Fenn was representinghimself in the murder trial;however, Superior Courtjudge Howard Leibovich had appointed Fenn's for-mer lawyer Mary Cremeras amicus curiae, a friend of the court, to help ensureFenn's right to a fair trialand afforded Cremer theopportunity to also make closing arguments onFenn's behalf.Cremer argued the evi-dence — including a con- fession to police — showedFenn was responsible forthe deaths but questioned whether Fenn had the req-uisite state of mind to beconvicted of second-degreemurder or whether he should face conviction forthe lesser charge of man- slaughter due to his co-caine intoxication.Cremer also addressed a potential automatism de-fence — which refers to ac-tions performed withoutconscious thought or in- tention — and acknowl-edged that expert medical evidence would be re-quired to help the courtcome to that determina- tion. No such evidence waspresented."With respect to intoxi-cation, expert evidence is not required," she said."The sole issue here is there any evidence of in-toxication affecting Mr.Fenn's mindset at the timeof the deaths." Fenn interrupted Cre-mer on multiple occasionssaying there was no mens rea — a legal term meaningcriminal intent — and thathe was now a new personcompared to who he was at the time of the deaths andrepeatedly declared him-self a king. "I had no brain, therewas no mental element,she's arguing a mental ele-ment, it's irrelevant," he said. "She's my ex-lawyer, Ifired her, I don't know whyshe's here."In closing arguments, the Crown argued thedeaths were not the resultof a cocaine psychosis but rage and jealousy over apotential breakup and thatthe children died simplybecause they were Krassi- mira's children.Cremer challenged that notion and said the evi-dence showed a volatile re-lationship rife with jealou-sy and toxic behaviour on both sides, including druguse by both Fenn and Kras-simira. "The evidence does notshow Mr. Fenn was jealousto the point of wanting tokill her ... nothing explains the deaths of the children,there's a complete lack ofevidence." Cremer also arguedFenn's statement to policedid not show intent to kill,but Leibovich challenged her on that point, pointingout that Fenn told policethat he stabbed Krassimirawith a knife because she kept breathing after hestrangled her."That seems to be every- day language that supportsthe intent to kill," the judgesaid.Leibovich is expected to deliver a verdict on Jan. 21,2022. Durham Student Trans-portation Services will bereviewing school bell times for the Durham DistrictSchool Board (DDSB) andDurham Catholic DistrictSchool Board with a report expected in January. Proposed bell time ad-justments of 10 minutes ormore require a public con-sultation process as well asschool board approval. Most secondary schools in Durham were moved tolater than usual 10 a.m. and4 p.m. bell times for 2021-22in response to a school bus driver shortage that hasbeen exacerbated by the pandemic. "The 10 a.m. to 4 p.m.schedule was the only waythat Durham Student Transportation Servicescould ensure all eligiblestudents can receive trans-portation services," the DDSB said in a statementthis summer.The move angered some students, who say a 4 p.m.bell impacts their ability towork at part-time jobs, doextracurricular activities or provide after-school careto younger siblings — andthat low-income familiesare impacted the most. Since the summer, morethan 3,800 people havesigned a petition calling on Durham's school boards tochange the bell times.DDSB student trusteesspoke out on the issue at the board's October standingcommittee meeting. Trustee De-Mario Knowles says studentshave been "significantlyimpacted" by finishing the school day at 4 p.m."Picking up younger sib-lings and getting to work ontime are examples of the conflicts that have beencreated from the schoolhour changes," he said. "I've heard from quite afew students that they haveto leave class early just toget to work on time," added student trustee Kayla Mal-colm. A new DDSB reportsays the upcoming bell timereview will look at using bus route "tiering" in themornings in an effort toeliminate the need for 10 a.m. and 4 p.m. bell times. The Oshawa couplepleaded guilty to multiple counts of fraud, admitting they falsely claimed thatchildren in their care suf-fered from grave medicalconditions, including can- cer, to solicit donationsfrom church congregants,charitable organizations and government agencies.Among the victims wereMarilynn Manuel and Bev-erly Rankil, sisters who are in their 80s. It is estimatedthe women were defraudedof about $650,000 by the La- rabys, whom they metthrough their church.The charges against theLarabys arise from inci- dents that date back morethan a decade and centreon scams the couplehatched involving two chil- dren over whom they hadguardianship, according tothe Crown's case. Senna Laraby pleaded guilty inJune to five counts of fraudover $5,000 and one countof fraud under $5,000. Rob- ert Laraby pleaded guilty to five counts of fraud over$5,000 and one count of as-sault relating to incidents involving one of the chil-dren.One long-running scheme involved convinc-ing others that one of thechildren suffered a varietyof serious health issues, in- cluding cancer, for which hospital visits and specialequipment were required,court heard. The Larabys targetedthe congregation of achurch in Clarington, court heard. Among thechurch members were Ma-nuel and Rankil, who re-peatedly provided money after being told the Lara- bys needed money to com-plete adoption proceedingsand for one child's steepmedical costs. The claims were bogus,the Crown submits in docu-mentation filed with the court.Also defrauded was aShriners Club, which pro-vided funds for hospital visits based on false claims,as well as the OntarioWorks and Ontario Disabil- ity Support Program. The Durham DistrictSchool Board is also listedamong the victims. The La- rabys falsely claimed achild's medical issues ne-cessitated "special equip-ment and construction," court heard.In their victim impactstatements Tuesday, Ma- nuel and Rankil told thecourt their life savings aregone, and that they worrydaily about how to cover costs for expenses related to health care and homemaintenance. "Mr. and Mrs. Laraby,you stole all our money," Rankil said. "We cannot domany things we workedand saved for." "You have been exploit-ing us," Rankil added. "Atour age, this is elder abuse.It is appalling that people like you have to stoop tothis because of your greed."In addition to peniten-tiary time for both accused,the Crown is seeking a fineof more than $750,000. Thatmoney ought to go to pay restitution to those victim-ized by the Larabys, courtheard.Ontario Court Judge Paul Burstein will pro-nounce sentence Nov. 1.In condemning the La- rabys for their actions, Ma-nuel quoted the Bible fromNumbers 32:23."Be sure," she scolded, "your sin will find you out." These little "skunks of the insect world" can cer-tainly live up to their name, releasing a chemical aerosol from tubules along their thorax that's yes, un- pleasant scent-wise, but otherwise harmless. They do so only in defence, whenhandled or disturbed. Otherwise, stink bugs are quite attractive. On average one to two centi- metres long, they're shaped like a shield, with leathery forewings foldedflat on their backs giving them a sleek, smooth, com- pact look. The 200 species native to North America —4,100 worldwide — come in a variety of colours, from camouflage browns andgreens, to bright yellow and red patterns on patent- leather black. Common as they are throughout south-ern Ontario, it's too bad we hardly ever see them. All summer long they'reout there hidden in the veg- etation, slurping up their favourite foods. Like all "true bugs" their mouthparts fuse together in a long tube, a sheath holding four stiletto blades for pok- ing holes, releasing saliva to dissolve organic matter, and sucking up the results. About a third of them feedon flowers, fruits and leaves, while the rest are predators of caterpillars and other insects. Every once in a while I get a taste of one when I come across a patch of wildraspberries and stop to snack, as they love raspber- ries, too. Sometimes they're drawn to porchlights. Because they over- winter as adults, they're right now looking forcracks and crevices to crawl into for the winter, which is the only reason one would ever get intoyour house. They have no interest in people at all. I asked gardeningfriends if they ever encoun- ter stink bugs and was sur- prised at the blank looks and shaking heads. Theyhad seen reports on the weather station about the brown marmorated spe- cies, which likely hitched a ride across the Pacific from Japan or China in packing crates a few decades ago.With none of its native predators here to keep it in check, it's now expanding happily in fruit groves and agricultural fields throughout North Ameri- ca, including Ontario. Al-ways one that gives the whole family a bad name! I'd like to give press time to our native anchor bug, aclassy black-and-yellow stink bug specializing in eating the larvae of gypsymoths, which defoliated so many trees across the prov- ince this summer. Mike McEvoy photo BACK OFF OR I'LL STINK YA CANCER SURVIVOR PLUGS FUNDRAISING EFFORT To the editor: The R.S. McLaughlinDurham Region CancerCentre recently launched a $20-million fundraisingcampaign. I can personallyattest to the benefits of hav-ing this world-class facility in our community. In January 2019, I foundout I had an aggressive form of breast cancer. Lessthan 24 hours after receiv-ing the diagnosis, I metwith a surgical oncologist at Lakeridge Health Osha-wa. Over the next two weeks, I had 13 appoint-ments at the hospital andadjacent cancer centre. Iunderwent numerous stag- ing and baseline tests, at-tended teaching sessionsand consulted with oncolo-gists. I received my first che-motherapy treatment justtwo and a half weeks after discovering I had cancer. Surgery and radiation fol-lowed. Throughout my jour-ney, I appreciated the in-credible care, compassion and skill exhibited by thestaff and volunteers at thecancer centre. Books on my disease ad- vised seeking multipleopinions on treatment op-tions. I never felt the need todo this — my medical teamwas extremely competentand I followed their recom- mendations with great suc-cess. Receiving care withinmy own community re-lieved the stress and fa- tigue associated with com-muting into the city.My workplace was min- utes away, allowing me tocontinue working betweenappointments. The broad range of equipment and services onsite streamlined care. Lab-oratory facilities within the building minimizedvisits to the centre — anhour after an appointment for blood work, I was able tomeet with my oncologist to review the results. Testingand counselling throughthe Genetics Clinic allowed me to make informed deci-sions regarding subse-quent risk-reduction pro-cedures. Our local cancer centre provided "one-stopshopping."Maintaining and en- hancing world-class facili-ties requires the financialsupport of its community.Equipment must be up- graded, research per-formed, and services sup-ported. A high-calibre in-stitution attracts and re- tains premium caregiversand administrators, whoare also essential for deliv- ering quality health care.I'd like to encourage resi-dents and business ownersto support the cancer cen- tre — it needs our help tosurvive and thrive. It may some day save your life as it did mine. The May 25, 2020, mur-der of George Floyd in Min-neapolis by a white policeofficer led to anotherround of debate and soul- searching about the sys- temic discrimination with-in our society.Protests were a constant across much of the UnitedStates, while here in Cana-da many communities andorganizations began to ex- amine their own internalbiases.Recognition of racismand its role in shaping ourcountry has become even more acute this year with the discovery of unmarkedgraves of Indigenous chil-dren at the sites of formerresidential schools. Canada's history isstained with the blood fromdiscrimination and that legacy lives on today.As a result, MetrolandMedia established adviso-ry councils in 16 communi- ties across our footprint,including Durham region,which publishes eight newspapers. Durham's ad-visory council membersjoined three smaller com-mittees, including one fo- cused on equity and inclu-sion, with a goal of helpingus to identify the priorityissues in our community,and how we, as media, can address them. The committee met onOctober 5 to discuss thechallenges and opportuni-ties in creating a more eq- uitable and inclusive soci-ety in Durham.As managing editor, I was tasked to write aboutwhat we have learned fromthat discussion. I will behonest: it has been a strug- gle to write this column.That's not because the top-ic is unimportant, uninter- esting or lacking endlessdiscussion points.Instead, as a white, cis-gendered male, I worry that I am ill-equipped tospeak on some of these is-sues. Fortunately, our com-mittee has members fromvarious diverse communi-ties.In reviewing the com- mittee's discussion on eq- uity and inclusion in Dur- ham, a few things have be-come evident. First, we need to accept our own biases around di-versity and equality. We allharbour misconceptionsabout people and issues. Only when we recognizethat can we hope to bringabout change. Second, we need to do abetter job at listening. Weare getting a chance to lis-ten to community con- cerns more through ourwork with our advisorycommittees, but we need to spend more time listeningto concerns at the neigh-bourhood level. Our news teams need to understand the obstaclespeople across Durham re-gion face, so they can tellthe stories that will help our communities to evolve.Third, we need to en-sure our newspapers mir- ror the reality of the com- munities they serve. Durham consists of peo-ple of different races, reli-gions, ages and abilities. The voices you read andthe faces you see in thisnewspaper must reflectthat. We are already takingsteps to ensure that we in-clude more diverse voices and perspectives in our ar-ticles, and do our part tofoster a more equitable so-ciety. We will continue on thatpath moving forward. Andif or when we fall short, all I ask is that you let us know. Mrs (Welfare) October 22, 1926 - October 14, 2021 ------------------ The Fallon family is deeply saddened to report that Nancy, our beloved Mother and Nanny, passed away in her 94th year on October 14, 2021 after a short, but peaceful stay at Ajax-Pickering General Hospital. Nan is survived by her two sons: Patrick of Sooke, British Columbia and Nick (Mary Lou) of Brooklin, Ontario. Nanny was adored by her four grandchildren: Simon (Nina), Dr. Elizabeth (Michael), Jack, and Daniel; god-daughter Jennifer Nichol, from New Zealand; nephews Christopher Welfare (Margaret) and Billy Welfare (deceased) and nieces Angela Richmond (Griff) and Daphne Penny (John). She will be especially missed by friends Rosemary and Keith Chandler as well as the numerous members of her extended family. Nan was predeceased by Sam, her husband of 44 years, and by her brothers Kenneth and Sydney Welfare. Nan was born in Tunbridge Wells, Kent, England and, as a teenager, entered the workforce as a military secretary in London during WW2. In 1946, she met Sam Fallon of Scarborough, England. They were wed in December 1948 and started a family in Tunbridge Wells, with the birth of Patrick in 1951. As a construction consultant with the British Public Service during the post-war era, Sam was frequently away from home on assignment and in 1955 was permanently transferred to Nottingham, where Nick was born. In 1957, Nan and Sam made the visionary decision to emigrate to Canada, following her brother Ken who had moved to Toronto in 1956. In 1957, Sam was hired by the Ontario Ministry of Public Works at Queen's Park, Toronto and, in 1958, the family settled at 61 Emperor Street in the newly-formed suburban Town of Ajax, a dwelling that Nan would call home for 62 years. Life during the six decades in Ajax featured a wide range of volunteer and social activities, including the Ajax Garden Club, the Ajax Seniors Club and the Women's Auxiliary of Ajax-Pickering Hospital. Nan was a founding volunteer and Secretary with the Aldon School for Students with Special Needs. She was a member of Seaton (Pickering) Golf Club for nearly 50 years, serving on various Committees, participating in Ladies Invitationals throughout southern Ontario, and recording a hole-in-one in 1972. Nan was truly a life-long learner and offered informed opinions on many historical and contemporary topics. She became known to family as Cybernanny in 2011 when she received an iPad on her 85th birthday which opened up the world of the Internet, email and electronic news delivery. She was also a voracious reader and made a weekly pilgrimage to the Ajax Public Library, where she typically borrowed six to eight books, a habit which she continued well into her nineties. This poem speaks to how she was seen by her many friends and family in her final days. She was deeply cherished and will be greatly missed by her children Croft (Suzanne), Korol (Will), and Troy (Kelly); her grandchildren Elizabeth (Vince), Cameron (Marianna), Shelby, Sarah, and Tayler; her great-grandchildren, nephew, and nieces; and her extended family and many friends. She was predeceased by her parents and sister, Margaret. Harriet was born at home in Blaine Lake, Saskatchewan, the second daughter of Willard and Mary Keys. Her teen years were spent in Vancouver, where she was active in CGIT and, as a violinist, three youth symphony orchestras. She worked as a nurse until marriage beckoned and she happily traded that role for motherhood. As matriarch of our household, she was seamstress, knitter, chef, financial manager, home renovator, and first mate of the sailboat "Chatterbox". Her home was filled with music and happiness. Harriet returned to nursing in 1980 and worked in labour and delivery welcoming newborn children. Years later, she was still greeted by mothers who remembered her compassionate care. After her marriage ended, a women's Outward Bound trip in 1986 awakened her love of travel and adventure. Many adventures ensued: hiking in Nepal, Nunavut, and Greenland; sea kayaking off the coast of Newfoundland; rafting in B.C.; and many cycling trips to Europe. A great lover of dogs, she always had at least one dog in the house and remained active walking her companion "Rocky" until her final day. Recently, she proclaimed that she had lived her life without regret and would not have changed a thing. An amazing mother and grandmother who was a tremendous support and inspiration to her family, Harriet was also a dear friend to many. Her positive energy and laughter will be missed. In accordance with her wishes, no funeral service or visitation is planned. A celebration of life for family and friends will occur when circumstances permit.
