Residents go to the wall

PICKERING - Two Pickering neighbors are battling town hall in a bid to
have the municipality pay for a collapsed retaining wall that divides their
properties.
John Evanoff of Creekview
Circle and Orlando Guerrieri of
Downland Drive are facing thou-
sands of dollars in repairs after the
wall collapsed this spring. Both
neighbors believe the wall was built

town should pay for repairs and the town is just as
adamant that it should not.
"'There's going to be a major fight," promises local
councillor Maurice Brenner, who's taken up the residents'
cause.
In late May, Evanoff and Guerrieri appeared before
council with the latter charging that the wall was "only
there because mistakes were made on the elevation (of the
subdivision)." Guerrieri also told politicians that "the
retaining wall was already rotten" when erected in the late
1970s by a development company that no longer exists.
During that meeting, town manager Noel Marshall told
council, "We have no information on how that wall got
there" and council refused to finance repairs.
Since then, however, Evanoff managed to dig up two
town memos dated 1978, which Brenner says indicate the
town did have concerns about the quality of the wall.
"...As far as the northern section of the wall is con-
cerned, we are satisfied that the timbers therein have not
been treated in accordance with the relevant CSA stan-
dard ... The wall should be removed and rebuilt..." reads
one memo to Marshall from now -retired director of works
Ray Hutchinson.
Marshall, on vacation at press time, was unavailable
for comment. Town solicitor and acting town manager
Tim Sheffield refuses to give an opinion on whether the
memo means town officials were aware of any problem
with the wall.
"I don't think I can comment on that," he says, adding
that, since council has already refused to finance repai
"it's not an issue the town has before it. The interpretation
of the memo is up to the person reading it."
But, according to Brenner, the town left the wall in
without replacing the untreated timber and signed off the
development.
The town, he says, made a mistake and should accept
responsibility. Brenner plans to ask council to reconsider
the issue.
If council again refuses to help, "I don't know what
we'll do," says Evanoff. "I don't want to think about it at
this point."

every other human to attack other
dogs." He adds that the pit bull,
named Cleo, would never have
attacked a human.
But neighbors told the News
djdvertiser they've been living in
,mqear of the pit bull and Heather
Moss, mother of the child who was
reportedly threatened by the dog
Thursday, says she'd carry a knife, a
hammer or an axe for protection
when walking on the street.
McDonald says the neighborhood
has treated his family too harshly.
"Poor little Cleo to us was not a
monster but a family pet," says
McDonald, who adds his children
sDave been "distraught and crying"
ince the shooting.
"She did attack the other little
dog (in May) and I know it was
wrong. I'd do anything to give that
little dog back", he continues. "We
want people to hear our side. It's not
the pit bull's fault it was bred to fight
other dogs. It was our fault she -got
loose. We're paying dearly for that."
Ross Balbernie of Pickering-
jax-Whitby animal control says
barges will be laid in Thursday's
incident. Charges include two counts
of allowing a dog to run at large and
Connie McDonald
one count of allowing a dog to inter-
fere with a person, he says.
This marks the second time ani-
mal control officers have filed
charges in regard to the pit bull. Last
May, 11 charges of bylaw infractions
were laid after Lori Crosby's
Yorkshire Terrier was killed as she
walked it on Front Road.
Whitby politician Dennis Fox,
chairman of the PAW Animal
Control Committee, says animal
control officers were told the pit bull
would be humanely destroyed fol-
lowing the attack on Crosby's dog.
"We suggested to the dog owner
that the dog be put down, which she
indicated she was going to do," he
says.
But Connie McDonald says she
was upset when she agreed to have
the pit bull destroyed and changed
her mind because she was afraid of
intruders. She kept the dog for pro-
tection after a man tried to get into
her house, she says.
The PAW committee could have
asked for a court order to have the
pit bull destroyed, Fox admits. But
the committee reviewed the incident
in June and decided to give the dog a
second chance, he says.
"Only as a last resort on our pan
would we want to kill an animal," he
says. "In trying to be sensitive
toward animals, we were hoping it
wasn't typical (behavior on the part
of the pit bull)."
The committee's decision to give
the dog another chance is "ridicu-
lous", says Moss. "Isn't that kind of
stupid? None of this would've hap-
pened."

Kristi Miscampbell rehearse.

union about resuming talks.
Curtis says contract talks didn't
start until late May and the fourth
and last bargaining session was on
July 18.
Following the July 18 session, the
workers voted unanimously to strike.
Raymond McIntosh, a member of
the union's bargaining committee,
says that, under the previous con-
tract, the highest hourly wage was
$15.89 and was paid to a top fitter -
welder. The average unionized wage
was about $13, McIntosh says.
The company's last offer was for
a three-year contract with a wage
freeze in the first year, two $200
lump sum payments in the second
year and two two -per cent increases
in the third year, McIntosh says.
The lump sum payments would
be made in June and December of
the second year of the pact and the
two -per cent increases would
A
become effective in June and
December of the third year.
Curtis says the union offered to
accept a one-year contract with a
one-year wage freeze.
The workers claim the company
is shipping work out to the former
Triple A Control building in Ajax.
That company, which also made con-
veyor systems, closed earlier this
year.
Union members have also been
picketing outside the Triple A
Control building at the corner of
Chisholm Court and Finley Avenue
in south Ajax.
"Two guys here saw a transport
pull out (of Triple A) last night.
Something's up," McIntosh says.
Other workers say Allied and
Triple A were "more or less sister
companies."
Allied company officials couldn't
be reached for comment.

To the editor:
The following is an open letter to
councillor Kip Van Kempen.
Dear Councillor Van Kempen:
1 received your letter today and
was totally surprised by your 'about
face'. Allow me to explain.
In the past you have insisted on
fiscal responsibility; augmenting
your position to the point of being
openly critical of some other coun-
cillors' spending habits with respect
to spending allowances in various
areas of municipal operations.
Sue Firth says, "Football?. Steve Hopkins says, "I don't

s' on land purchase?,
What is at issue here is the vublic
purchase of 20 acres on Frenchman's
Bay. Where are the financial fig-
ures??? How much is this way of
acquisition going to cost the taxpay-
er when a potentially free alternative
exists; which I will specify? A pri-
mary goal of the Pickering District
Plan is: to enable the town to main-
tain financial stability.
You speak of bargain basement
prices, but where are the appraisals
and financial figures to support what
you are implying? You ask people to
`Tell the whole story, Joe'
To the editor.
In former Ajax councillor Joe
Dickson's column "Regional
Happening's" of July 10, 1 am
sure he meant no disrespect
omitting to mention the other
one-third of council as being
supportive of the new seniors'
complex now under construction
in the south end of our town.
There are a couple of things
however that he either intention-
ally or unintentionally did say in
his column that might be mis-
leading to everyone on the street.
Mr. Dickson says that Mr.
Warren Jestin singled out the
new provincial government for
its "dreadful deficit" that will be
our "Armageddon". Mr. Dickson
should inform his readers that
Mr. Jestin also lambasted that
main culprit of our economic
woes, the federal government,
when he stated: "When one third
of your income is servicing the
debt, there's not a lot left over
for spending" (S45 billion a year
to service federal debt). Mr.
Jestin also stated that "cuts in
federal spending haven't saved a
dime". they have only cut trans-
fer payments to the provinces.
"They were only transferring the
problem to the provinces".
Canada is the second most
indebted nation in the world,
Jestin said!
How much is this colossal
debt costing every man, woman
and child in Canada,' Mr.
Dickson?

sign the dotted line without giving
them data! You ask residents for
signed letters; not ratepayers, the
group that ultimately pays. Will
shopping with a blank cheque occur?
You have failed to provide crucial
financial information to the ratepay-
ers who will have to carry the finan-
cial burden of the final price tag; a
group already overburdened with
taxes.
The logical, sensible alternative
to avoid taxing property owners fur-
ther would be to explore the possibil-
ity of the town, through a negotia-
tion process, recognizing the
owner's rights to the five -acre resi-
dential component in exchange for
the remaining 15 acres to be donated
for public acquisition. Fifteen donat-
ed acres is a substantial public acqui-
sition of the 'waterfront', which you
say is your ultimate goal.
Public money would be better
spent on developing the east spit.
Now it is a sleeping, useless pub-
licly -purchased resource, which falls
significantly short of its potential for
public use.
You say you want to lead th
charge and that it is imperative that
voice my opinion as a Bay Ridges
resident. Here it is. Before you say
"charge it" with the public purse; as
a ratepayer I don't like paying hid-
den costs. I want fiscal responsibili-
ty, coupled with responsible leader-
ship before my purse is squeezed!

Go for'the "Goose Party?'
to the editor:
It's time once again to r :view
the three existing federal parties
and the new Reform Party to
decide whether it's appropriate to
launch the Canada Goose Party.
I'm sure we wouldn't run last in
the polls, that's reserved for the
P.C.s. - The Rene and Brian gang.
The Canada Goose Party really
represents what Canadians perceive
in politics. You feed and nurture it
and its sole response is to crap on
your property.
The head of the goose would
represent the new party. The right
and left wing, the Liberals and
N.D.P. respectfully. That leaves the
other end to the P.C.s.
The Canada Goose feathers its
nest locally, lays a few eggs, then
heads south for the winter. What
could be more representative of
Canadians?
SOME PLATFORM PLANKS:
National capital; will be moved
to Ajax. No one comes into Ajax
except residents. This would elimi-
nate visitors to the capital and cut
costs. The old capital Ottawa can
be used for capital punishment.
Criminals whose crimes warrant
such punishment could be sent
there.
Leadership review: We won't
need conventions. On joining the
party each member receives a bag
of marbles. On committing a scan-
dal or indiscretion or caught taking
bribes, he or she will lose one mar-
ble. The one who loses all their
marbles becomes leader.
Free trade: We are in favor of
free trade as long as it's not Carter,
Key or Alomar. However, we
would restrict importation of cer-
tain fruits and nuts; owing to our
over -supply in the domestic mar-
ket.
Bilingualism: Canada is the only
country in the world where one
may be prosecuted for conducting
business in one of the official lan-
guages. This quaint Canadian cus-
tom could be expanded to anyone
conducting business in the other
language outside of Quebec could
be sentenced to capital punishment.
(See Nation Capital).
Bilingualism For The Simple
Servants: Jobs will be given to
Francophones with badly accented
English in months that have an 'R'.
Alternate months preference will
be to Anglophones who mumble
badly accented French.
Jobs: Preference for hiring or
appointments will be based on
qualifications, training and experi-
ence instead of on sex, color etc.
This is a radical departure from
current practices, but it should b49
given a chance.
Canada Post: Eliminate home
delivery and put a huge super blue
box on Harwood Avenue. The mail
can be then recycled immediately
and returned to us as the News
Advertiser.
Foreign relations: Each bona -
fide Canadian will be allowed to
bring in one foreign relation. Thio
would double our population, our r
unemployment, welfare, etc.
To those Canadians who are dis-
gruntled and disenchanted with
existing "Pineapples" in our federal
and/or provincial parties we offer
this prime opportunity to stand up
four your beliefs.
Go for the Goose Party.

Athletes keep park
neighbors 'prisoners
in own homes'
To the editor:
The following is a copy of a let-
ter sent to Tom Quinn, director of
community services and facilities
for the town of Pickering.
Dear Mr. Quinn,
I am writing to you on behalf of
Durham Condominium Corporation
No. 21.
A month ago, I spoke to Mr. Len
Hunter about the parking problem
our condominium townhouse com-
plex is experiencing because of the
community baseball and soccer
games that are played in Glengrove
Park. I originally was going to write
to the presidents of all the leagues
using the park, but Mr. Hunter sug-
gested it might be more effective if
you were apprised of the situation
and set up a dialogue with the
league representatives.
Our complex, at 1370 Fieldlight
Blvd., is directly across from
4Wilengrove Park. The complex con-
sists of six residences that face
Fieldlight with the remaining
homes on the outside of a semicir-
cular drive which surrounds the
front houses. This means there are
two entrances (or exits) from (or on
to) Fieldlight. On either side of both
exits, there are municipal signs for-
bidding parking close to the drive.
When the signs are obeyed, resi-
dents of the complex can leave
safely because they can see
approaching cars; however, when
ople park in these restricted areas
it impossible to drive out of the
complex without risking the front
end of your car! Whenever there are
soccer or baseball games at
Glengrove Park, the parents and
coaches park in these restricted
areas. Not only that, but they actu-
ally enter our private complex and
park in our visitor's parking area
and in the serni-circular drive which
is marked quite clearly as a fire
route and along which we the own-
irs are not allowed to park.
We are prisoners in our own
for the duration of the com-
munity summer sports program.
The sad part is that attached to
the park is Glengrove Public
School. It is perfectly legal to park

accommodate the sprawling
growth in the Seaton project and
the rest of Durham in the second
of the 20th century. It will
do nothing to solve the mess we
are in today.
If we allow current develop-
ment pauernt to continue, we will
turn Ontario into another southern
California and Toronto into moth-
er Los Angeles. This post Wald
War lI thinking h}s proved sense-
less and damaging, so why repeat
it in a nice place like Durham?
I If we start planning with
Durham in mind and not Metro,
we can turn things around.
Industrial and commercial devel-
r
in the school's lot during non -
school hours. There are spaces for
approximately 55 to 60 cars. I have
checked this lot during games and
the most cars that have ever been in
the lot are five and I'm not even
sure whether these were the cars of
sports participants.
Perhaps the leagues are unaware
that this parking exists, although
that certainly doesn't excuse the
arrogance of parking in private resi-
dential drives without permission.
I have verbally informed the
bylaw officer, Tom Howard, of our
problem and he said he would have
his parking control officers check
the area more frequently, although
we have seen no evidence of this. I
also informed him that the munici-
pal sign indicating No Parking
between the stop sign at Faylee and
our southerly entrance had been
knocked down and was missing.
We have also randomly called
the police department to come and
ticket the illegally -parked cars.
Police have even done so a few
times; however, it would appear
that only daily calling and ticketing
would improve the situation.
We are not complaining about
street parking in general. As long as
the cars are parked legally, we have
no complaints. We are complaining
about the illegal parking. The signs
are quite clear as to where one can
and cannot park. The signs are there
for a reason - to prevent accidents.
In the meantime, a large school
parking lot sits empty! All we ask is
that these sports participants display
some consideration for the residents
of the community that they are only
visiting!
We would be very grateful if you
could convey our message to your
leagues in a positive and effective
manner. Perhaps they are not aware
of the school -parking solution. We
do not want to call the police every
night to ticket their cars, but we are
tired of having our safety compro-
mised and our private property used
as a public parking lot.
Susan I— Blade,
Durram Condominium
Corporation No. 21
opment must be centred in
Durham. Then we could have a
community that lives and works in
Durham, never facing the two-hour
waits on expressways or bumper -
to -bumper traffic through the ham -
Ins. And can't we have
why poo-
pke living an Moro and driving to
Durham to work? Why does it
always have to be the other direc-
tion? Why can't we have more GO
and public transit?
The 407 is a 160 metre -wide
scar that would cut across die Oak
Ridges Moraine and destroy prime
farmland and other vital parts of
the environment from Pickering to
irutcruu"Awa. With a little thought
and some 1990s plarming, we can
cane up with better ways to spend
the taxpayers' money. I don't see a
need for it. It will not solve our
current coogapon mess.
