BY LESLEY BOVIE Staff Writer PICKERING —Kinsale residents say while they support the City’s new fill and topsoil regula- tions, they now expect some action to be taken on a stockpiling operation in their own backyard. “We are looking for results and we are looking for immediate results,” said Laura Orlandi. Pickering’s new bylaw requiring permits for the placing and dumping of fill and the removal of top- soil and altering land grades passed unanimously last week. But Mr. Orlandi pushed hard at the meeting for answers as to its effectiveness. “Will this prohibit any future companies like the one we have in Kinsale from doing this, and will it prevent and stop what we presently have in Kin- sale?” she asked. She and her neighbours have been trying to stop the dumping of fill on a property northeast of Bal- sam Road and Hwy. 7. They fear the fill is contaminated, while the owner of the property, James Sabiston, maintains it’s clean. Without a fill bylaw in place, Pickering’s only possible course of action up until now has been to sue the owner for not complying with zoning. The City has a court date at the end of March to that ef- fect. Now that the new bylaw has been passed, a letter was sent to Mr. Sabiston the following day, request- ing him to apply for a permit within two weeks (by Feb. 7) under the new regulations, City clerk Bruce Ta ylor said. The City has to process his application within 30 days or risk his appeal to the Ontario Municipal Board, he said. The new bylaw sets out “rigorous conditions” in terms of detailed plans and schedules, which must be met by the owner, said Mr. Taylor. Man charged in robbery attempts AJAX —A 39-year-old Ajax man faces theft and robbery charges following two separate incidents minutes apart Thursday morning. Durham Regional Police Sergeant Jim Grimley reports a man entered the Health-Rite IDA at 75 Bayly St. in Ajax shortly after 11 a.m. and demanded drugs. When he didn’t receive any, he fled. Minutes later, a man indicating he had a weapon tried to get drugs at the Shoppers Drug Mart, in the Harwood Shopping Centre. Cus- tomers and store staff tackled the man and held him until police ar- rived. No weapon was found, Sgt. Grimley said. Durham police were heading to the first call when they were redirected to the Shoppers Drug Mart, he added. Anthony John Eakley of Roo- sevelt Road has been charged with robbery, theft under $5,000, three counts of assault to resist arrest and one count of possession of proceeds of crime. DURHAM ––A new volunteer program will help Durham residents make good food choices through workshops and displays throughout the community. The community food ad- visers program was launched Wednesday, Jan. 29 by the Region of Durham in partnership with 18 com- munity groups. At the launch, the first 41 volunteer graduates pre- pared to begin promoting safe and nutritious food se- lection, preparation and storage to interested groups and organizations including seniors’ groups, community kitchens, shopping centres and service clubs. The volunteers have completed a provincially- sponsored training program consisting of 70 hours of in- struction and 20 hours of community practice in food safety and nutrition. The force is holding a first- ever one-week recruitment camp for women called OPP- Bound, with the goal of in- creasing awareness of employ- ment opportunities for women. Currently, OPP employs 985 female officers, nearly 20 per cent of its force, and 4,822 male officers, said Sergeant Karen Harrington of human resources. “We’re always trying to represent the community. There is not the representation we would like. The message we want to (send to women) is, ‘consider policing’,” she said. Sgt. Harrington said OPP hope to dispel any “miscon- ceptions” women have about policing that might deter them from a law enforcement ca- reer. “There are so many as- pects of policing” some aren’t aware of, she said. The camp will include “mentoring sessions with key female officers” and partici- pants will learn about the force’s history and also take part in firearm exercises, fit- ness drills, police vehicle op- erations and other practical ex- ercises. Up to 100 women will be selected for the five-day mini- camp, which will be held at the Provincial Police Academy in Orillia from July 6 to 10. The application deadline is June 1. Told co-worker he had mice to kill BY STEPHEN SHAW Staff Writer DURHAM ––In the months before his wife’s death by cyanide, Ganesh Raghunauth confided to a co-worker about his marital problems asking: “What can I do to be single again?” and “What’s the strongest poison on the market?” To the first question, Angelica Paulino answered, “There’s something called divorce.” In a later conversation Mr. Raghu- nauth asked, “What’s the strongest poi- son on the market,” Ms. Paulino testi- fied in Superior Court. “I said, ‘What are you trying to kill?’ I thought he was joking. He said ‘mice.’ I said, ‘You have mice at home?’ and he said ‘Yeah,’” the wit- ness said. Ms. Paulino recalled the conversa- tions Friday at the first-degree murder trial of Mr. Raghunauth, 31. The Pickering man is accused of drugging his wife Hemoutie (Geeta) Raghunauth, 28, with the sedative Temazepam before poisoning her with cyanide in the couple’s Beaton Way home on Mother’s Day 2000. He has pleaded not guilty. Ms. Paulino, who worked in the fi- nance department at York Central Hos- pital where Mr. Raghunauth was an ac- counts receivable analyst, said they discussed their personal lives daily. Ms. Paulino told court Mr. Raghu- nauth revealed to her he was having marriage troubles, that he and his wife, “were not getting along.” Ms. Paulino, who sat at the desk next to Mr. Raghunauth, said she over- heard a phone conversation between him and his wife in which she accused him of having an affair. Mr. Raghunauth told his wife, “It’s not true, you’re wrong,” she said. During the phone call he swore at his wife, told her to, “Shut up bitch,” and “drop dead,” Ms. Paulino said. In a conversation with Ms. Paulino about his wife, Mr. Raghunauth told his col- league that “he couldn’t stand a less in- telligent person” than himself. A couple of months before his wife’s death, Ms. Paulino said Mr. Raghunauth started asking about drugs and poisoning. “He would ask me, ‘If a person takes a whole bottle of Tylenol or seda- tives, what would happen to that per- son,’” Ms. Paulino told court. “If a person was poisoned and brought to the emergency department, would they save that person? How would they do it?” Mr. Raghunauth asked Ms. Paulino. She said she told him, “I don’t know, stomach wash, I guess.” The cause of Mrs. Raghunauth’s death was unknown until toxicology tests detected high levels of the sleep- ing drug Temazepam and cyanide in her blood and stomach. When he returned to work after she died, as police investigated, Mr. Raghunauth asked Ms. Paulino, “What does a toxicologist do?” “I said, ‘looks for toxins and chem- icals in a person’s body.’” Can that be found in blood? Mr. Raghunauth inquired. “Of course,” she says she told him. Mr. Raghunauth told Ms. Paulino he planned to have his wife’s body cre- mated. When Ms. Paulino asked him if she committed suicide, she said he replied. “No, definitely not. She couldn’t have done something like that.” Mr. Raghunauth was fired from the hospital June 6, 2000 for suspicion of fraud, court has heard. He was charged with murder a cou- ple of months later. Mr. Taylor said Mr. Sabiston’s ap- plication is well under way and tech- nical information can be forwarded to the City during the 30-day appli- cation process. Council deferred passing the bylaw in November at the request of Kinsale residents, who argued draft forms of the regulations had too many loopholes. Staff worked through their con- cerns and as a result, the bylaw will be much more literally interpreted, removing the discretionary powers of the City’s planning department, said Mr. Taylor in his report to coun- cil last week. “It is a better bylaw and yes, we support it,” said Ms. Orlandi at the meeting. “But with the trailer on it: We e xpect results.” Mayor Wayne Arthurs pointed out passing a bylaw doesn’t ensure com- pliance, “but it provides the neces- sary tools to act on someone who steps outside of it.” Pickering’s new fill and topsoil regulations compare favourably with other municipalities and is based on a model used by Toronto Region Conservation, Mr. Taylor told coun- cil. Uncertainty could be final nail in coffin For the first time in 18 years, crowds won't be flocking to the Metro East Trade Centre this week- end. There will be no fighting to find a parking spot, no steady streams of shoppers to navigate. The fruit stands, antique booths, and jewelry dealers are all gone. Their wares were packed up and shipped off site earlier this week. Sounds of active bargaining have been replaced with the hammering of workers in the first stages of dis- mantling the trade centre. It was meant to be a showcase for Pickering, a site attracting inter- national and national attention but was built just as the economy was taking a downturn. The trade centre became home instead to the Picker- ing Markets, where it earned its own reputation in the Greater To ronto Area for its eclectic mix of culture and enterprise. Still, developers and City offi- cials alike agreed the property was underused for its size. The southern portion of the centre came down a few years ago to make room for the arrival of a Wal-Mart. Now, the en- tire thing must go for a Sam's Club and several other big-box stores. It's also crunch time for the mar- kets' vendors. The next few weeks will determine if they have a per- manent home to look forward to in August. Without a temporary location in Pickering, the markets runs the risk of losing its vendors to other venues in their need to make a living for the next six months. How many of them will return to set up a booth when the new location opens at Squires Beach Road and Bayly Street? More importantly, how many regular customers could the mar- kets lose in the meantime? Vendors involved in the ongoing negotiations with area property owners say they don't want to think of those possibilities just yet. They'd rather concentrate on these more immediate problems first. But it's bound to be an issue for them. The markets' lawyers have said the Invar Building Corporation will want a certain level of commit- ment from vendors before building the new location. Should ongoing negotiations fail to secure a temporary site "in the area", we may see the end of the Pickering Markets. And that would be a loss, indeed. Not only is it a training ground for many small businesses, but it's become an institution in Durham as 'the place to go' for those searching for something different on a dime. What bothers me most is our government's apparent apathy in taking concrete steps to help combat the problem. The recent police press conference re- vealed Canada's efforts to curb child porn are so poor we "risk" being seen as a haven for pedophiles. Our federal government, so poor in its own ethics and accountability, so big on its own rhetoric, is really dropping the ball on this issue. Consider this for a moment: This giant Internet child-porn industry almost exclu- sively relies on multinational credit card companies to make money. Yes, that same card that buys your kids' clothes, books and diapers is the same card pedophiles use to buy disgusting, vile, images of our children being exploited in ways every loving parent can't even bear to imagine. And yes, these credit card companies happily take their two to four per cent of income generated (which amounts to millions of dollars per year). This is the biggest example of a lack of corporate ethics, greed and accountability that I have ever seen. Why can't our government pass a simple law, forbidding credit card companies from doing business with criminal child pornog- raphers? If Prime Minister Jean Chretien feels he needs a legacy, how about a legacy protect- ing our children? I know that it may be im- possible to stop child pornography, but the least we can do is make it difficult for these "low-lifes" to profit from it. That was the issue when the Ontario Court of Appeal ruled unanimously that the indiscriminate use of heat-seeking technol- ogy by police helicopters was an invasion of privacy. The three- judge panel decided the technology can still be used but only after police first obtain a search warrant. Section 8 of Schedule B, Part 1 of the Charter of Rights and Freedoms states: "Everyone has the right to be secure against un- reasonable search and seizure." Judge Rosalie Abella stated the "nature of the intrusiveness is subtle but almost Orwellian in its theoretical capacity." The heat-seeking equipment has been a weapon in the war on pot-grow homes across the GTA. Typically, a home used to grow marijuana produces an inordinate amount of heat in the produc- tion of the plants. High sources of heat in homes, therefore, could be a clue in the fight to shut down the homes. While police would not comment on the number of busts that have been made using the technology, federal drug prosecutor Alex Sosna, who current- ly has about 75 marijuana grow lab cases on his desk, says "a large number" involve the use of infrared equipment. It's unclear how those cases will now proceed given the court's opinion on the use of the equipment. In the past year 125 mari- juana grow homes in Durham have been shut down. Durham Deputy Police Chief Rod Piukkala says it hasn't been common practice for the police helicopter to fly over homes in the region to check for suspicious heat levels. He does admit, "I can't say never, but it would be impractical." The helicopter can and will be used in specific investigations, checking on suspect homes that were already targeted. In other words, police will have to present sufficient evidence to a judge or justice of the peace that a search warrant is needed before doing the air surveillance on a home, not the other way around. Naturally, the ruling is frustrating for police, who feel too many intrusions and steps are already needed to perform their jobs. "Every time our hands are tied it's frustrating. We need a search warrant for everything we do... We're always concerned when a tool in our toolbox has been removed," said Deputy Chief Piukkala. On the other hand, everything police officers do must meet the basic test of law. Their actions must achieve a balance between the protection of individual civil rights versus the vital role soci- ety asks them to fill in fighting criminal activity. It's a test that's central to democracy and one the police have failed in this par- ticular case. Stretch antagonistic muscle groups to maintain a point of tightness, hold for 40-60 seconds and release. Repeat each stretch three times. Strength of muscles is also important but overdoing it can lead to muscles tears. Warm-ups are most important before beginning the activity especially for cold weather sports. We idle our cars on cold winter days, but are we as kind to our bodies? Warm-up exercises help stretch muscles and allow for greater mobility. This minimizes the chance of injuries by allowing the muscles to be more responsive and act as better shock absorbers. Stream the part of the body used in the activity, for example, your legs in skiing or skating when warming up but also do upper body circular arm swings. A cool down period after the activity is also important. A sauna or whirlpool followed by a cool shower will help. Stop the activity when you’re tired. Remember, more injuries occur on that last run of the day when your fatigue hampers your reactive time and you are not paying attention. Winter sports require proper clothing. Upper body layering will keep you warmer and always wear a hat to prevent heat loss. Proper foot wear includes insulated waterproof boots or shoes. Socks must remain dry to prevent the occurrence of frostbite. Those suffering from pre-existing circulatory problems such as diabetes or Raynaud’s Disease should consult their medical doctor. Ski boots and skates should fit properly for a safe and uneventful activity. If the boots or skates are too loose, toes quickly get irritated in the toe box. If they are too tight, pressure leads to blisters and abrasions causing painful feet which may compromise control and lead to injuries or accidents. Skates that are too large or wide may lack proper ankle support leading to strains, sprains or even fractures. Some runners are trying spikes that fit over their shoes when jogging in icy areas. Some problems to watch out for are: 1) FROSTBITE: Skin freezes when exposed to cold temperatures and high winds. With longer exposure blood vessels constrict and skin colour changes from blue to white. A feeling of numbness or burning may indicate frostbite. Wet feet are more prone to frostbite as are people with previous history of frostbite. Prevention involves changing wet clothing and avoiding the use of alcoholic beverages. Shield yourself from high winds and keep moving. Treatment involves putting fingers in armpit touching warm skin. Remove clothing from the affected area and avoid rubbing the skin. Pickering’s finance and op- erations committee is recom- mending to council all on-street parking be prohibited during times of snow clearing opera- tions. In an effort to improve snow clearing, City staff originally recommended prohibiting all on-street parking between the hours of 3 and 6 a.m. from Dec. 1 to April 1. But finance and operations committee members said in No- vember they felt the bylaw was too restrictive. While a number of area mu- nicipalities prohibit on-street parking during the winter, there are currently no specific park- ing restrictions on Pickering’s books other than those that dic- tate vehicles can’t be parked for more than three hours at a time on city streets. Nor can they in- terfere with the movement of traffic or clearing of snow. It’s the interference stipula- tion that has sparked problems, said Richard Holborn, division head of municipal property and engineering. A bylaw enforcement officer must be present to witness the interference, slowing down snow clearing considerably, he said. But staff now feel the revi- sion of the wording and defini- tion of snow clearing could help address both their concerns and that of committee members. Under the proposed amend- ed bylaw, roads crews can noti- fy bylaw enforcement officers when snow plowing, salting and sand- ing begins. Bylaw officers can then ticket all on-street vehicles or tow, if necessary, to provide unimpeded ac- cess for plowing operations, Mr. Hol- born said in his report. Council is expected to deal with the issue Feb. 3.
