Defence calls for police to reopen case

AJAX — The mother of mur-
der victim Raphael Lazenby col-
lapsed in grief Friday as a jury ac-
quitted the man accused of killing
her son.
Jurors took six hours to decide
Jimmy Solomos wasn't the man
who stabbed and slashed the 22 -
year -old Ajax resident during a
fight outside a Pickering strip club
last March 18.
Mr. Lazenby, whose son was
17 -months -old at the time, suf-
fered nine knife wounds to the
stomach and chest, two of which
punctured his heart, a court heard.
Emotions clashed as the verdict
was read. Mr. Solomos, 24, em-
braced defence lawyer Ann
Bergenstein before rushing into
the open arms of his mother.
Friends and family members of
Mr. Lazenby, known as 'Rae,'
erupted in anger and sorrow,
storming from the courtroom in
tears.
Mr. Solomos, who had been in
custody a year, was immediately

Alfred Stong. As he was escorted
from the courtroom by police, one
man made a veiled threat.
For his protection, police
whisked Mr. Solomos from the
courthouse to meet his mother at
an unknown location.
"She gets to take him home and
I get to see my son at the grave-
side;" cried Lillian Lazenby as she
sobbed uncontrollably.
Weeping family members held
each other as they struggled to
grasp the reality Mr. Lazenby's
death has gone unpunished.
"I feel terrible for this family. I
know this causes them a great deal
of anguish. I realize this just
brings the pain of the murder back
to them;' said Ms. Bergenstein.
She called on Durham Regional
Police to reopen the case, but one
detective says there are no plans to
do so.

AJAX — Each and every
school day for a quarter of a centu-
ry, Corrie van Boxtel has been
bringing traffic to a dead stop.
The crossing guard helps sonic
150 kids on their way to St. Fran-
cis de Saks Catholic School and
Lincoln Avenue Public School
safely cross the intersection at
Church Street and Lincoln Avenue.
And the 72 -year-old Pickering
Village resident, who celebrated
her silver anniversary last Thurs-
day, has no plans to hang up her
stop sign.

it;' says Mrs. van Boxtel, who is
known to students as "Mrs. B" and
has never missed a day of work.
"I have never had any trouble
with kids. I have never had an ac-
cident and it's a busy corner there,"
boasts Mrs. van Boxtel, who ap-
plied for the job after seeing an ad-
vertisement in the Ajax -Pickering
News Advertiser when the
youngest of her six children was in
Grade 1.
"I could still be home with my
children when they were on holi-
days," Mrs. van Boxtel says of the
reasons for wanting to become a
crossing guard. "It's a nice little
job. I .can walk there and. it gives
me a reason to get up every day."
Certainly, her efforts are appre-
ciated.
"She is always so cheerful;'
says Gwen Moroney, who moved
to Pickering Village several
months ago and has found a friend
in Mrs. van Boxtel. "She has all
kinds of information about the
area. She always has time to talk,
but the children come first. She has
eyes in the back of her head, be-
cause she always seems to know
when they're coming.

notes Mrs. Moroney.
Admittedly, the three -hour -a -
day job ties Mrs. van Boxtel down,
as she must be at her post in the

Road rage between councillors over Pickering widening
Durham Region staff to give Town's Finch Avenue request a second look
Regional staff will give a second look at
the Town of Pickering's desire that Finch
Avenue be widened to four lanes after Pick-
ering politicians raised a ruckus during the
Durham council meeting Wednesday.
Pickering councillor Maurice Brenner ac-
cused fellow Pickering representative Rick
Johnson, who is also the Durham works
committee chairman, of ignoring the wishes
of Pickering council because the widening
of Finch isn't included in the Region's five-
year roads plan. In January, Pickering coun-
cil laid out its priorities for road work it
wants the Region to complete.
Coun. Brenner questioned Coun. John-
son, "Did you not hear what your council
told you?"
Coun. Johnson retorted that, in his 12
years on Pickering council, "This is the first
time Brenner has spoken about Finch."
He added that during a public meeting in
Pickering, "A number of residents said they
don't want Finch done"
Coun. Johnson noted the Pickering re-
quest has been forwarded to works staff for
consideration.
Pickering Councillor Doug Dickerson
and Durham works commissioner Vic Sil-
gailis also exchanged heated words.
Coun. Dickerson asked, "You're aware of
the Pickering directive?"
Mr. Silgailis replied that Finch Avenue
won't be widened simply because Pickering
council has submitted a written request.
"I'm aware of the correspondence. It's your
desires. It's a gratuitous piece of informa-
tion."
Coun. Dickerson persuaded Mr. Silgailis
to reconsider widening Finch to four lanes.
"We'll be back to you with our new priori-
ties," the works commissioner vowed.
But, in order for the Region to undertake
the project, Mr. Silgailis urged Coun. Dick-
erson and his colleagues to "Give us more
money."
Durham will spend $13.6 million on its
roads program this year. Major projects in-
clude widening Taunton Road from Garrard
Road in Whitby to Oshawa Creek ($2.99
million), improving the intersection of West -
Pickering daffodil helpers needed
The Canadian Cancer Society needs vol-
unteers in Pickering for its Look What Daf-
fodils Do Campaign designed to raise
awareness of the society's Daffodil Month.
Volunteers are needed to kick off the
April campaign by selling daffodils for four
dollars a bunch at various locations in
Durham Region on March 25, 26 and 27.

show aids
Pickering
Cubs, Scouts
DICKERING — Toy car enthu-
siasts from across Durham Region
are invited to get their motors run-
ning and head out to the upcoming
Diecast Car Show being held later
this month.
One dollar from all adult admis-
sions to the show will go to the Sev-
enth Pickering Cubs and Scouts
groups.
The show is being held at the
Pickering Recreation Complex on
March 28 from 9 a.m. to 4 p.m.
Admission is $5 for adults and
kids under 12 are admitted to the
show for free.
The show will feature diecast toy
cars of the Hotwheels and Match-
box varieties.
Among the attractions offered at
the event will be an orange race
track for kids, as well as a custom
diecast show.
The money will go towards funding cancer
research and community services for local
cancer patients. In April, volunteers are
needed to knock on doors in Ajax and Pick-
ering to ask for help in the fight against can-
cer.

"They deserve a guilty verdict,
but not for an innocent man:"
During a three-week trial, pros-
ecutors portrayed Mr. Lazenby as a
Good Samaritan who essentially
died for defending a dancer at the
Palace East on Dillingham Road.
Court was told Mr. Lazenby
was leaving the bar with buddy
Steven Smith about 2:15 a.m.
when he came upon a verbal dis-
pute involving Daniel Robinson
and girlfriend Annette Goguen,
who was in tears as Mr. Robinson
shouted insults at her in the lobby
of the bar.
Mr. Lazenby began "sticking
up for Annette, telling Daniel to
leave her alone;' one witness testi-
fied.
-'I said (to Rae) don't mess with
those guys;' Mc Smith testified,
referring to Mr. Robinson, Mr.
Solomos, Shean Glave and Paul
Mohammed.
At one point, witnesses said Mr.
Solomos pulled out a knife and
told Mr. Robinson words to the ef-
fect: "Don't worry, if anybody f-
-s with you, I got your back"
Mr. Robinson and Mr. Lazenby
stepped into the parking lot and
came to blows, with Mr. Lazenby
head -butting Mr. Robinson and
gaining the upper hand. Prosecu-
tors said Mr. Solomos, Mr. Mo-
hammed and Mr. Glave jumped in
at various stages of the fight and
each tried taking shots at Mr.
Lazenby. -
But the only person claiming to
have seen the actual stabbing was
exotic dancer Jodi Collins, the
Crown's key witness, who was ad-
mittedly drunk after consuming
four shots of Sambuca and six
glasses of vodka and orange juice.
Ms. Collins testified she was
pulling Mr. Robinson away from
the fight when Mr. Solomos
jumped in and started stabbing Mr.
Lazenby.
"I saw the knife go in... He just
kept stabbing and stabbing," Ms.
Collins said.
When a wounded Mr. Lazenby
keeled over in pain, Mr. Solomos
stood with a "blank look, like he
couldn't believe what he'd done,"
Ms. Collins said.' The knife was in
his hand with blood on it:'
Ms. Collins's testimony was
problematic, however. She admit-
ted in court she initially lied to po-
lice, giving various accounts of
what she witnessed.
Mr. Solomos, of Scarborough,
took the stand in his own defence,
denied he was the stabber and fin-
gered Mr. Robinson as the killer.
"I didn't want to rat on some-
one;' but Mr. Robinson "took
away one life" and wouldn't take
his, he said.
Jurors heard Mr. Solomos has
numerous convictions for robbery,
break and enter and escaping cus-
tody. They also heard Mr. Robin-
son, Mr. Solomos, Mr. Glave and
Mr. Mohammed took of together
following the stabbing and ran to
nearby railroad tracks.
They were quickly caught and
all four were initially charged with
second-degree murder. However,
the murder charges against Mr.
Robinson and Mr. Glave were re-
duced to assault a few days later,
while Mr. Mohammed was re-
leased unconditionally.
Mr. Solomos told court Mr.
Mohammed pulled out the knife in
the lobby. He also said Mr. Mo-
hammed handed the weapon to
Mr. Robinson before the fight
began and Mr. Robinson gave it
back to Mr. Mohammed as they
fled. Court heard blood found on
Mr. Mohammed's pants pocket
came from Mr. Robinson and Mr.
Lazenby.
Mr. Justice Stong told the jury
the verdict was "extremely rea-
sonable" given the circum-
stances.

Ontario lags behind
rest of Canada
All other provinces have hit
balanced budget targets
While Ontario, Canada's largest
province, has led the way in job cre-
ation and economic growth over the
last few years, the engine of Canada
has sputtered on another front.
With Quebec finally balancing its
budget this past week. Ontario is the
only province which has yet to hit a
balanced budget. Finance Minister
Ernie Eves and Premier Mike Harris
have said it won't be until the next fis-
cal year, 2000-2001, that the Province
will finally be in the black.
It's humbling to come second to
Quebec in this battle of finances.
Mind you, the federal government, as
part of its equalization payments, has
provided Quebec with an additional
$1.4 billion this year. Some of that
money came from the higher tax rev-
enues generated by the increased em-
ployment in Ontario and by better
revenues than expected from Ontario
businesses. Nevertheless, Quebec has
balanced its books for the first time in
decades, while Ontario has not.
Those who want Ontario to join
the balanced budget club argue the
Province should curtail, or at least not
increase spending on health and edu-
cation in order to eliminate the deficit
this spring. One group, the Ontario
Alternative Budget Group, has argued
the Province could have a surplus of
$1.6 billion this year if it did not in-
crease spending or cut taxes. Howev-
er, the premier has said he intends to
spend more on education and health
care and there are rumblings the To-
ries are mulling over a one -per cent
cut in the provincial sales tax lower-
ing it from eight -per cent to seven -per
cent. This latter policy could be just
in time for an expected spring or
early summer election call.
The Tories have been consistent in
their 2000 prediction of a balanced
budget. Back as far as the fall of
1995, the finance minister was pre-
dicting it would take five years to
reach a balance. That was before the
growth and employment rate really
took off corresponding with a dramat-
ic drop in welfare costs bringing in
far more revenue than the Tories
could have expected.
Finding the right balance is some-
thing for which the Province should
be striving hard. Surely if other gov-
ernments across the country can bal-
ance their books. Ontario, the leading
province, can as well. Tax cuts are
needed much more at the federal
level. The Tories have done their bit
in this regard delivering on the
promised 30 per cent provincial in-
come tax cut. Now's the time to bal-
ance the books and make every dollar
count towards building a better On-
tario.

already lost. Since he would have
to spend all this time and money
just to get back the $75 fine, ap-
pealing the ruling did not make
sense. It was cheaper for him to
keep his mouth shut.

Critics take aim -at Firearms Act
But supporters convinced it will increase public safety

For many hunters, target shooters
and other gun owners, new legisla-
tion requiring them to register all
firearms is intrusive and cumber-
some, and makes them feel like
criminals.
Indeed, many have been law-
abiding citizens and have taken
great care in ensuring their firearms
are safely stored. The federal legis-
lation goes too far, they criticize,
leading some to illegally sell hand-
guns and rifles in order to avoid the
cost and work associated with the
Firearms Act.
Supporters of the controversial
legislation believe registration of all
firearms will increase public safety,
but opponents wonder how it will
achieve that goal. After all, crimi-
nals aren't going to register their
guns, critics maintain.
Despite heated resistance, the
federal government went ahead with
the Firearms Act, under which the
registration of all firearms began
Dec. 1, 1998. Gun owners have until
Jan. 1. 2003 to register their
firearms.
'At the heart of the program is a
firearms licensing and registration
system that will assist in police in-
vestigations;' the department of jus-
tice said in a news release issued on
the first day of implementation.
"It will allow police to identify
illegal guns and better enforce
court-ordered firearms prohibitions.
Registration will also encourage
firearms owners to store their guns
properly and to report missing or
stolen firearms. This will help re-
duce thefts and senseless accidents,
especially those involving children."
That news release points to a poll
which indicated 82 per cent of
Canadians support registration, in-
cluding 72 per cent of rural resi-
dents. "Police groups, medical and
public health organizations, victims
and women's groups and other
groups concerned with public safety
support the need for an efficient reg-
istry of firearm and firearm owners."
Admittedly, opponents believe
the act started out as "fuzzy, feel -
good legislation;' notes Tony
Bernardo, executive director of the
Canadian Institute for • Legislative
Action.
But he says the act has had "cat-
astrophic" effects on the sale of
guns. The institute has launched a
class-action suit against the federal
government on behalf of 65 busi-
nesses from across the country for

Pickering man now commands
storied 48th Highlanders

Turner just got a promotion.
This was not your typical
change of job, though. A pa-
rade of 200 soldiers• a pipes
and drum hand and 500 spec-
tators helped Mr. Turner
mark the occasion.
The 42 -year-old Pickering
resident of six year~ recently
assumed control of the 48th
Highlander% of Canada, an
infantry reserve unit in
Toronto of 150 soldiers that
has seen recent action on
peacekeeping missions in
Bosnia, and provided help in
Toronto during January's
snow storm. in the Winnipeg
floods two summers ago and
Quebec's ice storm of last
winter. Mr. Turner, formerly
the Deputy Commanding Of-
ficer of the 48th Highlanders,
will be responsible for every-
thing Including the unit's
fighting efficiency as well as
administrative matters:'
Mr. Turner comes from a
rich military tradition. His
grandfather was a member of
the 48th Highlanders during
the First World War, and his
father was in the 48th High-
landers in the Second World
War.
.'Anytime you take over a
position like this, you have
big shoes to fill;' says Mr.
Turner. "Especially with the
48th Highlanders that has
such a long and storied histo-
ry of 109 years.'*
Mr. Turner will be the
53rd Commanding Officer of
the unit. He was recommend-
ed for the top post by outgo-
ing CO Cameron. The
Brigade Commander then
has to approve the selection
Pickering resident George Turner, 42, says he has big
shoes to fill in taking command of the 48th High-
landers of Canada, an infantry reserve unit. The 48th
Highlanders have served in Bosnia and more recent-
ly, helped Torimto dig out of January's crippling
snowstorm.

this fall is draw-
ing criticism
from teachers
here who say the
idea is a "hol-
low" promise
that won't have a
"meaningful"
impact on the ed-
ucation system.
"I just don't
think it's well
thought out,"
says Pat Jermey,
Durham district
president of the
Ontario Sec-
ondary School
Teachers' Feder-
ation (OSSTF).
"These pre-elec-
tion announce-
ments are some-
what astounding.
The details are so
unclear. It's a
very hollow,
shiny promise of
something that is
not meaningful
for education."
The Province
has announced it
will provide
school boards $5
million to help
them offer 1999
summer school
programs to bet-
ter prepare Grade
8 students for the
new high school
curriculum being
introduced this
September.
But, the gov-
ernment has not
yet provided
boards any de-

New pill helps smokers kick the nicotine habit
Are you a 'smokaholic'? That
would be one who says "Of course I
*now the dangers of smoking. I
haven't been living on Mars. But I
enjoy smoking and if it's destined to
kill me, so what?" If that's your atti-
tude no one can stop you smoking.
But for others, trying to break the
nicotine habit, a new drug 'Zyban',
could save your life.
Before any doctor gets on his white
charger, however, and starts preaching
the gospel, he or she should be sure of
one thing. How much good does it re-
ally do to quit smoking? After all,
.why give up a pleasurable habit if the
rewards are only minimal?
Most smokaholics and casual
smokers have tunnel -vision about to-
bacco. They associate smoking strict-
ly with lung cancer.
But there are several benefits for
those who stop smoking. Thirty per
cent of all cancers, 85 per cent of
chronic bronchitis and emphysema
and 25 per cent of coronary heart dis-
,aeasc and strokes are due to tobacco. In
effect, if you want to circumvent pre-
ventable disease there's no better way
than by giving up smoking.
There's another huge benefit. Un-
like life insurance you don't have to
die before your relatives reap the re-
wards. You get the profit and it arrives
quickly.
For instance, the risk of succumb-
ing to heart attack or stroke decreases
after one single day of abstinence!
You breathe easier within a few days
and if you have a smoker's cough this
improves within one to two weeks.
One year after quitting, the ex -
smoker's risk of dying from heart at-
tack decreases by 50 per cent and con-
tinues to decline further. After five
years the risk of stroke for an ex-
smoker is the same as for those who
have never smoked.

� The Charles H. Best Diabetes Centre
for Children and Youth is planning a
fund-raising gala in celebration of its
10th anniversary.
The centre, the only one of its kind in
Canada, is aiming to raise $75,000 from
4he event. All proceeds will go toward
the centre's unique program for children
and adolescents with Type I insulin-de-
pendent diabetes.
Tickets are $170 each. Corporate ta-
bles, which will include a celebrity
guest, are available at $2,000 each. The
evening will begin with cocktails, wine -
$pang and hors d'oeuvres with musical
entertainment provided by the Durham
Benefit Wind Ensemble. A silent auc-
tion and a live auction will also be held.
Tickets for the auctions will be available
to gala participants, as well as to the
public, at $5 each. It's being held Satur-
day, March 27, l 999 at Trafalgar School

You would have to be a die-
hard smoker not to be impressed
with this preventive package. But
even if you are persuaded you've
no doubt heard stories of friends
who have repeatedly failed in
their efforts to stop smoking.
Why do smokers fail'? The
most popular method of giving up
doesn't make it the most success-
ful. It often ends up 'kicking the
cat.' Three to four per cent are
cured by this method.
Nicotine replacement therapy
(NRT) has a better track record.
NRT works by providing smokers
with limited amounts of nicotine
which help decrease withdrawal
symptoms. Nevertheless, by the
end of one vear its success rate is

only 12 per cent.
Zyban Sustained Release
Tablets have the best track record
and Zyban uses a different ap-
proach. It's a nicotine -free med-
ication and works directly on the
addiction centres in the brain.
This drug was originally de-
veloped to treat depression. Then
it was discovered patients who
were not depressed were also
helped by Zyban.
Zyban minimizes withdrawal
symptoms and cigarette cravings
by affecting dopamine and nora-
drenaline activity in the brain. It's
•
believed that these chemicals play
a role in nicotine addiction.
"Zyban is a prescription drug.
Patients are prescribed 150 mil-
ligrams (mg) of Zyban a day for
three days. They then take 150
mg twice a day for seven to 12
weeks.
It's important to start Zyban
one to two weeks before you de-
cide to quit smoking, as it takes
about a week for Zyban to reach
effective blood levels.
The most common side-effects
are insomnia and dry mouth.
Zyban should not be taken if pa-
tients have a history of seizures,
alcohol dependence, or have suf-
fered from anorexia nervosa or
bulimia.
It is also contraindicated for
those who are taking medication
to treat depression such as
monoamine oxidase inhibitor.
There are no studies that show
Zyban is safe for pregnant or
nursing mothers.
How effective is Zyban? One
study showed Zyban was signifi-
cantly more effective than the
nicotine patch. Forty-nine per
cent of patients on Zyban were
smoke-free at four weeks com-
pared to 36 per cent on the patch.
After one year 23 per cent were
smoke-free compared to 12 per
cent using the patch.
It is important for patients and
their doctors to realize that psy-
chotherapy along with Zyban
gives the best long-term results.

number. Registered nurses will
provide this supportive aid.
Last, never, never forget tobac-
co kills three times more North
Americans every year than alco-
hol, AIDS, illegal drugs, motor
vehicle accidents, suicide and
homicide. If smoking cessation
isn't "preventive medicine" I

Alan: Many, many years ago, I
orked as a radio disk jockey and I
til do 50s to 60s D.J. gigs on the side.
Dr. Franko: And your educational

Alan: I went back to school for a

Alan: As a lawyer dealing with

ed me to attend a workshop. It was

hanged my life. That was 21 years
ago.

Can/Am Junior Cup Matches in
Myrtle Beach, South Carolina March
20 to 21.
The team is comprised of the On-

PICKERING —The Pick-
ering Boyer Pontiac Panthers
are on the verge of shunting
the Oshawa Legionaires to the
sidelines after taking the lead
in the best -of -seven series at
the Oshawa Civic Auditorium
Thursday night.
The Panthers took a 3-2 se-
ries lead in the OHA Ontario
Provincial Junior 'A' Hockey
League East Conference semi-
final series after putting forth
their most complete effort of
the post -season in a pivotal 6-2
win over the Legionaires.
Game six in the series was
played Friday. March 12 at the
Pickering Recreation Com-
plex, after the News Advertis-
er's press deadline. Game
seven, if necessary, was con-
tested on Saturday afternoon
in Pickering.
The Panthers stymied the
Oshawa offence in a physical-
ly -played contest, something
they hadn't been able to do in
overtime losses to the Legion-
aires last Tuesday and Satur-
day nights. Moreover, Picker-
ing's powerplay finally found
its groove, going three -for -six
in the contest.
"It was our best playoff
game of the year. Certainly it
was by far the best we've
played on the road where
we've struggled in the play-
offs;" says Panthers' head
coach Rod McGillis. "As a
coaching staff, we challenged
the players to rise to the occa-
sion. Any team worth its salt
has to play well on the road"
The team received strong
individual efforts from goal -
tender Joel Cameron who was
back in net for Thursday's
game after sitting down for
Tuesday's game in favour of
Paul Guthrie. Cameron al-
lowed two goals on 36 shots.
Meanwhile, the team got of-
fensive leadership from Jeff
Milroy, who scored two goals
in the contest.
"Jeff Milroy has been a
sparkplug for our team. He's a
very hard-working, intelligent
and disciplined player, so
when you put those three com-
ponents together, he's a big
factor on the team. It was fit-
ting that he scored two impor-
tant goals for us;" says
McGillis.
Also scoring for the Pan-
thers were Tora Crnilovic,
Jason Lange, Sean McMorrow
and George Trifon. Earning as-
sists were Joel Johnston with
three, Doug Carr and Bill Dun-
can each with two, Trifon, T.J.
Kemp, Luc Chiasson and Mar-
cel Rodman all with one.

The Durham West Lightning bantam 'B'

Durham West Girls' Hockey Association
"Tournament in thrilling fashion as a shoot-
out was needed to break a deadlock with
the Willowdale Red Wings in the title game
Sunday.
The championship game at the Picker-
ing Recreation Complex's O'Brien arena
featured excellent scoring chances and out-
standing goaltending. The game was score-
less after regulation time before moving to
a three -player shoot-out. The first Light-
ning shooter, Charlotte Dowley, flipped a
perfect backhand over the Willowdale
goalie to give Durham West a 1-0 lead. The
three Willowdale shooters were all stymied
by Lightning netminder Mary Lawrence,
whose outstanding glove save off the first
Red Wings' shooter was the best of the
tournament and scaled the victory for
Durham West.
The semi-final game pitted the Light-
ning against the rival Whitby Wolves. The

the provincial championships in April

first stanza, the Wolves got hungry and
opened up a 2-0 second -period lead on two
miscues by the Lightning. A little more
than a minute into the third frame, Meghan
Ritchie was set up perfectly by Lindsey
Rocks and Lauranne Hutton. Eight seconds
later, Laura Hill scored on a rebound from
Courtney Puddister and Jenna Vermeulen.
The third Lightning goal was scored by
Meaghan O'Reilly with 3:12 remaining
from Phillips. The Lightning then got
empty -net goals by Puddister and Michelle
Damiani with assists going to Lawrence,
Hill and Dowley.
The bantams started the tournament
with a 4-0 win over the North York Storm.
Scoring were Vermeulen, Rocks, Marianne
Carefnote and Ritchie. Assists went to
