An Ajax man has beenconvicted of defying a pro-vincial stay-at-home order imposed during the CO-VID-19 pandemic after ajustice of the peace rejectedhis argument that a trip with friends to get food wasan allowable exceptionwritten into the legislation.Rather than being com-pelled to make a necessarytrip to provide for himselfor his family, Jaelen Gon- salves-Borrice was morelikely "socializing" with"buddies" when he wasstopped by a Durham police officer in Pickering, Justiceof the Peace Kevin Hunterruled. "Even if I accept his evi-dence at its highest, I findthat the defendant was stillengaged in the very beha- viour the stay-at-home or-der sought to prohibit,"Hunter wrote in a recently- released ruling.During a trial held by te-leconference in early Janu- ary, Hunter heard that Gon-salves-Borrice was amongfour people in a car stoppedby a Durham police officer in the area of Kingston andFairport Roads on the nightof May 6, 2021. The officer stopped the car after seeingit and another vehicle in anotherwise empty parkinglot, court heard. At the time a provincial stay at homeorder, imposed to slow thespread of COVID-19, was inplace. The four people in thecar were charged with con-travening the Emergency Management and Civil Pro-tection Act. Gonsalves-Bor-rice represented himself attrial, testifying that he and three of his friends, who alllive in separate residences,had driven to Toronto that night to get food. Whenspotted by police they wereparked and consulting Goo-gle Maps to determine the fastest way for them all toget home, he said.Gonsalves-Borrice said that while he and hisfriends were together in thecar, all wore masks in rec- ognition of the public health mandate.In judging the case,Hunter had to determine if Gonsalves-Borrice wasguilty of attending a socialgathering in defiance of theemergency order, or if he was eligible for an excep-tion under the order - thelegislation made allowanc- es for people who found itnecessary leave their resi-dences to get food."The defendant's testi- mony left with me with theimpression that he believedthat he was permitted to leave his residence thatnight for the purpose of get-ting food. His testimony on-ly makes sense in that con- text," Hunter wrote. Ultimately, Hunterfound that the exception inthe legislation did not apply to Gonsalves-Borrice'scase."This exception allowed an individual, not a group,to leave home to get foodwhich was necessary tosustain that person and/or their family. It was not aninvitation for the defendantand his buddies to grab a meal and hang out," Hunterwrote. "In my view, it is farmore likely that the defen-dant was simply out social- izing in a group, rather thanan individual who left hometo get food out of necessity." Hunter found Gon-salves-Borrice guilty ofcontravening the act. Most at home in boreal and mixed coniferous for- ests, these fluffy-tailed ro-dents can also thrive in res- idential areas where ever- greens abound, and I've gotten to know them better watching out my window than I ever have on a canoe trip. Don't let those big dark innocent eyes fool you. Red squirrels are anything but sweet and cuddly, no mat- ter how adorable they look sitting up on their haunch- es nibbling a sunflowerseed. These nimble, high- speed tree climbers have one thing on their mind: comfort and survival,which they ensure with their Me First attitude. Not that they don't havegreat entertainment value, dashing through the yard and keeping all other occu- pants on alert, even muchlarger grey squirrels. Red squirrels are territorial year-round, so you neversee two together peacefully sharing seeds under a feed- er. Classed as "larder hoarders," they spend latesummer and autumn fran- tically clipping cones from conifers and piling them in a heap under a tree for win- ter. And then defending their cache from all com- ers, while trying to stealmore from the neighbours. But they have to be bold to stay alive. Being so small, without fat reserves, they burn a lot of calories to keep warm, even wear-ing thick winter underfur and sleeping in snug tree cavities by night.You'd think our local red squirrels would know by now that we're not going to leave them hungry after asnowfall, so they should just relax and enjoy the "free food" we put out. Buteven in the midst of plenty they keep caching, burying sunflower seeds in the ground or snow. I watcheda junco feeding near a hole in a snowbank, only to fly off in alarm when a red squirrel came barreling out. With an ancient cedar hedge on one side, a sprucehedge on the other and white pines at the rear, our yard seems to be where three red squirrel territo- ries overlap. The occu- pants all squabble with each other, but the one onthe east side also seems to have it in for any male car- dinal that flits down to "his" patch under the lilacswhere we scatter bird seed. I watch from the dining room window at lunchtimeas, over and over, a red car- dinal shows up and the squirrel puts it to the chase. Minutes later, the jun- cos, tree sparrows and mourning doves will have settled in eating again. But as soon as the cardinal re- joins them, whoosh! Here comes the red squirrel. Oshawa experiencedone of the largest snowfallsit has experienced in years. As a citizen of Oshawa, itwas astounding to see bothcity staff and citizens ofthis great community come together to supportone another in this tryingtime. Whether it was clear- ing a neighbour's snowwindrow, pushing carsstuck on snowy streets, oroffering a hot beverage to those working hard to clearthe roads, acts of kindnesswere seen throughout thecity. As an employee, I washumbled by the outpour-ing of kindness and under-standing from our resi- dents. I'd like to extend mythanks and give the snow- removal operations teamsome well-deserved recog-nition. I would also like to rec-ognize the efforts of thewaste department as theytrudged through windrows and snowbanks and bravedfrigid temperatures to col-lect waste, the parks de- partment for keeping thetrails and various park lotsclear, as well as making La-keview Park and other ar- eas safe for residents touse, which is crucial dur-ing lockdown, the forestrycrews clearing branches, fallen trees and brush fromthe aftermath of the highwinds, the fleet team for keeping the wheels turn-ing, and the facilities group for clearing out snowaround buildings and pro- viding entry for virtualprograms to continue. Each department showed commitment to pro-viding this community withquality services. In snow-cleanup efforts like these, personal sacrifices aremade in order to keep upwith the level of service that our community has come toexpect of our city staff.We are a communitybuilt upon a historic and strong foundation of la-bour and unity. As our cityexpands and grows, wemust not forget this foun- dation and that the work-ing people of Oshawa con-tinue to support each other. Kevin Alexander Sweeney lost his life at 63 years of age due to medical complications surrounding an abdominal aortic aneurysm. His passing was unexpected and sudden. The devastating loss of Kevin will likely reverberate through the lives of his family, friends, and community for many years to come. Kevin was born to David and Joan Sweeney in Toronto, Ontario. From a very early age, he was found always building, breaking, and fixing - Kevin loved to tinker. He attended Danforth Collegiate and Technical Institute where his aptitude for technology and electronics blossomed. He turned that proficiency into a 42 year long career with Bell Canada as a Computer Technician and IT Infra- structure Specialist. For more than 25+ years, Kevin was a long-standing and enthusiastic member of the Ajax-Pickering Ringette league, and Ringette Canada. During those years he wore many hats - Asst. Coach, Coach, League Coordinator, Fair Play Project, Ajax Assoc. Board Member, Central Region Board Member, Ajax/Pickering Assoc. Board Member, Tournament Committees, and Ringette Ontario Member. To say the rink was his second home would be a gross under- statement. He vehemently believed that everyone deserved to experience the joys of ringette and the right to play. He fought every day, tirelessly, for every underdog he knew. Kevin is survived by his mother Joan Sweeney; his admired wife of 40 years, Carol Sweeney; his beloved daughters and son-in-laws, Candice Sweeney and Paul Evans, Meagan Sweeney and Mihael Fofic, and Jacilyn Sweeney and Cameron MacDonnell; his treasured grand-daughter, Quinn Sweeney MacDonnell; and his dear sisters and their spouses, Cheryl and Dave Shannon, and Kim and Eric Belanger. She was a board member with the Pickering Figure Skating Club and the Rose of Durham, actively dedicating her time and energy. Louise loved her family and friends more than anything and always did everything she could to ensure they were taken care of. She loved to knit and sew and she created many sweaters, outfits, costumes and bears with her talent. She will be missed dearly by all.
