Harrington Deed for $2.500 Two his ______ Mrs Ed Thornton Bond for 2.000 James Thornton mortgage for 2.000 McKenzies Mtg .450 Pugh Mtg 1.250 " "Report of John E. Farewell on the title to the E ½ of the E. ½ of Lot No. 22 in the 4th Concession of Pickering. The whole of lot was patented to Peter Robinson on the 14th of November 1803. The first registration affecting the title is no 13527on the abstract which is a Memorial of a deed Poll dated the 26th of Nov 1836 and registered on the 28th December 1846 and whereby John Stotts of Pickering Yoeman for 350 pounds ____released and quit claimed to Thomas Nelson Scripture of the same place. All his right title etc in and to all and singular the north half of lot no. 22 in the fourth concession of the Township of Pickering which said lands are butted and bounded or may be otherwise known as follows that is to say Commencing at the North East angle of the said lot Then South sixteen degrees East. Fifty-chains to the centre of said lot Then South seventy four degrees west twenty chains to the side line between lots nos 22 and 23 Then North sixteen degrees west fifty chains to the concession line in the rear of said lot Then north seventy four degrees East twenty chains to the place of the beginning. The instrument purports to have been witnessed by Sidney J. Hamilton of Toronto. Innkeeper Ezra Bates of Pickering farmer and John Crawford of Toronto Gentleman. I do not see what right John Stotts had to release to T.N. Scripture as the lot was patented to Peter Robinson and up to this date Peter Robinson does not " "appear to have sold to John Stotts or any other person. John Stotts’ wife does not appear to have relased her dower. The Mortgage number 16137 on abstract by William Proudfoot and wife to Henry Moyle appears to have been property discharged by No. 24886 on abstract. Though what right Wm Proudfoot had to mortgage the premises I cannot accertain by reference to the Registrars books. The next registration affecting the title is a memorial of a Deed dated the 10th of December 1852 and registered on the 15th Dec. 1852. Whereby William Proudfoot of Toronto and Caroline Proudfoot (for the purpose of barring her dower) for 150 pounds conveyed to David Thornton of Pickering the North East quarter of lot number 22 in the fourth Concession of Pickering absolutely This deed purports to have been witnessed by James Henderson of Toronto Caroline Proudfoot properly barred her dower. I cannot find any right that Wm Proudfoot had to deal with the property. The next registration is the Will of Daniel Thornton (No. 379 in abstract) by which the following bequests and Devices are made (1) He provides for payment of funeral charges and just debts (2) He then bequeaths to his sons Amos Thornton William Edward Thornton and Thomas Thornton one bed and bedding each. The remainder of his household furniture he bequeaths to his daughters Lucy" "Ann, Ellen Jane, and Elizabeth Thornton share and share alike as near as possible (3) (This I should have inserted before I did the last clause) He gives his wife Elizabeth Thornton the use and benefit of all his real and personal estate during her natural life and after her death. (Here clause No.2 should have been inserted by me) (4) The remainder of his real and personal estate he then gives and bequeaths to his Executors in trust to be sold in such manner and on such terms as they shall determine and to pay the proceeds to his children as follows. (a) To his daughter Lucy Ann Thornton $ 300 (b) To his daughter Ellen Jane Thornton $ 300 (c) To his daughter Elizabeth Thornton $300 (d) To his son William Edward Thornton $250 (e) To his son Thomas Thornton $250 (f) To his son Wm Ed Thornton ¼ of balance (g) To his son Thomas Thornton ¼ of balance (h) To his son Amos Thornton ¼ of balance (i) To his son James Thornton ¼ of balance The will then proceeds to say; That if at their mother’s death his sons are desirious of Keeping the property in their own names. It was his will that they should do so if they paid their sisters the amounts due them within three years after the death of their mother He also desires his sons to work the farm during the lifetime of their mother and they are to have the use and benefits thereof except what is required for the support and maintenance of their" "Mother and unmarried sisters living at home. The real Estate is described as being the N.E ¼ of lot No. 22 in the 4th and the S.E ¼ of lot 23 in the 5th con of Pickering. As his son Asher Thornton had already been provided for he makes no provision for him in the will His sons James Thornton, William Edward Thornton and Thomas Thornton were appointed his executor. Daniel Thornton died on the 31st of March 1869 and his will was registered on the 8th of July 1869. Under his will the following 8 persons are interested in the Estate of Daniel Thornton 1-Ellizabeth Thornton his widow 2-Lucy Ann Thornton his daughter 3-Ellen Jane Thornton his daughter 4-Elizabeth Thornton his daughter 5-Wm Ed Thornton his son 6-Thomas Thornton his son 7-Amos Thornton his son 8-James Thornton his son The next registration is No. 646 an abstract whereby Amos Thornton and Anna Thornton his wife bargained sold and quit claimed for $800 to William Edward Thornton all his rights, title interest &c in and to the N.E ¼ of lot No. 22 in the 4th and the S.E. ¼ of lot No. 23 in the 5th Con, of Pickering. Were Wm Ed Thornton and Thomas Thornton in possession of the premises on the 30th Dec 1869 the date of said release. " "The next registration is No. 2660 , an abstract and is dated 30th Nov, 1876 whereby William Edward Thornton of the Village of Markham Soda Water manufacturer and Almira his wife granted released and quit claimed to Thomas Thornton of Pickering farmer all their right title &c in and to the said lands (described as in No. 646). The next registration is a Bond (No 4335 on abstact) by Thomas Thornton in favor of Almira Thornton wife of Wm Ed Thornton for $2,000. and dated on the 30th of Nov 1876. The said bond to be void on pay[ment] to the said Almira Thornton of $1,000 in lieu of Dower by Thomas Thornton.. Immediately after the decease of Elizabeth Thornton the widow of Daniel Thornton. The bond has never been discharged so far as is shown by the registrations The next registration is a Deed (No 4336 an abstract) dated 25th September 1880 and registered 15th June 1881 – Whereby Elizabeth Thornton widow of the late Daniel Thornton, James Thornton, Thomas Thornton, Eleanor Jane Thornton All of Pickering, Lucy Ann Wilkinson born Thornton of the Township of South Dorchester County Elgin, Devisees of said Daniel Thornton of the first part, Thomas Wilkinson, Mary Thornton wife of James Thornton and Saloma Thornton wife of Thomas Thornton of the Second part-conveyed to James D. Harrington of Markham the said lands for $2500 The next and last registration affecting the title is No 4406 an abstract and" "a deed dated 1st April 1881 and registered on the 13th Oct. 1881 Whereby James Thornton, William Edward Thornton and Thomas Thornton as Executors under the will of Daniel Thornton and Elizabeth Thornton the widow of Daniel Thornton Convey to James D Harrington the above lands for $2500. This deed recites that they convey under the power received by the Executors of Daniel Thornton . They enter into all the covenants contained in the usual form of conveyances pursuant to the Act respecting short forms of conveyances and they convey free from all encumbrances As to T.N. Scriptures interest in the above lands I may say some years ago I acted for his administratux in winding up his estate and I never heard of any claim to this land. It may not have been the same Scripture but the T.N. Scripture whose estate I wound up was an Hotel Keeper in Whitby John E Farewell " "Registrations 1. Evidence of the right of John Stotts to deal with the property on the 26th Nov 1836 2. Declaration that at that date John Stotts was unmarried or a widower or that his wife has since died or that at that date the land was in a state of nature 3. Decleration as to possession of Thomas Nelson Scripture on 26 Nov 1836 4. Evidence of the right of Wm Proudfoot to deal with the property on the 10th of Dec 1852 5. Decleration of possession of Wm Ed Thornton and Thomas Thornton on 13th Dec 1869 6. A similar Declaration as to possession by Thos Thornton on 30th Nov 1876 7. Discharge of Bond No 4335 on abstract 8. Decleration that Ellen Jane Thornton mentioned in the will of Daniel Thornton is the same person as described in the deed No 4336 on the abstract as Eleanor Jane Thornton 9. Release of interest by the husband of Eleanor Jane Thornton in a decleration that she was unmarried on the 25th Sept, 1889 10. Release by Elizabeth Thornton the daughter of Daniel Thornton and her husband if she has one 11. Declaration having possession of the property as far back as possible "
