The 23-year term recom-mended by the Crown anddefence for Babar Ali - he islinked to what is consideredthe largest seizure of carfen-tanil ever in Canada -- is ap-propriate, but ought to be re- duced to reflect the hardtime he's served in pretrialcustody, and will continue toexperience in penitentiary, Superior Court judge CaryBoswell ruled. The judge re-duced the 23 year sentence by five years."I am of the view the sen-tence imposed - 18 years - re-mains fit," Boswell said in an Oshawa courtroom Friday,Feb. 11. Boswell also gave Alienhanced credit for his time in pretrial custody, leavinghim 12.5 years to serve. Alihas also been ordered to paya fine of $1 million. Ali, 34, pleaded guilty lastNovember to a total of 34charges - he was originally facing 111 charges - one relat-ing to the possession of morethan 26 kilograms of carfen-tanil, a powerful opiate, and the remaining 33 linked tothe seizure of more than 30semi-automatic handgunsand other weapons. The drugs and guns werediscovered by firefightersresponding to a carbon mon- oxide alarm at a residenceon Liartis Drive in Pickeringon Sept. 20, 2017, accordingto an agreed statement of facts entered during thehearing. Firefighters ob-served plastic totes full of a chalk-like substance, as wellas cookie trays full of thesame substance on a count- er, court heard. Durham police obtaineda search warrant and even-tually removed 26.5 kg ofcarfentanil mixed with caf- feine, and 33 firearms alongwith a large quantity of am-munition, court heard. Ali's guilty pleas sparedhim an even longer sen-tence, the prosecutor said:"Had this matter gone to tri- al, this case clearly wouldhave called out for a life sen-tence."Boswell accepted the joint submission on sen-tence from the Crown anddefence, but took note of the hardships Ali has facedwhile in provincial jailsawaiting trial. Prisoners in jails like Lindsay's Central East Corrections Centrehave endured long stretchesof being locked down in cells during the pandemic, thejudge acknowledged. Ali contracted COVID-19during this pretrial custody and also endured violenceand racial slurs, courtheard. Pandemic restric- tions " will continue to makeprison life more miserablethan it would normally be,"Boswell said. In addition to his prisonsentence and $1 million fine,Ali was ordered to pay more than $11,000 in restitution tothe family that lived up-stairs in the Pickering resi-dence at the time of the bust. V An Ajax man was one of two people ar-rested in Welland on drug trafficking charges.The Niagara Regional Police seizeddrugs with an estimated value of more than $45,000. Police started an investiga-tion into the sale of fentanyl from a homein the Lyons Avenue and Hagar Street ar-ea, police said. On Wednesday, Feb. 9, police carriedout a search warrant and two suspectswere arrested.Seized in the raid was $2,140 in Canadi-an currency, 37 grams of fentanyl, 337grams of cocaine, and two grams of crys-tal methamphetamine, police said, with an estimated total street value of $45,040.Tevin Simpson, 24, of Ajax, and Anto-nio Webb, 21, of Brantford, were arrested.Each faces three charges of trafficking a schedule 1 substance (cocaine, fentanyl,and crystal methamphetamine) and onecharge of possession of proceeds obtained by crime under $5,000.The pair were released on an under-taking with a future court date. AJAX MAN BUSTED ON DRUG TRAFFICKING CHARGE A 17-year-old has been charged withsecond degree murder in the death of aPickering man.Quinton McDonald, 32, was shot and killed in a townhouse on Dragonfly Ave-nue in Pickering in September 2021.Durham Regional Police responded to townhouse in the Taunton Road and Sap-phire Drive area on Monday, Sept. 27 atabout 11:30 p.m. Several shots had beenfired and McDonald was found with mul- tiple gunshot wounds, police reported atthe time.Two occupants were found at the sceneand arrested. McDonald and the two oc-cupants lived in the residence, police add-ed.On Thursday, Feb. 10, Durham homi- cide investigators arrested a 17-year-oldboy who lived in Richmond Hill.He's been charged with second degreemurder and several firearms charges. They're the longest-liv- ing creatures on the planet,outlasting humans by hun- dreds of years when we don't cut them down. They're the tallest by far,true giants. With their feet in the ground and arms in the sky, they serve as the skin of planet Earth, hold- ing soils, regulating water cycles, cleaning air. Every single tree growing today,no matter how big or tiny, is doing its best to reverse our climate-change dilem- ma, and deserves a grateful pat, a hug, a murmured thank you. So while we're out walk-ing in the yard, neighbour- hood or local nature re- serve, we should do that. Share the love, as my Zoomfitness coach Cindy Legare often says. What's not to love about a tree?Let's get to know them, too — as individuals, with their own quirks and char- acteristics. Every kid inCanada should be able to tell an oak from an ash from a maple. A willowfrom a poplar or birch. A white pine from a red pine, spruce, balsam fir or tama- rack. How many of us adults can? And how many parents make sure their little ones learn to observe and value trees? Shade providers, wind breakers, slope stabi-lizers: they're vital to our lives. Who doesn't remem- ber a special tree they loved during childhood? Or one they planted?Winter is the ideal time to get up close and personal with trees, when they're bare of leaves and not fullof birds to distract you. Take a good look at the bark — thick layers of deadcells protecting the tree from drying out, from the cold and from attacks by in- sects and disease. Some are smooth and sinuous, and some have cracks, curls, ridges andgrooves, providing habi- tats for spiders, beetles and millipedes, and subse- quent food for browncreepers and nuthatches, plus scaffolding for li- chens, mosses, ferns and fungi. If there ever was a hy- draulic miracle of nature, trees are it, with sapwoodpipelines carrying water and minerals from their roots up to their buds and branches, and sugars from their leaves to every other part, energy captured from the sun and made usablefor many other forms of life, via fruits, nuts, flow- ers — and maple syrup! The cambium is thegrowing layer, manufactur- ing cells inside and out, so a tree expands its girthover the years, adding more and more heartwood, fibrous cells glued together with lignan to make itsspine as strong as steel. The CTA knew how these truckers felt beforethe protest, but did not lis-ten to them. Neither the prime minister nor any-body else has bothered ask-ing about their plight. Thetruckers had no choice but to protest. Further, theCTA insinuates that theprotest is not organized and lawful.However, it is both.Finally, the last state-ment written by Mr. Las- kowski is quite disturbing:"We must adapt and com-ply with this mandate." Heis asking others to comply without question. If onedeems something immor-al, unethical and anti-dem- ocratic, one must not com-ply. To comply to a govern-ment-imposed mandate that one does not agreewith is to say that the state has control over one's freewill. If one is forced to do something through coer-cion or bullying, that is notconsent. In a democracy,one must consent through one's own free will forsomething to be valid. Tocomply by force is what happens in totalitarianstates, which it seems he isadvocating for, just like thefederal government. In a trial where Fennchose to defend himselfand offered no defence onhis own behalf other than bizarrely rambling aboutfinding his soul, SuperiorCourt judge Howard Lei-bovich was left to deter-mine whether his claims ina police interview that hewas in a cocaine-induced psychosis were a mitigat-ing factor.Ultimately, Fenn wasconvicted of second-degree murder in the deaths ofKrassimira "Krissy" Pejci-novsk, her 15-year-old son Roy and 13-year-old daugh-ter Venellia.Krissy and Roy werefound dead at 36 Hilling Dr. in Ajax on March 14, 2018,and Venellia — Vana to herfriends — was found griev- ously wounded in the base-ment of the home and laterdied in hospital.Fenn was arrested that same day in Oshawa afterhe was found hiding in ashed and he confessed to the murders in an inter-view with Durham policeon March 15.In the interview, he claimed that he was in a co-caine psychosis and also of-fered up some details of themurders. In a lengthy ruling onFeb. 11, Leibovich said thatwhile he believed Fenn was using cocaine, he did notbelieve his claims of memo-ry gaps or a cocaine-indu-ced psychosis. He pointed out thatFenn's claims of memoryloss were inconsistent with saying he didn't want to re-member and with his de-scriptions of the crimes. Fenn's claims were alsoinconsistent with experttestimony on the effects ofcocaine, which is not known to prompt black-outs, as well as testimonyon how quickly cocaine is metabolized, said Leibov-ich.Krissy and Roy werelikely killed some time af- ter midnight but before 5a.m. as Fenn wiped his cell-phone at that time, said the judge.He also made an effortto conceal Krissy's body,hiding her under a pile of tires in the garage.Witness testimony nar-rowed the attack on Venel-lia to a short window after 10:30 a.m. the day of the kill-ings.A friend sleeping over noted that the teen girlwent downstairs in searchof her mother. Ten minuteslater Krissy's boss Sherry Robinson arrived andspoke to Fenn. Robinsonwould describe seeing blood on Fenn's clothes.Police arrived shortlyafterwards but Fenn hadfled. He was caught on cam-era at a gas station just af-ter 11 a.m. in Pickering and all the witnesses, includingVenellia's friend, Robin-son, the gas station atten-dant and the taxi cab driver who drove Fenn to Oshawa,said he didn't seem im-paired. In fact, experts had tes-tified that someone in astate of cocaine psychosiswould have had difficulty driving to Pickering."It shows he was not in-toxicated when he attackedVanna," said Leibovich, pointing out that Fennknew what he was doing ashe told police he purpose- fully looked away whilekicking the girl during a"savage attack."Leibovich pointed to Fenn's own words to policeas his motive for killingKrissy: he was enraged that she was accusing himof cheating. He beat andstrangled her in the garage and when she continued to breathe, Fenn got a knifeand killed her."I found that his rage inkilling Krissy led to his at- tack on Roy. With respect toVanna, I find that Mr. Fennattacked her in a futile, pathetic attempt to escapedetection."By the time Mr. Fennattacked Vana, he had al- ready killed Krissy andRoy and buried Krissy'sbody under tires and gar- bage bags ... Vana came tohim looking for her motherand he murdered her for it."As to Fenn's claims dur-ing his trial that he hadfound his soul and true purpose while incarcerat-ed, Leibovich handily dis-missed those claims. "This is not a valid de-fence."Following his verdict, Leibovich asked Fenn if hewanted to retain a lawyerfor his sentencing, point-ing out that murder carries an automatic life sentenceand the main issue to deter-mine in sentencing is when Fenn would be eligible toapply for parole. The mini-mum time is 10 years. Fenn declined and Lei-bovich determined thatFenn's former lawyer, whowas appointed as a friend of the court to ensure he re-ceived a fair trial, wouldcontinue to serve in that role for sentencing.He will be sentenced onMarch 18. Following the birth of their daughter Lynn, they decided to start a new life in Canada and immigrated to the Toronto area in 1957. After searching for just the right career, Bill settled into Honeywell Canada and he and Margaret purchased a home in Pickering, with the birth of son Craig they completed their "millionaires' family". Bill enjoyed life, he loved a good joke, a good beer, playing the drums, boating on Lake Ontario, and curling. Bill retired in 1997 to start a new career (golfing), truly a life well lived.
