People opposed to devel-opment on the DuffinsCreek wetlands complex inPickering blocked the en- trance to the site on Thurs-day, Feb. 11."The drilling truckshave been going in thisweek," said Ginny Colling,who lives north of Port Per-ry. Ten vehicles blocked en-trance to the work sitewhere drilling has begun,gravel access roads have been built, and heavy ma- chinery has been makingits way onto the land.The Ministry of Housing and Municipal Affairs ap-proved development in thisarea to accommodate awarehouse facility through a Ministerial Zoning Order(MZO) in late October.The development dubbed Project Lonestar ispart of the Durham Live de-velopment at SquiresBeach Road and Bayly Street in Pickering."This was a provinciallysensitive wetland whichmeant that for 25 years anyconstruction and develop-ment was prohibited inthat area," Colling said. She noted the develop-ment will destroy habitatsfor many different spe-cies, including migratory birds. The blockade was orga-nized by EnvironmentalAction Now Ajax-Picker- ing, which is opposed to de-velopment on this land andthrough the increasing useof MZOs. The current provincialgovernment is being criti-cized for increasingly ap- proving more MZOs thanever before. MZOs essen-tially circumvent the regu-lar municipal planning process at a municipal lev-el."They're really beingabused in order to push de- velop and pave over wet-lands and natural areas,"said Colling. The City of Pickeringclaims this part of the wet-land complex is not signif-icant, but residents dis- agree. "When we have torren-tial downpours in the sum-mer where does all the wa- ter go?" asked Oshawa resi-dent Crystal Fielding.Fielding, somewhat newto activism, felt this cause is one she needed to get in-volved in."It was incredible to hear the volume of vehiclesupport as they were pass-ing by," she said. "It waslarge volumes of vehicles honking and waving sup-porters."She grew up playing inthe woods, and says her children won't have thesame experience.The protesters say there are others where the build-ing can go, and it doesn'thave to be on a wetland."I think there's quite a lot of support, quite a lot of awareness and concern about the situation," saidSusan Spicer. "Because it isso egregious." Spicer is the priest at St.George's Anglican Churchin Pickering."It's an assault on the Earth. PROTESTERS BLOCK CONSTRUCTION ENTRANCE TO DUFFINS CREEK WETLAND IN PICKERING KRISTEN CALIS KCalis@durhamregion.com NEWS DEVELOPMENT ISUNDERWAY TO BUILDWAREHOUSE ONLOCAL WETLANDS Ontario's top court has ordered a new trial for aPickering man convicted ofhuman trafficking offenc-es.While he acquitted Ter-rell Ochrym of some of thecharges he faced, Superior Court judge Alex Sosnaconvicted him of exercisingcontrol over a 17-year-oldsex worker, despite the young woman's testimonythat she was not coerced,the Ontario Court of Ap- peal found in a ruling re-leased Jan. 27.The judge heard evi-dence that Ochrym assis- ted the sex worker by pro-viding rides to motels andhelping advertise sexual services, the ruling said. Inconvicting Ochrym, the tri-al judge appeared to focussolely on the accused man's actions, without regard to the nature of the relation- ship between him and thesex worker, the courtfound.Ochrym was 38 when he was arrested along with anassociate, Oral Richards,in 2017. Durham police al-leged at the time the twomen exercised control overthe young woman, convinc-ing her to enter the sex trade. The charges againstRichards were dropped af-ter he gave a statement topolice, according to the Court of Appeal ruling.During Ochrym's trialcourt heard that the young woman and Richards want-ed to enter the sex trade,but were ill-equipped to doso and asked Ochrym for help, the ruling says.When he testified,Ochrym did admit to as- sisting with the plan, in-cluding driving the youngwoman to motels. Duringthe trial, Sosna also heard testimony that the young woman sent photos of her- self in sexual poses toOchrym's phone. "(Ochrym) admittedthat he let Mr. Richards use his cellphone and Back-page account to advertisesexual services to be pro-vided," the ruling says. Ochrym was convictedof two human traffickingoffences: exercising con- trol over a person offeringsexual services, and know-ingly advertising sexualservices. Ochrym was sen- tenced in December of 2019to two and a half years inprison but was given credit for two years of pretrialcustody, leaving him withsix months to serve.In his judgment, Sosna acquitted Ochrym of acharge of procuring a per-son under 18 to work in the sex trade, finding a reason-able doubt that the accusedman knew the young wom-an's true age. The judge found Ochrym guilty in- stead of a similar Criminal Code offence that makes noreference to the complain-ant's age. At the same time,however, Sosna found no evidence Ochrym had re-cruited the young womanto work in the sex trade, theruling notes. No evidence was intro-duced at trial indicatingOchrym received any mon- ey from the young woman,and he was acquitted of acharge of deriving a benefitfrom prostitution. The young woman testi-fied she was not heldagainst her will and was free to leave when shewished, the Appeal Courtruling says.The Appeal Court noted that during final submissi-ons in the trial, the Crownargued Ochrym's claim that he'd merely helped thewoman pursue sex workwas false. The defendantwas not given adequate op- portunity to refute the Crown's assertion in final arguments, the courtfound.On appeal, duty counselacting for Ochrym argued Sosna had erred in enter-ing a conviction on thecount relating to exercis-ing control. The judge ap- peared to have convictedOchrym on that charge"simply because he facili- tated the (young woman) inproviding sexual services,"the Court of Appeal rulingnotes. The Appeal Courtagreed with a defence sub-mission that Ochrym's ac- tions did not meet the testfor conviction under theCriminal Code for exercis-ing control over a sex work- er. The local health department said earli-er this month that it was reviewing its pro-cess after Toronto announced it wouldpublicly name employers with significant workplace outbreaks. Durham's new tracker lists the numberof active and resolved outbreaks and orga-nizes them by category, such as retail or manufacturing, however, businesses arenot named and there are no details on the scope of each outbreak. As of Jan. 29, there are 13 active work-place or event outbreaks in Durham. Retail settings make up 26 per cent of the 90 outbreaks reported since May 2020,while manufacturing and industrial set-tings represent 22 per cent.Eleven per cent of outbreaks were in corporate or office settings and eight percent were in food and beverage services. The new data shows a significant in- crease in workplace and event outbreaksin Durham in the last three months.From May 2020 to September 2020 therewere 10 outbreaks total. There were seven outbreaks in October,then 22 in November, 30 in December and21 in January. A workplace outbreak is defined as twoor more lab confirmed COVID-19 cases in aworkplace within a 14-day period that havean epidemiological link, such as the same shift or same work area. A community event outbreak is three ormore lab confirmed cases from at least twodifferent households within a 14-day peri-od that have an epidemiological link.
