Durham Regional Police say. 01 the 7,583 vehicles counted by volunteers at busy intersections in Durham Region, 1,453 drivers and passengers failed to strap themselves into the potential life-savers. In the eves of the law, his action -- or inaction -- is a criminal offence. The man pleads guilty to criminal negli- gence causing hod 11) harm after admitting to neglecting his dying roommate's need for prompt medical attention. His sentence: Nine months of being confined in the comfort of his own home, without a television set. That sentence, meted out last week by Justice John Mclsaac, would be laughable but for the serious circum- stances surrounding the case. But it's all perfectly accept- able under the provisions of new federal legislation enact- ed last month. One man dies because of the profound lack of compas- sion of another and his punishment, essentially, is that he is sent to his room. This is justice'? Using the yardstick in the above case, why not simply ground violent young offenders and remove Nintendo privileges" Robbers:' We could make them stand in a cor- ner. Robbers with guns? Make them stand in a corner on one leg, for a long time. Though the intent of the recently enacted legislation is based on principles of criminal reform, this was not the case in which to apply it. This man has pleaded guilty to a criminal charge akin to a drunk driver running over a pedestrian and driving off in an alcoholic haze. Surely, even with a plea arrange- ment, there should have been a sentence containing some measure of deterrence. Surely the message contained in this "sentence" is one that has no redeeming value to society. One man is dead and another can continue to live his life with a minimum of discomfort. After nine months he'll get his television back. Whatever happened to common cour- tesy for your fellow commuters'? As everyone is now aware, there are construction delays on Hwy. 2, between Elizabeth Street and Church Street in Pickering Village. As you should also be aware, since the News Advertiser reported this about three weeks ago, this construc- tion will be ongoing for approximately three months. Can't we show each other a bit of com- mon courtesy out there'? You know the two lanes are reduced to one lane, do you have to go right to the end of the merging lane before you move over? You're just slowing everything else down! Can't you reduce your speed to allow some of the local traf- fic out onto Hwy. 2, especially in the mo m- ing? Elizabeth and Church are the only exits out of there, as you know. Why do all of us have to be frustrated every morning and evening? I have gladly given to them each and every time they have "blocked all the exits" to the parking lots. My kids love to see the "firemans" up close. From what she said in her letter, it appears she did not even let the firefighter tell her they were collecting for the hospital (as they always do when they come up to your window). Perhaps Ms. Chapman is unaware these firefighters are more than likely doing this collecting on their days off. Perhaps she is also unaware that in this time of cutbacks, it takes some creativity to bring extra funds to our hospital. Ms. Chapman, I suggest you reflect on your good fortune. It appears you are one of those people who never gives a thought to what happens if someone in their family is in an accident, gets sick enough to require the services of the hospital, or, for that matter, suffers through a fire. I can only hope your attitude is an isolated one, and most people are quite happy to put up with it taking "15 minutes" to exit the park- ing lot when such a good cause is at stake. "I'm climbing the walls right now. It's defi- nitely not fun. There's no TV to watch, so what do I do? I stare at four walls, listen to the radio and read books. That's my life right now," says the 42 -year-old convict, one week into the court -imposed confine- ment to his Oshawa apartment. Guilty of criminal negligence caus- ing bodily harm in the 1993 death of his roommate, Mr. Finlav was ordered last Friday by Mr. Justice John Mclsaac to remain under 24-hour house arrest for nine months, a first -of -its -kind condi- tional sentence described bN defence "aw-yer Tom Balka as "unusual." The kicker in Mr. Justice Mclsaac's sentence, Mr. Finlay is also barred from having any access to a television, a con- dition which even high-risk offenders in maximum security prisons aren't sub- ject to, Mr. Finlay reminds anyone who scoffs at the sentence. "I'm very happy that I'm not in jail, but actually if you take a look at jail, they've got television. And they don't have to worry about how they're going to get their groceries... That's what's going to be cruel and unusual punish- ment. I think." Mr. Finlay was first charged with second-degree murder in the death of his 46 -year-old roommate Peter Bar- clay, but a jury could not reach a verdict at his two-month trial earlier this year and a mistrial was declared. Last month. Mr. Finlay pleaded guilty to the reduced charge of criminal negligence, admitting he failed to seek medical help for his dying roommate. ,ho succumbed to internal brain hem- orrhaging, the result of a series of blows to the head. "I'vc been through three or four years of being (accused) of something I didn't do and the people who did do it are still walkin, around._ I lost a close friend," says &1r. Finlay, who's con- cerned his words could be- construed as making light of the sad circumstances surrounding the case. Critics may question the sentence, applied under Bill C-41, recently pro- claimed federal legislation, and wonder about the ability of correction officials to enforce it. Mr. Finlay, however, vows to return Mr. Justice Mclsaac's good faith. Mr. Finlay recalls, as the judge passed the unique sentence, he said, "I've got the responsibility to set a precedent for others to follow. He's taken a chance with me and I want to prove he made the right choice. I don't want to let him down. "The judge said it would cost the government $37,500 to keep me holed up in jail for nine months. That's a huge expense; that's a college fund. Why warehouse people who aren't violent and spend all that money when you could have them try and contribute to the community instead?" David Freedman, area manager for Oshawa's provincial probation and parole office, admits monitoring sen- tencing conditions such as those imposed on Mr. Finlay pose a chal- lenge. It would be safe to say we have not come across anything quite like this before, but as far as we're concerned will do our best to enforce it," says Mr. Freedman. Mr. Finlay says he has been told he will be subjected to frequent surprise visits day and night from police and probation officers. Mr. Finlay says the cable in his apartment has been disconnected by Rogers Cable and his television set placed in storage at his broth- er's roth- ers residence. Anne Marie says that in most cases young offenders shouldn't he treated like adults where incarceration is more likely and hopes of rehahilitation are lessened. -I focus on negotiation, either before the young offender is charged, when restitution and community service will he more constructive, or after charges have been laid, when probation, and again community service and restitution are more effective then incarceration;' she explains. Anne Marie offers services for young offenders that include representing clients on all criminal code charges and drug offenses. She will also conduct investigations and appear at bail hearings and plea bargainings. Her other services includes real estate transactions, including the purchase, sale and mortgage of homes; wills and estates and powers of attorney. She will handle property and ownership disputes, represent you at boards, commissions and inquiries and act as your legal counsel for wrongful dismissal suits and human rights actions. Anne Marie offers a 1/2 hour free consultation. Her office is open Monday to Friday and evening and weekend appointments are available. Her office is located at 487 Westney Rd. S. Unit 8 in Ajax.
