James Park, Damian Sergeant and Matthew Dunbar were found not guilty Wednesday night of break and enter, robbery and forcible confinement. Mr. Dunbar was found guilty of theft and carrying a concealed weapon. The verdicts came just before 11 p.m. after two days of deliberations by jurors, who heard vastly different versions of events in Tammy Lewis’s Malaga Road apartment in the early morning hours of March 30, 2009. The Crown contended the three accused men, along with a fourth accomplice, burst into Ms. Lewis’s apartment intent on robbing her to seek revenge for an earlier drug rip-off. But other witnesses, including Mr. Sergeant and Mr. Park, of Ajax, testified there was no robbery at all. “I think there was clear reason- able doubt,” said defence lawyer Laura Gior- dano, who represented Mr. Sergeant. “I’m incredibly satisfied with the outcome.” The trial, which began Oct. 20, was unusual in a number of ways. The complainant, Ms. Lewis, was murdered in late 2009 in what police described as a domestic incident. So jurors heard her taped testimony from a pre- liminary hearing held last year. And a key Crown witness testified there was no plot and no robbery, even though he pleaded guilty to the crime at the 2009 preliminary hearing. Trevor Davidson -- who is Mr. Park’s broth- er -- told prosecutor Mitchell Flagg he had pleaded guilty assuming his charges would be dropped or reduced, and was dismayed to learn that wasn’t the case. He said there was never any plot to commit a robbery, and that the men on trial got caught up in the fallout of a dispute between him and Ms. Lewis. Jurors heard that when Mr. Davidson demanded payment for a drug debt, Ms. Lewis got upset and tried to phone 911. The phone cord was ripped out of the wall, but the call went through and Durham police, responding to an unknown trouble report, busted the four men at the scene. Ms. Lewis told the cops she had been held against her will and robbed, the jury heard. Mr. Dunbar was found in possession of some cigarettes and a purse taken from the apartment. He was also carrying a large knife. That evidence appears to have led to his con- viction on two of the charges he faced. COURTS Acquittal in Durham home invasion trial durhamregion.comNews Advertiser • November 12, 20105 P “Basically the units are (now) sitting there essentially without power and without the capability of running,” he said. The four Pickering “A” units went into ser- vice in 1971 and were operated until 1997 when all four units were shut down. Unit 4 was then upgraded and returned to service in 2003. “There were a lot of difficulties with that project,” said Mr. Robinson. The project went over budget, drawing neg- ative press and attention. He said the amount of work required, environmental assessments and regulatory requirements turned out to be more than anticipated and lessons were learned from it, most especially that there’s no such thing as too much planning. Unit 1 was returned to service in 2005 and the project was on time and on budget, but the decision was made to not return Units 2 and 3 to service. “There were a lot of issues with those two units that would have taken more money and time to correct ... the decision was to put them into safe storage,” Mr. Robinson said. The five-year process involved removing all the fuel and water from the reactors. All the units in Pickering “A” share systems. “As we went into the safe storage project, we had to make sure we could isolate Units 2 and 3 from Units 1 and 4,” said Mr. Robinson. Because Units 2 and 3 sit between the other two units, it made disconnecting them more complex than if the whole station had to be shut down. Mr. Robinson explained there are three phases in a plant’s life: active life, safe storage and decommissioning. Units 2 and 3 will be decommissioned along with the rest of the plant after the 2020 shutdown. The project will take decades. OPG has decided not to refurbish the Pickering “B” units, but instead invested $300 million in extending the plant’s life to 2020. As to why nuclear plants must be refur- bished after a period of time if they are to keep running, Mr. Robinson explained the main reason is because the pressure tubes which contain the fuel rods in the reactor must meet codes and standards. They absorb hydrogen and once they’ve reached their limit, they must be replaced. Mr. Robinson said the success of the safe storage project gives OPG a great deal of credibility when embarking on other projects such as the refurbishment of the Darlington units. So it becomes ever more important for us to remember the unselfish, gallant service of the more than 26,000 Canadian men and women who answered the call of liberty for the people of South Korea from 1950 to 1953. It’s often referred to as ‘Canada’s forgot- ten war’, because the heroes’ welcome home our soldiers so richly deserved failed to materialize. Many Canadians have since come to learn of the unspeakable depriva- tions and harsh conditions under which our soldiers fought in some of the most intense battles, sometimes against impos- sible odds, opposite determined and well- equipped Communist troops. Veterans who served during the Korean war will never forget it. From the bone- chilling cold of Korean winters, to the overwhelming numbers of “human-wave assaults” by the enemy, to the frustrations of gaining one yard, one hill at a time ... this war was a lesson in endurance, bravery and commitment. Canadian citizens must remember our soldiers’ courage under fire in the face of sometimes overwhelming force; of the pain and unbearable loss suffered in the name of duty. Many of our comrades-in- arms were left behind and some remain unaccounted for even today. Younger gen- erations will never know it all, because so many surviving veterans continue to qui- etly hold the tears and pain deep inside. South Korea is free today, enjoying free- dom and prosperity won in a war where Canadian soldiers stood side by side with their UN allies and South Korean troops fighting aggression and tyranny. New school progress reports put focus where it should be Parents of elementary school stu- dents across Durham Region will see some changes on their children’s prog- ress report cards next week. Instead of letter or percentage grades traditionally used to mark a student’s progress, the new reports focus pri- marily on a student’s progress to date. And the learning skills portion of the report is being given greater promi- nence in the new documents, an area which focuses on organization, collab- oration or initiative. These are characteristics that speak more clearly about how a young boy or girl is doing as it relates to the curricu- lum and encourages more discussion among parents and teachers and par- ents and their children. For instance, a child might be doing adequately in math or language, but has work habits that require greater focus and development. These prog- ress reports will help parents identi- fy areas for improvement, which will better serve children as they mature and confront more complex educa- tional subjects or more detailed project assignments. Teachers in Durham are excited about the prospect of greater insight provided to parents with this new approach to monitoring achievement and learning. Many expect it will pro- vide the impetus for more teacher-par- ent contact and dialogue and enable them to be more aware of their child’s progress and therefore more willing to participate in promoting learning and improving work habits at home. For young children, past report cards that focused on curriculum achieve- ment through percentage or letter grades tended to render learning hab- its as somehow less important or sec- ondary to the achievement. But teachers know that success in developing learning skills and work habits tend to run in lockstep with bet- ter grades. This new focus will also assist chil- dren in improving in the areas in which improvement is required, and will result in better overall grades. This is an important and timely step in re-engineering the approach to marking student progress in Ontario elementary schools. The ABCs of learn- ing are still at the foundation of our education system, but the A’s, B’s and C’s of report cards of the past are no longer the focus for teachers in terms of achievement. Eight out of 10 chose not to get into the vehicle of a driver who had been drinking. Positive choices like these are being cel- ebrated by the health department during Drug Awareness Week, Nov. 15 to 20. The Ontario Philharmonic's music director says everybody involved with it, including its patrons and audience, is pumped about this year’s concerts at The Regent Theatre in Oshawa. “This is really an exciting sea- son, I would say the most excit- ing we've had... because this is the first time this orchestra has a place to call home,” says the Ajax resident. The OP begins its 2010/2011 season on Nov. 26 at 7:30 p.m. with Sparkling Vienna, a fund- raising concert for the Oshawa Hospital Foundation. In recent years the orchestra has performed at the P.C. Ho Theatre in Scarborough and at the UOIT campus in Oshawa. But while the former was and is an excellent venue, it's not in Dur- ham. And while the university bailed out the OP when it literal- ly had no place to go, offering its gymnasium, it was not suitable for a classical music concert. With the UOIT now The Regent Theatre’s owner, he says it “came to the rescue again. “They were fantastic,” Parisotto says. “Without the UOIT we would be in pretty deep trouble right now. They believe in the arts and they believe in culture.” He was at the Oct. 30 Jim Witter concert at the theatre to check out the sound and called it “a good room.” The Regent’s high, plaster ceiling and minimal car- peting contribute to good sound, Parisotto says, noting a few rows at the front of the facility will have to be removed to accom- modate a larger stage that can hold the entire orchestra. “The feeling I get is that there’s a real effervescence out there, a real enthusiasm about the re- existence of The Regent Theatre,” he says. Parisotto says ticket sales for this season “are better than ever and I would say The Regent has a lot to do with it.” He says Sparkling Vienna fea- tures the most famous orches- tral music to come out of Vienna, including by Johan Strauss, both father and son. “Johan Strauss ll was the Michael Jackson of the 19th cen- tury,” he says. The program features his clas- sic On the Beautiful Blue Dan- ube waltz and the Die Fleder- maus Overture, which Parisotto says is “brilliant and a lot of fun. “It’s a turbo-charged program with a lot of fun music and famil- iar music,” Parisotto says. As a nod to the many Dur- ham residents whose families hail from the UK, Bruch's Scot- tish Fantasy is on the program, featuring the virtuoso violinist Philippe Quint, an international star. The season’s second concert features another major star who has become a great friend of the OP and serves on its board of directors, Michael Burgess. Parisotto says Burgess “couldn't believe the quality of the orches- tra” when he first encountered it and promotes it wherever he goes. The OP presents Michael Bur- gess - Christmas Magic on Dec. 17, featuring the Les Mis star with a jazz trio, as the OP sits this one out. “I think that The Regent The- atre lends itself wonderfully to this program,” he says, noting the audience can expect Christmas tunes and carols. “He doesn’t want to reveal exactly what he’s going to be singing that night.” Parisotto says that Quint and Burgess are performing here speaks to the quality of the OP. “There’s no doubt that this orchestra, in our community, in Durham Region, is a major cul- tural force for us and I would even venture to say for Canada,” he says. The PineRidge Arts Council is starting a new gallery in Pickering, Silverstone Gal- lery, with a grand opening celebration set for Sunday. “It’s filling what Ajax, Pickering and all of Durham needs, places for artists to dis- play their work,” says coordinator Gary Faulkner. The gallery is at 617 Liverpool Rd. near the lakefront. For half of the year, during the warmer months, it is the Silverstone Paddle Company, owned and run by Luke Peterkin. However he offered the space to PRAC to use as a gallery for its member artists from November to April. It will be open Thursdays and Fridays from 2 to 8 p.m. and Saturdays and Sundays from 2 to 6 p.m. “We have a place that is going to exhibit Durham artists, all the artists will be from Durham,” says Faulkner, himself an artist and musician. “We’ll probably have 20 to 30 artists showing at once. It’s not big but we’re going to get the most out of it.” While the artists won’t have to pay to show their work, to show its appreciation, PRAC says Peterkin will receive a 20-per cent commission on sales. The rest goes to the artist; PRAC is not receiving any money from sales. Faulkner says that’s a good deal for the artists as “normally the gallery will take 50 per cent off the top.” The exhibiting artists will be required to act as volunteer staff at the gallery while it is showing their work. Faulkner says PRAC artists in all kinds of media can apply to exhibit their art, but it’s mainly featuring visual art. It will also carry jewelry, books and CDs. A rough plan is to have one group show until Jan. 15 and a second group show from then to mid-March, though he says the entire roster of artists might not change. Among the first artists showing are Ian Bodnaryk from Bowmanville, Janice McHaffie from Oshawa, Pickering’s Sha- ron Steinhaus, Maureen Lowry of Whitby and Don Hightower of Ajax. Faulkner notes that he’s getting daily e-mails as the word spreads. The gallery wasn’t even open yet when it logged its first sale. The team was awarded two spots on the Peach Belt Conference all-conference second team, with Prince, a freshman from Ajax, garnering one of the spots. Prince, a midfielder, led the Falcons with seven goals this season including one game-winner. The Pickering High School grad also dished out two assists. Five of her goals came in conference games. SOCCER Orrett receives academic honour CALIFORNIA -- Kristen Orrett has proven she is just as good in the class- room as she is on the soccer pitch. The Pickering resident was among four players from the California University of Pennsylvania women’s soccer team to be named to the ESPN academic all-dis- trict II first team. It was the second season in a row that Orrett has been named for the honour. Orrett, a junior defender, helped anchor the top-scoring defence in the PSAC at 0.37 goal per game, while also recording a career year on offense. In her third year as a starter, she has tallied two goals (both game-winners) and three assists for seven points. Orrett boasts the highest GPA on the team at 3.97 while pursuing a degree in secondary educa- tion. To qualify for the academic all-district honors, student athletes must maintain a cumulative 3.30 GPA or higher and must have reached sophomore athletic and academic standing at their institution. TORONTO MAPLE LEAFS Back to the glory days Ajax author releases new book looking back at Stanley Cup years SHAWN CAYLEY scayley@durhamregion.com AJAX -- While the Toronto Maple Leafs have done precious little to impress the modern day fan, Ajax author Kevin Shea is hopeful his most recent book can bring fans of all ages back to a better time. A championship time. Shea, along with contributors Paul Patskou, Roly Harris and Paul Bruno, recently released a book titled: Toronto Maple Leafs - Diary of a Dynasty 1957-1967. The work is a look back on what is likely the most successful 10-year span in the history of the organization as they went from a bottom- feeding, run-of-the-mill club to league power- house, highlighted by three consecutive Stan- ley Cup victories from 1962-64 before capping it off with another in 1967. For a man who has penned eight previous books, Shea said this one held extra-special meaning due to memories it evoked from his childhood. “The idea came from some of my most cher- ished childhood memories,” Shea said in a recent interview. “As a family, we spent a lot of time in the 1960s watching the Maple Leafs and those were some of the best times. I love to write and hockey is a passion of mine, so this made sense to do. This was a dream.” Shea said, unlike most books that take a look back on the Maple Leafs’ better years, this one captures more than just the bookend, which was, of course, that famous 1967 season, the one that marks Toronto’s last Stanley Cup cel- ebration. “The book goes back through all the impor- tant games from those seasons, 1957-67,” he said. “A lot of books really focus on that sea- son, but this one really takes a look at what went into those teams being so successful.” Perhaps the most enjoyable part of the entire project for Shea and his contributors was going through years and years of old taped games of Hockey Night in Canada from that era, along with never-before-released interviews with the likes of Leafs greats Johnny Bower, Dave Keon and George Armstrong, among others. “To go back and confirm some of the legends of those old Maple Leafs’ teams through those stories was something special,” said Shea, who has also authored Leaf-related books on Ron Ellis, Bill Barilko and one titled Centre Ice, which was a comprehensive look at the team, Maple Leafs Gardens and the Smythe family. The near 500-page book, published by Firefly Books, was released earlier this year. He got a weekend split in Provincial Women’s Hock- ey League play, but even in the game his Lightning lost, to the 14-0-0 Mississauga Chiefs, his team was in the game to the final minutes. After a 4-2 setback to the league’s top team on home ice Saturday, the Lightning bounced back the follow- ing day, travelling to London where they doubled the Dev- ilettes 4-2. “I’d have to say I was extremely pleased the way the girls played against Mis- sissauga. Our girls played really well,” said McDonald. The Lightning opened the scoring against Mississauga, as Megan Kirkham scored in the first, but Mississauga came back with one in the second and another early in the third to take the lead. The Lightning answered back just six seconds later as Emily Rose Galliani Pecchia scored to even the game at 2-2. Mis- sissauga took the lead five minutes later, and added another into an empty net on the power play with just 1:20 remaining in the game for the 4-2 final. Goalie Jackie Rochefort was solid in goal, stopping 21 of the 24 shots she faced, while the Light- ning fired 16 the other way. In London, the Lightning jumped out to a 2-0 lead on goals by Sara Kaljuvee and Emily Kekewich in the opening period, but London answered with one in the sec- ond and a power-play goal early in the third to even the score 2-2. Marissa Maugeri took over for the Lightning, scoring twice just 1:40 apart to restore the two-goal lead, the second goal coming on the power play. The Light- ning held a 27-19 advantage in shots on goal, with net- minder Chantal Bicket pick- ing up the 4-2 win. “The most important part of that was the fact it became 2-2 and we ended up win- ning. That was a real good win for us,” said McDonald. The weekend leaves the Lightning, winners of three of their past four, with a record of 3-4-1-1. Much of that suc- cess McDonald credits to the team’s penalty killing and the effort they are putting in. “The biggest thing I like is the effort,” he said. “They work hard every game. We’re not going to give up. “We’ve told the girls right from the start whether you win or lose, at the end of the day it’s not as important as the effort you put in. If you put in a strong effort, then you are going to come out on top more times than you don’t. They work hard in practice and it carries over to games.” The Lightning will take a sabbatical from PWHL games this weekend, travel- ling to Detroit to compete in the Manon Rheaume tour- nament against Canadian and American teams. The tournament provides an opportunity for the team’s Grade 12 players to be seen by Canadian and U.S. college coaches. HOCKEY Midget AA Lightning reach final ERIE, PA. -- The Durham West Huawei Midget AA Lightening travelled to Erie, Pennsylvania to play in the Mercyhurst Tournament, winning the silver medal. So far this season, the team has lived a charmed life in tournament play, making it to the finals in all three, but having to accept silver med- als to date. The ladies opened the tournament with a solid 4-0 victory over Ohio. Jennifer Sisson potted two goals with singles to Lindsay Smith and Sarah Joseph. Kimber- ley Keller notched the shut- out, stopping 24 shots. Next up was a date with Ham- ilton where the team just could not get its game going, dropping a 1-0 decision. In the final round-robin game, the Lightning faced a strong team from Gilmour Acad- emy. Special teams were the deciding factor as Gilmour Academy scored two power play goals and a shorthand- ed goal. Nicole Staneland scored Durham’s only goal in a 3-1 loss. This set up a return match against Hamilton and this time the Lightning brought their game. Nicole Staneland and Acey Maves scored in a 2-0 victory. Devon Jarvis recorded the shutout. Gilmour Academy also advanced to the finals so the Lightning had a chance for redemption and a gold medal. Gilmour Academy is a private prep school with older, recruited players, so a victory was not going to be easy. Durham came up with its best game of the season and went toe-to-toe with Gilmour Academy, trad- ing scoring chances until Gilmour Academy scored on a power play. RINGETTE Hurren an all-star in Finland TAMPERE, FINLAND -- Pickering native Beth Hur- ren came home from the world ringette champion- ship with an all-star award and a medal, and yet still likely wasn’t satisfied. The 29-year-old defender, making her second appear- ance on the world stage, expressed before leaving for the tournament in Finland that the only goal was to wrest the gold medal away from the favoured Finns. It didn’t happen, though, as the hosts won all three meetings between the two ringette powerhous- es, including a two-game sweep of the final, giving Finland its third straight world title in a sport once dominated by Canada. The Canadians gave it a good go, especially in the first game of the final, but lost 6-5 in overtime. Fin- land completed the sweep with a less demanding 6-3 decision in the second game, which was played the following da. In the preliminary round, Canada opened with a 30-0 blowout over Sweden and also easily handled the United States, 14-4, while dropping a close 9-8 deci- sion to Finland. Hurren had only one point in the tournament, a goal against Sweden, but was named one of the two all-star defencemen, along with Finland’s Jonna Rust- salainen.
