A judge ordered lawyers for both sides to

DURHAM — Emotions
are naming high at the public
school board, where fining up
older schools, alternate -day
kindergarten and a dispropor-
tionate tax hike dominated
budget talks Thursday.
Though the Durharn Board
of Education had whittled a
proposed tax hike of 6.7 per
cant down to an average I2 -
per cant nxrease, trustees will
likely chop even further.
That's because the mill
rate, which is based on prop-
erty assessment, varies wide-
ly throughout the region. If
approved now, the budget
would pass on the klwest tax
increase of .01 per cent to
Oshawa public school sup-
poners and the highest of 3.4
per cent to those in Brock
Township. (Ajacians would
be hit with a 2.51 -per cent
hike, Pickering residents 2.07
per cent and Whitby school
board barkers 0.65 per cant)

But $2 million must be

lion on schools which have
fallen into disrepair and
adding general purpose
rooms to 80 -year-old facili-
ties in Oshawa, where stu-
dents must be bused to other
facilities for physical educa-
tion classes.

PICKERING — The Town of
Pickering must adopt a procedural
bylaw 6utlining rules which must
be followed before municipal prop-
crty is sold off, Town council was
told Monday night.
The provincial government's Bill
163 requires that all municipalities
have bylaws for the disposal of
municipal Property in Place by May
1, Town manager Tim Sheffield
said.
Although Pickering adopted a
policy for the sale of Town -owned
land in May of 1990, no bylaw cur-
rently exists. The Town's policy
contains many of the same ele-
ments contained in Bill 163, how-
ever.
Under Bill 163, municipalities
are required to do the following:
- by bylaw or resolution passed
at a public meeting declare the
property to be sold as surplus.
• obtain at least an appraisal of
the fair market value of the real
property. (Council adopted an
amendment to this provision which
states a second appraisal can be
requested by council if necessary.)
• notify the public of the pro-
posed sale of the property.
The sale of property, if consistent
with the bylaw, would not be open
to court challenges, according to
the bill.
The bylaw does not apply when
land is being sold to public bodies
such as other municipalities, school
boards, conservation authorities and
provincial and federal levels of
government -

"One of the main attractions for the
Pickering lands is that the entire east-
ern half of the GTA (Greater Toronto
Area) does not now have an airport
with a runway of adequate length
(6,000 feet) to serve long-haul corpo-
rate jets, let alone mid-size passenger
aircraft," the study says.
The study goes on to conclude that,
even if a corporate -commuter airport
were developed in Pickering,
inevitably, there will still be a need
for a second major international air-
port in Ontario. It points out that
Pearson International is expected to
reach capacity in the next 20 years.
A new major airport development
on the Pickering lands or an expanded
Hamilton Airport are the only viable
solutions to the province's future air-
port needs, according to the study.
Although expansion of the
Hamilton airport would be less costly,
the Pickering site would give planners
greater flexibility. It is located closer
to downtown Toronto and Pearson
airport, has existing train service, and
could serve more than twice as many
people as Hamilton airport because of
its location, the study notes.

is expecting around 600 applicants for
50 job openings.
Michaels, which has opened several
arts and crafts warehouses throughout
southern Ontario in the last year -and -a -
half, says the company will accept job
applications at its new location in
Pickering Monday beginning at 9 a.m.
Michaels will open a 20,000 -square -
foot warehouse in the Pickering Home
and Design Centre, Brock Road and
Hwy. 401, later this spring.
"Hopefully, those 600 people will see

today's News Advertiser) and show up
Monday," company spokesman Rob
Williams says.

Durham Board of Education trustees are about to
take a test April 3. And, taxpayers have their pens
out ready to grade the politicians on how well they
do in Equitable Economics 101.
The trustees meet at 7 p.m. that day at the board's
education centre in Whitby to decide if they should
spend $1 million to patch up schools that have fallen
into disrepair.
The board's new headquarters on Taunton Road
East provide a suitable background for the test of the
trustees. They'll deliberate in what can only be
described as an opulent facility over whether an
operating surplus left over from last year's budget
should be used to offset this year's tax hike or to fix
older schools, some of which can only be described
as antiquated.
Passing a popularity test will be uppermost in
some trustees' minds. Many will think they can earn
an A -plus from overburdened taxpayers by curbing
spending. Others will believe they can be the par-
ents' pets by approving renovations to every school
that could use a new coat of paint.
But, they must instead be guided by the principle
of fairness. Is it fair that some students attend class
in modern, state -of -the art schools while others try to
learn in ancient facilities that were built when the
strap was some educators' favorite teaching tool?
Is it fair that children of people who have just
moved into new subdivisions should attend the most
modern schools while the offspring of long-time res-
idents who used to stoke the fires in one -room
schoolhouses now study in portables at those aging
halls of learning?
We can only hope trustees know the right answer
to those 'Yes' and 'No' questions.

1, Dan Gardiner, my wife and
family would like to take this oppor-
tunity to thank loyal customers who
supported our family -run Food
Town. To those village residents and
fellow merchants that chose not to, it
would have made a difference or I
would not be writing this letter.
To support the family run busi-
ness in our unique village is impor-
tant. This would keep a sense of
community and togetherness that
should be evident- Our town leaders
have not done much to keep the vil-
iage alive in the past and it is a mis-
take. They are mainly interested in
tax revenue from conglomerates.
These large U.S. companies are
putting smaller Canadian stores out
of business. One large US. compa-
ny, came to Ajax and got its own
traffic lights and turning lanes. We in
the village have been fighting for
lights at the corner of Linton and
Hwy.2 for six years to protect our
residents, slow traffic and assist cus-
tomers entering and exiting our
shops. Harwood and Hwy. 2 is being
rebuilt to house and give proper
access to other new businesses which
should benefit from this process.
The changes that are coming to
the village are changes that I have
been fighting for, and are going to be
too little too late for the surviving
few. The residents of the village must
become more interested in support-
ing local stores because our politi-
cians do not seem to be.
Unfortunately for the merchants, no
member of council has a business in
the village. If they did I am sure
things would be different. j

Lawsuit against Metro over Brock

approval in a recorded vote March 6.

PICKERING — About 100 residents living
near a proposed housing development between
Rosebank Road and Rougemount Drive showed
up at Town council Monday night ready to do bat-
tle.
But some last-minute negotiations between
Town councillors and representatives of
Garthwood Homes Limited, the subdivision's
builder, averted a showdown between the Town
and angry residents opposed to a zoning amend-
ment.
The builder had originally asked for an amend-
ment allowing lot frontages to be scaled down
from 15 metres (50 feet) to as small as 13.5 metres
(44 feet) to increase the number of lots in the
Oakwood Drive subdivision to 54 from 48.
But company representative Nick Lazaridis sur-
prised members of the gallery when he announced
Garthwood Homes would drop its zoning amend-
ment request in exchange for smaller sideyard set-
backs on some lots and permission to develop two
lots originally slat-
ed for a neighbor-
hood park.
In exchange. the
Town will receive
a $75,000 cash -in -
lieu of parkland
payment.
"If council
accepts these
changes, we're
prepared not to
continue with the
rezoning applica-
tion," Mr.
Lazaridis said as
several citizens
waited for their
turn to address
council.

frontages, this is a
victory in itself,"

compromise between the developer and the Town.
The meeting briefly turned sour, however, when
one member of the audience attempted to shout
down Ward 3 regional councillor Rick Johnson,
who suggested the Town waive the $75,000 cash -
in -lieu of parkland payment from the developer.
"If we're going to waive the (parkland) why not
work with the developer and waive the payment?
We're already giving up two lots worth about
5400.000,.. he said.
But Ward 1 regional councillor Maurice
Brenner argued that giving up the cash -in -lieu pay-
ment "would be a dangerous precedent" for the
Town to set.
"We're not in the business of handing out
money to the development industry," he said.

Daffodils will soon be spring-
ing up here, as the battle
against cancer continues.
April is Cancer Month
across Canada and the daf-
fodil festival kicks off its
annual fund-raising campaign.
"Cancer is such a prevalent
disease, affecting children,
moms, dads and the elderly.
We all have to help fight it. -
says Cindy Janssen, co-chair
of the festival and member of
the Beta Sigma Phi Sorority,
which has organized the sale
of daffodils in Ajax and
Pickering for the past 18
years.
In 1977, flower sales raised
$1,500 for the Canadian
Cancer Society to fund
research, services for cancer
patients, health programs on
prevention, early detection
and treatment of cancer.
Last year, sales surpassed
$27.000.
During this year's fund-
raising campaign, members of
the sorority and local seniors
clubs will sell daffodils on
Thursday. March 30 and
Friday. March 31 from 4 to 8
p.m. and on Saturday, April 1
from 10 a.m. to 4 p.m.

DURHAM - The murky waters of
Canada's sexual assault laws will be
cleared through the introduction of a
new law, says Durham MP Alex
Shepherd.
The federal government is in the
midst of amending the Criminal
Code to disallow drunkenness as a
defence for committing sexual
assault and Mr. Shepherd hopes the
new law "will be on the books by
mid -summer."
The law is being changed in the
wake of last September's decision by
the Supreme Court of Canada that
allowed extreme intoxication to be
used as a defence in a sexual assault
case.
In the widely -publicized Daviault
case, the defence successfully argued
the degree of intoxication rendered
the defendant unconscious of the
crime being committed.
"I understand the law and the judi-
cial process and how the Supreme
Court arrived at the decision," said
Mr. Shepherd.
"But it's not consistent with soci-
etal attitudes today, so it's appropri-
ate legislators step in. It's hard to
imagine a situation that someone
was so intoxicated they were uncon-
scious but could still commit a
crime."
In the Daviault case, the Supreme
Court judges who ruled for the
defendant -- including two female
judges -- looked upon the defence
argument in a similar vein as a plea
of insanity.
After the decision was handed
down by the Supreme Court, Mr.
Shepherd said his office received
phone calls and letters requesting
government action.
"We immediately got reaction -- a
good portion from females -- who
see this as a threat and want it rew-
fwd and yes, we should change it,"
Shepherd said.
The new law is being fast -tracked
through the House of Commons and
should be in the bands of the Senate
by late May, Mr. Shepherd said.

set a direction for the courts that
laws in the area of intoxication and
sexual assault have been interpreted
too liberally," said Mr. Shepherd -

Vehicle owners who don't nor-
mally drive between 1 am. and 5
a.m. are the prime target group for
participation in the program.
Drivers put a highly visible sticker
in the rear window of the vehicle
which indicates that vehicle owner
has given police consent to pull the
car over and verify the driver's
licence and ownership when it is
being driven between those hours.
Last year auto thefts in Durham
increased by 50 per cent compared
to 1993 totals.
"In Oshawa car thefts were up
about 90 per cent," St. Sgt. Ryrie
says. "Many of the car thieves are
under 18 years."
Many of the thefts are joy -rides
and many cases involve alcohol he
says.
' Ihere's not only the destruction
of vehicles to worry about, there's
the loss of lives. That's something
we see too many times."
Participation in the program is
free and registration forms can be
picked up at any CAA office or at
any Durham Regional Police divi-
sion. Mail completed to Crime
Prevention Ontario for processing.

A balance beam specialist, the for-
mer member of the Winstonette
Gymnastic Association placed fourth
on the beam for the Hawkeyes at
their most recent meet at the Swphar" Wessely
University of Oklahoma.
Wessely is currently the highest ranking Hawkeye gym-
nast on balance beam, seeded 25th in the U.S. In the central
region, in which Iowa State competes, she's currently
ranked 10th on beam.
The University of Iowa women's gymnastics team travels
to Champagne, Illinois for the Big Ten Conference
Championships this Saturday.

dedicated years to coaching hockey. Or, it
can be the crossing guard who spends >a
little extra time with children. Hometown
Heroes come in all shapes, sizes, colors and
ages.
We need you to tell us who you think is a
Hometown Hero.
On April 5 we'll publish a story and picture
on each of the 50 Hometown Heroes we've
selected. The hero and a guest will be
honored at a dinner to be held at Gallantry's
in the Pickering Town Centre. The hero will
receive a commemorative T-shirt and
plaque.
