A specific blood test is needed to detect hepatitis B. The six clinics performed electroen- cephalograms (EEG) where needle-like electrodes were placed into patients' scalps. The tests were conducted between 1990 and this year and the hepatitis B out- break began in 1992 and poked in 1995. The most recent case occurred in January of this year. A 50 -page interim report notes the hepatitis B rate among patients at the clin- ics is about 1,410 cases per 100,000 — approximately 500 time's higher than the rate of 2.5 cases per 100.000 among the general population. `"]itis is a startling rate and it makes this one of the biggest outbreaks of hepatitis B,- Dr. Panaro says. 'This elevated rate among patients fiom the clinics is an urgent warning to these ER -1 clinic patients who have riot yet been tested to do so as sans as possible to ensure they W not transmit the disease to their sexual partners or unborn children;' says lead investigator Dr. Ian Johnson, associate medical officer of health in North York. Hepatitis B is a blood born virus that attacks the liver and can lead to cirrhosis and liver cancer. While medical officials don't kriow what caused the outbreak, Dr. Panwo says its "definitely linked to the: six clinics. We haven't found out what it is abowt the clin- ics ' that led to the outbreak. The clinics stopped performing IT(is in February, but because hepatitis B virus can incubate in the liver for nine month.% before people develop symptoms or get the disease, more cases may not tum up until the end of the year. Dr. Panaro notes. The confirmed eases are scattered among the six clinics. "If one cleric is more responsible we don't know. There's no clinic where all the arses occurred and no clinic with none; of the cases. That's what makes it so complicated." We were having quite a lot of fun until an elderly woman called from her front porch. "Wc don't want any of that around here' Are you going to clean the road'" I responded that it would wash away with the rain. Her response was that I was to get my hose and wash down the mud -encrusted street to get the chalk off. The boys (seven in total) were in a state of confusion. They wondered why the woman would have a problem with a bunch of Grade 2 students drawing pictures on the road. One child summed it up quite accurately with, "She has a bad attitude!" I wonder if this woman raised her children in a bubble'? What will her reaction be when the neighborhood is finished and there are sidewalks and the kids are playing hopscotch and skipping? Has she forgotten what it was like with young kids around? Perhaps she is happy about the way society has evolved, where we are afraid to let our kids outside to play for fear they will be abducted, beaten or raped. Ontario's highest court has dis- missed an appeal by insurers for the Durham Children's .Aid Socicty (CAS i of a lower court judge's SI 10.(XX) compensation award to the priest. which the CAS was ordered to pay for back- ing groundless allegations that he sexually abused his two adopted children. The court upheld the landmark 1994 decision — the first in Canadian hjstory to find a Children's Aid Society negligent — but reduced the compensation awarded by S25.0(N). "It's been an unbelievable nightmare:' said the priest, whose name js protected hN a court pub- lication ban. "It's been I 1 years. I\,%,) months and 1 I days and I'm glad ft's over." The allegations of abuse were made in 14ti5 against thepriest, who Iiycs outside of the region, by his ex-wife, who lives in Oshawa. while the two were pitted against one another in a uhjld custody battle. Despite it doctor's report that found "no physjcal signs of sexu- al abuse:' the CAS hacked the alle,nations and granted a child protection order forbidding the priest to scc his children without CAS super inion. Following a 51-4.Iay family Court trial, the priest won sole Custody of his children, now between the ages of 12 and 15. and was cleared of the molesta- tion changes in 1957. In 1944. the CAS and social worker Marlon Van Den Boomen were ordered to pay $1 100X) in financial compensation 1SI(X)000 for general damages and 51().(X)0 tier puniti-e damages) after the priest launched a Civil suit against the CAS for "gross negligence, incompetence and malicious pros- ecution." He had sued for $1.5 million in Compensation. CAS insurers. required to pay the $I 00.(XX) for general damages WAS isn't covered for punitive damages I appealed the decision. In its 17 -page ruling released last week. the Court of Appeal upheld Judge William Somers's 1994 decision granting compen- sation, but cut the award by S25.(xX). In its ruling, the Court of Appeal issued numerous scathing observations of the CAS and social worker Van Den Boonlen's handling of the investigation. The Court noted the social worker's "lack of training and experience" and failure "to keep an open mind and conduct a Fair and balanced Investigation.- It nvestigation"It also said she refused to fol- low up a doctor's finding of no physical evidence to substantiate the allegations; did not consider the source of the allegations "and motivations behind them"; never conducted an interview with the priest in the early stages of her investigation; failed to record interviews and keep accurate notes. knowingly filed false and misleading court documents-, allowed the priest's ex-wife to .,act as co -investigator" and turned "a deaf ear too ' the priest's Claims of innocence. Jim Duhray, executive director of the Durham CAS, says the agency accepts the court's judg- ment and -does not dispute the facts" "We're glad it's over and we want to move on;" he said. "It's been it learning experience for everybody, but it was it very, very sad set of difficult circumstances. The CAS `has made a lot of changes so this is not likely to happen again.' -- director We're glad it's finished and that (the priest) will be- able to get on with his life." He says the CAS has made "a lot of changes since the case" to its investigation procedures, "so that a situation like this is not like- ly to happen again:' All investigations of child abuse allegations are to be thor- oughly "assessed from both sides of the issue" and any major deci- sions involving cases must be authorized by a supervisor, Mr. Duhray says.
