"Our efforts to see whether there was room for a negotiated settlement appear to have been for naught," he said Fri- day. "There simply wasn't sufficient ground for us to find an agreement." Pickering is suing Metro in an attempt to force it to close the Brock West landfill at Brock and Third Con- cession Roads, and to obtain compensa- tion for the environmental damage the dump has allegedly caused. Court documents say the director of Conforti Holdings Limited is accused of evading more than $280,000 in federal income taxes by filing "false or deceptive ' tax returns. A joint investigation involving Revenue Canada and Metro Police was launched about a year ago when a group of fran- chisees cause forward, saying they were being told to falsify tax statements, says Oshawa hairstylist Lorenzo Biscardi, 35, the former operator of salons in Pickering Town Centre and Oshawa Centre. The aaysed's lawyer, Jonathan Rosenthal, says the charges against his client have "absolutely no merit whatsoever." and are "the result of complaints from a group of disgruntled fran- chisees discontent with making payments under the franchise agreement that their own lawyers negotiated on their behalf. "(My client) never doctored any docu- ments whatsoever... Absolutely not," says Mr. Rosenthal. Mr. Bisrardi. who has recently opened his own Oshawa salon, says, "Every- body's lives have been ruined by all of this. This has been hell for my wife and dniklren. The Brock North site east of Brock Road near Fifth Concession Road has been ckw3d since 1974 after operating for one year because of leachate prob- lems. Metro must still pump leachate from the site and transport it to the sewage treatment plant on the lakeshore. Mayor Arthurs said if the Town's lawsuit goes to trial, the hearing is expected to last four to six weeks. FROM PAGE 1 summer and are continuing, according to Mayor Arthurs. The Town contended the landfill may be illegal because its expansion was approved in 1980 with- out a hearing under the Environmental Protection Act; that more garbage has already been put into the dump than was allowed for under the 1980 approval; and that the passible illegali- ty of the expansion brings into ques- tion the validity of the various certifu- cates of approval issued for the site. The Town also maintained Brock West is polluting adjacent lands and contaminating West Duffins Creek. Pickering wanted Metro to pay for the cost of cleaning up the environmental contamination and to compensate the Town for loss of land value. Durham Board of Education trustees approved Monday new pro- cedures which can break down dis- cretionary business costs of supervi- sory officers in the following areas: conference expenses, food, car allowance, accommodation and other business travel. In December, the board's standing committee will receive a report out- lining expenses in those areas from September to December. In June, the committee will receive expense reports from January to June. At the same time, the locations and topics of conferences attended by supervisory officers will be reported. The new procedures "will provide accountability" to both trustees and the public, noted Oshawa trustee Kathleen Hopper, who has main- tained trustees need to know how much supervisory officers spend and how that money is spent. For instance, if trustees knew how much some staff members spend on mileage, they could decide if it would be cheaper to lease a car, she has said. Last month, Mrs. Hopper wrote to the Minister of Education and Train- ing seeking help in her request to obtain expense accounts. (Board director Pauline Laing had said staff would meet the request of the board as a whole, but not of an individual trustee. However, Ms. Laing initiated the new procedures without direction from the board.) Mrs. Hopper believes the new pro- cedures "go hand in hand" with recently -approved guidelines for administrative expenses which out- line the use of credit cards, meal allowances, travel expenses and tele- phone calls by staff. According to a report on the new procedures by Ms. Laing, "board auditors could be asked to examine the data in the expense report for compliance with administrative pro- cedures at the request of the board." Mr. Murphy represents 15,000 Ontario Hydro workers, including about 7,000 who are employed at nuclear facilities like Pickering Nuclear Generating Station. About 90 managers in Ontario Hvdro's nuclear division received pay hikes of up to 15 per cent as of Julv 1. or a total of about S %(10,(X)0 in raises. Senior managers at the Pickering nuclear plant received some of the largest increases. Information on the wage hikes was faxed to the Power Workers Union office from an undisclosed source in Pickering. according to Mr. Murphy. He notes Ontario Hydro made record profits last year, and says the utility should be paying down its debts and improving facilities such as the problem -plagued Pickering sta- tion "rather than taking that money and feathering their own nests". Ontario Hydro spokesman Al Manchee says the raises are part of a reorganization of pay scales for man- agement which has been undertaken this year. Mr. Manchee notes management wages at the utility have been frozen for over three years. And last Janu- ary, he says, management salaries were actually reduced by a total of S2.5 million. "Their base salaries were cut five per cent and they went to a bonus system. If they met performance cri- teria they would be eligible for cer- tain bonuses." According to Mr. Manchee, the July pay hikes were made after a study of management level jobs. A number of jobs were re -rated because of changes in responsibility and accountability. "In some cases, managers were being paid less than some of their staff. "All these factors contributed to the pay raises." Mr. Murphy says the bonuses management personnel are now eligi- ble for can equal up to 30 per cent of their salary. Stirring up the fire is Oshawa Mayor Nancy Diamond, who went public Friday morning with the charge that unnamed Toronto businessmen are orchestrating "a hostile takeover" of the museum, with the aid of its curator, Michael Foley. For his part, Mr. Foley denies the charge, saying he isn't behind any takeover and the new members to the museum's board of directors were approved through proper procedures. While the mayor and other board members are within their rights to turn to the City solicitor for advice — which is exact- ly what they've done — the press conference raises more questions than it answers_ Answers, however, are precisely what Durham Region residents deserve, particularly for a facility that celebrates the Canadian contribution to automo- tive history. A good number of Durham Region residents — from east to west — earn their living directly or indirectly through the automotive industry. If the Oshawa mayor is going to go public, she should be prepared to go public all the way. She isn't. She's willing to accuse a group of businessmen of a takeover, but refuses to name those she accuses. This makes it rather difficult for the public to ask those who stand accused for their side of the story, and it weakens the mayor's position. For now, we're left only with the comments of Mr. Foley, who is worried about the future of the financially -troubled museum. Whether anyone besides Mr. Foley really cares is another question. The City gives the museum a token grant and refuses to make it tax exempt; it attracts few visitors; and a S3 -million fund-raising campaign has managed to scrape together a mere 547,000 in a year. If the City of Oshawa suddenly cares so much about the future of the museum, let it cough up some of that S2 million surplus that's been identified in this year's municipal budget. As for the mayor's accusations against a group of people she refuses to identify, she's left us no choice but to take them with a grain of salt. Sunday's. best Hospice care is for the living in Durham To the editor: Hospice Durham greatly appreci- ates the excellent coverage of its volunteer program with families fac- ing a life-threatening illness (Care for the Dying. Oct. 22 edition). Although we do not often have the good fortune of establishing long friendships, the emphasis of the Hospice service is to help people live life as fully as possible. Smoking ban creates ugly perception of teenagers To the editor. I am a Grade 12 student at Ajax High School and have been going to the same school for four years. During my first two years there was a smoking section at the back of the school, but recently it became a law for schools not to have a smoking sec- tion. Since the smoking section has been banned the number of suspensions has increased a great deal. It's our choice to smoke or not, and even if we are pushed off school property it's not going to make peo- ple quit. By not having a smoking section it actu- ally makes the school look worse, as every morning and lunch there are about 150 stu- dents outside the front of the school block- ing the sidewalk. If nothing is going to change I would like to know: Why is it a law not to have a smoking section? Our school should still have a smoking section. Cast year a law was passed banning smoking on school property. The consequence for being caught is sus- pension. The first offence is a one -day suspension, the second a three-day suspension. The third time and every time thereafter you're gone for a week. This is insane. I realize the government intends to discourage us from smoking, but banning it on school property is a step in the wrong direction. It does nothing but get kids kicked out of school. This is not a deterrent as most kids don't mind a little vacation now and then. The thing to do is to bring back the smoking sec- tion and restrict minors from being permitted in this area. Smokers going through a few hours of withdrawal can become testy, lose their abili- ty to concentrate, get headaches and become anxious. The banning of smoking at school has been government's first major failure in their battle against teen smoking. Since then the government has launched an S8 -million anti- smoking advertising campaign aimed at teens. This also was a disaster. The government plans to launch another advertising campaign as part of its plan to spend $185 million over the next three years. Personally, I don't have any alternatives. Obviously, the task of finding one has proved to be too difficult for our government. Government needs to accept the fact that there is nothing it can do to stop teens from smoking. Smoking is a part of our own personal freedom. have a solitary suggestion from those of us who wish to see smoking become less hazardous to us all: regulate the amount of nicotine and tar in tobacco to minimize the damage smoking inflicts. The plaza is on a 0.5 -hectare property at the intersection of Wal- nut Lane and Kingston Road in Pickering. Previous zoning and official plan provisions only allowed highway industrial -commercial development on the site, though a temporary use bylaw has permitted some retail stores to operate at the plaza over recent years. The residential component approved by the committee would allow housing at a density of up to 100 units per hectare. The changes approved are con- sistent with the provisions of the Town Centre West Urban Design and Land Use Study approved by Council in February. Pickering duathlete runs and cycles against world's best By AL RIVET' SPORTS RE IORTER PICKERING — While it wasn't his first choice, Pickering's Andy Lubczynski will be taking his best shot at the World Duathlon Championship in Mexico early next month. The 30 -year-old Scarborough elementary school teacher is no stranger to world -calibre events, having competed in the World Triathlon Championships (long dis- tance cycling, running and swimming) in 1993 in Birmingham, England and last year in New Zealand. This year, he qualified to compete at the worlds for duathlon (cycling and run- ning) in Cancun, Mexico in November. "My first choice was to qualify for the worlds in triathlon, but it didn't quite pan out as far as qualifying for that." notes Lubczynski. "Plan B was to qualify in duathlon. The sports are so similar. It's the duathlon that's gaining in popularity. You have to be that much more focussed in duathlon." After a frustrating start in the President's Choice Triathlon Series, Lubczynski finally hit pay dirt at one of the last duathlons of the season at the Guelph Lake II event Sept. 9. With only two spots available on the 12 -member Canadian world team in the 30 -to -34 age bracket, he came up with his best per- formance of the season to finish third in his age class and earn a berth on the s q u a d. Lubczynski completed the opening two -kilome- tre run in six minutes 22 seconds, the 30 -kilometre bike in 47.32 and the final seven -kilo- metre run in 25.33 for a total time of one hour, 19 minutes and 27 seconds. "It was a personal best," he explains. "It's one of the faster bikes and runs I've done. Everything felt fine. All this fitness training car- ried me through triathlon, so (duathlon) was a natural progression... The condi- tions were right and I felt strong going in there. I knew exactly what I wanted to achieve." Lubczynski says he's as prepared as he can be to run and cycle against the world's best in Cancun. And, the experience of hav- ing compet- ed at two previous world cham- pionships might give him a mental edge at this year's race. "I find the big thing is to be calm about the whole thing. The differ - e n c e between this year and last year is that I'm more mentally prepared. I've been training more effec- tively and smarter, but not necessarily harder this time. It's a myth that more train- ing is better. More quality is the key. "First and foremost, I want to do the best that I can. The heat and the higher `All I can do is train and keep the fitness up. A former Quebecer, Ms. Beaudry says, "After living in Ontario for nine years, I know the other side of the country. I think if I were in Quebec and not knowing Canada or Ontario, I'd probably vote Yes. "rd go for No now if I could vote," says the native of Iles de La Madeleine, an island in the Gulf of St. Lawrence. A member of Cercle Francophone d' A- jax, Ms. Beaudry says, "All the people I know from Quebec living in Ontario would vote No. The people I know in Ontario frau Quebec don't agree with separation" She thinks the economy will be a deciding factor when people vote. "It's not a good time because of the econ- omy. It's not a good time to even think about (separating). Everyone is going to look at the impact on their family." People living near Ottawa will vote No, because they're aware of the feelings of English-speaking Canadians, she believes. "But, if you live in the middle of the province, in a small town, you don't see the impact of separation and you may vote Yes. They think it will make their lives better." While she hasn't been following the sov- ereignty campaign closely, what's she's heard is "confusing. If you listen b (Premier Jacques) Parizeau, what he says makes sense. If you listen to (Prime Minister Jean) Chretien, what he says makes sense." It reminds her of the 1950 referendum and the question people were asked to vote on. "Nobody understood the question at the time. It was so vague. You couldn't say Yes or No" Both she and her husband have family liv- ing in Quebec. "My family is kind of split. Some will vote Yes, some will vote No." During the campaign, Bloc Qudbdcois leader Lucien Bouchard said a No vote does- n't mean separatists won't try again in the future to ask Quebecers to leave Canada. However, Ms. Beaudry says, "Someone will have to stand up and say `Whoa. It's a small bill, but it hits them in the pocket."
