The five -gallon can was found by a man near Wilson, New Y(rk, around noon Wednesday, says Durham Regional Police Staff Sergeant Sandy Ryrie. The man notified the United States Coast Guard in Niagara, New York, and Durham police picked it up Wednesday night. Thecan is in good condition indicating it hadn't been in the water king and was marked with English and French writing, a sign it's like- ly Canadian, he adds. The U.S. Coast Guard and the Niagara County Sheriffs Department began an exten- sive search of the New York State coast Thursday and was to continue the hunt for clues today, Staff Sgt. Ryrie says. Since that time, public pressure has been mounting to reinstate full ser- vice. Last year, more than 80X1 Durham residents signed petitions demanding more GO. Premier Rae's announcement is part of the provincial government's overall plan to make urban growth in the Greater Toronto Area (GTA) more manageable. "There is no lower cost alterna- tive to build the kind of transporta- tion this region will need in the coming years," says Premier Rae in a press release. "Biz tapping into the existing rail network, we can make: transit a more attracti%a option." In addition to extending and restoring all -day lakeshore service, the new GO vision includes improving frequency of service on all existing lines and serving ne-w destinations on two new corridors — a mid -Toronto line providing connection to both Yonge and Spadina subways and a line serving northeast Metro and southeast Markham. The first steps should be com- plete within five years. The capital costs will be 5125 million and annual operating costs S2.8 million. The hearing date has not been set. The 44 -year-old Whitby resident, who also served as area coroner, was found guilty of sexual impropri- eties with five of his former patients by a disciplinary panel of the College of Physicians and Surgeons of Ontario. The panel found Dr. Gabrielle not guilty of sexu- al intercourse with one patient and not guilty of sex- ual improprieties with another. In reaching it; decision on the sexual assault allegation, the panel ruled "the com- plainant had fabricated the story of going to the Rape Crisis Centre." But the panel found Dr. Gabrielle guilty of incident; involving sexual touching and sexual remarks to patients from 1987 to 1993. and one act of sexual touch- ina in 1994. The incidents involved women ranging in age from their early 2fk to their early 4(k. In its 34 -page decision. the panel ruled that the fami- ly doctor had "a pattern of choosing victims. "Complainants were vul- nerable women who had a high degree of dependence on Dr. Gabrielle for medica- tions, medical treatment and for psychological support. Those selected were most likely to accept abuse and least likely to retaliate." the panel ruled. The panel found the "sex- ual improprieties" involved sexuzd touching and kissing of patients by Dr. Gabrielle during "examinations". The incidents occurred in "the doctor's office, as opposed to his examining room, where there is no examining table and no patient drapes." In reaching its conclu- sions, the panel noted simi- larities in the evidence given by two different com- plainants during a discipli- nary hearing. '"There were striking sim- ilarities in the evidence of the two complainants," the panel decided. "In both instances, the attacks were sudden and unexpected... the complainants were pushed to the flexr by the shoulders without excessive violence. Both complainants described a peculiar look on the doctor's face ... men- tioned a weird look and strange appearance to the eyes ... a flushed face and agi- tation." The panel also concluded "a pattern of telling off- color jokes and making comments regarding under- wear was common to (Dr. Gabrielle's) complainants." DURHAM — The Ministry of Transportation says it has stepped up truck safety enforcement, but it hasn't gone far enough for the family of a woman killed by a transport wheel. Angela Worona, 31, of Whitby was killed instantly in February after two wheels snapped off a truck and one smashed through her windshield on Hwy. 401 at the Ajax -Whitby bonder. Her family was initially told it was a "freak accident", but alarming numbers of truck safety problems suggest other- wise, they say. The Canadian Automobile Association called in December for tougher enforcement after a one -day safety blitz saw 73 per cent of tucks inspected being pulled off the road. While waiting for the results of an investigation the Worona family has been drumming up signatures for a peti- tion to be sent to the Minister of Transportation. Ms. Worrorxna's parents and six siblings have been working diligently to help prevent a similar tragedy. The family is not asking for new regulations, but more staff to enforce current rules. "We don't want to bring the trucking industry to its knees," says Angela's bother Tun. "We just want the system enforced" Family members recall watching a television report in which a transport company owner stated that being fined was the cost of doing business." Mike Worona. "An OPP constable toll me that they used to be able to stop trucks if they felt they were unsafe. Now they can only pull a truck over if dwre is a gluing safe- ty concern. - But there are more regulations than there used to be. Today there is a Commercial Vehicle Operation Registration (CVOR), separate from ownership, which an inspector can check on a driver's record. The Ministry of Transportation can also put restrictions on companies that continue to have a poor truck safety record. Current regulations state drivers can only be on the mad 13 hours before rest- ing for eight hours. They are also allowed an additional two hours working time for loading and unloading. While there are new regulations. dri- vers can get around them, according to the Woronas. One area the family believes is being misused is the drivers logs. Some drivers may bypass regulations altogether. At many weigh scale stations truck drivers can by-pass the depot. One truck driver, wishing to remain anonymous, admitted that truckers will radio other drivers when a weigh scale is in service. Ministry officials admit it happens, but have dit%ring views on the degree of the problem. At the Thickson Road weigh station in Whitby, drivers can actually see the lights calling trucks u% with enough time to take the Tbidwn Road exit and com- pletely by-pass the station. The driver faces a $165 fine if he pur- posely detours around a weigh scale. Trude inspection blitzes are co-ordi- nated throughout Canada, the United States and Mexico. Statistics are then sent to respective governmental agencies for review. But, according to results of a recent "safety blitz" conducted by the Ministry of Transportation, marry truck drivers regularly climb into unsafe rigs, and this cutting of comers by the trucking industry is putting all motorists at risk. This was tragically illustrated last February when 31 -year-old Angela Worona of Whitby lost her life on Hwy. 401 in Ajax. In what was termed "a freak accident", Ms. Worona died instantly when a wheel came loose from a truck and bounced through the windshield of her car. But her family questions whether the accident was really "a freak" in light of the one -day safety blitz statistics; 73 per cent of trucks randomly pulled over were taken off the road. It would be unfair to paint the entire trucking industry with a tainted brush. There are, no doubt, companies and drivers taking safety regulations seri- ously. But the safety blitz numbers suggest those companies and drivers are in the minority. The Worona family, now gathering support for a petition demanding stricter enforcement of existing regula- tions, shouldn't be the only people to be alarmed. Anyone who uses Hwy. 401 should be just as upset. It's time for the ministry to ensure regulations are enforced and that there's sufficient staff levels to do so. When one considers the numbers of transport trucks on the road, the long distances weary drivers are travelling, the sheer volume of traffic, it's surpris- ing an OutcYy hasn't gone up sooner. Sadly, the out- cry domes too late to save Angela Worona. But by putting the brakes on errant trucking com- panies now, the Ontario government does have a chance to save other lives. Teenage Head, which per- forms such punk classics as Disgusteen and Teenage Beer Drinkin' Party, is back on the road and will play The All Fools Ball at B.F. Idaho's in Ajax Saturday. Head guitarist Gordie Lewis notes the band has always liked playing in and around Toronto, and has enjoyed a loyal Durham Region following throughout its 17 years. "It always feels great see- ing the same people over the years and we seem to be get- ting new and younger people out to the shows. I'm starting to pay more attention to the people in the audience," he says. The renaissance of Teenage Head in the '90s is at full swing. Besides playing bar gigs mast weekends, the Hamilton -based band is recording its fust album in more than five years, with a working title of Bingo, Bango, Bongo, says Lewis. "So far, so good," Lewis says of the progress on the album during a telephone interview with the News Advertiser from his Hamilton home. "It feels good. I just listened to some of the stuff this morning. It's kind of like we never left. We're hoping for the best. We're looking forward to finishing 15 songs or so." Recording at Spike's Sound in downtown Toronto, Teenage Head has five fin- ished tracks which may show up on the album, including Walkin' Alone, Seen It and Done It, Down to the Under- ground, My Mommie's Pot and a song which is as yet untitled. The album was orig- inally scheduled for release in May, but has been pushed back to mid -summer, says Head manager Sam Boyd. Teenage Head features its original members from the '70s including Frankie Venom on lead vocals, Lewis on lead guitar and Steve Mahon on bass guitar. Mark Lockerbie replaced original drummer Nick Stipanitz. Meanwhile, a video com- pany headed by Bob Barrett and partner Ric Rarunada is in the midst of making a doc- tunentary on Teenage Head. The band has furnished the company with videotapes and recordings for the docu- mentary look at the band. And not just good times - boom times. The Canadian is Jeff Rubin, chief economist at Toronto securities dealer Wood Gundv Inc. He predicts the economy in 1995 will grow by five per cent, its best performance since 1984. This is well above most forecasts of 3.8 per cent and an impressive improvement on 1994's expansion of 4.2 per cent. ,%IT. Rubin says the low Canadian dollar ensures that the powerful export boom will continue and that consumer spending will return to a level not seen since the late 1980s. The strong growth in employment will also continue, he says, and that 600,000 new jobs - most of them full-time - will be created in 1995 and 1996. A major difference between a house and a condominium purchase is that when you buy a house, you become the legal owner the day you move in. Not so with condo buyers. A condo buyer does not become the legal owner until the condominium corporation has been registered with the Ministry of Consumer and Commercial Relations. This process can take up to three years after occupancy. Years ago, the delay in legal ownership caused condo buyers to be without some warranty protection offered by the Ontario New Home Warranty Program (ONHWP). A condo buyer for example. who was prevented from moving in on the promised date had no legal right to expect any notice of delay or financial compensation for alternative living arrangements. OtiHWk'P changed this inequity between condominium and home buvers by implementing protection against delayed occupancy for condo buyers who signed Agreements of Purchase and Sale after April 1, 1991. With this new protection, a confirmed occupancy date or a tentative occupancy date that is clearly identified as tentative had to be included in every Agreement of Purchase and Sale. If the Agreement only mentions a tentative date. it must disclose when the purchaser will be informed of the confirmed date when a specific stage of construction is reached such as the foundation being completed. The buyer :rust receive this notice, as outlined in the Agreement. no later than 120 days before the confirmed date and no later than 30 days after the roof assembly is complete. If a builder fails to give notice of the confirmed date 90 days before the tentative date in the original agreement, �. �rw, wj � BY AUBREY LEBLANC then the tentative date automatically becomes the confirmed date. The wording may appear complicated but the meaning has effectively safeguarded the warranty coverage for condo buyers for the last three years. These regulations do not interfere with the builder's ability to offer occupancy before the confirmed date. If this is the case. the purchaser must consent in writing to the earlier date. Similar to delayed closings for freehold houses, the vendor can move the confirmed occupancy date ahead once by up to 120 days. But the purchaser must receive written notice of this change in occupancy date at least 65 days before the confirmed date. The vendor can also have a 15 -day extension if the purchaser is given 35 days notice. Delays in occupancy that are caused by strikes, tires, civil insurrections. floods or Acts of God are beyond the vendor's control and are not subject to the rules. Canadian want bigger homes, says CMHC Homeowners are thinking bigger, according to a study by the federal government's Canada Mortgage and Housing Corporation (CMHC). People planning to buy a home in the next five years say that want it to be nearly 50 per cent larger than where they are living now. Those already owning a home and planning to "move up" say they expect to pay about eight per cent more for the new home than the expected selling price of their existing home. And location and neighborhood is the key for new home buyers, says the study. As a result, "builders need to focus on more than the features of their homes," says Dallard Runge, CMHC- Ontario spokesperson. "They need to create and sell `communities."' In Toronto, almost two out of three planning on buying a home in the next five years will be fust -timers, says the study, compared with a figure of 40 per cent for first-time buyers across Canada. "First -timers led the Toronto housing market during the first half of the decade and now it appears that they will dominate the second half as well," said CMHC. Budget was food news, say builders The federal budget was good news for the buyers of new homes, say representatives of the building industry. "It was positive news and I think you'll soon see interest rates falling," said Ward Campbell, president of the Ontario Home Builders' Association. A good budget - and lower interest rates - is one of three hurdles that must be overcome before confidence returns to Ontario, says Mr. Campbell. The second is the threat of Quebec separation, the third the defeat of the Bob Rae government. "I think the outcome of the sovereignty referendum in Quebec is becoming quite clear. Quebeckers want to stay in Canada." And he is sure the Ontario government will be rejected for one in favor of more private enterprise, reducing the deficit and cutting the size of government. Myer Godfrey, president of the Greater Toronto Home Builders' Association, predicted five-year mortgage rates below 10 per cent as a result of the budget. "the best thing for the housing industry is a growing economy with stable interest rates and a confident consumer and this budget was a good step in that direction." said Mr. Godfrey. He says he thinks the government's plan to reduce taxes are conservative and that there will be even greater reductions in the deficit over the next 12 months. "It will be great news a year from now," said Mr. Godfrey. Bruce Clemmenson, president of the Canadian Home Builders' Association, said the budget was strong medicine. "Not only can we take it, we've been advocating such measures for a long time to achieve lower, stable interest rates. A Toronto company is building a plant to manufacture plastic houses, which in August will begin turning out the first of an estimated 10,000 to 15,000 kits a year. The company is Royal Plastics Group Ltd. of Vaughan, which has three models open for viewing on a site next to the company's plastics plant on Highway 27 just south of Highway 7. The models range from a 650 sq. ft. design the company is exporting in increasing quantities to more than a dozen countries worldwide, including Argentina, China and Vietnam, and to the Caribbean, to a 2,5(H) sq. ft. two-storey with a full basement. . Home sales up by 50% in 1994 Figures from the Greater Toronto Home Builders' Association (GTHBA) show a total of 16,920 new home sales in 1994, an increase of nearly 50 per cent over 1993. The figure includes single detached homes, semis, townhomes and condominiums. The top five municipalities in the Greater Toronto Area in sales were Mississauga (3,160), Markham (1,529), Brampton (1,660), Scarborough (1,252) and North York (1,349). ;\ew home prices in the greater Toronto area increased in 1994 to an average of $208,(M, up from just under S2(H),000 in the previous December. Sales of new homes were at least 20 higher than in 1993, which were 12 higher than in 1992. Interest rates in February were 5.5 per cent (for six months) and 7.25 (for five years) before hitting 5.62 per cent (for six months) and 10.75 per cent (for five years) in June. The 650 sq. ft. model is built on an eight -inch concrete slab without a foundation. The second model is a 1,250 sq. ft. bungalow with a Spanish -style "tile" roof and a "stone" facade that looks like the real thing. It has three bedrooms and an open - concept plan with a vaulted ceiling. The 2,5(0 sq. ft. model has a fine stucco facade and an imposing oak double front door and would look good in any neighborhood. The houses are made from pre -fabricated panels that slide together snugly, and are then reinforced with concrete poured into cavities in the panels. DESPITE SALES DIP IN JANUARY Overall increase seen for 1995 Sales of new homes in the Greater Toronto Area were down in January, according to figures released recently by the Greater Toronto Area Home Builders- Association. But there's plent% of room for optimism in the housing industry, experts say. "The decline in total sales, although somewhat disappointing, comes as no surprise to us," said Myer Godfrey, president of the association. "Frankly, we anticipated a slow start to 1995 due to the recent spike in interest rates. We are, however, projecting a five per cent increase in new home sales in 1995 subject to the outcome of the Quebec referendum and the Ontario election." He added, "The federal budget is an important factor in determining whether we enjoy a traditionally strong spring market ... a budget that strengthens the dollar and allows interest rates to fall (allows) consumer confidence to return and the housing market to surge ahead." Mr. Godfrey says the market represents a "tremendous opportunity" for homebuyers ready to buy now because the cost of building materials is expected to go up. A national survey of builders and renovators found that 80 per cent are expecting to pay more for lumber and other building materials in 1995 and half expect houses prices to rise, said Mr. Godfrey. "With prices set to rise, potential purchasers would be wise to act now."
