At the request of John A. White, Esq., Reeve, I have
carefully Ooneldered the provisions Of the Liquor License Act
with reference to the submitting a BY4Law to the Electors for the
Repeal of the By-law probiblting the sale of Liquors by retell
in Plakering.
Under Bastion 141 of the Act provision to made for the
compulsory anbmDesion of the original or lest mentioned By -Law
open the petition of at least twenty-five per sent Of the total
number qualified to vote. And under Sub-eeotion 6 of Section
141 the repealing By -low is to be submitted and approvedin the
same manner am the orlglnel Byilaw.
If, therefore, a petition signed by the requisite am -
ter Of Electors has been presented to the Council in manner pro-
vided for in the Act praying for the sobmissiea of the repealing
By-law it will be the duty of the Council to submit the repealing
By-law to a vote of the Municipal eleotera at the proper Municipal
election. I an fortherof opinion that in either ease Of the
original or repealing By-law gush a By-law Mair at the dbearetion
of the Council be aubmi tted to the alecters even if no petition,
or an.dneufflelent petition hes been presented to the Council.
