new act without Picker-
ing's amendments.
"We're talking about a complete ero-
sion of our power as a municipality to
control our own affairs;' said Ward 2 lo-
cal Councillor Mark Holland in urging
his colleagues to support the more ag-
gressive position against the new act.
Ward 1 Regional Councillor Maurice
Brenner, who also wanted the Town to
refuse to endorse the provincial initia-
tive, described the proposed act as "a
step backwards" for Pickering.
"In fact; ' he said, "we're being put on
a choker."
Ward I local Councillor Dave Ryan
suggested the Province is playing a
"cynical game" of divide and conquer
by handing new authority to regional
governments while taking away the
powers of local municipalities.
Also urging Council to refuse to en-
dorse the act without changes was
Joanne Dies, a representative of Con-
cerned Citizens of Durham, which she
described as a "government watchdog
group" with members across the region.
-I feel I have no voice and I feel my
right% have been systematically taken
away from me;' Ms. Dies told council-
lors.
She maintained the act is another step
in the process of the elimination of local
autonomy in favour of the globalization
and corporatization of society.
Town solicitor Penny Wyger reported
to Council the new act appears to tip the
balance of municipal power and author-
ity to the region. I level and would allow
further restrictions to be put on munici-
palities through provincial regulations.
She suggest% the Province may "take
away, through regulation, what it ap-
pears to be granting through the legisla-
tion"
The proposed act would:
* Prohibit Pickering and other Durham
municipalities from undertaking their
own restructuring initiatives — such as
an Ajax -Pickering amalgamation.
* Severely limit the Town's ability to en-
ter into joint public/private sector ven-
tures which could reduce the cost of pro-
viding services or provide new revenues.
* Give Durham Region final authority in
all but a few relatively minor areas of
municipal jurisdiction such as building
code enforcement, garbage collection
and nuisance bylaws.
* Allow the Province to override local
bylaws by regulation, so municipal by-
laws would be subordinate to any li-
cence, order or permit issued by the
Province.
However, sore councillors suggest-
ed the act would not change things that
much.
"We are creatures or children of the
Province;' said Ward 2 Regional Coun-
cillor Doug Dickerson. `hey already
have the powers they're talking about
here; they're just trying to separate them
a little more" He also suggested juris-
diction doesn't count for much in the
face of public sentiment, citing failed
provincial attempts to locate a landfill in
Pickering as an example.

Rx for good
health care
Residents in Ajax and Pickering certainly seem to
have fared well amid the massive hospital restructuring
process which has taken place across Ontario in recent
months.
And judging by the gush from hospital officials on
Tuesday, the amalgamation of the Ajax -Pickering and
Scarborough hospitals — to be renamed the Rouge Val-
ley Health System — will benefit health care in eastern
Toronto and western Durham Region.
Phrases tossed around at the announcement all speak
to the consensus among administrators at both hospital
sites that the amalgamation will provide benefits for all
involved: "We are going to grow this site": "equal access
to care": "No physicians will be disadvantaged, or the pa-
tients they look after': "We can provide much -improved
services".
If there was anything missing from this latest hospital
amalgamation. it was the type of bitter acrimony that has
characterized so many of the reforms ordered by the
Health Services Restructuring Commission.
That, too, bodes well for residents of Ajax and Picker-
ing.
And it's comforting to know that some of the health
care professionals at Ajax -Pickering General Hospital —
which will soon be called the Ajax and Pickering Health
Centre — will take on high-profile responsibilities under
the new administration.
That continuity of care, and the efforts of those who
drafted the amalgamation blueprint, illustrate a co-opera-
tive approach to the merger and the desire to bring the
best and brightest from both health care facilities togeth-
er to make the sum greater than its two parts.
Residents in Ajax and Pickering, fearing in recent
months what they might lose with the amalgamation, can
now rest assured that they are likely to benefit from the
move.

It was deja vu

would rather not have taken.
On Tuesday and Wednesday, I had the
torturous pleasure of sitting through
meetings where one of the main topics
was garbage. More specifically, what to
do with the stuff after it's picked up.
I spent many a day and night listening
to people talk to or yell at their politicians
with suggestions on where the garbage
should go. One suggestion was inventive.
although biologically impossible.
There have been some legendary land-
fill battles in Pickering, as Durham Re-
gion, Metro Toronto and the Province
looked at those vast, empty airport acres
and thought they had found an answer. At
one meeting at the Pickering Recreation
Complex, then Durham Chairman Gary
Herrema had to wear a bullet-proof vest
after receiving death threats.
I was there when the Pickering -Ajax
Citizens Together for the Environment
(PACT) was formed. For those new to the
area, the P was added to ACT, which was
the Ajax Citizens Together, a group
formed to stop an industrial waste treat-
ment centre from opening here.
Not to make light of the subject, but
I've had my fill of garbage. However, it
seems to be making a comeback. Durham
Council next Wednesday will probably
approve spending $150,000 to study a
long-term waste management strategy.
As Durham works department operations
director Jack McCorkeli said, "From our
perspective, we start with a clean piece of
paper. What's best for Durham for the
next 20 years?"
With a clean sheet of paper, all the old
ghosts and goblins will resurface, includ-
ing landfills and incineration. A dump in
Durham is doubtful, because a previous
Regional Council decided there would be
no new greenfield landfill sites. But, the
current or subsequent Regional Councils
can overturn that decision, although it
will be a long and loud fight.
If saying the word landfill is akin to
swearing in church, just think of the re-
action to an incinerator.
There will be plenty of opportunity for
the public to speak up during the study.
My guess is that, even though some
politicians still bear the scars of previous
trash bashes, another garbage fight will
be long and nasty.

Greater Toronto Services Board — and
Toronto will soon be in the same position
as Durham, and that's looking for a place

Durham teens get sobe0 ring reminder

After losing -the brother I never had"
to a car accident earlier this month, a Port
Perry man hopes area residents will visit
Accident Awareness '98, where they will
be reminded "driving is a full-time job.
You need all your faculties."
That lesson is one of the most impor-
tant Hans Gieben, 38, can pass on to other
drivers after losing his best friend of 35
years.
Jim Burghgracf, 42, was killed less
than a mile from his house after dropping
his son off at a friend's home. He says the
man who struck his friend was driving on
the wrong side of the road.
" I could see his house from the acci-
dent location;' Mr. Gieben recalls. "You
wouldn't believe the number of people
whose lives have been turned upside down
by this;' he says of the father of four who
would have celebrated his 23rd wedding
anniversary this weekend.
"It's over. Nothing will ever change
that"
While it's "incredibly difficult" for Mr.
Gicben to share his story, he hopes he can
help prevent another tragedy.
"If you don't hurt yourself, think of the
people left behind who have -to deal with
everything. People don't realize the gravi-
ty of what's in their hands when they're
driving.
"You take things for granted. You don't
realize what potential you have when you
sit behind the wheel...What does it take to
make sure everyone is buckled up and to
drive sensibly?"
Mr. Gieben believes the mangled cars
at Accident Awareness '98 will serve as a
strong reminder to drivers about what can
-happen on the road.
Presented by Durham Regional Police,
the event kicked off Thursday and runs
through Sunday at the Metro East Trade
Centre in Pickering.

the importance of safe driving and the per-
ils of such things as speeding, drunk dri-
ving, recklessness, running red lights and
failing to wear seat -belts.

One display, for instance, consists of a
car ripped in half.

According to a report, the driver was
travelling at a high speed down a munici-
pal road when he lost control and slid
sideways into a utility pole at 150 kilome-
tres an hour.
The driver's seat broke off and the dri-
ver fell backwards, avoiding the pole. He
survived, but his twin brother did not.
The brother continued to slide sideways
and struck his head against the pole. He
died instantly.
Though graphic, such displays won
rave reviews from those in attendance.

But organizers are disappointed that
just 10 high schools sent students to view
the event. "It's really disappointing," ad-
mits Constable Sherri Elliot. "Principals
just didn't get it, telling us they couldn't
see how it fit into their curriculum. And
those who did agree to send students sent
those from auto mechanic and law classes.
This applies to all students. If only we
could get that across:'

on Brock Road north of Hwy. 401 in Pick-
ering from 10 a.m. to 5 p.m. Friday and
Sunday and from 10 a.m. to 6 p.m. Satur-
day.

Durham College calls in new programme
OSHAWA — Classes have now begun for
Durham College's new call centre certificate pro-
gramme.
Classes are held at the college's skills training
centre on Champlain Avenue in Whitby. Students
are being trained in proper customer service rep-
resentative techniques, including communica-
tions, voice intonation, clarity and using multi-
screen date bases.
Customer service, sales and marketing are
handled through call centres.
There are 5,000 call centres in Canada, 65 per
cent of them in Ontario and each employing at
least 10 agents. Union Energy announced earlier
this year it is opening its national call centre in
Oshawa, employing about 100 people.

Floats and bands are welcome to
join in the Home Week parade, which
has a theme of Celebrate Being a Kid.
The parade starts at 1 p.m.
The Village Festival starts at 10
a.m.
It's free to enter either parade.

Your child is in a classroom for only 9 months of the vicar, but
his/her ability to learn does not stop in July! In fact, the summer
break is no more than a product of our agrarian past when math and
reading were less crucial- But. summer is actually a great time for
your child to increase literacy & numeracy skills! Fur this reason,
you should carefully consider your options when choosing a
summer program for your child. You can take advantage of those
months to stimulate your child's academic potential.
Research has shown that summer instruction benefits children
significantly. In fact. learning should continue all year long.
Retention of basic skills and concepts is increased by continuing
education throughout the summer, particularly in the areas of
spelling and math. In September, then, children will be better
prepared to tackle advanced material and they will he more
confident. A recent study published by the Toronto Board of
Education (January, 1996) found that children who attended a
summer program not only improved their literacy and numeracy
skills, but also developed a positive outlook on school. Children
who begin school confidenth, in September are more likely to
maintain their self-esteem throughout the year. When deciding
which type of program to select, examine your child's final report
card. What are his/her strengths? Does he/she need to review
language or math skills? Based on the teacher's suggestions, find a
program that reviews basic concepts and provides extra practice.
Individualized programs arc ideal because they provide the
flexibility for your child to progress at his/her pace, focusing on the
areas which require attention.
Remember that maintaining a balance between academic and
recreational activities is important. In addition to your child's
academic program, consider your child's extra curricular interests. If
your child is curious about nature• explore the possibility of an
outdoor science education program. If your child is musically
inclined, consider putting him/her in a music camp. If your child's
interest is art, then an art camp will present an excellent
opportunity.A child interested in sports will want to attend a sports
camp. Summer activities should be useful and rewarding at the same
