She says Mr. Snobelen's focus in education is money while school boards are con- cerned about students. Last week, during a provincial cabinet retreat, Mr. Snobelen said an education overhaul could see the Province take over school curriculum and funding of edu- cation and school boards would be eliminated or drastically reduced in size and importance. He said municipal councils could take over the education responsibilities not looked after by the Province. That would include the location of new schools and how provincial pro- grams would be adapted for each community. At least that's the case if the approximately 80 residents who attended the official unveiling of Pick- ering's proposed new Official Plan Tuesday are representative of their town. They wanted to know what the Town is going to do to preserve agri- cultural lands in north Pickering, pro- tect the Rouge Valley system and save their neighborhoods from infill devel- opment. North Pickering resident Lorne Almack of the Green Door Alliance 'urged council to wrest control of the northern airport lands hack from the federal government. "They do what they like and we have no appeal;" said Mr. Almack, adding citizens are being "denied the benefits of municipal government" and that the whole airport issue has been dragging on for 24 years. He maintained an airport never will or should be built in north Pickering and the thousands of acres of land expro- priated by the federal government for it should be returned to private owner- ship for agricultural use. Mr. Almack claimed the area could generate mil- lions of dollars worth of production in crops such as soya beans, which could provide significant economic benefits to Pickering. "Try to do something about clear- ing this up," he told Town officials. "The committee is just looking at the policy." Seven small schools, including four in Oshawa and one in Pickering, were identified in a report by board staff as meeting the criteria for con- sideration for possible closure under the current board policy. But that policy has been suspend- ed while Ms. Jordan's committee reviews and possibly revises it. The review was ordered by the board alter the report was released in April and met with fierce opposition from local trustees, parents and Oshawa Council. "I'm strongly opposed no matter what school it is," says Oshawa trustee Mike Nicholson, a member of the review committee. "This is not good for education." Taking 200 students from one school and putting them into another puts a strain on classrooms, gyms and washrooms and classrooms, Mr. Nicholson contends. It also means more portables, he adds. The committee has met once and will hold more meetings Sept. 25. Oct. 1 and 21. At the first meeting, the committee reviewed the current policy and members were given information about other school boards' closure policies. Municipal Affairs 'Minister Al Leach made it clear that municipalities would be nothing "dramatically different" from Durham's procedures. Durham's policy, adopted in 1984, simply states the procedure for closing schools is to be consistent with Ministry of Education guide- lines. Regulations dictate that schools with consistent under -e=nrolment and high maintenance costs should be considered for closure by a commit- tee made up of trustees, parents, ratepayers and school officials. This committee would study all options, including closure and changing school boundaries. for at least six months before reporting to the board. "I think that is only wise," Ms. Jordan says. "We do look at build- ings and facilities to make sure they are being used efficiently. I don't think the taxpayers would want us to have buildings that are empty or require substantial renovations if there were alternatives: ' The seven schools list- ed in the April report are Valley View in Pickering, Cedardalc, Harmony Road, South Simcoe (win- ner of a national award last year) and Mary Street Public schools in Oshawa, R.A. A motion for the new bylaw is being brought forward by Ward 1 Councillor Maurice Brenner. "This bylaw is not being written as a gag order;" says Coun. Brenner. "It's being written to spell out the rules. It's not to he used as a vehicle for cover- up. ' Right now in Pickering there is no penalty for coun- cillors revealing information discussed in -camera by Council, as long as it doesn't involve privacy require- ments imposed by the provincial Freedom of Infor- mation and Protection of Privacy Act. For example, if a councillor reveals informa- tion about an individual employee discussed in -cam- era, that councillor could be charged with violating the information and pri- vacy act. But it is legal for a councillor to reveal information about, for example, Town property negotiations even if those negotiations have been dis- cussed in -camera as allowed under the Municipal Act. "Councillors have the permission in law to discuss the issue in private;" explains Paul Jones, local government policy manager with the provincial Ministry of Municipal Affairs. But that doesn't require them to discuss it in private, and doesn't prohibit coun- cillors from revealing what Council discussed in private. Under the Municipal Act, however, municipalities can pass bylaws gov- erning their own proceedings which forbid revealing the contents of confi- dential Council discussions, according to Mr. Jones. A fine of up to $5,000 could be imposed on any councillor who violated a Pickering confidential- ity bylaw. Prosecution would have to take place through the provincial court system. Pickering can't pass a bylaw that forbids councillors to publicly discuss matters that were discussed in -camera if Council did not have the right or obligation to discuss those matters behind close doors. Items councillors do have the right to discuss in private include matters involving property negotiations, personnel or litigation. Mr. Brenner maintains, for exam- ple, that even if Pickering already had a confidentiality hylaw no councillor could be punished for revealing in- ,:amera discussions about its 51 -million investment loss with Confederation Life, since that is not a matter the Town is allowed to keep Necret under the Municipal Act. Brenner maintains a confi- dentiality bylaw is needed to stop leaks of information about property negotiations and legal matters the Town is involved in. -Historically there has been that problem in the Town;' he says, citing as an example the leak of information concerning Town negotiations for the $1.15 -million purchase of the Port Pickering Marina site on Frenchman's Bay for parkland. Mr. Jones says the kind of bylaw Pickering is contemplating is not yet common in Ontario but has been adopted in several municipalities over the last three years. What municipali- ties have to consider in passing such a bylaw, he says, is that it might on occasion keep matters of public inter- est out of the public domain. Mr. Brenner's motion is expected to come before Council Oct. 7. Official plan input sought FROM PAGE 1 for use only as a smaller, regional airport rather than the international one originally planned by the feder- al government. Stephen Marshall of Save the Rouge Valley System commended the Town for recognizing and taking some measures to protect the Rouge Valley in its new Official Plan, but maintained more needs to be done. He urged Pickering to add policies to the plan to recognize and preserve scenic roads as part of the town's cultural heritage; discourage com- muter traffic along roads such as Townline Road where motorists pass through sensitive natural areas; and to better protect environmental- ly sensitive areas everywhere. Residents from several ratepay- ers associations urged the Town to protect their neighborhoods with limitations on lot sizes and the cut- ting down of trees. Town staff are still accepting public input before the recommend- ed Official Plan goes for considera- tion before a special meeting of Pickering Council's executive com- mittee Thursday, Nov. 7 at 7:30 p.m. Copies of the new plan may be pur- chased from the Town or viewed at local libraries. Since 1981, the Ontario Community Newspaper Association (OCNA), to which we belong, has recognized our outstanding youth by presenting the Ontario Junior Citizen of the Year Awards. The News Advertiser is again this year asking for your help in finding some outstanding kids between the ages of six and 18. We know they're out there. Some deserve the honor for their tremendous attitude in living with a disability. Some have identified a local need and did something about it, while others have taken a leadership role by devoting a tremendous amount of time and energy toward community service. Warren Sun fits all those criteria. The 13 -year-old Ajax resident, who was bom with spina bifida, is serving as this year's Timmy for the Easter Seal Society. This past week, Warren gave two airline tickets to a dying Ajax Mom who wants to take her daughter to Disney World before it's too late. He wins our nomination as Junior Citizen of the Year. You might have another person in mind as a nominee. Take a look down your street. Are there some youngsters who stand out because they show kindness and compas- sion, or do you know someone who acted instantly in a moment of crisis`' These are the types of kids we can all be proud of and who deserve our recognition. The OCNA and Bell Canada are jointly sponsoring the awards. Nominating someone is easy. Simply stop by our office and pick up a nomination form. Fill it out and bring it back to our office. It's that easy. Everyone nominated will receive a certificate commem- orating their nomination. Up to 12 youths and one youth group will be chosen to receive the award. They and their families will be guests of honor at a luncheon in Toronto during the annual convention of the OCNA. Award recipients are invited by Ontario's lieutenant gov- ernor for a reception and family portrait at Queen's Park and are presented $200 and a Junior Citizen pin. The people that create a community, the grassroots and growing up to the flag" v Letters to the editor Unanimous agreement on capital punishment impossible To the editor: The situation suggested by Marnee Stern that 100 per cent of the constituents would agree on any subject is purely hypothetical. It would be difficult to find 100 peo- ple in absolute agreement on any question or be ready to defend their moral conviction. Mr. McTeague made clear his own opposition to capital punish- ment before he was elected. It was John Diefenbaker who stopped hanging in this country. He could not bear to sentence another human being to death. It's been proven capital punish- ment is not a deterrent. In the past, too, some innocent people have been sentenced to death. Our system of justice is not per- fect. In the U.S. where capital pun- ishment is allowed in some states, few rich murderers have paid the penalty. Even many mothers of innocent victims, the mother of Alison Parrott for example, have opposed it. Most of us have experienced at some time the "urge to kill". Fortunately, good sense or the lack of a weapon prevents us. The question of weapons is another controversial question on which unanimous agreement will never be achieved. Mary Brooks, Ajax There's irony in Liberal policies To the editor - While the bickering between Liberal MP Dan McTeague and Reformer Marnee Stern has become tiresome at best, it does offer some confirmation of the self-serving policies of the Liberal party - It's curious Mr. McTeague would not represent a majority of his constituents in the capital pun- ishment issue when he so clearly accepted the same majority when it suited him most — at election time. As well, I could only shake my head in disbelief when Jean Chretien vigorously endorsed the murder of Iraqi troops in order to defend the Kurdish faction from Saddam Hussein. While I happen to agree with the U.S. position myself, one must remember that Chretien's endorsement comes from the same government that won't allow its own citizens to defend themselves or their families from violent criminals by using even the most innocent of devices such as pepper spray. Forget the ones you read about in the newspapers on a regular basis -- the ones who run afoul of the law. They're few and far between. Most kids today are good kids. It's just that good kids don't often make the headlines. Warren Sun is an exception. He's a special kid, an especially good kid. He was moved to give up his two tickets to anywhere in the world to a person whose situation he perceived as worse than his own. It was the best birthday present ever for young Akaysha, who cele- brated her milestone at the Honey Garlic restaurant in Ajax Tuesday. That restaurant is holding a fund- raiser all this weekend to collect money to help purchase an airline ticket for a third person to accom- pany the Bensons to Disney World because of Nancy's deteriorating condition. And, the Royal Scot restaurant in Ajax is planning a fund-raiser for Oct. 5. Good COMO- trate citizens both. About $75,000 was raised for the hospital's foun- dation during the inaugural Mayors' Charity Classic Golf Tournament at Cherry Downs Golf and Country Club in Pickering. Pickering Mayor Wayne Arthurs, Ajax Mayor Steve Parish, along with Durham Region Chairman Jim Witty hosted the event that attracted a sell-out crowd of 144 golfers. The four corporate co-sponsors were the Pickering Town Centre, Cherry Downs, the Royal Bank Finan- cial Group and the Ajax -Pickering News Advertiser. Also instrumental in organizing the tournament was Howard Sokolowski, chief executive officer of Tribute Homes in Pickering. "It was a spectacular day on a superb golf course and incredibly well organized. It was the single largest fund-raiser ever held so far for the Ajax -Pick- ering General Hospital. PAGE 12 -TELE NEWS ADVERTISER SUNDAY, SEPTEMBER 22,19% Frain track trespassers derailed in Durham safet blitz Y BY CHRIS BOVIE IWRHAM STAFF DURHAM -- People trespassing on rail- way property were the target of a joint safe- ty and enforcement blitz this past week. Canadian Pacific and Durham Regional Police co-ordinated a safety blitz Wednesday and Thursday to crack down on people illegally tres- passing on railway property. Similar blitzes are being held this month at other locations in the province. "We're just trying to save lives," says Detective Sergeant Don Ross of the CP police service. "Someone could slip and fall and hit their head on the rail, or they could twist an ankle or break an arm. A couple of years ago a person was found frozen in a ditch by the Albert Street tracks (in Oshawa). He was alive, but appar- ently was intoxicated and had fallen down the hill." The Durham stretch of the St. Lawrence and Hudson Railway, a division of CP, is one of the worst for accidents, says Det. Sgt. Ross. "Durham has 20 per cent of the track and 33 per cent of the inci- dents." One of the worst areas for people illegally crossing the tracks is in the Albert Street area in Oshawa. Other trouble spots include the area by Harmony Creek in Oshawa. Thornton Road by the Oshawa -Whit- by border and Garden Street in Whit- b�. Since 1990 there have been 13 accidents along the CP rail in Durham, which covers a 40 -mile stretch. Four people have been killed and eight hurt_ Canadian National report-, similar numbers in Durham. Already this vear there have been one death and two injuries. CN offi- cers have charged 30 juvenile tres- passers and issued 74 warnings to young people and charged 67 adults and warned 160. The blitz was originally to be tar- geted at students, but a number of recent accident-, involving adults has broadened the scope of the campaign. A few years ago Mr. Ross watched a mother push her six -month-old child in a stroller across the tracks. "She put her hand on the no -tres- passing sign to get over." During a media information ses- sion held Wednesday five people were spotted trespassing along the tracks. CP Constable Richard Ridge caught up to one mart who received a warning and was escorted off rail property. "On an average day I'll stop two or three people," Const. Ridge said. "I have stopped as many as 15 to 20 peo- ple in one day." Wednesday's blitz will be followed by spot checks of key problem areas, but people shouldn't expect only a slap on the wrist. "The first time we will issue a warning," says Det. Sgt. Ross. "The second time they'll be charged. If they have a bad attitude the first time they might be charged." The maximum penalty under the . Trespassing Property Act is $1,000, but first-time fines are $65. The names of people caught illegally on rail property are registered on a com- puter and anyone convicted under the Railway safety Aa willalso have a . criminal record. The Young Offenders Act doesn't pertain to railway offences. Anyone over 12 can receive a court summons. "I've caught four year olds walking U down the tracks," says Det. Sgt. Ross. "Sometimes their parents aren't home and sometimes they tell us it's OK." Besides trespassing, a major area of concern is motorists trying to illegally cross the tracks at level crossings ahead of oncoming trains. Already this year there have been 53 accidents on railway property in Ontario resulting in 12 deaths. .
