" "L.S. $5.60 IN THE SUPREME COURT OF ONTARIO. IN THE MATTER OF the Estate of NICHOL McINTYRE, late of the Township of Pickering, County of Ontario, Farmer, deceased. Wednesday, the 9th day of March, 1932. Pursuant to the Judgment herein, dated the 8th day of January, 1932, having caused an office copy thereof to be served upon Edith Bevans, Adelia Mechin, Frances Thornber, Thomas C. Brown, Walter Borsberry, Donald Robert Beaton and the Official Guardian, and having issued a Warrant, dated the 1st day of February, 1932, and having caused the same to be served upon the above-named parties, I proceeded to dispose of the matter referred to me, and thereupon was attended by Adelia Mechin, Walter Borsberry and Donald Robert Beaton, and in the presence of Solicitor for the said Donald Robert Beaton (none of the other parties attending although served with due notice) I find as follows: 1. That Edith Bevans, of the City of Toronto, is entitled to one-seventh of the residuary estate of the said deceased, and being the share of Flora Robson, deceased. 2. I also find that Catherine Yong was entitled to a one-seventh share in the residue of the estate, and died intestate survived by seven children, namely: (a) Frances Allaway, died intestate, survived by the following, whose shares are as follows: (i) Rupert Allaway, Whitby, Ontario, 1/245th. (ii) Leslie Allaway, U.S.A. 1/245th. (iii) Frank Allaway, Whitby, Ontario, 1/245th. (iv) Helen Beal, died October 30, 1930, intestate, survived by: " "-2- (a) Husband, John H. Beal, Claremont, Ontario, 1/735th share. And two children: (b) Maude Beal, Claremont, Ontario, 1/735th. (c) Ethel Beal, Claremont, Ontario, 1/735th. (v) Kate Thexton, Toronto, Ontario. 1/245th. (b) Eleanor Allaway, died intestate, survived by one daughter: (i) Ethel Lepior, Lansing, Michigan, who is entitled to a 1/49th share. (c) Mary Ann Poucher, Toronto, Ontario, died intestate, survived by two children: (i) Norman Young Poucher, Toronto, Ontario, 1/98th share. (ii) Adelia Mechin, Pickering, Ontario, 1/98th share. (d) Rachel Mitchell, died intestate, survived by: (i) Bertis L. Mitchell, Carland, Michigan, 1/147th share. (ii) Truman P. Mitchell, Los Angeles, California, 1/147th. (iii) Eva Horn, Flint, Michigan, 1/147th. (e) Annabella Mitchell, died intestate, survived by one son: (i) Robert F. Mitchell, Ovid, Michigan, 1/49th share. (f) Robert Nelson Young, died intestate, survived by five children: (i) Elizabeth McFadden, Flint, Michigan, 1/245th share. (ii) Myrtle Elsemore, Flint, Michigan, 1/245th share. (iii) Ida Simpson, Minneapolis, Minn. U.S.A. 1/245th share. (iv) James Young, Waterloo, Iowa, U.S.A. 1/245th share. (v) Lloyd Young, Des Moines, Iowa, U.S.A. 1/245th share. (g) Joseph Young, died intestate, survived by the following children: " "-3- (i) Nina Young Clark, Lansing, Michigan, 1/147th share. (ii) May Young Brooks, Lansing, Michigan, 1/147th share. (iii) Bertha Young Hicock, Lansing, Michigan, 1/147th share. 3. I also find that Eliza Johnson was entitled to a one-seventh share in the residue of the estate of the said deceased, and died intestate. All of her children are now dead, and the following have left heirs surviving: (a) John Johnson, deceased, survived by: (i) Widow, entitled to a 1/84th share. (ii) Daugher, Mrs. W.G. Ferris, New Westminster, B.C. 1/84th share. (b) Joseph Johnson, deceased survived by the following children: (i) Joseph Johnson, Minneapolis, Minn. U.S.A. 1/210th share. (ii) Herbert Johnson, Texada Island, B.C. 1/210th share. (iii) Roy Johnson, Edmonton, Alta. 1/210th share. (iv) Mrs. Evan Jevne, Wetaskiwin, Alta. 1/210t share. (c) Nichol Johnson, deceased, survived by: (i) WIDOW, Eleanor Johnson, Toronto, Ontario, 1/84th share. (ii) Florence Eleanor, Toronto, Ontario, 1/84th share. (d) Jane Johnson Thornber, deceased, survived by: (i) Son, Herbert, died intestate, survived by: (a) Widow, Violet, who is entitled to a 1/504th share, and also three children: " "-4- (b) Fraser Thornber, 1/756th share. (c) Herbert Thornber, 1/756th share. (d) Laura Thornber, 1/756th share. all of the City of Toronto. (ii) Georgina Symons, died intestate, survived by two daughters: (a) Mrs. Guy Hume, Toronto, Ontario, 1/336th share. (b) Mrs. Cuthburt Woodhouse, Toronto, Ontario, 1/336th share. (iii) Laura, Buffalo, N.Y. 1/168th share. (iv) Frances, Buffalo, N.Y. 1/168th share. (e) Hannah Johnson Haley, died intestate, survived by one daughter: (i) Mrs. Pearl Haley Patrick, Kansas City, Missouri, U.S.A. 1/42nd share. (f) Elizabeth Johnson Thomson, died intestate, survived by the following children: (i) Charles, Richmond Hill, Ontario, 1/168th share. (ii) George, Toronto, Ontario, 1/168th share. (iii) Laura, Toronto, Ontario, 1/168th share. (iv) Leo, Cooksville, Ontario, 1/168th share. 4. I also find that Rachel Beaton, deceased, was entitled to a one-seventh share in the residue of the estate, and the following persons are entitled to share, in the following proportions: (a) Hannah Beaton, Hamilton, North Dakota, 1/28th share. (b) Estate of John S. Beaton, Oshawa, Ontario, 1/28th share. (c) Donald Robert Beaton, Whitevale, Ontario, 1/28th share. (d) Hector Beaton, 1/28th share. " "-5- 5. I also find that Margaret Brown, deceased, was entitled to a one-seventh share, which share is divisible among the following, in the following proportions: (a) Isabella Brown, Brougham, Ontario, 1/21st share. (i) John W. Gerow, Brougham, Ontario, 1/42nd share. (ii) Phyllis Mowat, Brougham, Ontario, 1/42nd share. (b) Thomas C. Brown, Brougham, Ontario, 1/21st share. 6. I also find that Archibald McIntyre, deceased was entitled to a one-seventh share in the residue of the said estate, and the share is divisible among the following, in the following proportions: (i) Walter A. Thomson, Toronto, Ontario, 1/70th share. (ii) Louisa Thomas, California, 1/70th share. (iii) Edith Thomas, California, 1/70th share. (iv) Hattie Thomas, California, 1/70th share. (v) Florence Thomas, California, 1/70th share. (a) Walter Borsberry, Oshawa, Ontario, husband of Eliza Jane McIntyre, 1/14th share. 7. I also find that Dugald McIntyre, deceased, was entitled to a share of one-seventh, which share he devised by his Will, dated 2nd April, 1895, to Donald Robert Beaton, who is entitled to the said one-seventh share.
