Teachers' unions are "pleased" a judge has refused to issue
an injunction ordering strikers back to work, but educators
hope they're not in for a long walkout.
Mr. Justice James MacPherson of Ontario Cam, general
division, ruled in favor of the province's teachers yesterday.
saying there is no evidence their strike has caused irreparable
harm to students.
'Obviously we arc pleased the judge has recognized the
government is merely trying to bully the teachers;' says Pat
Jetmcv. Durham district president of the Ontario Secondary
School Teachers' Federation. The court ruling highlights the
"government's unfair negotiating stance. Hopefully it will put
additional pressure on the govcmrncnt...to try to resolve the
issues.,,
Eileen Lennon, president of the Ontario Teachers' Federa-
tion, told reporters Monday teachers have achieved a "moral
victory" and she hopes the ruling -will give the government
some impetus to make the changes that arc required"

Crash victim's injuries life-threatening
An Ajax woman is in hospital with life-threatening
injuries after the Toyota she was driving southbound
on Rotherglen Road was hit by a dump truck west-
bound on Hwy. 2 in Ajax around 8:45 a.m Monday.
Milly Lem, 34, was rushed to Ajax -Pickering General
Hospital and later transferred to Sunnybrook Health
Sciences Centre in Toronto with what Durham
Regional Police Sergeant Rick Bates calls "multiple
trauma" injuries. Firefighters had to extricate Ms. Lein
and her mother Sul-oi Lem, 65, of Ajax. She was taken
to Ajax -Pickering Hospital with minor injuries. Dump
truck driver Clemente Mancino, 63, of Scarborough
was shaken up but unhurt. An inspection of the; truck
found it to be in good condition and its mechanical fit-
ness wasn't a factor. Police are seeking witnesses to

PICKERING — One candidate stole the
show at a Ward 3 election forum Thursday night
in Greenwood by announcing he didn't want cit-
izens to vote for him.
Ward 3 Regional candidate Richard Ward,
who has sought the mayor's job in past elections,
said he's only running this time to tell people
about not being allowed to speak at Pickering
Council meetings and to urge them not to vote for
Mayor Wayne Arthurs. Mr. Ward also explained
he switched from the mayors' race to the Ward 3
Regional contest in order to avoid taking votes
away from the two may-

In his presentation to the forum, Coun. John-
son listed holding the line on taxes despite
increases in social services, welfare and policing
costs as one of the most important achievements
of his term in office. He said it takes "business
experience" to be able to make the budget cuts
.necessary to keep taxes down and to be able to
justify those eras.
Coun. Johnson noted he was the fust one on
Council, whale he has served nine years, to vote
against tax increases and the fust to do so on the
Pickering Hydro Commission, where he has
served six years.

mean a lengthy strike.

Ajax. "Thc judge seems to be
supporting our side"
But, Mr. Tmannetje says,
"I'm fearful it means a long
strike. I'm pretty pessimistic.
The government is holding a
pretty hard line"
However some striking
teachers say they think the rul-
ing will lead to "meaningful"
discussions over Bill 160
between the two parties.
" I think it's good news and a
vote for democracy:' says Keith
Wainwright, a picket captain at
Pickering High, which is attend-
ed by students from both Ajax
and Pickering. "The govern-
ment seems to have been wait-
ing on this judgment ... now
they'll have to sit down (and
engage in) serious talks"
Helen Pring, another Picker-
ing High teacher, says the ruling
gave teacher a boost on what
was a quiet morning on the
picket line.
"We want to get back into the
classroom, but only after a fair
agreement has been reached:'
Meanwhile officials from the
region's two school boards say
they're somewhat disappointed
teacher won't be back in the
classrooms.
"The majority (of teachers)
want to get back to work:' says
Ruth Ann Schedlich, chairman
of the Durham Board of Educa-
tion. "It just breaks my heart
when I see them out on the pick-
et line. The spirits are up but I
wonder for how long"

and the government have to do
some "good bargaining" to put
an end to the walkout.
"I think everyone is wearing
a little thin"

Board, says he's "disappointed"
the strike will continue, but
feels even if an injunction had
been granted there would still
have been "outstanding prob-
lems.
-I'm still optimistic the
teacher and the government
will come to an agreement and
resolve this issue, hopefully
very soon.
Talks between the two sides
continued last n'ght. The dead-
line for amendments to the bill
is tomorrow.
Take Our Kids to Work

As Grade 9 students across Canada
prepare to participate in Take Our Kris
to Work day Wednesday. the Ontario
teachers' strike is likely to affect the
number of pupils taking part across the
province.
Officials from the region's two
school boards are encouraging student%
to take part if they can. yet say the num-
ber of participants is expected to be
lower than past year.
"I don't think many students will be
going to work:" says Ruth Ann
Schedlich, chairman of the Durham
Board of Education. "Ontario will be
badly affected"
The goal of the annual program,
organized by The Darning Partnership,
is to help develop relationships between
parents and children and to instill a
sense of community responsibility.
Mrs. Schedlich, who sits on The
Learning Partnership's board of direc-
tors, says the program is heavily pro-
moted through schools and she there-
fore fears Ontario students will lose out
this year.
"It's a shame ... a lot of work goes

Mayoralty hopefuls clash
on casino, tax freeze

PICKERING — The mayoralty candidates
continued what has been so far a rather polite elec-
tion race Monday as they faced off at Town hall in a
TV debate.
However, incumbent Mayor Wayne
Arthurs, Ward 2 local Councillor Sherry
Senis and Ward 3 local Councillor Enrico
Pistritto did manage to lock horns a few
times during the session.
The mayor's challengers maintained he
shouldn't be taking credit for a four-year
tax freeze. Coun. Senis noted the freeze
period has included service cuts such as an
end to the collection of grass clippings so
there has in effect been a tax increase.
Mayer Arthurs countered he has done a
"pretty good job" of keeping taxes down
and maintaining service's.
Coun. Pistritto pointed out that at bud-
get meetings a few years ago he was push-
ing for zero tax increases while the mayor
was supporting increases of two to three
per cent. The mayor replied that at that
time he was against councillors wanting to
freeze taxes by dipping heavily into Town
reserves instead of reducing expenditures.
Mayor Arthurs pressured his rivals to
justify their positions on the casino refer-
endum to be held in the Nov. 10 election.
He pushed Coun. Pistritto, who is per-
sonally opposed to a casino here, to state
how he would vote on an application for
one if residents support a casino in the ref-
erendum. Coun. Pistritto replied voters
know his position on the issue and if elect-
ed mayor he would vote against a casino.
"Casinos are there to make money; it's
Ong to take money out of the economy:'
he said, adding that money would be taken
from those who could least afford it.
The mayor questioned how Coun.
Senis could say there was no need to take
a position on the casino issue because n
was up to the public to decide in a referendum, at the
same time she was taking positions on provincial
downloading and an environmental review of the
Pickering nuclear station, which are also both the
subject of plebiscite questions. Coun. Senis coun-
tered that even though she was personally opposed
to a casino, there was no reason to "foist" her views
on the public. She said if an application for a casino
came before Council she would vote in
accordance with the referendum result.

On the issue of provincial down-
loading. Coun. Pistritto said it was unlike-

to a five-year budget planning process to
increase efficiency and cut costs. Coun.
Senis said it would be necessary to run
the Town in a "lean and mean" manner
and share costs with Ajax.
But both she and the mayor also
maintained it was important to continue
fighting the Province on downloading
and trying to persuade Queen's Park
shifting welfare and social costs to the
property tax base is a bad idea. During an
economic downturn, said the mayor.

selves in a bankruptcy situation:'

dents do not want pooling of GTA taxes if
it means Pickering in effect paying for
services in Metro Toronto.
"Pooling is unhealthy in that we
don't have a say in what we pay:' said
Coun. Senis in reference to concerns all
the GTA will have to share welfare and
other costs while the way they are admin-
istered will be decided by Toronto or the
Province.
Both Coun. Senis and the mayor
stated they favor moving toward amalga-
mation with Ajax to provide more etlti-
cient government and head off forced
municipal restructuring by the Province.
However. Coun. Piste itto said he was opposed to
amalgamation at this time, maintaining it would

Officer may have to arrest election bid

PICKERING —The Metro Toronto Police Ser-
vices Board is expected to announce today whether
it will give Sergeant and Pickering resident Bill
McLean permission to run for the position of Ward
2 local councillor in the Nov. 10 municipal election
here.
Mr. McLean's campaign recently hit a snag
when the board decided it would instigate his can-
didacy to see whether it violates the Police Services
Act.
The act states an officer must ask his or her
police services boaid for permission to run for
office, must take an unpaid leave of absence until the
election is over and must resign if he or she wins.
These rules appear to apply to all officers of munic-
ipal police forces (not Ontario Provincial Police offi-
cers), even if they are not seeking election in the
municipality in which they work.
Mr. McLean, a sergeant with over 28 years on the
Toronto police force, has neither asked for permis-
sion nor taken a leave of absence for his run for
office in Pickering, according to his campaign co-
ordinator, John Moniz.
The local candidate is one of three Metro police
officers registered to tun for election in municipali-
ties outside Metro Toronto. Their union, the Metro
Police Association, is backing the officers' actions
and is maintaining the act is unfair in restricting their
right to tun for office in their communities. The can-
didates are maintaining they will have no conflict of
intertest since they would not be elected in Metro.
Mr. Moniz said Mr. McLean has been advised by
association lawyers not to talk to the media before
the Metro board decision. He expects the Metro
board to grant Mr. McLean permission to run. He
also said that if he wins, Mr. McLean doesn't want
to resign from his police job but will if he has to.

Challenger Wayne Rowe said his experience as a
budget systems financial analyst who has been
employed on and off since 1991 has prepared him to
deal with Town affairs as well as to relate to the prob-
lems of constituents.
He suggested his job as regional councillor will
be not to push his own opinions but rather to listen to
the views of constituents and carry them to Council.
Mr. Rowe told those assembled the town hasn't
heard the whole truth about Ontario Hydro and
needs to. He noted Hydro needs to be helped to "get
their act together" by fixing or closing the 'A side of
the Pickering nuclear station. He noted he didn't
want to see the whole plant close.
The candidate also said one of his major goals in
office would be to bring new business to Pickering.
"We live here, we play here, but we can't work
here," he stated.

Nothing's changed
Mr. Justice James MacPherson was able to accom-
plish one thing with his Monday morning ruling for
striking teachers and against the Government of
Ontario: he got the two sides talking again.
Actually, the judge made that request to the war-
ring factions after two long days of hearings on
Friday and Saturday and at least negotiations are tak-
ing place.
Justice MacPherson, after much talk in court,
decided irreparable harm had not been done to stu-
dents and parents as a result of one week of missed
school. He did indicate that, should the strike drag on
for two or three more weeks, harm could come to stu-
dents who've simply missed too many classes to
make up their school semester or year.

Education Minister Dave Johnson, in amendments
made to Bill 160 last week, set maximum class sizes
at 22 students for elementary school and 25 students
for secondary school. He also indicated non -certified
instructor WOULD NOT replace any teachers in
schools but would only augment instruction. He also
said prep time would be cut by one-third and that sec-
ondary school teachers, on average, would have to
spend one more half-hour in class each day. On prep
time and classroom time for high schools, Mr.
Johnson only asked Ontario to meet the national
average.
With these amendments in hand, why are teachers
still on strike? Surely, it isn't reasonable on their pan
to expect the government to withdraw Bill 160 com-
pletely. That isn't going to happen, for if it did, the
government could not continue with any credibility
to bring forward legislation if it backed down every
time any large group protested.
Remember, the proposed cut of $667 million
amounts to only four per cent of the total yearly edu-
cation budget of $14 billion. Half this amount will be
recovered by reductions of trustees and amalgama-
tions of school boards (which has already taken
place) so the remaining cut, the cut teachers are on
strike over, amounts to about two per cent of the total
budget. Hardly the destruction of public education,
as labelled by teachers' union leaders.
The only "victory" to be gained by anybody in this
mess is when students are. learning and teachers are
teaching again. Let the talking continue but let's get
back to what's really important here.

Tories destroying
my girls'
education
To the editor:
I'm vehemently opposed to Bill
160 entitled The Education Quality
Improvement Act. The Common
Sense Revolution states the
Progressive Conservatives are support-
ive of government having less involve-
ment in the daily operation of school
boards. Bill 160 is contra -positive of
one of those fundamental positions.
The Tories want the public to
believe Bill 160 is about teacher prepa-
ration time and class sizes. Mike
Harris made a TV appearance recently
at a cost of one million tax dollars to
propagate this bifurcation and in
reviewing Bill 160 I find it to be about
control. This arbitrary control gives the
Tory government power over our
schools, educators, school financing,
and ultimately our children. This
power is about cutting costs through
centralized, low-cost running of
schools and, while I recognize the edu-
cation system could improve, there
have been sevrral Royal Commissions
over the past few years that have thor-
oughly examined our education sys-
tem. The government has not acted on
any of their reconinxnWiations and
arrogantly ignored the best source of
information — educators themselves.
The Tories have been able to manipu-
late the public through their perpetual
resentment of teacher holidays and
general distaste for unions.
Interestingly the teachers' unions can-
not afford a S 1 -million media blitz to
tell their side of the story.
The draconian changes the Tories
are proposing and the archaic strong-
arming methods of enforcing change
are unacceptable to me as a profes-
sional and as a taxpayer I do not want
to have anything less than properly
paid professional teachers with univer-
sity degrees teaching my children. I do
not want to have business persons or
anyone less than trained professionals
in the classroom.
I interface regularly with my chil-
dren's teachers, principal and respective
school board. It has been my personal
experience that my daughters' school
principal and teachers are dedicated,
hand -working professionals who truly
care for the dliidrert and work many
long hours of unpaid overhung.
I am alarmed the Tory government
continues to target women and chil-
dren when proposing cutbacks.
Women are the majority of teachers, as
are health-care workers and social ser-
vice recipients, not to mention the
Tories' attempt to reverse pay qty
I will not sit quietly while the Tory
government destroys my daughters'

Make wise choices
for changing times
Municipal elections through the years have
been poor cousins to provincial and federal
votes. They've been marked historically by low
voter turnout and general apathy
Although as a sports reporter I'm not an
active participant in the News Advertiser's cov-
erage of the Nov. 10 election in Ajax and
Pickering, I can't help but think this will be a
watershed election. Ignore it at your own peril
folks, because in the immortal words of Bob
Dylan..the times they are a changin' and our
choices on election day will determine if those
changes are handled deftly or badly.
Voters in both towns need look no further
than the downloading on to municipalities by
Queen's Park. It will force our elected officials
to be even more frugal, creative and, yes, make
hard choices which we'll all have to live with in
future years. How well these challenges are met
directly depends on who we elect to represent
us for the next three years.
In Pickering, municipal politicians have
finally gotten wise to the fact that what's good
for Ontario Hydro is not necessarily good for
Pickering. Yes, the nuclear facility is a major
employer which plows untold dollars back into
the community. However, public confidence in
the utility has been shaken to its foundations by
recent reports of mismanagement and safety
problems. In the past, politicians and citizens
alike accepted Hydro's explanations at face
value, but the status quo isn't an option any-
more. These newly -elected officials must push
for major changes at the facility geared toward
its safe operation, dernand real dialogue
between the municipality and the nuclear
poobahs and be an effective watchdog for the
town.
There is no shortage of issues which
demand our elected officials' attention. How
about the GTA and how its sphere of influence
will be felt on municipalities within it? Will the
Province mandate the possible amalgamation
of Ajax and Pickering? What about recreation-
al services in the two towns? An ever-expand-
ing population demands more recneatwital
opportunities. People in Ajax and Pickaing
need look no further than the mega playground
of Whitby's Iroquois Park to see haw that town
has handled the growth in recreation needs
The old adage of getting the government
you deserve has never rung enter. At no time in
Ontario's history has a civic vote had such far-
reaching ramifications.
