BY KEITH GILLIGAN STAFF REPORTER DURHAM — Cam Jackson calls it a new direction, but changes he's proposing to the Ontario Workers' Compensation Board promise to become anoth- er battleground between business and labor. New Directions for Workers' Compensation Reform keeps the Progressive Conservative gov- ernment's pledge in the Com- mon Sense Revolution to com- pletely revamp the WCB "to restore business confidence, pro- tect workers and bring fiscal sanity to the board's operation" But. Ontario Federation of Labour organization services director Jim Pare says the pro- posed changes "are going to make the workplace more dan- gerous and workers are going to he exposed to more hazards. "There's no question workers will go home less healthy and less safe- Ron afe"Ron Calhoun, provincial chairman of the Employers' Advocacv Council, sees the changes differently, saying Mr. Jackson, the Minister';4'ithout Portfolio responsible for'*VCB reform, is trying to "retain fair- ness in the OXCB) Act and make the board fiscally responsible to the employer community." One of the proposals aims to eliminate by the year 2014 the NVCB's unfunded liability — the difference between the board's assets and what it expects to pay out in future claims. It's at about $10.8 billion and Mr. Jackson says it could reach $18 billion by 2014. Mr. Calhoun calls the unfund- ed liability a "millstone around the neck of the business commu- nity and it's affected the Province's credit rating. It's an honest attempt to reverse a dan- gerous trend." Mr. Pare says everyone has an unfunded liability they deal with. "Think of your personal life and all the money you'll need to buy all the food you'll buy, the rent you'll pay, your children's costs. That's your personal unfunded liability," Mr. Pare says. Under proposed reforms, when a worker files a claim with the Workers' Compensation Board, the employer will decide if the worker is eligible. That will lead to intimidation, Mr. Pard charges. "It's the fox look- ing over the hen house. "If an employer doesn't have to pay for a claim, they won't have any incentive to prevent them." Mr. Calhoun dismisses labor's concerns about intimida- tion. "You have to approach the spirit of the Act and the integrity of the Act. and not be jaundiced by what somebody might do. "The name of the game is survival and everyone has a vest- ed interest in the WCB system;" Mr. Calhoun adds. Other highlights of Mr. Jack- son's report: D compensation for chronic stress will be eliminated. O more research will be under- taken on the prevention of repet- itive strain injuries, management of the condition and compensa- tion for people afflicted. D a direct payment program will be started so an employer would have to pay workers' compensa- tion benefits directly to the injured worker for up to six weeks following the date of the injury. After that time, the WCB will handle the claim. The report says direct payment will ensure an injured worker of uninterrupt- ed payments and give employers an incentive to reduce accidents and invest in health and safety. Mr. Jackson is also calling for workers' compensation benefits to be cut to 85 per cent of their net pay from the current 90 per cent. Cutting benefits is "just polit- ical;' Mr. Parr charees. "There's $2.3 billion in the system and this (benefit cut) would save $20 million. It won't mean anything to the system, but it may mean something to a low-wage work- er. Over the years, the WCB has been used as a political football, as each of the four provincial governments in the past decade has brought in new legislation dealing with how the board should be run. Mr. Pare says. "The board has never recov- ered from four bills in 10 years. Each government has its own philosophical view on workers' compensation and that's the problem." Mr. Calhoun says, '17he employer community is solidly behind the need, the philosophy of helping injured workers. We want them to get compensation and get back to work" With the changes Mr. Jackson is proposing, "the employer has no less an obligation than he's ever had." "The workplace is safer than it's ever been. The costs have gone up and they're staying off the job longer. Injuries cost more. The reforms tighten up the process so they can return to work sooner." "Mere was a sharp pain in my lower back. I could hardly walk," he says. Mr. White stayed on the job at Mead Pack- aging in Ajax for another four hours before going to the hospi- tal. He hasn't worked since. These days, the Oshawa resi- dent spends his time trying to cope with the constant pain and fighting with the Workers' Com- pensation Board over his claim. "I can't stand up straight. I can't turn around. I can't sit down for a long time or I have to get up and go for a walk," he says. "I'll never be the way I was. I'm 29 years old. I don't want to be like this for the rest of my life." When he stands, Mr. White bends forward. His right leg is in "pain con- stantly. It makes me feel awful:' "His doctor said he'd be like this for the rest of his life. That's when he cried," his wife Anne - Marie says. His daily routine sees him go for a short walk, come home and sit down, then lie down, then start the cycle all over again. As for finding another job, Mr. White says, "Who's going to hire someone who can't sit down for a long time, can't lift, can't twist?" The native of Marystown, Newfoundland came to Ontario in 1990 to find employment. He began working in a fish -pro- cessing plant when he was 15. "I've worked hard all my life. "By not allowing a male to support their cause, they are judging his intent strict- ly according to his sex," maintains Pickering resident Richard Hemingway, who didn't participate in the event but learned of Mr. Hayes's experience through his son's church youth group. "This is no different than judging how someone will act according to their skin color or ethnic background. Do the organizers believe males aren't capable of supporting an issue that affects the opposite sex? Many men are married to women or are fathers of daughters and therefore share the same concerns;" explains Mr. Hemingway. Mrs. McDonald, whose husband and two sons helped organize the event and cheered participants on, recognizes the role men must play in fighting violence against women and children. The ga hasn't started, but the owner of Mr. Casino is seeking approval to have another permanent site for a Durham - based charity casino. In the coming months the Ontario government is expe ed to introduce parameters for charity casinos. The Mike Harris government is expected to approve about 35 perm nent sites for charity casinos around the province and Durham Region will likely be awarded one or two, esti- mates Mr. Burns. A charity casino is already being built Scugog Island. These charities could mean huge profits for a variety c non-profit groups in the area. It could be the difference between an organization struggling and one ably meeting its special needs. As it stands now, charity casinos run by companies Ilk Mr. Burns' can only set up shop in one spot for a few dad at a time. This 'gypsy' existence makes it tough for the casinos to establish a routine with patrons. Charities, which range from sports organizations to ne profit groups, need the money raisc;d from these casinos t stay afloat. We've all heard the horror stories related to funding cuts, downsizing and fixed inWmes, but it's wor for the charities which have only one source — the publi The casinos are a creative form of fund-raising and as Casino Rama and Windsor have demonstrated the casino are a huge drawing card. And if the money goes to a gro in need, everybody wins. The idea of charity casino is more palatable than the previous casino ideas floated through Durham in the past months because the winners are charities and not some faceless conglomerate. What we need our municipal leaders to do is pay clo attention to what their constituents have said on the subj To revisit the casinos without properly gauging public op ion and examining all aspects of their operation could cat irreparable damage. It could also knock hundreds of jobs out of the water, but it could save the community from other unforeseen problems. Traffic and noise con- siderations would affect a mini- mum of citizens compared to a location closer to the centre of town. Council approved a budget age of $25,000 to hire a consultant to assist in the establishment of a p� public/private partnership. The concept is for the town to provide the land and the private partner to build the recreational facilities. At least it is prior to the opening. Then the money must be found to maintain it. Expensive lighting systems, 100 acres to keep clean and tidy, roads, and many other things will have to be maintained. The revenue from a few ice pads or whatever facility is built would hardly pay for it. The saving grace may be that the pri- vate business people are smart enough to see the downstream cost and might never invest in this grand scheme. Time will tell. The local residents in the small community around Audley and Taunton Road lead a peaceful existence. They like it that way. They don't want change. If they did, they would probably move south to live near the Ajax Community Centre. Having a sportsplex built across the street is not their desire. While these peo- ple represent the minority of citi- zens in the town, their wishes must be considered in a democrat- ic society. It is not my place to determine whether the building of a sport- splex is the right thing for the Town of Ajax. It is for the people of Ajax to decide. If they don't start getting involved, it may be decided for them, in spite of any opinions they may have had. Only they can express their wishes. More on the hospital front: Pickering firefighter Ron Ireland called last week to express his disap- pointment at a letter we published from a reader who took exception to the recent 'Boot Toll' held to raise $26,000 for the hospital. The annual toll, which targets motorists at area shopping centre parking lots, is another great and friendly way for volunteers to help their local hospital. Firefighters took up posts at park- ing lot entry points and solicited donations from people entering or leaving in their vehicles. It's a vol- untary toll and most motorists are happy to help. But in a perfect case of 'You can't please all of the people all of the time', one motorist was offended enough to write to her community newspaper. She has a perfect right to be offended, but it doesn't mean much in the big picture. Most cheerfully donate every year; an informal poll of some of my friends in the commu- nity confirmed they too enjoy shar- ing a friendly smile and a loonie with a local firefighter, especially since it's for a good cause. Don't fret, Ron. We expect to see you out there again next year.
