PICKERING — A strong 'no' vote by residents on
provincial downloading of social costs will not likely
have much influence with Queen's Park, according to
Mayor Wayne Arthurs.
Citizens were asked for their view on downloading in
a referendum held in conjunction with the municipal
election Monday.
Eighty-two per cent answered 'no' to the question:

Mayor Arthurs said his policy on the casino issue will
be governed by the referendum result.

PICKERING — The push is on for an a ri-
ronmental assessment of the Pickering nuclear sta-
tion after an 86.9 per cent vote calling for one in a
referendum held as part of Monday's municipal
election.
"That's what we were hoping for," said Durham
Nuclear Awareness (DNA) spokesman Dave Mar-
tin of the overwhelmingly positive referendum
(result. "We were expecting a very strong 'yes'
vote based on the response we were getting at the
door."
DNA, a citizens' group on nuclear issues, cam-
paigned extensively on the referendum question
during the final weeks of the election, when vol-
unteers went door-to-door to hand out some of
about 15.000 DNA pamphlets distributed in the
community
"We intend to use the referendum result to put
po[itical pressure on Queen's Park to hold an eavi-
yoamental assessment," said Mr. Martin. "We will
be writing personally to every MPP this week with
the results of the refereadum:'
DNA has already sent an information package
on the issue to each member of the Ontario Hydro
board of directors and urged them not to decide
their position on an environment&[ assessment
before considering the referendum results. The
local group will also seek the help of other envi-
ronmental organizations in pushing for the review.
Mr. Martin noted many eyes have been on Pick-
ering during the course of this referendum.

The 31 -year-old man, who was under
investigation for drinking and driving, was
strip searched in a prisoners' shower area at
17 Division before taking a breathalyser test.
Mr. Flinioff testified he felt embarrassed
and intimidated by the search, which was per-
formed in an area in view of other officers,
including female officers, said trial Judge
Donald Dodds.
A senior officer told court the policy was
adopted by the force in response to several
cell block incidents involving weapons.
Strict enforcement of the order required all
persons taken into custody be subjected to the
strip search, regardless of the circumstances,
court was told. That included "young and old;
men and women; the sick, healthy and dis-
abled: the belligerent and the co-operative"
Mr. Flintoff. who was initially given a pat
down. or frisk search at the scene of the acci-
dent, was charged with two alcohol-related
offences following the breath lest. He was
[hen released.
He was co-operative with the officer at all
times and the officer had no reason to suspect
he was armed, said Judge Dodds. who ruled
the strip search was "warrantless... unrea-
sonable"
He excluded the evidence obtained from
the breath test and dismissed the charge of
driving with more than 80 milligrams of alco-
hol in IW millilitres of blood.
The Crown successfully appealed the rul-
ing on the over 80 charge, however it con-
ceded the strip search was illegal.
Still, in his written decision released six
weeks ago. Mr. Justice D.S. Ferguson was
highly critical of the police department's
casual use of the strip search procedure.

police about their understanding of the law

The policy had the potential to diminish
the public's confidence in the administration
of justice, "and perhaps more particularly in
the police department itself;' added Judge
Dodds in his decision.
The issue of the over 80 charge is now
headed for the Ontario Court of Appeal,
which is expected to hear the case early next
year, said Oshawa criminal lawyer Alan
Risen, defence counsel for Mr. Flintolf.
In an intercicw this week. Mr. Risen called
the policy "a shocking invasion of a citizen's
right to privacy and to human dignity." He
added a case was recently thrown out of court
in Cobourg under the same circumstances and
another is pending In Peterborough.
Meanwhile, the Durham Regional Police
policy on strip searches was revised recently
in light of the court decisions.

the provincial government prior to the teachers'

The Durham Board of Education has seen a
draft application form for the subsidy but will
not receive the final documents from the min-
istry until the rebate is approved by the legisla-
ture, says board communications manager Mary
Brown. Tice subsidy is intended to he retroactive
to the first day of the strike and is to he paid by
school boards with "money saved from teach-
ers' salaries:' Ms. Brown says.
Application forms will be distributed
through schools. Eligible students include chil-
dren 13 years of age or younger, those 14 and
older who require special supervision due to
special needs and children who normally attend
day care centres in a publicly funded school
who were unable to gel to the centre.
Meanwhile, a recorded message on the
Durham Region Roman Catholic Separate
School Board's information line is reminding
parents to hold on to their receipts.

Graduation ceremonies rescheduled
Commencement and award assemblies
cancelled last Friday due to the teachers'
strike are being rescheduled by secondary
schools across the region.
The Durham Board of Education post-
poned commencement assemblies at seven
secondary schools last Tuesday due to the
teachers' walkout in protest of Bill 160.
Ceremonies will be held at Pickering's
Pine Ridge Secondary School Nov. 14 at 7
p.m., at Ajax's Pickering High School Nov. 21
at 7:30 p.m., and at Ajax High School Nov. 28
at 7:45 p.m.
New dates have not yet been confirmed for
commencement assemblies at Brock High
School and Uxbridge Secondary School
although decisions are expected to be made
later this week.

Candidates',
take a bow
A tip of the hat goes out today to all candidates in
Monday's municipal election — both those who were
successful in their bids for political office and those who
failed to win enough votes.
We prefer not to call the unsuccessful candidates
losers. Whether they finished first or last, cvervone who
ran for election in Ajax and Pickering is a winner, as far
as we're concerned.
Candidates for Town and Regional Council and
Durham's public and separate school boards deserve cred-
it for rising to the challenge issued in the 1960s by then -
U.S. President John F. Kennedy. To paraphrase, he urged
citizens to ask not what their country could do for them.
but what they could do for their country. The men and
women who ran titr election here Monday asked them-
selves what they could do for their community and
answered by running for office.
Cynics out there will contend that people who aspire to
politics do so out of hunger for power or a desire to line
their pockets. Those cynics are the same individuals who
see the glass as half empty.
We choose to look at it as half full. It's our belief that
99.9 per cent of people who put their names forward as
candidates for election do so out of a genuine concern for
their fclkow man, out of a desire to make their community
a better place or to improve the quality of education our
children get.
As for the charge that people who rim for office are
rnorey-hungn individuals, we say that's nonsense. Those
who arc elected mayor of towns the size of Ajax and
Pickering, for example, pretty much have to abandon or
put on hold carters in the private sector that pay them
more than they -II make in office. And. individuals who
serve a% ecuncillo n or school trustees can expect to be on
call 24 hours a day. seven days a week. con top of the 40.
50 or 60 hours a week they might work in their regular
jobs.
Public service is often a thankless job as most politi-
cians crtly hear from constituents when they have a beef.
They rarely get bouquets from the people they we trying
o serve. And. most politicians — especially at the grass-
noots level of municipal councils and school boards — do
a great job representing the people who eiected them as
well as those who didn't.

who ran in Mondays clestitn. To those who won scats on
council or schoxal board, congratulations. To incumbents
who lost seats, we offer our heartfelt gratitude for a job
well dome in the past. To pcopk who failed in their first
attempt at political office, we extend our appreciation for

the call to serve your community.

Teachers trying to protect turf

protest the tare-sidod coverage of
your paper. I cavi t recall you sup-
porting the government on its pro-
posed school refmns.
So. I point out the khllowing:
1) The ghwMy of education has
been dcchnmg in Ontario over the
past several year. 1 drink even the
teachers' umiorhs agree on this.
Therefore the starts quo is not an
option. The present system is net
working. The government has the
guts h, admit dot and do something
about it unlike previous govern-
ments which studied the pits 11,
ad nausam and then diose the
comfortable and polttcally expedi-
tat path of doing nothing. The
Provincial education cabal, emom-
passishg the scut" boards, trustees,
union bureaucracies and tac.:hem
now fats threatened by proposed
reform because it would upset dei
comfortable system, a system
which has seen our taxes increase
over the past 10 yeah with no car -
responding increase m quality.
Reform is needed.
2) Education is a provincial
government responsibility. How
any provincial St»rrnmea ch—
to discharge this responsibility is its
business. whether it he through
school boards or other irsutuuons,
or whether it decides to look after
the responsibility itself. Therefore
the argument that the proposed
reform is only a big pow grab on
the part of Queen's Park is a red
herring. It already has that power
under the BNA Act. The fact it
bother the ululation cabal that the
government is choosing to exercise
its constitutional right is too bad. If
experience shows the reforms arc
not working. the government can
change its policy or the ole tonic
can change the governmem lit is
the elated representatives of the
people who should govem this
province, not union leaders.
3) The union leaders' response
to the government initiative was to
strike. h was an illegal action, but
so what? The teachers showed the
students whose best interests they
profess to have at heart that if you
don't agree with a particular law,
disregard it and do your thing any-
way. Call your action another name
and that will make it OK.
Whenever a group takes the law
into its own hands, that is the begin-
ning of anarchy. I would hope the
teachers' employers penalize the
participants in this illegal action,
just as I would be penalized for not
paying my school taxes even
though I think they are the most
unfair levy in the world. But the
chance of that happening is minus-
ule when the syslctn allows wil oW
management as well as board mar-
agemrnt to walk the picket lines
with they employees. It boggles the
mind! The system is self-servmg
and begs reform.
i) The arrogance the unions
showed during the strike is had to
believe. but typical. Who knows
what part the antics of the union
demonstrators played is the auto-
mobile accident at Liverpool Road
and Hwy. 2 when three picketmg
teachers were hit by a car? If the
wachhes were waving placard% in

ment should repeal the Rand
Formula that the Davis government
passed in error some time ago. This
would allow individuals to opt out
of union membership and the
requirement to pay union dues if
they disagree with union behavior
and philosophy. Perhaps then the
disruption this type of illegal union
activity causes to our society would
be eliminated.
The dispose has nothing to do
with the wades' unions' con-
tention that it is about quality or
preserving education. It has every-
thing to do with their far that a sys-
tem which they have bush up over
time to serve their own purposes is
about to be upset, that someone
dares to encroach upon their cozy
set-up, and therefore they are figh-
ing tooth and rail to preserve iL The
govern mem has no uhmor motive
in proposing reforms, will not ben-
efit from them, and is doing so sok- .

will be beneficial in the long run.

would like to voice my opinions
regarding the leacher' pretest of
Bill 160.
I offer my sympathy to all
teachers for the constant teacher -
bashing from the public and the
government presently in power. I
also offer my sympathy to the
solo■ leaders who are depicted as
forceful commanders, of an army.

This draconian provincial gov-
ernment has been making arbitrary
cuts to essential sectors and the
education system has not been
spared. h's obvhus to me that
those who do not support teachers
arc jealous of their high pay, sutn-
mer vacation and pension plan.
They are not thoroughly informed
of all the positive activities hehird
school door. Bill 160 is about
control and money. not about
improving education.
Maybe those who arc not in and
ground schools are unaware of
WaLhcr%' numerous responsibili-
ties requiring large amounts of
unpaid overtime before school. at
remss, during lunch and during
bus duties. The work involved for
their daily classes includes prepar-
ing kssons, activities, tests and
homework. On average. teachers
spend two to four hours a night on
those tasks. In addition, teacher
are also expected to rum extracur-
ricular activities for sports learns,
bands. choir and drama clubs.
Teachers put in a lot of overtime
for which they receive no pay.
Even tough teachers often enjoy
cunning these activities, they often
go unrecognized for their efforts.
The high pay, summer vaca-
tions and pension plan so
begrudged taches ace not the rea-
sons they decided to ger into this
pokssion. Teachers, like demists,
raltsise two university degrees but
dentists make twice the amount a

instructional days or limiting class
size: it is abort democracy. The
teaches' protest is a protest for the
suxlc ts, the education systtm and
for democracy. U passed Bill 160
will give the provincial gover-
ment coral control to dictate how
the education system should be
run.

Second Oshawa man charged
in Halloween attack on teen-
OSHAWA - More charges
have been laid in connection with
a Halloween attack in which a 13 -
year -old girl was lured to an
Oshawa residence where she was
physically and sexually assaulted.
The teenager was trick or
treating with a friend when she
met an acquaintance who invited
her to what he said was a Hal-
loween party at a home on Dorch-
ester Drive, says Sergeant Jim
Grimley.
"When she went with the fel-
low (to the residence) she found
there wasn't a party and reports
being assaulted and sexually
assaulted;" Sgt. Grimley said.
The complainant, who met her
alleged attacker previously at an
Oshawa dance club, went later in
the night with her parents to the
sexual assault trauma centre at
Oshawa General Hospital. Sgt.
Grimley said.
Police have now charged
Ramiro Cisneros, 36, of Dorch-
ester Drive with sexual assault,
sexual interference and forcible
confinement.
His nephew. Hermes Cisneros.
19, of Bonnett Court in Whitby
has also now been charged with
forcible confinement, in addition
to earlier charges of sexual
assault and sexual interference.
Both men are scheduled to

been charged by police after two Scu-

The 16 -year-old was charged by
Durham Regional Police with posses-

gog Island borne where money dating
back to the 1930s and 1960s was taken.
Two local business owners alerted
police recently that they had received
some old money for purchases and
believed it might have been stolen.

those provided by the Scugog Island
resident and the youth was arrested
shortly after.
He is scheduled to be in Oshawa
court Dec. 12.

In the final game, the Raiders
scored a 3-1 win over the Brampton
Maroons. who were undefeated and
perched in first place in their league
standings going into the game. Darryl
Felgemacher had his best game of the
season, earning most valuable player
award. He scored the game winner
with a blast from the blue line.
Andrew Sawyer also had a strong
game with a goal. Defenceman Greg
Garrett completed the scoring and
added an assist. Michael Kostka and
Scott Masterton also added an assist
apiece. Goalie Sean O'Sullivan made
some huge saves to preserve the win.
Peterborough was too much for
the Raiders to handle in the semi-
final game as Ajax -Pickering lost 5-1.
Noel Coultice earned MVP honors
for his hard-working, two-way play.
He chipped in with a nifty goal set up
nicely by Derek Lynden. Netminder
Luke Chivers kept the Raiders close
for most of the contest.
In round-robin play, Ajax -
Pickering crushed the opposition by
scoring 20 goals while allowing only
one.
In the first game, the Raiders
rolled over Sudbury 7-1. Winger
Brett McConnachie scored twice and
earned MVP honors. Single markers
went to Brian Wilkins, Lynden.
Kostka, Coultice and Matt
Pernerowski. Adding assists were
Brian Campbell, Coultice and Justin
Hall with two each, Lynden.
Pernerowski and Masterton with one
apiece.
Chinguacousy was no match for
the Raiders who won 8-0.
Defenceman Justin Hall scored his
first two goals of the season and
picked up the MVP award. Other goal
scorers were Felgemacher with two,
Wilkins, Adam Markew, Pernerowski
and Sawyer with one apiece. Drawing
assists were Kostka and Pernerowski
with two each, Wilkins, Garrett,

apiece. Chivers earned his second
